This paper argues that Charlie Gard’s parents should have been the decision-makers about their son’s best interests and that determination of Charlie’s best interests depended on a moral decision about which horn of a profound moral dilemma to choose. Charlie’s parents chose one horn of that moral dilemma and the courts, like Charlie Gard’s doctors, chose the other horn. Contrary to the first UK court’s assertion, supported by all the higher courts that considered it, that its judgement was ‘objective’, this (...) paper argues that the judgement was not and could not be ‘objective’ in the sense of objectively correct but was instead a value judgement based on the judge’s choice of one horn of the moral dilemma. While that horn was morally justified so too was the horn chosen by the parents. The court could and should have avoided depriving the parents of their normal moral and legal right and responsibility to decide on their child’s best interests. Instead, this paper argues that the court should have acknowledged the lawfulness of both horns of the moral dilemma and added to its judgement that Charlie Gard’s doctors were not legally obliged to provide treatment that they believed to be against their patient’s best interests the additional judgement that Charlie’s parents could lawfully transfer his care to other doctors prepared to offer the infant a trial of the experimental treatment requested by his parents. This is the first full-length study of the doctrine of the Trinity by an analytic philosopher. It appears in a new series, “Oxford Studies in Analytic Theology,” and so reflects the growing interest within analytic philosophy of religion in the application of the tools and results of analytic philosophy to Christian doctrinal claims. Hasker is concerned almost entirely to make sense of the doctrine rather than justify it, and claims to have reached “a coherent, meaningful, scripturally adequate, and theologically orthodox” (...) The classical statement of the doctrine is of course that contained in the Nicene Creed, which is in effect the common creed of all Christians: that there is “one God”; the Son is “of one substance with the Father” and the Spirit is “worshipped and glorified with the Father and the Son”; the Son was “begotten of the Father before all ages. On July 2021, the UK High Court of Justice heard the Case CO/2066/2020 on the application of Heidi Crowter who lives with Down’s syndrome, and Máire Lea-Wilson whose son Aidan has Down’s syndrome. Crowter and Lea-Wilson, with the support of the disability rights campaign, ‘Don’t Screen Us Out’, have been taking legal action against the Secretary of State for Health and Social Care (the UK Government) for a review of the 1967 Abortion Act: the removal of section 1(1)(d) making termination (...) of pregnancy lawful for ‘severe’ fetal indications detected after 24 weeks' gestation. On 23 September 2021, the High Court dismissed the claim. This action came at a time when non-invasive prenatal testing (NIPT) was introduced into the NHS England Fetal Anomaly Screening Programme for the trisomies 21, 13 and 18. The implementation of NIPT has been heavily criticised, in particular by ‘Don’t Screen Us Out’ campaigners, for increasing fetal selection and discrimination of people living with disabilities. The case of Crowter and Lea-Wilson echoes debates in other European countries such as in France and Germany, where the introduction of NIPT in the public healthcare system has provoked equally vehement public reactions and discussions. The comparison between these three countries allows contextualising the public discourses around NIPT and the ground for termination of pregnancy in relation to different socio-cultural and political contexts. We examine how each country, and particularly England, deals with the conflict between the principles of promoting the rights of people living with disabilities and preserving women’s reproductive autonomy. On the basis of this, it is analysed (...) to what extent it is meaningful to attribute causal and moral responsibility to parents in theory and in practice. It is argued that although there is a sense in which many parents are causally and morally responsible for the obesity of their children, most parents are not blameworthy and the attribution of parental responsibility in most cases does not justify intervention in the family context by society on behalf of the children. In the analysis of the possible justification of more general interventions, parallels are drawn to the distinction between hard and soft forms of paternalism. In 1992, as part of a larger charitable campaign, the Prince of Wales (Prince Charles, Queen Elizabeth’s older son and heir) launched a line of organic food products called “Prince’s Duchy Originals”.1 The first product that went on sale was an oat cookie: “the oaten biscuit.” Since then the oaten biscuit has been joined by hundreds of other products and Duchy Originals has become one of the leading organic food brands in the UK. Let’s imagine that he is so proud of the oaten biscuits that he eats them regularly. Also, let’s imagine that one day Queen Elizabeth asks the Prince to water the plant in her room. As she explains to him, she’ll be gone for the day and the plant needs to be watered every afternoon. But the