La integración de la tecnología en el ámbito del derecho penal plantea desafíos significativos debido a la falta de regulación de la inteligencia artificial (IA), lo que podría comprometer los derechos fundamentales. Este estudio se centra en abordar estos desafíos y proponer soluciones mediante un análisis exhaustivo de la situación actual y las posibles implicaciones de la IA en el sistema jurídico penal. El objetivo principal de esta investigación es analizar los problemas, desafíos y oportunidades que surgen con la implementación (...) de la inteligencia artificial en el ámbito penal. Se busca identificar la necesidad de una regulación específica para la IA en el derecho penal, con el fin de proteger los derechos fundamentales de las personas y garantizar un sistema jurídico justo y equitativo. Para abordar esta problemática, se adoptó un enfoque metodológico cualitativo. Se llevó a cabo una revisión bibliográfica detallada para examinar los antecedentes, problemas y desafíos asociados con la IA en los sistemas jurídicos, especialmente en el ámbito penal. Además, se realizaron análisis de criterios y opiniones de expertos en derecho para obtener una comprensión más profunda de la situación y las posibles soluciones. Los resultados de este estudio revelan la necesidad urgente de establecer una normativa específica para regular la aplicación de la inteligencia artificial en el ámbito penal. Se destaca que la falta de regulación representa un riesgo significativo para los derechos fundamentales, especialmente en lo que respecta a la configuración de delitos con el apoyo de la IA. Además, se identifican diferentes dimensiones que deben abordarse en la regulación, incluyendo principios y reglas básicas del derecho, supervisión humana de los sistemas de IA y la promoción de la innovación responsable en este campo. Este artículo subraya la importancia de establecer una regulación efectiva para la inteligencia artificial en el ámbito penal. Esta regulación no solo protegerá los derechos fundamentales de las personas, sino que también promoverá un uso responsable y progresivo de la IA como una herramienta valiosa para los profesionales del derecho. El artículo pretende aportar algunos trazos teóricos, metodológicos y prácticos para la lectura de la cuestión del Estado y el poder, desde la perspectiva de la gubernamentalidad sugerida por Foucault y sus herencias latinoamericanas. Se parte del supuesto de que en la actualidad argentina y salteña, la multiplicidad de lógicas y prácticas de gobierno que codifican al Estado y sus avatares encuentran una clara expresión en el gobierno de la pobreza y en los diagramas vinculares entre gobernados y gobernantes, tejidos (...) en los móviles del poder y la resistencia. En esta dirección, se delinean dos ejes expositivos. Por un lado, una analítica de los conceptos y cuestiones sugeridas desde la propuesta de la gubernamentalidad; por otro lado, una aproximación al gobierno de la pobreza y con ello a dos casos que dan cuenta del entramado relacional entre gobernados-gobernantes y prácticas de gobierno, resistencia y autogobierno entre las cuales se configura y re-configura el rol del Estado. Apostando a una “una ontología del presente”, se analizan formas de poder y resistencia que aún hoy en día se constituyen, reconfigurándose. Asimismo se sugiere un cruce metodológico entre genealogía y etnografía, en la apuesta a un ejercicio crítico de pensamiento a fines de contribuir a desnaturalizar y des-sustancializar las prácticas de gobierno, sus lógicas y nuestras conductas presentes. This article investigates the impact of the adoption of International Financial Reporting Standards (IFRS) on the comparability, quality, and efficiency of financial reporting, both in public administration and in emerging markets. Through a quantitative approach, data from various public institutions and emerging market companies that have adopted IFRS in recent years were analyzed. The results indicate a significant improvement in the comparability and quality of financial reports, although accounting efficiency varies depending on the degree of implementation and administrative modernization in (...) the countries. It is concluded that the adoption of IFRS has an overall positive effect, but its total impact depends on the institutional capacity of countries. (shrink)

In this paper I explain the impact of phenomenological philosophy in the conceptions of Luís Cabral de Mancada about law and juridical experience. Stressing that Moncada was the first scholar in Portugal who made an extensive use of phenomenological doctrines within his own field of research, I show that Husserl, Hartmann, and Scheler were the most influential thinkers for him. As a matter of fact, they had a positive impact on Moncada’s conceptions about Law, the axiological realm, the State, and (...) jusnaturalism. (shrink)

