Leo Strauss’s early book Philosophy and Law has remained a stumbling block in current Strauss scholarship. This article seeks to explore the text by way of the ensuing debate between Strauss and Julius Guttmann concerning the historical and systematic presuppositions of Jewish philosophy. In decisive respects Guttmann was unable to follow Strauss’s argument, particularly because he could not solve the riddle whether Philosophy and Law was a precursor of the “exoteric” Strauss or not. On the one hand there emerged a new sense of the irreplaceability of individual people, of the finality of death and the immeasurable preciousness of a single life. On the other hand death, that which followed one's demise, became conceptually (...) more austere. For the first time since antiquity, perhaps ever, the belief that death is pure negativity or nothingness asserted itself with enough success to become a generally accepted cultural attitude. 1 This image of sheer nonexistence, this death stripped down to its ontological minimum, is the most extreme form of mortality that has arisen in the history of the West, the hardest perhaps to take, the most naked. In ways that could not have occurred before, these two developments in the history of death have worked with and against each other to create a new understanding of subjectivity, a set of theorizations about human individuality that, for all their diversity of detail, are bound together by a certain historical determinacy. Hegel's views on the relation between mortality and subjectivity, for instance, like Heidegger's or Blanchot's, have no precedent, but they do have endless repercussions. Whatever their causes, the newness and the effectiveness of these theories indicate that during the nineteenth century a unique cultural formation arose in relation to mortality. The moment still has not passed, since the basic elements of the new death continue to operate on contemporary imaginations and theorizations. What follows is an attempt to draw the portrait of the death that emerged for the first time in the nineteenth century: to critically and analytically examine formulations of the relation between death and identity in order to determine the value of absolute mortality as an individualizing principle. Often these formulations are most clearly articulated by post-nineteenth-century thinkers, but they are the products, and indeed the expressions, of that historical transformation that occurred sometime after the Revolution. When we read these texts and arguments, we are asking not merely whether they are valid as arguments, but about the value of the general attitude they reflect—the value not only of a specific kind of death, but of a kind of subjectivity that is unique to the last two hundred years. And since that subjectivity is probably the most significant product of those centuries, the most pervasive and the most intimately affecting, we are also, intentionally or not, asking about the value of a whole period.To read this relation between mortality and subjectivity, we must come to some understanding about the terms at issue, especially what death is or is not when considered in its most extreme form as simple nothingness. It may seem odd that this is an issue at all, but nonexistence has proven a difficult concept to integrate into theorizations [End Page 90] of human life. The first question to raise in this context is whether death can be considered a state, a divisive proposition on which much hangs. In the introduction to a recent collection of essays on metaphysics and death, John Martin Fischer baldly asserted that "being dead is a condition or a state" [4]. The philosopher Paul Edwards, however, has pointed to some of the "absurdities," as he puts it, of considering death as an ontological condition. To imagine death as a state is, he argues, to attribute to it some sort of being, but death, understood as the permanent loss of consciousness and experience, has no being and is simply absence. Claude Levi-Strauss mentioned several times in his work that the notion of transformation is the keystone of the structural analysis he pratices. By his own admission, this notion stems from his reading of D’Arcy Thomson’s book On Growth and Form during World War II in the United States. But Levi-Strauss makes use of two very different meanings of transformation, relating to two distinct morpho-genetic traditions. On the one hand, he is inspired by Goethe’s Morphology. All forms can be (...) seen as transformation of a Urform, an original form, from which they grow out like a tree. But on the other hand, D’Arcy Thomson’s emphasis lies on the geometric simplicity of a transformation grid that allows the transition from one biological form to the other without considering any original from which other forms would be derivable. Levi-Strauss’ epistemological choice to study myths and masks can be better understood when his concept of transformation is clearly defined in relation to Goethe and D’Arcy Thomson. This article develops a comparative and recursive approach to political ontology by drawing on the ontological turn in anthropology. It claims that if ontological commitments define reality, then the use of ontology by recent pluralist political theorists must undercut pluralism. By charting contemporary anthropology’s rereading of structuralism as part of a plural understanding of ontology, it will be shown that any political ontology places limits on the political, and