This article examines the question of whether private obstetric care in South Africa can be saved in view of the escalation in medical and legal costs brought about by a dramatic increase in medical negligence litigation. This question is assessed with reference to applicable medical and legal approaches. The crux of the matter is essentially a question of affordability. From a medical perspective, it seems that the English system as well as American perspectives may be well suited to the SA (...) situation. Legal approaches are assessed in the context of the applicable medicolegal framework in SA, the present nature of damages and compensation with reference to obstetric negligence liability, as well as alternative options to the present system based on fault. It is argued, depending on constitutional considerations, that a system of damages caps for noneconomic damages seems to be the most appropriate and legally less invasive system in conjunction with the establishment of a state excess insurance fund. BackgroundFor many decades, the debate on children’s competence to give informed consent in medical settings concentrated on ethical and legal aspects, with little empirical underpinnings. Recently, data from empirical research became available to advance the discussion. It was shown that children’s competence to consent to clinical research could be accurately assessed by the modified MacArthur Competence Assessment Tool for Clinical Research. Age limits for children to be deemed competent to decide on research participation have been studied: generally children of 11.2 (...) years and above were decision-making competent, while children of 9.6 years and younger were not. Age was pointed out to be the key determining factor in children’s competence. In this article we reflect on policy implications of these findings, considering legal, ethical, developmental and clinical perspectives.DiscussionAlthough assessment of children’s competence has a normative character, ethics, law and clinical practice can benefit from research data. The findings may help to do justice to the capacities children possess and challenges they may face when deciding about treatment and research options. We discuss advantages and drawbacks of standardized competence assessment in children on a case-by-case basis compared to application of a fixed age limit, and conclude that a selective implementation of case-by-case competence assessment in specific populations is preferable. We recommend the implementation of age limits based on empirical evidence. Furthermore, we elaborate on a suitable model for informed consent involving children and parents that would do justice to developmental aspects of children and the specific characteristics of the parent-child dyad.SummaryPrevious research outcomes showed that children’s medical decision-making capacities could be operationalized into a standardized assessment instrument. Recommendations for policies include a dual consent procedure, including both child as well as parents, for children from the age of 12 until they reach majority. For children between 10 and 12 years of age, and in case of children older than 12 years in special research populations of mentally compromised patients, we suggest a case-by-case assessment of children’s competence to consent. Since such a dual consent procedure is fundamentally different from a procedure of parental permission and child assent, and would imply a considerable shift regarding some current legislations, practical implications are elaborated. This paper focuses on stakeholder identification as per the value sensitive design (VSD) approach applied to the context of quantum technologies (QT). We provide two comprehensive lists of stakeholders as starting points for VSD researchers and practitioners. These lists encompass a diverse range of organizations, including private companies, government agencies, NGOs, partnerships, and professional/trade organizations. Our aim is to facilitate the recognition, legitimation, and understanding of stakeholder interactions in the development of QT. These stakeholder lists can serve as a foundation (...) for designing and implementing policies and strategies that promote the ethical and responsible development of QT, considering the values and interests of various stakeholders. Furthermore, these lists can enable empirical and technical studies on specific QT innovations using an ethics-by-design approach like VSD. Overall, this paper contributes to a better understanding of the complex and dynamic nature of the QT landscape and highlights the importance of stakeholder engagement and collaboration in shaping its future. Based on a qualitative survey among 203 US workers active on the microwork platform Amazon Mechanical Turk, we analyze potential biases embedded in the institutional setting provided by on-demand crowdworking platforms and their effect on perceived workplace fairness. We explore the triadic relationship between employers, workers, and platform providers, focusing on the power of platform providers to design settings and processes that affect workers’ fairness perceptions. This paper provides a phenomenological analysis of postphenomenological philosophy of technology. While acknowledging that the results of its analyses are to be recognized as original, insightful, and valuable, we will argue that in its execution of the empirical turn, postphenomenology forfeits a phenomenological dimension of questioning. By contrasting the postphenomenological method with Heidegger’s understanding of phenomenology as developed in his early Freiburg lectures and in Being and Time, we will show how the postphenomenological method must be understood as mediation theory, (...) which adheres to what Heidegger calls the theoretical attitude. This leaves undiscussed how mediation theory about ontic beings involves a specific ontological mode of relating to beings, whereas consideration of this mode is precisely the concern of phenomenology. This ontological dimension is important to consider, since we will argue that postphenomenology is unwittingly technically mediated in an ontological way. The upshot of this is that in its dismissal of Heidegger’s questioning of technology as belonging to “classical philosophy of technology,” postphenomenology implicitly adheres to what Heidegger calls technology as Enframing. We argue that postphenomenology overlooks its own adherence to the theoretical attitude and ultimately to Enframing, and we will conclude with calling for a phenomenological questioning of the dimension that postphenomenology presently leaves unthought, meaning that we will develop a plea for a rehabilitation of the ontological dimension in the philosophy of technology. Due primarily to technological advances over the last decade, quantum research has become a key priority area for science and technology policy all over the world. With this manifesto, we wish to prevent quantum technology from running into fiascos of implementation at the interface of science and society. To this end, we identify key stumbling blocks and propose recommendations.