Este estudo tem como objetivo analisar, de forma crítico-reflexiva, os processos que se mostram implicados na formação do professor, tendo em vista a materialização de práticas educativas inclusiva-anticapacitistas no contexto da EPT. Para essa finalidade, a metodologia empregada subsidiou-se em uma abordagem qualitativa; recorrendo, para tanto, a pesquisa bibliográfica, por meio de estudos e produções de autores que tratam sobre a educação especial inclusiva e a formação de professores na EPT, sempre de modo a articular a discussão destas temáticas com (...) o capacitismo. Como resultado da análise realizada, compreende-se a necessidade de instituir políticas públicas voltadas à formação docente, numa perspectiva anticapacitista na EPT, a fim de ressignificar a condição da deficiência, a partir de um enfoque despatologizante do indivíduo afetado pela lesão. O presente texto é oriundo da disciplina “Ontologia e Ciências Humanas: O Kant de Heidegger”, ministrada pelos professores Gustavo Silvano Batista e Eduardo José Marandola Junior entre janeiro e fevereiro de 2024, no Programa de Pós-Graduação Interdisciplinar (ICHSA) da Faculdade de Ciências Aplicadas (FCA) da Unicamp no campus de Limeira-SP. Nele procuro analisar no segundo Heidegger em sua crítica pós-metafísica, portanto após a sua discussão sobre a metafísica kantiana, a maturação da ideia do Dasein. Nessa leitura específica de Heidegger destaco (...) o momento, apesar de não conclusivo, em que o Ser aparece como um ser-com, no qual vislumbro a possibilidade de diálogo, de encontro com outras percepções de mundo, entre elas, a oralidade na perspectiva de Amadou Hampaté Bâ. Com isso indico que apesar dos nítidos distanciamentos existem campos proximais, nos quais para a tradição oral ocorre o interesse pelo outro, o que estabelece a base necessária para que a palavra aconteça. Fazer a genealogia do poder nunca foi o propósito claro de Foucault. No entanto, a questão do poder foi tema recorrente em suas investigações a ponto de estudiosos do trabalho do filósofo sugerirem uma divisão e organização de seu trabalho a partir de três eixos teóricos. Dentro dessa perspectiva, a analítica do poder marcaria a trajetória filosófica de Foucault na década de 1970. De fato, até 1994, ano de publicação do conjunto de textos, entrevistas e conferências de Foucault no Dits (...) et écrits, a questão da analítica do poder era majoritariamente conhecida a partir de livros como Surveiller et punir e Histoire de la sexualité I: la volonté de savoir. Com o início da publicação dos cursos no Collège de France a partir de 1997 as interpretações a respeito da analítica do poder sofrem um alargamento. Mas é somente em 2015 que a totalidade dos cursos de Foucault no Collège de France foram publicados, abrindo um importante caminho para a investigação a respeito das primeiras reflexões a respeito do poder. No presente artigo procuramos mostrar como os primeiros passos da analítica do poder de Michel Foucault se dá a partir de um contexto gauchiste ainda configurado em termos de dinástica do saber. Nesse sentido, procuramos mostrar como o período da dinástica corresponde a um esboço teórico, tentativas primeiras de conceituação do poder, marcadamente desenvolvido em contraposição com o marxismo. Essa contraposição se dá sobretudo na recusa tanto do esquema marxista de infra-superestrutura, quanto do modelo contratualista de sociedade estatal. (shrink)

In this paper, I analyze Carlos Cossio’s theory of law, and how his theory was a reaction to Kelsen’s juridical positivism. The most important aspect I highlight is the logical abstract normativism defended by Kelsen, and how it was overcome by a transcendental and existential theory of law, which Cossio develops in a close relationship to Husserl and Heidegger views.