thus cannot exhaust political experience. This position will be established through an (...) analysis of the role of Claude Lévi-Strauss in the work of Ernesto Laclau and Chantal Mouffe and a comparison with the political ontology represented by perspectivism and potential affinity. Anthropology’s lesson for political theory is that ontology cannot simply be revised and treated in the singular, but that political ontologies must be analysed comparatively to reveal the shortcomings of, and recursively alter, one’s own political frame of reference. Foundationalism and coherentism are two fundamentally opposed basic epistemological views about the structure of justification. Interestingly enough, there is no consensus on how to interpret Husserl. While interpreting Husserl as a foundationalist was the standard view in early Husserl scholarship, things have changed considerably as prominent commentators like Christian Beyer, John Drummond, Dagfinn Føllesdal, and Dan Zahavi have challenged this foundationalist interpretation. These anti-foundationalist interpretations have again been challenged, for instance, by Walter Hopp and Christian Erhard. One might suspect that (...) inconsistencies in Husserl’s writings are the simple reason for this disagreement. I shall argue, however, that the real question is not so much how to read Husserl, but how to define foundationalism and that there is overwhelming textual evidence that Husserl championed the most tenable version of foundationalism: a moderate foundationalism that allows for incorporating coherentist elements. The aim of this paper is twofold. The first is an interpretative one as I wish to provide a detailed account of Husserl’s conception of experiential justification. Here Ideas I and Introduction to Logic and Theory of Knowledge: Lectures 1906/07 will be my main resources. My second aim is to demonstrate the currency and relevance of Husserl’s conception. This means two things: Firstly, I will show that in current debates in analytic epistemology there is a movement sharing with Husserl the (...) basic idea that certain experiences gain their justificatory force simply from their distinctive phenomenal character. Secondly, I shall reveal the benefits of Husserl’s specific version of this view. Thus, one of my aims is to show that debates in current analytic epistemology could profit from adopting certain Husserlian elements. More precisely, I will defend Husserl’s claim that perceptual experiences are justifiers due to their self-giving phenomenal character as opposed to the currently popular view that it is the phenomenology of pushiness that makes them justifiers. Attention has a role in much of perception, thought, and action. On the erotetic theory, the functional role of attention is a matter of the relationship between questions and what counts as answers to those questions. Questions encode the completion conditions of tasks for cognitive control purposes, and degrees of attention are degrees of sensitivity to the occurrence of answers. Questions and answers are representational contents given precise characterizations using tools from formal semantics, though attention does not depend on language. (...) The erotetic theory proposes an integrated account of attention in cognitive control and of attentional focus in perception. The functional role of attentional focus on objects, properties, and locations has to do with picking out something that corresponds to what a task is ‘about’. The erotetic theory of attention opens new avenues in theorizing about the relationship between attention, representational content, phenomenal character, and practical reason. A novel representationalist account of salience is proposed. The theory also provides an account of distraction that suggests when distraction is a defect in practical reasoning. (shrink)

A study of how contemporary cinema and film-philosophers explore radical skepticism about our knowledge of the world.

During a pandemic, demand for intensive care often exceeds availability. Experts agree that allocation should maximize benefits and must not be based on whether patients could have taken preventive measures. However, intensive care units are often overburdened by individuals with severe COVID-19 who have chosen not to be vaccinated to prevent the disease. This article reports an experiment that investigated the German public's prioritization preferences during the fourth wave of the coronavirus pandemic. In a series of scenarios, participants were asked (...) to decide on ICU admission for patients who differed in terms of health condition, expected treatment benefits, and vaccination status. The results reveal an in-group bias, as vaccinated individuals preferred to allocate more resources to the vaccinated than to the unvaccinated. Participants also favored admitting a heart attack patient rather than a COVID-19 patient with the same likelihood of benefiting from ICU admission, indicating a preference for maintaining regular ICU services rather than treating those with severe COVID-19. Finally, participants were more likely to admit a patient to intensive care when this meant withholding rather than withdrawing care from another patient. The results indicate that lay prioritizations violate established allocation principles, presaging potential conflicts between those in need of intensive care and those who provide and allocate it. It is therefore recommended that allocation principles should be explained to enhance public understanding. Additionally, vaccination rates should be increased to relieve ICUs and reduce the need for such triage decisions. (shrink)

