Legal judgment writing mobilises a process of story-telling, drawing on existing judicial discourses, precedents and practices to create a narrative relevant to the specific case that is articulated by the presiding judge. In the Feminist Judgments projects feminist scholars and activists have sought to challenge and reinterpret legal judgments that have disadvantaged, discriminated against or denied women’s experiences. This paper reflects on the process of writing as a feminist judge in the Australian Project, in an intimate homicide case, R v (...) Middendorp. Drawing on the work of Judith Butler on intelligibility, iterability and the communality of violence and vulnerability, this article argues that feminist judgments necessarily require some uncomfortable compromises with unjust gendered institutions. While ‘donning the robes’ may be an uncomfortable process, a feminist re-articulation of the law’s carceral power serves to unsettle and challenge some aspects of gendered oppression, even though it cannot unsettle the operation of the institution. The article concludes that effective feminist interventions by members of the judiciary may require donning robes that are not entirely comfortable in order to persuade and advocate for change. The Augustan Age in Scotland was the half-century between the publication of Hume's Treatise on Human Nature and the death of Robert Burns in 1796. In this period Edinburgh was at her height as a cultural centre. This is a 1956 study of eminent Scot Adam Smith - author of The Wealth of Nations - and the Scotland in which he lived and wrote. It also examines the contribution which he and his fellow-countrymen made to the accomplishment of the eighteenth (...) century in many fields. Dr Fay begins with a brief account of Smith's life, and goes on to describe the eighteenth-century Kirkcaldy where he spent his youth, the Glasgow where he matured, and the Edinburgh which gave him fulfilment. We are told of the part Smith played in the development of Political Economy as a science, and the book closes with an account of his relationships with such men as Townshend, Gibbon and Benjamin Franklin. My differences with F. R. Ankersmit's essay are historiographical and theoretical. On the historiographical plane I disagree with the sharp distinction he draws between the "ontological realism" of Enlightenment historiography and the historical outlook of classical historicism. An examination of Gibbon's Decline and Fall of the Roman Empire shows that Gibbon indeed takes into account internal changes in the Roman Empire. Ranke and Droysen on the other hand assume that the rubjects of their study, whether the Papacy or the Prussian (...) state, preserve their identity through time. And in their attempt to "raise history to the rank of a science" , historicists in seeking to show wie es eigentlich gewesen , go farther in the direction of realism than do Enlightenment historians who are keenly aware of the role of perspective and of the literary and aesthetic aspects of historical writing. On the theoretical plane, although I agree with Ankersmit that metaphor occupies a central role in historical discourse, I disagree when he writes that "coherence has its source either in reality or in the language we use about it. There is no third possibility." I argue that while reality can be approached only through the mediation of language and metaphor, these presuppose a reality which can be known, no matter how complex and mediated the process of cognitive approximation may be. Rejecting historical realism, Ankersmit nevertheless wants to "encounter the past with the same directness with which the anthropologist encounters the alien culture," and thus to escape "all the ideological and emancipatory pretensions of its historiographical predecessors." Yet the very "new cultural history" he takes as an example shows that this cannot be done. (shrink)

The relevance of the research In the face of increasing global competition, business was challenged to seek new methods for creating their competitive advantage and at the same time the decreasing budgets of higher education institutions were pressured to find new streams of financing. In both cases, collaboration is seen as an important method for achieving their objectives but universities of today have as well to find the appropriate balance between teaching, basic and applied research, and entrepreneurship. Ten types of (...) university-business collaboration are related quite directly to the missions of the university and the needs of business. Curriculum development and delivery is one of that ten, which aim is to develop human resources to modern society. A summary of benefits was identified in the academic literature as arising from UBC in relation to curriculum design and delivery for multiple stakeholders including academics, students, university administration, business and community. Overall, UBC may take various forms that are influenced by different factors but even if all stakeholders seeks the main purpose of this process they may get different benefits. The research aim was to identify the benefits of universities and business organizations in curriculum development. The objectives of the research: to determine the instruments and activities used for universities and business organizations collaboration, to identify universities and business organizations benefits from collaboration to the various stakeholder groups. Analysis of recent research and publications. UBC became the subject of education and management sciences. P. D'Este and M. Perkmann explored the factors of UBC, the types were identified by T. Davey, T. Baaken, V. Galan Muros, A. Meerman, T. Barnes, A. Gibbons and the levels of UBC were represented by B.N. Ponomariov, P.C. Boardman, T. Davey, R. Laužackas. The benefits of UBC to research quality have been studied by researchers T. Davey, M. Crespo, N. Carayol, H. Forsyth, R. Laxton, S. Lamichhane, T. Nath Sharma, P. Van der Sijde and H. Dridi, as a collaborative factor for learning improvement by researchers K. Ramakrishnan, N.M. Yasin, A. Draghici. An overview of the study of this object shows that it was mostly analysed in vocational training and in last ten years’ period the publications is growing in UBC. Research methodology. The paper seeks to represent the UBC benefits for different stakeholders and collaboration forms, which was used by university with the business