Prince decides not to water the plant. Escitalopram is the son of citalopram . In a recent judgment1 the Court of Protection was highly critical of health professionals for continuing to provide clinically-assisted nutrition and hydration in the face of disagreement about the patient’s best interests, without seeking to resolve the issue. This hearing had been set up specifically to consider whether GU’s dignity had been properly protected, and if not why not, given concerns raised by the Official Solicitor about what she considered to be “a complete abrogation of responsibility to consider properly or (...) at all, and to determine whether it was in GU’s best interests and therefore lawful to continue to give him an invasive medical treatment, CANH.” In April 2014, at 63 years old and living in Thailand, GU sustained severe injuries after suffering from an electrocution accident. He sustained a cardiorespiratory arrest with a significant delay before cardiopulmonary resuscitation was started and was unconscious and unresponsive. In September 2014 he was transferred to the UK. In August 2018, GU’s brother made a request for a best interests decision concerning the continuation of CANH. The family met to discuss this and all except GU’s son, agreed that continuing CANH was not in GU’s best interests. In view of the fact that there was not unanimity among the family, a decision was made that CANH should continue. Commenting on this decision, Mr Justice Hayden said ‘the apparent assumption that in the face of family disagreement ‘ therefore will continue to be cared for by nursing staff ” is a troubling non sequitur’ and stressed that ‘family dissent to a medical consensus should never stand in the way of an incapacitated patients’ best interests being properly identified’. Is Tom Shakespeare disabled, or simply distinct in stature? And if the latter, what makes that distinction important?For more than a decade, the British sociologist has been a critical voice in the sociology of difference. The son of a physician with achondroplasia “widely admired as a doctor and as a disabled role model” ,1 Shakespeare fils also has achondroplasia, is the father of children with the condition and, like his father, is professionally successful. As his book’s back cover announces, Shakespeare (...) has “taught and researched sociology at the Universities of Cambridge, Sunderland, Leeds, and Newcastle. He has written and broadcast extensively about disability and genetics, and his co-authored books include The Sexual Politics of Disability, Exploring Disability, and Genetic Politics.”This volume brings together a decade of papers that, Shakespeare says, “draws on my experience of being a disabled person, and the son, father, husband and friend of disabled people”1 to argue the following thesis: “Disability results from the interplay of individual and contextual factors. In other words, people are disabled by society and by their bodies.”1 That argument, he suggests, has resulted in the “breakdown of my relationship with the mainstream of the UK disabled people’s movement”, whose members advance a model of disability based wholly on social construction. Shakespeare sees that as simplistic and no longer viable despite of the extraordinary gains made by those seeking parity through advancement of the social construction thesis.1According to Shakespeare, his former confrères in the British disability movement see as a betrayal his rejection of their argument, one he formerly endorsed, and thus perhaps a repudiation of a generation of admittedly successful activism. Apparently, I’m a righteous son of a bitch, morally speaking. At least that’s the conclusion I would have to reach if I trusted the results of a morality test I took at the BBC website (bbc.co.uk/labuk/experiments/morality). The test was devised to collect data for a “new theory” that seeks to make sense of human morality in terms of a super-organism concept. Briefly, the idea is that “we, as individuals, behave as if we are part of a bigger ‘superorganism’ when we (...) are organised into large social groups, as in cities or societies. ... all moral actions are based on the fundamental need to ‘police’ society in order to keep the ‘superorganism’ functioning properly.”. Contemporary accounts of logic and language cannot give proper treatments of plural constructions of natural languages. They assume that plural constructions are redundant devices used to abbreviate singular constructions. This paper and its sequel, "The logic and meaning of plurals, II", aim to develop an account of logic and language that acknowledges limitations of singular constructions and recognizes plural constructions as their peers. To do so, the papers present natural accounts of the logic and meaning of plural constructions that result (...) from the view that plural constructions are, by and large, devices for talking about many things (as such). The account of logic presented in the papers surpasses contemporary Fregean accounts in its scope. This extension of the scope of logic results from extending the range of languages that logic can directly relate to. Underlying the view of language that makes room for this is a perspective on reality that locates in the world what plural constructions can relate to. The papers suggest