Multiscale modeling techniques have attracted increasing attention by philosophers of science, but the resulting discussions have almost exclusively focused on issues surrounding explanation (e.g., reduction and emergence). In this paper, I argue that besides explanation, multiscale techniques can serve important exploratory functions when scientists model systems whose organization at different scales is ill-understood. My account distinguishes explanatory and descriptive multiscale modeling based on which epistemic goal scientists aim to achieve when using multiscale techniques. In explanatory multiscale modeling, scientists use multiscale (...) techniques to select information that is relevant to explain a particular type of behavior of the target system. In descriptive multiscale modeling scientists use multiscale techniques to explore lower-scale features which could be explanatorily relevant to many different types of behavior, and to determine which features of a target system an upper-scale data pattern could refer to. Using multiscale models from data-driven neuroscience as a case study, I argue that descriptive multiscale models have an exploratory function because they are a sources of potential explanations and serve as tools to reassess our conception of the target system. Perceptual experiences justify. When I look at the black laptop in front of me and my perceptual experience presents me with a black laptop placed on my desk, my perceptual experience has justificatory force with respect to the proposition that there is black laptop on the desk. The present paper addresses the question of why perceptual experiences are a source of immediate justification: What gives them their justificatory force? I shall argue that the most plausible and the most straightforward answer (...) to this question consists in what I call the phenomenological conception of perceptual justification. Perceptual experiences justify by virtue of their distinctive presentive phenomenology. This is a truly internalist conception that enjoys significant advantages over rival conceptions. In the course of his paper, I demonstrate the advantages of the phenomenological conception and defend it against a recent objection. (shrink)

The Erlöserkirche at Bad Homburg was built between 1903 and 1908 at the instigation of Kaiser Wilhelm II. It combines a neo-Romanesque exterior with Norman-Sicilian mosaics inside. Both were „Germanic“ to the emperor, and the church embodied his all encompassing claim to the tradition of the medieval Holy Roman Empire of the German Nation. Alternatively, the contemporary Byzantinist Ernst Gerland pointed to a Byzantine origin of the Norman-Sicilian models (and thus subtly contradicted the „pan-Germanic“ myth). This „Byzantine“ reading has prevailed (...) ever since, but does not stand up to scrutiny. It only serves to obscure the „pan-Germanic“ concept of the church. This contribution restores the „Germanic“ understanding and makes the point that the latter must be acknowledged in order to make proper sense of the church’s art and architecture, but also in order to face (rather than to downplay and conveniently forget) the racist-chauvinist character of German imperialism. Cross-cultural comparisons often investigate values that are assumed to have long-lasting influence on human conduct and thought. To capture and compare cultural values across cultures, Geert Hofstede's Cultural Dimensions Theory has offered an influential framework. Hofstede also provided a survey instrument, the Values Survey Module (VSM), for measuring cultural values as outlined in his Cultural Dimensions Theory. The VSM has since been subject to a series of revisions. Yet, data on countries have been derived from the original VSM — and (...) not on one of the revised versions of VSM. We tested three scales (indulgence, power distance, and individualism) from the latest version, the VSM 2013, as part of a larger survey across 57 countries. Two main findings emerged. For one thing, country scores based on the VSM 2013 scales correlated only weakly with country scores of the same cultural dimensions obtained in a large previous study. Thus, the validity of the VSM 2013 is in doubt. For another thing, the internal consistency of the VSM 2013 scales was overall poor, indicating that the scales did not reliably measure well-defined constructs. Can phenomenologists allow for the existence of unobservable entities such as atoms, electrons, and quarks? Can we justifiably believe in the existence of entities that are in principle unobservable? This paper addresses the relationship between Husserlian transcendental phenomenology and scientific realism. More precisely, the focus is on the question of whether there are basic epistemological principles phenomenologists are committed to that have anti-realist consequences with respect to unobservable entities. This question is relevant since Husserl’s basic epistemological principles, such as the (...) “principle of all principles,” seem to suggest that epistemic justification is limited to what can be originally given in the sense that if an object cannot be given in an originary presentive intuition, then one cannot be justified in believing that this object exists. It is the main aim of this paper to show (i) that