Este ensayo se pregunta por qué el concepto de institución —omnipresente, fundamental, la marca que distingue a la sociedad humana de agrupaciones animales no humanas: jaurías, matanzas, rebaños, colmenas, exaltaciones— es tan difícil de definir; introduce el concepto de instituciones defectivas; ofrece definiciones de institución, defecto y republicanismo en registros filológicos, filosóficos, económicos y sociológicos; y enfatiza el problema estructural de ofrecer definiciones de estos términos desde dentro de instituciones que requieren tales definiciones, pero que también sirven como condición de (...) su inteligibilidad. Partiendo de la tradición anarcofilosófica, se ofrece una alternativa, que es también una alternativa a las figuras de gobierno asociadas a la concepción liberal del Estado: un republicanismo aberrante compuesto por instituciones defectivas, atravesado por la necesidad de su abolición. This publication features the stories and experiences of pharmacy professionals who identify as members of historically underrepresented groups. This collection of personal essays presents significant events in the lives of those in the pharmacy community whose experiences have been shaped by their race, ethnicity, gender or gender presentation, sexual orientation, ability, language, mental health, or other factors. The perspectives from the narratives highlight the importance of diversity, equity, and inclusion in the healthcare sector. The authors of the narratives also reflect (...) on their experience to consider what they wish would have happened in the experience, to offer advice for others that may be faced with similar situations. Access to these stories will deepen the collective understanding among pharmacy colleagues, patients, and society of the experiences that individuals from historically underrepresented groups within pharmacy have experienced. Algunos autores han sostenido que es posible que en el pasaje de la mano invisible, en La teoría de los sentimientos morales, Smith esté contestando a Rousseau. Esta hipótesis se basa en una fraseología similar que usan tanto Smith como Rousseau en el Discurso sobre el origen de la desigualdad. En esta nota se mostrará que es posible realizar una distinción importante con relación al período histórico que Smith está analizando en el pasaje de la mano invisible de TSM IV: (...) 10 y el que Rousseau está analizando en el Discurso sobre el origen de la desigualdad, a pesar de la fraseología similar con relación a las rudas selvas de la naturaleza. Some authors have contended that it is possible that Smith is answering Rousseau in The Theory of Moral Sentiments. This hypothesis is based on a similar phraseology used both by Smith and by Rousseau in the Discourse on the Origin of Inequality. In this note, a clear distinction will be made. In the aforementioned works, Rousseau and Smith refer to different periods of time, in spite of the similar phraseology used in relation to "the rude forests of nature". (shrink)

According to Renan, the day of Marcus Aurelius’ death could be considered as the decisive moment in the downfall of the ancient civilization. He, thus, wonders: “If Marcus Aurelius, the unique emperor-philosopher, did not succeed in saving the world, who else, then, could have saved it?” He notes that the emperor’s death was followed by the succession to the throne of his corrupted son, Commodus, and his friends, who all were all ignorant. Renan observes that the emperor’s kindness could not (...) have prevented the unfortunate fate that befell the Roman Empire after his death. What we have here is the perennial problem, already established in Plato, regarding the role of the philosopher-king in establishing a good state and educating good citizens. However, the case of Marcus Aurelius, as demonstrated by Renan in his book, shows the inability of philosophy to serve the real needs, which ultimately leads to disastrous and irreparable consequences. The present paper attempts to reconstruct the reasons for the unsuccessful application of philosophy, especially the philosophy of the Hellenistic era, to the administrative system of the Roman Empire. It is argued that the failure is mainly due to political, religious and cultural problems. (shrink)

Il faut examiner le débat autour du stoïcisme de Montaigne. Les critiques qui ont vu le jour présentent un Montaigne qui s'intéresse à la philosophie, un humaniste qui essaie de survivre en des temps troublés et d'exercer son esprit pour s'affranchir des contraintes morales et sociales. Pourtant, si l'on regarde de plus près la construction et la genèse des Essais, on s'aperçoit que Montaigne continue d'étudier patiemment les textes anciens, et particulièrement les textes stroïciens, jusqu'à la fin de sa vie. (...) Il affirme que sa recherche est l'homme. Et, tout au long de cette recherche, se développe un dialogue entre Montaigne et lui-même, dans la mesure où son projet explicite est de se connaître. Cette position elle-même ne saurait se comprendre que dans un éclairage stoïcien : cette position du moi - Montaigne - qui débat avec l'homme - Montaigne pris dans l'Univers -, c'est celle où l'homme est Montaigne lui-même dans son rapport au cosmos, où cet « empire dans un empire » trop souvent rebattu se trouve dans la recherche de Montaigne étendu aux dimensions de l'univers. C'est cette persistance du stoïcisme, notamment de la rhétorique stoïcienne, qui anime et rend justice à l'oeuvre de Michel de Montaigne. (shrink)