In this paper, we report on the development of The Sustainable Port video game, which aims to simulate the complex dynamics and decisions occurring in the present and future development of a port area considering environmental aspects (CO2 emissions) and profit. To evaluate if this game fulfills its purpose, we asked 75 students and 34 employees at the Port of Rotterdam (PoR) to play The Sustainable Port. Our results show that PoR employees score higher than students suggesting a transfer between (...) real-life experience of being an employee in the port and performance in the game. Furthermore, port participants reported that The Sustainable Port can be successfully used to start discussions about the future of the Port of Rotterdam and to raise awareness about the complexity characterizing the decision-making processes occurring in a port environment. Our results, taken together, provide evidence of the effectiveness of The Sustainable Port in simulating dynamics occurring in port development and give us optimism about future applications. In this paper we inquire into the fundamental assumptions that underpin the ideal of the Bio-Based Economy as it is currently developed . By interpreting the BBE from the philosophical perspective on economy developed by Georges Bataille, we demonstrate how the BBE is fully premised on a thinking of scarcity. As a result, the BBE exclusively frames economic problems in terms of efficient production, endeavoring to exclude a thinking of abundance and wastefulness. Our hypothesis is that this not only entails (...) a number of internal tensions and inconsistencies with regard to the ideal of BBE, but ultimately undermines the ideal itself, by pushing purported regenerativity into a cataclysmic and terminal discharge. We here point to the strategies that the BBE employs in this exclusion, the fundamental assumptions regarding the relation between energy and economy that underpin this endeavor, as well as to the resulting inconsistencies and their catastrophic consequences. We finally argue for the introduction of the presently excluded question of abundance and wastefulness and explore the implications of such a question for the ideal of a zero-waste humanity. Microbiota-gut-brain research is a fast-growing field of inquiry with important implications for how human brain function and behaviour are understood. Researchers manipulate gut microbes to reveal connections between intestinal microbiota and normal brain functions or pathological states. Many claims are made about causal relationships between gut microbiota and human behaviour. By uncovering these relationships, MGB research aims to offer new explanations of mental health and potential avenues of treatment. So far, limited evaluation has been made of MGB's methods and its (...) core experimental findings, many of which are extensively reiterated in copious reviews of the field. These factors, plus the self-help potential of MGB, have combined to encourage uncritical public uptake of MGB discoveries. Both social and professional media focus on the potential for dietary intervention in mental health, and causal relationships are assumed to be established. Our target article has two main aims. One is to examine critically the core practices and findings of experimental MGB research and to raise questions about them for brain and behavioural scientists who may not be familiar with the field. The other is to challenge the way in which MGB findings are presented. Our positive goal is to suggest how current problems and weaknesses may be addressed, in order for both scientific and public audiences to gain a clearer picture of MGB research and its strengths and limitations. Humans are always interested in distinguishing natural and artificial entities although there is no sharp demarcation between the two categories. Surprisingly, things do not improve when the second type of entities is restricted to the arguably more constrained realm of physical technical artifacts. This paper helps to clarify the relationship between natural entities and technical artifacts by developing a conceptual landscape within which to analyze these notions. The framework is developed by studying three definitions of technical artifact which arise from (...) different perspectives. All these perspectives share two intuitions: that technical artifacts are physical objects that exist by human intervention; and that technical artifacts are entities to be contrasted to natural entities. Yet the perspectives are different in the way they spell out these intuitions: the relevant human intervention may range from intentional selection to intentional production; and the contrast between technical artifacts and natural entities may be introduced by a constitution relation or by defining properties that set technical artifacts apart. The three perspectives are compared and their similarities and dissimilarities are explored with the help of ontological analysis. (shrink)