interpretative reasons exist for not reading Husserl in such a way and (ii) that systematic reasons exist as to why phenomenologists should not subscribe to this criterion. I shall put forward a different criterion of justification that satisfies the spirit of Husserlian transcendental phenomenology and allows for justifiably believing in the existence of unobservable scientific entities. Motivated by results of Bagaria, Magidor and Väänänen, we study characterizations of large cardinal properties through reflection principles for classes of structures. More specifically, we aim to characterize notions from the lower end of the large cardinal hierarchy through the principle [math] introduced by Bagaria and Väänänen. Our results isolate a narrow interval in the large cardinal hierarchy that is bounded from below by total indescribability and from above by subtleness, (...) and contains all large cardinals that can be characterized through the validity of the principle [math] for all classes of structures defined by formulas in a fixed level of the Lévy hierarchy. Moreover, it turns out that no property that can be characterized through this principle can provably imply strong inaccessibility. The proofs of these results rely heavily on the notion of shrewd cardinals, introduced by Rathjen in a proof-theoretic context, and embedding characterizations of these cardinals that resembles Magidor’s classical characterization of supercompactness. In addition, we show that several important weak large cardinal properties, like weak inaccessibility, weak Mahloness or weak [math]-indescribability, can be canonically characterized through localized versions of the principle [math]. Finally, the techniques developed in the proofs of these characterizations also allow us to show that Hamkin’s weakly compact embedding property is equivalent to Lévy’s notion of weak [math]-indescribability. The focus of this paper are the ethical, legal and social challenges for ensuring the responsible use of “big brain data”—the recording, collection and analysis of individuals’ brain data on a large scale with clinical and consumer-directed neurotechnological devices. First, I highlight the benefits of big data and machine learning analytics in neuroscience for basic and translational research. Then, I describe some of the technological, social and psychological barriers for securing brain data from unwarranted access. In this context, I then (...) examine ways in which safeguards at the hardware and software level, as well as increasing “data literacy” in society, may enhance the security of neurotechnological devices and protect the privacy of personal brain data. Regarding ethical and legal ramifications of big brain data, I first discuss effects on the autonomy, the sense of agency and authenticity, as well as the self that may result from the interaction between users and intelligent, particularly closed-loop, neurotechnological devices. I then discuss the impact of the “datafication” in basic and clinical neuroscience research on the just distribution of resources and access to these transformative technologies. In the legal realm, I examine possible legal consequences that arises from the increasing abilities to decode brain states and their corresponding subjective phenomenological experiences on the hitherto inaccessible privacy of these information. Finally, I discuss the implications of big brain data for national and international regulatory policies and models of good data governance. (shrink)

Barnett and Block (J Bus Ethics 18(2):179–194, 2011 ) argue that one cannot distinguish between deposits and loans due to the continuum problem of maturities and because future goods do not exist—both essential characteristics that distinguish deposit from loan contracts. In a similar way but leading to opposite conclusions (Cachanosky, forthcoming) maintains that both maturity mismatching and fractional reserve banking are ethically justified as these contracts are equivalent. We argue herein that the economic and legal differences between genuine deposit and (...) loan contracts are clear. This implies different legal obligations for these contracts, a necessary step in assessing the ethics of both fractional reserve banking and maturity mismatching. While the former is economically, legally, and perhaps most importantly ethically problematic, there are no such troubles with the latter. (shrink)

Abstract Theories of descriptions tend to involve commitments about the ambiguity of descriptions. For example, sentences containing descriptions are widely taken to be ambiguous between de re , de dicto , and intermediate interpretations and are sometimes thought to be ambiguous between the former and directly referential interpretations. I provide arguments to suggest that none of these interpretations are due to ambiguities (or indexicality). On the other hand, I argue that descriptions are ambiguous between the above family of interpretations and (...) what may be called ‘institutional’ as well as generic interpretations. My arguments suggest that an adequate theory of descriptions may require considerable rethinking. Most contemporary theories of descriptions appear to be committed to one or more claims about the ambiguity of descriptions that I reject in this paper. I suggest that my observations provide a reason to renew efforts to develop a theory of descriptions within a representationalist theory of interpretation. It is well known that Husserl considered phenomenology to be First Philosophy—the ultimate science. For Husserl, this means that phenomenology must clarify the ultimate phenomenological-epistemological principle that leads to ultimate elucidation. But what is this ultimate principle and what does ultimate elucidation mean? It is the aim of this paper to answer these questions. In section 2, we shall discuss what role Husserl’s principle of all principles can play in the quest for ultimate elucidation and what it means for a (...) principle to be ultimately elucidating and ultimately elucidated. We will see that the Husserlian thesis that originary presentive intuitions are an immediate and the ultimate source of justification qualifies as the ultimate epistemological principle. (shrink)