that reflections on plural constructions point to a broader framework for understanding logic, language, and reality that can replace the contemporary Fregean framework as this has replaced its Aristotelian ancestor. The purpose of this paper is to diagnose and analyze the gap between philosophy of technology and engineering ethics and to suggest bridging them in a constructive way. In the first section, I will analyze why philosophy of technology and engineering ethics have taken separate paths so far. The following section will deal with the so-called macro-approach in engineering ethics. While appreciating the initiative, I will argue that there are still certain aspects in this approach that can be improved. In (...) the third, fourth, and fifth sections, I will point out three shortcomings of engineering ethics in terms of its macro-level discourse and argue that a number of certain insights taken from the study of philosophy of technology could be employed in overcoming those problems. In the concluding section, a final recommendation is made that topics of philosophy of technology be included in the curriculum of engineering ethics. (shrink)

In this article I analyze how journalistic codes of ethics in the United States wrestle with the matter of leaks. After assessing how leaks-particularly from government sources-can compromise journalistic independence, I discuss strengths and weakness of ethics codes. Four research questions are explored via a systematic analysis of 47 codes. Although leaks are never explicitly addressed in these codes, the treatment of confidential sources and the need to maintain journalistic independence are addressed.

This article is a critical review of The Technological Bluff, the last book on technology by Jacques Ellul. Although this work has attracted little attention, the concept oftechno-logical bluff1 provides a new perspective to understand contemporary technological society. After presenting Ellul’s exposition of the concept of techno-logical bluff, its original contribution to technology studies is emphasized. It is also examined how the analysis of techno-logical bluff is connected with other major Ellulian notions such as autonomous technique and the efficiency principle. (...) This is followed by a suggestion that the analysis of techno-logical bluff could function as a basis for a constructive dialectic relationship between classical and more recent discourses on technology. Even though many people have been looking for the origin of human beings, we still don’t know how human beings came into existence. So far, there are two major theories to explain human beings’ starting point – creationism and the theory of evolution. These theories are so abstract that it is hard to accept either one.This essay presents a new theory which explains how human beings and all beings come into existence and carries implications bearing on human conduct. The theory (...) is called “The Principle of Human Essence,” and it was first proposed by Hungduk Bokyoung Son. He points out everything in the world was created by human beings, for nothing can be mentioned or described without them. Then he asks what the human being is, and defines it as a living thing which thinksand speaks. Next, he tries to determine where human consciousness came from, and shows that language is the source of consciousness. Finally, he explains that language can exist only where it is formed between at least two people, and that consciousness is the ability to discern words. Through his unique concept, summed up in the maxim “Words and Earth are simultaneous existence,” Hungduk shows that two living things become human beings through communication, that mind and body exist simultaneously, and that human beings and space exist at the same time. If words are the origin of thoughts, and none of us can possess language without communication with other people, it follows that no one can be a human being by himself or herself. For this reason, Hungduk claimseach person is the cause of each other’s being, so people exist as mutual causations at the same time. I think that, through his metaphysical principle, he offers clear reasons why we must trust each other, solve conflicts between people, and make a world where people live well together, so I hope to introduce his philosophy to other philosophers around the world. The notion of optimality is often invoked informally in the literature on metacognitive control. We provide a precise formulation of the optimization problem and show that optimal time allocation strategies depend critically on certain characteristics of the learning environment, such as the extent of time pressure, and the nature of the uptake function. When the learning curve is concave, optimality requires that items at lower levels of initial competence be allocated greater time. On the other hand, with logistic learning curves, (...) optimal allocations vary with time availability in complex and surprising ways. Hence there are conditions under which optimal strategies will be relatively easy to uncover, and others in which suboptimal time allocation might be expected. The model can therefore be used to address the question of whether and when learners should be able to exercise good metacognitive control in practice. (shrink)