In this paper we propose and analyze a game-theoretic model of the epistemology of peer disagreement. In this model, the peers' rationality is evaluated in terms of their probability of ending the disagreement with a true belief. We find that different strategies---in particular, one based on the Steadfast View and one based on the Conciliatory View---are rational depending on the truth-sensitivity of the individuals involved in the disagreement. Interestingly, the Steadfast and the Conciliatory Views can even be rational simultaneously in (...) some circumstances. We tentatively provide some reasons to favor the Conciliatory View in such cases. We argue that the game-theoretic perspective is a fruitful one in this debate, and this fruitfulness has not been exhausted by the present paper. (shrink)

In October 2019, the Belgian government announced the opening of an asylum center in a former retirement home, leading to civic and political protest that escalated into arson. We examine the construction of the events before, on, and after the arson by analyzing 135 articles from Flemish newspapers, the public broadcaster’s news website, and alternative media between October 25 and November 30, 2019 using qualitative content analysis. Our analysis emphasizes journalists’ role as gatekeepers, deciding which actors get access and legitimation (...) in media coverage. Focus is on the dynamic process of how events become discursively constructed through the interventions of journalists and their sources attempting to gain primary definer status. Our analysis confirms that institutional sources remain more likely to achieve primary definer status in legacy news media. Alternative media perform similar discursive interventions as legacy news media but utilize them to provide access and legitimacy to different actors and standpoints. In the first days of news coverage, in particular, the narratives developed in right-leaning alternative media seemed to spread in legacy news media. In the following days, governmental actors and experts, through their interventions in legacy news media, were able to steer the discourse in a different direction. (shrink)

ABSTRACT Understanding how extremist Salafists communicate, and not only what, is key to gaining insights into the ways they construct their social order and use psychological forces to radicalize potential sympathizers on social media. With a view to contributing to the existing body of research which mainly focuses on terrorist organizations, we analyzed accounts that advocate violent jihad without supporting any terrorist group and hence might be able to reach a large and not yet radicalized audience. We constructed a critical (...) multimodal and multidisciplinary framework of discourse patterns that may work as potential triggers to a selection of key cognitive biases and we applied it to a corpus of Facebook posts published by seven extremist Salafists. Results reveal how these posts are either based on an intense crisis construct or on simplistic solutions composed of taken-for-granted statements. Devoid of any grey zone, these posts do not seek to convince the reader; polarization is framed as a presuppositional established reality. These observations reveal that extremist Salafist communication is constructed in a way that may trigger specific cognitive biases, which are discussed in the paper. (shrink)

Site‐specific recombination events are of fundamental importance in many biological systems. In vitro experiments using purified proteins and DNA sub‐strates are yielding insights into strand exchange mechanisms and synapsis of recombination sites. By examining results across a range of systems ‐ prokaryotic and eukaryotic ‐ two distinct classes of site‐specific recombinase enzymes can be defined.