Proponemos analizar el alcance de las nociones roigeanas de "teoría y crítica" como categorías epistemológicas para un humanismo crítico latinoamericano desde una lectura alternativa de Teoría y crítica del pensamiento latinoamericano. Indagamos de qué forma estas categorías involucran la legitimidad del discurso filosófico, decisiones en torno del problema del sujeto y de la verdad y modos de entender la historia. Mostramos cómo Roig opera una ruptura, en el marco de lo que él denomina una ampliación metodológica en el campo del (...) quehacer filosófico, al imbricar conceptualizaciones epistemológicas con ejercicios reflexivos en los que el filosofar explora la experiencia vital, construye sus propias fuentes y se abre a una dimensión axiológica. En el marco de este desarrollo, Roig revisa el "legado", incorpora otras voces e interviene críticamente la estructura axiológica de los discursos y analiza sus formas de reconocimiento. Buscamos mostrar las herramientas teóricas y críticas que ofrece este libro en particular para discutir las condiciones y posibilidades del saber filosófico como saber práctico social, situado y liberador y los términos de los humanismos que supone o interpela. We propose to analyze the scope of Roig´s notions, "theory and criticism", as epistemological categories to reach a critical humanism of Latin America, based on the book Teoría y crítica del pensamiento latinoamericano, as an alternative reading. We evaluate how these categories involve the legitimacy of philosophical discourse, and the decisions taken on the subject´s problem, the truth and the possible ways to understand history. We also show how Roig, in the framework of what he identifies as methodological amplification within the field of philosophy´s task, fixes a rupture when interweaving epistemological concepts with reflective exercises in which the art of philosophy explores the vital experience, builds and rebuilds its own sources and opens up to an axiological dimension. In this framework, Roig revises the "legacy", adds other voices, handles critically the axiological structure of discourses and analyzes its ways of recognition. We aim to present the theoretical and critical tools of this book, especially to discuss the conditions and possibilities of the philosophical knowledge taken as practical, social, established and as liberator; and to discuss the terms of humanisms that the philosophical knowledge presents or interpellates. In this article, the author describes sweeping changes in the gender system and offers explanations for why change has been uneven. Because the devaluation of activities done by women has changed little, women have had strong incentive to enter male jobs, but men have had little incentive to take on female activities or jobs. The gender egalitarianism that gained traction was the notion that women should have access to upward mobility and to all areas of schooling and jobs. But persistent (...) gender essentialism means that most people follow gender-typical paths except when upward mobility is impossible otherwise. Middle-class women entered managerial and professional jobs more than working-class women integrated blue-collar jobs because the latter were able to move up while choosing a “female” occupation; many mothers of middle-class women were already in the highest-status female occupations. The author also notes a number of gender-egalitarian trends that have stalled. (shrink)

Recent application of theories of embodied or grounded cognition to the recognition and interpretation of facial expression of emotion has led to an explosion of research in psychology and the neurosciences. However, despite the accelerating number of reported findings, it remains unclear how the many component processes of emotion and their neural mechanisms actually support embodied simulation. Equally unclear is what triggers the use of embodied simulation versus perceptual or conceptual strategies in determining meaning. The present article integrates behavioral research (...) from social psychology with recent research in neurosciences in order to provide coherence to the extant and future research on this topic. The roles of several of the brain's reward systems, and the amygdala, somatosensory cortices, and motor centers are examined. These are then linked to behavioral and brain research on facial mimicry and eye gaze. Articulation of the mediators and moderators of facial mimicry and gaze are particularly useful in guiding interpretation of relevant findings from neurosciences. Finally, a model of the processing of the smile, the most complex of the facial expressions, is presented as a means to illustrate how to advance the application of theories of embodied cognition in the study of facial expression of emotion. Aristotle's discussion of the motivation of the good person is both complicated and cryptic. Depending on which passages are emphasized, he may seem to be presenting a Kantian style view according to which the good person is and ought to be motivated primarily by reason, or a Humean style view according to which desires and feelings are or ought to be in charge. In this book, Paula Gottlieb argues that Aristotle sees the thought, desires and feelings of the good (...) person as interdependent in a way that is sui generis, and she explains how Aristotle's concept of choice is an innovative and pivotal element in his account. Gottlieb's interpretation casts light on Aristotle's account of moral education, on the psychology of good, bad and half-bad people, and on the aesthetic and even musical side to being a good person. A major obstacle for materialist theories of the mind is the problem of sensory consciousness. How could a physical brain produce conscious sensory states that exhibit the rich and luxurious qualities of red velvet, a Mozart concerto or fresh-brewed coffee? Caging the Beast: A Theory of Sensory Consciousness offers to explain what these conscious sensory states have in common, by virtue of being conscious as opposed to unconscious states. After arguing against accounts of consciousness in terms of higher-order representation of (...) mental states, the theory claims that sensory consciousness is a special way we have of representing the world. The book also introduces a way of thinking about subjectivity as separate and more fundamental than consciousness, and considers how this foundational notion can be developed into more elaborate varieties. An appendix reviews the connection between consciousness and attention with an eye toward providing a neuropsychological instantiation of the proposed theory. (shrink)

In this paper, I present two presumed alternative definitions of metavalidity for metainferences: Local and Global. I defend the latter, first, by arguing that it is not too weak with respect to metainference-cases, and that local metavalidity is in fact too strong with respect to types. Second, I show that although regarding metainference-schemas Local metavalidity is always stable, Global metavalidity is also stable when the language satisfies reasonable expressibility criteria.

