Recent trends in business ethics along with growing attacks upon unions, suggest that employee rights will be a major social concern for business managers during the next decade. However, in most of the discussions of employee rights to date, the very meaning and legitimacy of such rights are often uncritically taken for granted. In this paper, we develop an account of employee rights and defend this conception against what we take to be the strongest in-principle objections to it.

In Higher Superstition, published early in 1994, biologist Paul R. Gross and mathematician Norman Levitt denounced an `Academic Left' at once militant and ill-informed in its criticisms of science. Gross and Levitt showed sharp eyes for the pretentious and absurd in the works of American postmodernists, feminists, multiculturalists, radical environmentalists and, alas, exponents of science studies -- that is, historians, philosophers and sociologists of science. In the Autumn of 94, physicist Alan Sokal, inspired by Gross and Levitt's book, submitted a (...) spoof article portentously entitled `Transgressing the Boundaries: Toward a Transformative Hermeneutics of Quantum Gravity' to Social Text, a leading journal in the expanding field of cultural studies. As he later told Janny Scott of the New York Times : I structured the article around the silliest quotations about mathematics and physics from the most prominent academics, and I invented an argument praising them and linking them together. All this was very easy to carry off, because my article wasn't obliged to respect any standards of evidence or logic. The editors of Social Text were hoodwinked. By an unhappy coincidence, shortly after receiving Sokal's article they decided to produce a special `Science Wars' collection, including the unrefereed article together with responses to Higher Superstition. `Transgressing the Boundaries' duly appeared in the Spring/Summer 96 double issue, accompanied by articles from a number of those denounced by Gross and Levitt and lampooned by Sokal -- the perfect setting! Voltaire's Pangloss, the man who held among other things that noses were clearly created in order to support spectacles, is the very archetype of the lunatic teleologist; a caricature of sublimely confident faith in the general and undeniable goodness of the world's arrangement, a faith that managed astoundingly to survive the Lisbon earthquake and his own subsequent auto dafé. Voltaire, of course, is poking fun at such conceptions; and, no doubt, in their extreme sanguinity as well as in their apparent (...) imperviousness to devastating empirical counter-evidence, they do seem to be eminently risible notions. In the face of them we might be tempted to abandon ‘métaphysico-théologo-cosmolonigologie’, and to agree with Candide that ‘Cela est bien dit, mais il faut cultiver notre jardin’. (shrink)

The main focus of this paper ison ways in which Kantian philosophy can informproponents and opponents of constructivismalike. Kant was primarily concerned withreconciling natural and moral law. His approachto this general problematic was to limit andseparate what we can know about things(phenomena) from things as they are inthemselves (noumena), and to identify moralagency with the latter. Revisiting the Kantianproblematic helps to address and resolve longstanding epistemological concerns regardingconstructivism as an educational philosophy inrelation to issues of objectivity andsubjectivity, the limits of (...) theoretical andpractical reason, and the relation betweenhuman experience and the world. It also servesto address ethical concerns regardingliberation from limited self-interests andcontexts conditioned by localised beliefs andinclinations. In light of revisiting theKantian problematic, both Glasersfeld's radicalview of constructivism and Jardine's socialcritique of constructivism are found wanting.Beyond constructivism, Kant's distinctionbetween phenomena and noumena and the limits ofreason that follow from it are brieflyconsidered in terms of Merleau-Ponty's noveldouble-embodied notion of flesh as anontological primitive – as a matter of beingboth in, and of, the world – with an aim tomore intimate connections between epistemologyand ethics. Jardine examines the evolution of concepts of dialectics during the Renaissance and problems of methodology that influenced the teachings of the founder of philosophy in the modern era, F. Bacon. The work traces the sources of these problems in the dialectics of antiquity and its medieval interpretation. Sources little known to the Soviet reader are cited. In order to evaluate Bacon's reaction to the dialectics of his day, the author also describes works named in the statutes of Cambridge University (...) in the sixteenth century as textbooks on dialectics. They are writings by humanists — bearers of the ideas of the Enlightenment — I. Caesarius, R. Agricola, D. Seton, and others. To a certain extent they were based on the work by Peter the Spaniard Summulae Logicales, which is taken as a point of departure for the further evolution of dialectics. (shrink)

Resumen: Durante la década del sesenta, la revista Movie hereda de Cahiers du cinéma las preferencias por la politique des auteurs y por cierto cine norteamericano. No obstante, sin abandonar esa predilección por un “cine de directores”, a lo largo de su trayectoria la revista británica intentará desarrollar un riguroso método de análisis formal a través de detallados close readings de los films. Algunos de sus integrantes buscan aplicar al cine los planteos de F. R. Leavis y la revista Scrutiny (...) a propósito de la crítica literaria. Es esta modulación analítica la que será puesta en cuestión con el auge del estructuralismo y el posestructurailsmo a los que se asocia la revista Screen en los años 70.: During the sixties, the journal Movie inherits from Cahiers du cinéma the preferencies for a politique des auteurs and for certain american films. However, never abandoning this tendency towards a “cinema of directors”, the british journal develops a rigorous method of formal analysis and detailed close readings. Some of its members try to apply to cinema the concepts elaborated by F. R. Leavis and the journal Scrutiny in reference to literary criticism. It is precisely this analytic method that will be questioned during the boom of structuralism and post structuralism to which the journal Screen will be asociated in the 70s. (shrink)

Spiritual Theology's journey through these last decades shows an itinerary of development, the fruit of which is an ever more solid identity. This book seeks to present a perspective in that itinerary and in tune with the signs of our times: on one hand, militant secularism and, on the other, a widespread, concrete resurgence of experiences of transcendence. In this sense, the author is presenting a path of study organized around five concepts: presence, mystery, transcendence, lived experience, and transformation. In (...) effect, the inner transformation worked by the Presence of Mystery leaves a new knowing, in which the relationship with reality is renewed, since it has expanded and dilated beyond sensible perception, opening the subject up to an unlimited and real horizon of transcendence. The awareness of perceiving a 'greater reality' within reality leaves an emotional resonance that teaches a new way of feeling and reacting in the face of sensibly perceived reality. (shrink)

The book provides relevant selections from a sampling of the historical approaches to legal obligation taken by writers such as Plato, Augustine, (...) Aquinas, Hobbes, Locke, Hume, Rousseau, Thoreau, Bentham, Marx and Engels, and Martin Luther King, Jr. These classical discussions are augmented by critical questions and commentary, by independent discussions of the question of legal obligation by a wide range of contemporary writers, and by relevant judicial cases discussing matters such as conscientious objection and civil disobedience.