This paper systematically compares two frameworks for analysing technical artefacts: the Dual-Nature approach, exemplified by the contributions to Kroes and Meijers , and the collectivist approach advocated by Schyfter , following Kusch . After describing the main tenets of both approaches, we show that there is significant overlap between them: both frameworks analyse the most typical cases of artefact use, albeit in different terms, but to largely the same extent. Then, we describe several kinds of cases for which the frameworks (...) yield different analyses. For these cases, which include one-of-a-kind artefacts and defect types, the Dual-Nature framework leads to a more attractive analysis. Our comparison also gives us the opportunity to respond to Vaesen’s critical paper. We do so by distinguishing two readings of the Dual-Nature framework and pointing out that on the sustainable, weaker reading, Vaesen’s considerations supplement the framework rather than offering an alternative to it.Keywords: Technical artefact; Dual Nature framework; Collectivist framework; Artefact use. SUMMARYHistorians of historiography have recently adopted the language of ‘epistemic virtues’ to refer to character traits believed to be conducive to good historical scholarship. While ‘epistemic virtues’ is a modern philosophical concept, virtues such as ‘objectivity’, ‘meticulousness’ and ‘carefulness’ historically also served as actors' categories. Especially in the late nineteenth and early twentieth centuries, historians frequently used virtue language to describe what it took to be a ‘good’, ‘reliable’ or ‘professional’ scholar. Based on three European case studies—the German historian Georg (...) Waitz, his French pupil Gabriel Monod and the Belgian historian Henri Pirenne —this article argues that such virtues cannot neatly be classified as ‘epistemic’ ones. For what is characteristic about virtue language in historical scholarship around 1900 is an overlap or entanglement of epistemic, moral and political connotations. The virtues embodied by, or attributed to, Waitz, Monod and Pirenne were almost invariably aimed at epistemic, moral and political goods at once, though not always to the same degrees. Consequently, if ‘epistemic virtues’ is going to be a helpful category, it must not be interpreted in a strong sense, but in a weak one. (shrink)

Aristotle's zoological writings with their wealth of detailed investigations on diverse species of animals have fascinated medieval and Renaissance culture. This volume explores how these texts have been read in various traditions (Arabic, Hebrew, Latin), and how they have been incorporated in different genres (in philosophical and scientific treatises, in florilegia and encyclopedias, in theological symbolism, in moral allegories, and in manuscript illustrations). This multidisciplinary and multilinguistic approach highlights substantial aspects of Aristotle's animals.

Various approaches have emerged over the last several decades to meet the challenges and complexities of anticipating and responding to the potential impacts of emerging technologies. Although many of the existing approaches share similarities, they each have shortfalls. This paper takes as the object of its study Anticipatory Ethics for Emerging Technologies (ATE) to technology assessment, given that it was formatted to address many of the privations characterising parallel approaches. The ATE approach, also in practice, presents certain areas for retooling, (...) such as how it characterises levels and objects of analysis. This paper results from the work done with the TechEthos Horizon 2020 project in evaluating the ethical, legal, and social impacts of climate engineering, digital extended reality, and neurotechnologies. To meet the challenges these technology families present, this paper aims to enhance the ATE framework to encompass the variety of human processes and material forms, functions, and applications that comprise the socio-technical systems in which these technologies are embedded. In this paper, we carry out a critical analysis of the concept of technology in the current design of the bio-based economy (BBE). Looking at the current status of the BBE, we observe a dominant focus on technological innovation as the principal solution to climatic instability. We take a critical stance towards this “ecomodernist” worldview, addressing its fundamental assumptions, and offer an underarticulated explanation as to why a successful transition toward a sustainable BBE—i.e. one that fully operates within the Earth’s (...) carrying capacity—has not yet been reached. Bernard Stiegler has developed a philosophical perspective on the concept of economy, broadening it to include the human condition through the notion of desire. This theory can help to obtain a more profound understanding of why ecomodernist strategies are dominant today. Stiegler’s theory of the libidinal economy offers an analysis of controlled and exploited human desire as a primary driver behind modern techno-economic structures. Our hypothesis is that a critique of contemporary technofixism _as_ a critique of libidinal economy is a necessary step to take in the discussion around the BBE as a concept, if the BBE is ever to bring about a system that can truly operate within the Earth’s carrying capacity. Recognized as a simple communicative behavior, referential pointing is cognitively complex because it invites a communicator to consider an addressee's knowledge. Although we know referential pointing is affected by addressees’ physical location, it remains unclear whether and how communicators’ inferences about addressees’ mental representation of the interaction space influence sensorimotor control of referential pointing. The communicative perspective-taking task requires a communicator to point at one out of multiple referents either to instruct an addressee which one should be selected (communicative, COM) (...) or to predict which one the addressee will select (non-communicative, NCOM), based on either which referents can be seen (Level-1 perspective-taking, PT1) or how the referents were perceived (Level-2 perspective-taking, PT2) by the addressee. Communicators took longer to initiate the movements in PT2 than PT1 trials, and they held their pointing fingers for longer at the referent in COM than NCOM trials. The novel findings of this study pertain to trajectory control of the pointing movements. Increasing both communicative and perspective-taking demands led to longer pointing trajectories, with an under-additive interaction between those two experimental factors. This finding suggests that participants generate communicative behaviors that are as informative as required rather than overly exaggerated displays, by integrating communicative and perspective-taking information hierarchically during sensorimotor control. This observation has consequences for models of human communication. It implies that the format of communicative and perspective-taking knowledge needs to be commensurate with the movement dynamics controlled by the sensorimotor system. (shrink)