organizations from leisure industry. Quantitative research was used to gain quantify opinions of benefits and instruments of UBC – and generalize results from a larger sample population. Methods applied for the research was scientific literature review, a questionnaire survey for business organization leaders and mathematical statistics. Conclusion. The benefits of the UVB were grouped according to the type of stakeholder's: society, university administration, academics, entrepreneurs, students. The benefits of business stakeholders include additional funding, access to education resources, lecturer and coordinator, support in evaluating the program and developing new study subjects. The highest rated benefit to others stakeholders from their view could be reducing academic staff training costs, as well as business information available to student projects, skills development and student employment opportunities and human resource development in the region. One area in which the moral philosopher might say something useful for the thinking of economists is that of welfare economics – not by improving formalizations or criticizing proofs as to conditions necessary or sufficient for an optimum situation, much less by suggesting what particular state of society would be optimal. Rather, he can do this by pointing out some distinctions, by suggesting how some terms used by economists can profitably be defined, and by questioning some assumptions which seem to (...) lie behind the thinking of some economists. The following discussion is aimed along these lines. The main goal of the argument will be to produce helpful definitions of “increase the welfare of an individual” and “increase social welfare.”. Despite their status as high-income food producing nations, children and their caregivers, both in the United States (U.S.) and Australia can experience food insecurity. Nutrition researchers formed a joint U.S.-Australia collaboration to help advance food security for households with young children aged 0–5 years. This study investigated food insecurity from the perspective of caregivers, especially their perceptions of the impact of food insecurity on their own childhood, their current life, and for the children in their care. Semi-structured interviews were conducted (...) from July to September 2020 during the COVID-19 pandemic. Participants were recruited in Omaha, Nebraska, U.S. (_n_ = 19) and Melbourne, Victoria, Australia (_n_ = 22), during periods of stay-at-home public health orders. These two case study sites enabled an exploration of some universal, and some context-specific, social, economic, and health conditions that buffer, or exacerbate, food insecurity for families in these neo-liberal political settings. An inductive thematic analysis was conducted and established six themes:_growing up poor_, _lessons learned_,_ feeding a family amidst a pandemic_,_ caregiver coping strategies_, _food security in the early years_ and _protecting (young) children_. Perspectives on local anti-hunger strategies were organized to outline participant’s preferred solutions. Household food insecurity is conceptualized in public policy in the U.S. and Australia as a short-term crisis for people, justifying austere, time-limited and patchwork solutions. A narrative of caregivers’ lived experience of food insecurity suggests that it is inter-generational, and exacerbated by a food system shock (i.e., COVID-19). These findings from two varying cities and nations offer a different conceptualization of the timespan and nature of the phenomenon of food insecurity, challenging a dominant policy narrative and highlighting the inadequacy of current so-called solutions. In their 2008 paper, Persson and Savulescu suggest that for moral bioenhancement (MBE) to be effective at eliminating the danger of ‘ultimate harm’ the intervention would need to be compulsory. This is because those most in need of MBE would be least likely to undergo the intervention voluntarily. By drawing on concepts and theories from epidemiology, this paper will suggest that MBE may not need to be universal and compulsory to be effective at significantly improving the collective moral standing of (...) a human populace and reducing the threat of ultimate harm. It will identify similarities between the mechanisms that allow biological contagions (such as a virus) and behaviours (such as those concerned with ethical and unethical actions) to develop, spread, and be reinforced within a population. It will then go onto suggest that, just as with the epidemiological principle of herd immunity, if enough people underwent MBE to reach a minimum threshold then the incidence and spread of immoral behaviours could be significantly reduced, even in those who have not received MBE. Cloud Computing paradigm has reached a high degree of popularity among all kinds of computer users, but it may not be suitable for mobile devices as they need computing power to be as close as possible to data sources in order to reduce delays. This paper focuses on achieving mathematical models for users moving around and proposes an overlay mobility model for Fog Data Centres based on traditional wireless mobility models aimed at better allocating edge computing resources to client demands. Resilience has become a key concept in the global climate change discourse, not least in relation to climate change adaptation in the Global South. Taking Bangladesh as an example, this paper explores the role and function of resilience in one of the most climate vulnerable nations. The aim is to examine and critically discuss the popularity of resilience in recent climate change policy. The paper looks into the following aspects of climate change resilience: the relation between resilience and the concepts (...) of mitigation/adaptation; resilience as a re-description of existing socio-ecological means of adaptation; resilience as an example of the integration of climate change adaptation and development; resilience as a strategic resource in obtaining international climate change funding. The four aspects illustrate how the discourse of resilience is surrounded by rather diverse mechanisms and dynamics, which may account for the concepts popularity. It further indicates that while the concept promises a pro-poor and context sensitive approach to climate change resilience, it also risks effacing the principal differences between development and climate change adaptation.
