Since 1991, sperm donors in the UK have had the legal right to withdraw consent for the use of their sperm in fertility treatment. This has the potential to adversely affect patients. It may mean that previous recipients of a donor’s sperm cannot have further children who are full biological siblings to an existing child, and that embryos created from the donor’s sperm and a patient’s eggs must be destroyed.

Under current UK law, an embryo cannot be transferred to a woman's uterus without the consent of both of its genetic parents, that is both of the people from whose gametes the embryo was created. This consent can be withdrawn at any time before the embryo transfer procedure. Withdrawal of consent by one genetic parent can result in the other genetic parent losing the opportunity to have their own genetic children. We argue that offering couples only one type of consent (...) agreement, as happens at present, is too restrictive. An alternative form of agreement, in which one genetic parent agrees to forego the right to future withdrawal of consent, should be available alongside the current form of agreement. Giving couples such a choice will better enable them to store embryos under a consent agreement that is appropriate for their circumstances. Allowing such a choice, with robust procedures in place to ensure the validity of consent, is the best way to respect patient autonomy. (shrink)

Asbestos-related illnesses contribute to the deaths of more than 100,000 people worldwide (ILO 2006) and the plight of sufferers of these illnesses has become a global ethical issue. A leading, Australian building products corporation, James Hardie, created a complex corporate structure that included the establishment of a “Victims Compensation Fund”, and moved its corporate headquarters to the Netherlands to reduce its liabilities. Hardie claimed that this move was tax minimization (Haigh 2006). In this study case, a number of ethical issues (...) provides the opportunity to discuss many business-society questions. These include the duties of the company towards a wide range of stakeholders affected in some way by Hardie’s earlier production of asbestos-related products and its subsequent responses to the question of compensation. Spinoza’s metaphysics has returned in the work of Hugh Everett as physics— as a complete and consistent interpretation of Quantum Mechanics that resolves the traditional puzzles of the standard interpretation of Quantum Mechanics.

In this remarkably clear and original study of the Tractatus Peter Carruthers has two principal aims. He seeks to make sense of Wittgenstein's metaphysical doctrines, showing how powerful arguments may be deployed in their support. He also aims to locate the crux of the conflict between Wittgenstein's early and late philosophies. This is shown to arise from his earlier commitment to the objectivity of logic and logical relations, which is the true target of attack of his later discussion of (...) rule-following. Within this general framework Dr Carruthers explores a number of themes, including the early Wittgenstein's doctrine of the priority of logic over metaphysics, the nature and purpose of his programme of analysis for ordinary language and the various possible arguments supporting the existence of Simples. He offers many original interpretations and defends them with considerable attention to textual detail, yet the book's clarity and directness will make it accessible to anyone acquainted with the Tractatus. Following its welcome revival in the late twentieth century, metaphysics in the analytic tradition has succumbed to decadence, with an astonishing variety of outlandish and extreme positions or “metaphysical follies” being taken seriously. This has caused an inevitable backlash among more scientifically-minded philosophers and incurred the scorn of scientists. Much of the reason for this is the blithe ignoring of empirical science by armchair metaphysicians. The roles of empirical knowledge in good, scientific metaphysics are however unclear. In virtue of its (...) maximal generality, metaphysics is remote from straightforward empirical checks. This article explores, with historical and contemporary examples, the ways in which empirical information may inform and be fed back into metaphysics, the disputed role of common sense, and the delicate balance to be maintained, within a fallibilist, scientific metaphysics, between speculative, categorial and empirical elements. Peter Homans offers a new understanding of the origins of psychoanalysis and relates the psychoanalytic project as a whole to the sweep of Western culture, past and present. He argues that Freud's fundamental goal was the interpretation of culture and that, therefore, psychoanalysis is fundamentally a humanistic social science. To establish this claim, Homans looks back at Freud's self-analysis in light of the crucial years from 1906 to 1914 when the psychoanalytic movement was formed and shows how these experiences (...) culminated in Freud's cultural texts. By exploring the "culture of psychoanalysis," Homans seeks a better understanding of what a "psychoanalysis of culture" might be. Psychoanalysis, Homans shows, originated as a creative response to the withering away of traditional communities and their symbols in the aftermath of the industrial revolution. The loss of these attachments played a crucial role in the lives of the founders of psychoanalysis, especially Sigmund Freud but also Karl Abraham, Carl Jung, Otto Rank, and Ernest Jones. The personal, political, and religious losses that these figures experienced, the introspection that followed, and the psychological discovery that resulted are what Homans calls "the ability to mourn." Homans expands this historical analysis to construct a general model of psychological discovery: the loss of shared ideals and symbols can produce a deeper sense of self (psychological structure-building, or individuation) and can then lead to the creation of new forms of meaning and self-understanding. He shows how Freud, Jung, and other psychoanalysts began to extend their introspection outward, reinterpreting the meanings of Western art, history, and religion. In conclusion, Homans evaluates Freud's theory of culture and discusses the role that psychoanalysis might play in social and cultural criticism. Throughout the book, Homans makes use of the many histories, biographies, and psychobiographies that have been written about the origins of psychoanalysis, drawing them into a comprehensive sociocultural model. Rich in insights and highly original in approach, this work will interest psychoanalysts and students of Freud, sociologists concerned with modernity and psychoanalysis, and cultural critics in the fields of religion, anthropology, political science, and social history. Martin Heidegger is widely regarded as one of the most influential philosophers of the twentieth-century, and his seminal text Being and Time is considered one of the most significant texts in contemporary philosophy. Yet his name has also been mired in controversy because of his affiliations with the Nazi regime, his failure to criticize its genocidal politics and his subsequent silence about the holocaust. Now, according to Heidegger's wishes, and to complete the publication of his multi-volume Complete Works, his highly (...) controversial and secret 'Black Notebooks' have been released to the public. These notebooks reveal the extent to which Heidegger's 'personal Nazism' was neither incidental nor opportunistic, but part of his philosophical ethos. So, why would Heidegger, far from destroying them, allow these notebooks, which contain examples of this extreme thinking, to be published? In this revealing new book, Peter Trawny, editor of Heidegger's complete works in German, confronts these questions and, by way of a compelling study of his theoretical work, shows that Heidegger was committed to a conception of freedom that is only beholden to the judgement of the history of being; that is, that to be free means to be free from the prejudices, norms, or mores of one's time. Whoever thinks the truth of being freely exposes themselves to the danger of epochal errancy. For this reason, Heidegger's decision to publish his notebooks, including their anti-Jewish passages, was an exercise of this anarchical freedom. In physics, the temporal dimension has units of infinitesimally brief duration. Given this, how is it possible to perceive things, such as motion, music, and vibrotactile stimulation, that involve extension across many units of time? To address this problem, it is proposed that there is what is termed an “information construct of happening” (ICOH), a simultaneous representation of recent, temporally differentiated perceptual information on the millisecond time scale. The main features of the ICOH are (i) time marking, semantic labeling of (...) all information in the ICOH with ordinal temporal information and distance from what is informationally identified as the present moment, (ii) vector informational features that specify kind, direction, and rate of change for every feature in a percept, and (iii) connectives, information relating vector informational features at adjacent temporal locations in the ICOH. The ICOH integrates products of perceptual processing with recent historical information in sensory memory on the subsecond time scale. Perceptual information about happening in informational sensory memory is encoded in semantic form that preserves connected semantic trails of vector and timing information. The basic properties of the ICOH must be supported by a general and widespread timing mechanism that generates ordinal and interval timing information and it is suggested that state‐dependent networks may suffice for that purpose. Happening, therefore, is perceived at a moment and is constituted by an information structure of connected recent historical information. (shrink)