Who should decide about organ donation after death, the individual or the family? This paper examines why this practical question can be difficult to resolve. A comparison is made between standard decision‐making in medicine and decision‐making about organ donation. The questions are raised of the connection of the dead body to the person, and of who properly has autonomous control over the dead body. To understand the issues, an exploration of autonomy is needed, but at the same time this shows (...) that a resolution depends on addressing complex spiritual and cultural issues, and questions about the autonomy of the individual versus that of the group. The Stoics try to demonstrate, in a theoretical context, more than any other philosophy, the link unifying the parts with the whole, in all areas of existence; namely, from man to divine reason, from god to nature – a tautological link in some cases – from matter to logos or creative pneuma. This unifying bond – hexis or continuity – guarantees the attachment between bodies which are in a state of sympathy which also constitutes their existence. It remains to seek (...) the meaning of this notion; draw on its etymology: according to Bailly’s dictionary, the term hexis in Greek means among other meanings: action of possessing, possession. And according to the dictionary of L.‑S.‑J., hexis derives from the future of the verb ἕξω, from the verb ἔχω, ; in its intransitive form refers to a permanent condition, namely to an act, which results from practice.In order to make an attempt to define this concept or to orient its function, it seems appropriate for us to do some research – we could say historical –, consulting texts prior to Stoicism, examining its place and the nuances it takes in different contexts and finally, follow its interpretation where, according to philosophical approaches, it sometimes means disposition, habit, or situation. Nevertheless, the Stoics give this term an original meaning, different from the one that was granted to it until then. It is the hectic pneuma or the tension prevalent in the universe. In this perspective, we will try to define its function and compare it with the notion of hexis in Aristotle, where it acquires the meaning of metaxy, in his Metaphysics, Δ, 1022b12. (shrink)

The present article is divided into two parts: the first focuses on the affections of the soul in general, while the second part investigates the case of melancholy, as it is studied from Aristotle and the Stoics to Galen. The main point of the first part is an analysis of the Chrysippean treatise On the Affections of the Soul as it appears in the Galenic treatise On the Doctrines of Hippocrates and Plato. The analysis identifies several Chry­sippean influences from Plato (...) and Aristotle regarding the psyche. In the second part, the case of melancholy is analyzed through the pseudo-Ar­istotelian treatise Problem XXX 1. The discussion shows the common points between the Aristotelian text and the Chrysippean fragments regarding the issue of melancholy. This article aims to bring to light the evolution of the phenomenon of melancholy in Galen’s thought, which is connected with the study of both medical and philosophical texts already existing before him. In this essay, Paula McAvoy critiques a commonly held view that teaching young people to be good choice makers should be a central aim of sex education. Specifically, she argues against David Archard's recommendation that sex educators ought to focus on the development of autonomy and teaching young people that “choice should be accorded the central role in the legitimation of sexual conduct.” Instead, McAvoy argues that under conditions of gender inequality this view advantages boys and disadvantages girls. Juxtaposing (...) a case of a culturally arranged marriage with a spring break scene from Ariel Levy's Female Chauvinist Pigs: Women and the Rise of Raunch Culture, McAvoy shows that focusing on sexual choice making obscures and reifies the unequal social conditions that young people navigate. She concludes by suggesting an alternative that is in line with Sharon Lamb's argument in “Just the Facts? The Separation of Sex Education from Moral Education” that intimate encounters are better governed by attending to our ethical obligations to others. (shrink)

Self-conflict is a feature of most women’s lives, particularly as we struggle to balance the demands of work and family. Theories of autonomy that rest on a notion of a coherent self treat self-conflict as incompatible with autonomy; therefore, women who suffer self-conflict fail to act autonomously. Though autonomy and self-conflict can be accommodated by conceiving of autonomy as a matter of degree relative to a context of choice, this result sanctions a political system that forces the prioritization of one (...) context over another. Yet choices in one context often compromise choices in another context, creating a situation where acting autonomously simultaneously diminishes autonomy. Given that autonomous choice justifies political liberalism, it is unjust that choices are set against one another in this way. Consequently, the burden on liberal governments to address the structural sources of self-conflict is far greater than is often supposed. (shrink)