In the past decade, the fields of machine learning and artificial intelligence (AI) have seen unprecedented developments that raise human-machine interactions (HMI) to the next level.Smart machines, i.e., machines endowed with artificially intelligent systems, have lost their character as mere instruments. This, at least, seems to be the case if one considers how humans experience their interactions with them. Smart machines are construed to serve complex functions involving increasing degrees of freedom, and they generate solutions not fully anticipated by humans. (...) Consequently, their performances show a touch of action and even autonomy. HMI is therefore often described as a sort of “cooperation” rather than as a mere application of a tool. Some authors even go as far as subsuming cooperation with smart machines under the label ofpartnership, akin to cooperation between human agents sharing a common goal. In this paper, we explore how far the notion of shared agency and partnership can take us in our understanding of human interaction with smart machines. Discussing different topoi related to partnerships in general, we suggest that different kinds of “partnership” depending on the form of interaction between agents need to be kept apart. Building upon these discussions, we propose a tentative taxonomy of different kinds of HMI distinguishing coordination, collaboration, cooperation, and social partnership. (shrink)

Recent interest in phenomena of simulation, pretense, and play has given rise to new philosophical debates on the basic structure of human action and action planning. Some philosophers sought to transform Hume's desire-belief-action model by sophisticating its basic structure. For example, they introduced “hypothetical world boxes” or imaginary “i-desires” and “i-beliefs” into the standard model, in order to account for the representational and motivational structures of imaginary scripts. Others used phenomena of behavior driven by imagination to attempt a more fundamental (...) critique of the Humean tradition. This article aims to show how the pragmatist tradition could be used as a resource in reframing current debates on imagination, pretense, and simulation in the cognitive sciences. This article probes the relationship between archives and history by examining the archive policy on historical research in the first modern administration state of the German lands, the kingdom of Bavaria. Given the continuing tradition of the theory and practice of the arcana imperii in the 19th century, state archives served first and foremost the state. As a result, researchers’ interest in archival material was to undergo an administrative vetting procedure, in order to safeguard the interests of the state. By (...) examining comparatively the cases of two petitioners supplicating for the historical use of state archives in Munich, the article showcases the policy of secrecy and the resultant administrative threshold separating the sphere of the arcana from the public. Caution guided the archive politics of state officials and, ultimately, their more or less explicit notions and concerns decided which material was finally to be released, in order to become a ‘source’ for historical study. Historical researchers such as the writer Alessandro Volpi and the historian August Kluckhohn were thus required to meet specific criteria and to overcome political hurdles, in order to gain access to the desired clues guarded by the state. As a result of this, the opportunity to inspect archival material was very much dependent on the political communication between petitioner and government, and its result, the granting or denial of access, was not without ramifications for historical research and the epistemic status of historical knowledge. "Die vorliegende Studie versucht aus problemgeschichtlicher Perspektive einige Aspekte Wang Biíschen Denkens vorzustellen, insofern sie in Kontinuität zur song-typischen Abstraktionsleistung des sogenannten Neokonfuzianismus gesehen werden können. Wang Bi (226-249) gilt als einer der prominentesten Vertreter der xuanxue, einer wei-jin-zeitlichen intellektuellen Strömung ausgeprägt spekulativen Charakters. Bereits zu Lebzeiten wurde er als einer der brillantesten Köpfe und als maßgeblicher Kommentator des Yijing (Buch der Wandlungen) und des Daodejing gefeiert. Diese Kommentare wie auch die von ihm verfaßten Auslegungen jener Werke gelangten zu beträchtlicher (...) Fernwirkung innerhalb ideengeschichtlicher Entwicklungen Chinas. Von dem unverkennbar innovativen Argumentationstyp, der die Texte des Wang Bi auszeichnet, sollten entscheidende Impulse für den kulturtraditionellen Diskurs folgender Jahrhunderte ausgehen.