ABSTRACT Tensism is the view that tense is not merely a property of language and the mind, but of the world itself. Perspectivalism extends this idea to all perspectival properties be they person or locational. One challenge that perspectivalism faces is the problem of expressing the contents of the beliefs and utterances of persons that are in other perspectival positions. One proposed solution to this problem is to allow for semantic theories that "realign" the expression of contents so that the (...) contents expressed by persons in other perspectival positions can be re-expressed from one's own perspectival position. In this paper I argue that a similar semantic realignment strategy could be deployed in helping perspectivalists generally come to grips with a puzzle raised by the Special Theory of Relativity. In short, the strategy is to realign the expression of contents in another inertial frame so that they are expressed from within your inertial frame. As we will see, the strategy is not puzzle free. Bears comprise a subculture of gay men who valorize the larger, hirsute body. This research interrogates Bear culture as a gendered strategy for repudiating effeminacy that simultaneously challenges and reproduces norms of hegemonic masculinity. In this research, the author situates his ethnographic study of a major metropolitan Bear community in its social and historical context to illuminate this paradox, with special emphasis on the embodiment of Bear masculinity and its effect on sexual practice. The author concludes that through a process (...) of embodied agency, Bear culture yields a number of sexually innovative practices that disperse pleasure across the body and disrupt genitally centered, phallusandreceptacle interpretations of sex. However, the subversive potential of these practices is significantly undermined by an attendant set of practices that reflect heteronormative and hegemonically masculine interpretations of sex. Hai, Peter NV Lay people have always played a vital role in the life and mission of the church but it is only after the Second Vatican Council that the question of the laity has come into focus in a new way in Catholic theological reflection. Indeed, in the wake of Vatican II, the council that introduced a Copernican shift in the Catholic understanding of the laity, lay people have become the theme of a Synod of Bishops, the subject (...) of an Apostolic Exhortation, and the topic of several pastoral statements of national conferences of bishops. This paper begins with a review of the state of the question highlighting the need for a comparative investigation of the theologies of the laity according to John Paul II, the Federation of Asian Bishops' Conferences, and the Vietnamese Episcopal Conference. It then highlights the differences and convergences in these theologies. As all three theologies draw their inspiration from the teachings of Vatican II, and a prominent element of the council's concerns was the emphasis on the universal call to holiness, we will also provide a detailed comparison of this notable aspect across these theological systems. Our argument is that while some minor points of divergence and disagreement remain there is a greater convergence and agreement between these theologies of the laity. (shrink)

In The Political Limits of Environmental Regulation: Tracking the Unicorn, Bruce Yandle identifies some of the key weaknesses of federal environmental regulation, including its regressive effects, its tendency to better serve selected political interests than the cause of environmental protection, and the EPA's failure to follow sensible priorities. Additional problems may also be cited, including the tendency to exclude citizens? voices from deliberations regarding the degree of pollution control. But Yandle's conclusion regarding the likely superiority of decentralized and market?sensitive alternatives (...) to centralized regulation is overstated. Any such alternatives necessarily will continue to be grounded in relatively uniform national standards. Moreover, in the context of American political economy, market?based controls would continue to deny many citizens real voice and choice. The quest continues to be for the combination of controls that best preserves both the environment and liberty. (shrink)