This volume features 16 essays on the philosophy of technology that discuss its identity, its position in philosophy in general, and the role of empirical studies in philosophical analyses of engineering ethics and engineering practices. This volume is published about fifteen years after Peter Kroes and Anthonie Meijers published a collection of papers under the title The empirical turn in the philosophy of technology, in which they called for a reorientation toward the practice of engineering, and sketched the likely benefits (...) for philosophy of technology of pursuing its major questions in an empirically informed way. The essays in this volume fall apart in two different kinds. One kind follows up on The empirical turn discussion about what the philosophy of technology is all about. It continues the search for the identity of the philosophy of technology by asking what comes after the empirical turn. The other kind of essays follows the call for an empirical turn in the philosophy of technology by showing how it may be realized with regard to particular topics. Together these essays offer the reader an overview of the state of the art of an empirically informed philosophy of technology and of various views on the empirical turn as a stepping stone into the future of the philosophy of technology. The aim of this study was to test whether an online video game can be used to investigate planning ability and whether fluid intelligence, objective numeracy, and subjective numeracy are predictive of game performance. Our results demonstrate that fluid intelligence is particularly important, which is in line with previous non-game-based studies that show a relationship between classical planning tests and fluid intelligence. Video games have been previously used for research into cognitive processes and taking them online facilitates data collection on (...) a larger scale. Online video games also afford data collection without the expense and stress of a laboratory environment. For these reasons, using online video games to investigate human cognition is a promising alternative to the classic cognitive paradigms used in laboratories. (shrink)

The brain adapts to changes that take place in the body. Deprivation of input results in size reduction of cortical representations, whereas an increase in input results in an increase of representational space. Amputation forms one of the most dramatic disturbances of the integrity of the body. The brain adapts in many ways to this breakdown of the afferent–efferent equilibrium. However, almost all studies focus on the sensorimotor consequences. It is not known whether adaptation takes place also at other “levels” (...) in the system. The present study addresses the question whether amputees dream about their intact body, as before the amputation, or about the body after the amputation and whether the dream content was a function of time since the amputation and type of amputation. The results show that the majority of the dreamers reported dreams about their intact body although the mean time that elapsed since the amputation was twelve years. There is no clear relation with the type of amputation. The results give modest evidence for the existence of a basic neural representation of the body that is, at least, partly genetically determined and by this relatively insensitive for changes in the sensory input. This study aimed to evaluate if eye blinks can be used to discriminate players with different performance in a session of Nintendo Entertainment System (NES) Tetris. To that end, we developed a state-of-the-art method for blink extraction from EAR measures, which is robust enough to be used with data collected by a low-grade webcam such as the ones widely available on laptop computers. Our results show a significant decrease in blink rate per minute (blinks/m) during the first minute of playing (...) Tetris. After having defined 3 groups of proficiency based on in-game performance (Novices, Intermediates, and Experts) we found out that expert players display a significantly lower decrease in blinks/m compared to novices during the first minute of gameplay, which shows that Tetris players' proficiency can be detected by looking at eye blinks/m variations during the early phase of a game session. This difference in blinks/m is observed throughout the entire game session, which supports the general conclusion that proficient Tetris players have a lower decrease in blinks/m, even when playing more difficult levels. Finally, we offer some interpretations of this effect and the relationship that our results may have with the visual cognitive workload experienced during the gameplay. (shrink)

Selection on grandparental investment is more complex than Coall & Hertwig (C&H) propose. Patterns of investment are subject to an intergenerational conflict over how resources should be distributed to maximize fitness. Grandparents may be selected to distribute resources unevenly, while their descendants will be selected to manipulate investment in their own favor. Here we outline the evolutionary basis of this conflict.
