The doctrine of consent is built upon presumptions of mental capacity. Those presumptions must be tested according to legal rules that may be difficult to apply to COVID-19 patients during emergency presentations. We examine the principles of mental capacity and make recommendations on how to assess the capacity of COVID-19 patients to consent to emergency medical treatment. We term this the CARD approach.

A full discussion on his understanding of rights as "trump cards" which privilege the individual claim over the group policy; the critique of legal positivism; the history of a legal institution according to the analogy of a chain novel; and the insistence upon a theory of adjudication that is both constructive and yet faithful to the deepest intentions of legal documents.

In this paper we recount several research projects conducted at ImaginationLancaster a Design-led research laboratory, all of which consider Object-Oriented Ontology. The role OOO plays in these projects is varied: as a generative mechanism contributing to ideation; as a framework for analysis; and as a constituent in developing new design theory. Each project’s focus is quite unique—an app, a board game, a set of Tarot cards, a kettle and a living room—however they are all concerned with developing new understandings relating (...) to the ubiquitous, networked, ‘smart’ technologies which are often referred to as the Internet of Things. Through our reflexive account of these research projects the aim of this paper is to provide insights into, and promote new discussion about, the relevance and scope for OOO in socio-technical Design Research, and beyond. Unlike the many services already transformed by artificial intelligence (_AI_), the financial advice sector remains committed to a human interface. That is surprising as an AI-powered financial advisor (a _robo-advisor_) can offer personalised financial advice at much lower cost than traditional human advice. This is particularly important for those who need but cannot afford or access traditional financial advice. Robo-advice is easily accessible, available on-demand, and pools all relevant information in finding and implementing an optimal financial plan. In a perfectly (...) competitive market for financial advice, robo-advice should prevail. Unfortunately, this market is imperfect with asymmetric information causing generalised advice aversion with a disproportionate lack of trust in robo-advice. Initial distrust makes advice clients reluctant to use, or switch to, robo-advice. This paper investigates the ethical concerns specific to robo-advice underpinning this lack of trust. We propose a regulatory framework addressing these concerns to ensure robo-advice can be an ethical resource for good, resolving the increasing complexity of financial decision-making. Fit for purpose regulation augments initial trust in robo-advice and supports advice clients in discriminating between high-trust and low-trust robo-advisors. Aspiring robo-advisors need to clear four licensing gateways to qualify for an AI Robo-Advice License (AIRAL). Licensed robo-advisors should then be monitored for ethical compliance. Using a balanced score card for ethical performance generates an ethics rating. This _gateways-and-ratings_ methodology builds trust in the robo-advisory market through improved transparency, reduced information asymmetry, and lower risk of adverse selection. (shrink)

There are major concerns about the level of personal borrowing, particularly sourced from credit cards. This paper charts the progress of an initiative to create a Responsible Lending Index (RLI) for the credit industry. The RLI proposed to voluntarily benchmark lending standards and promote best practice within the credit industry by involving suppliers of credit, customer representatives and regulators. However, despite initial support from some banks, consumer bodies and the Chair of the Treasury Select Committee, it failed to gain sufficient (...) support from financial institutions in its original format. The primary reasons for this were related to the complexity of building such a robust index and the banks trade body’s fear of exposing its members to public scrutiny. A revised alternative, the Responsible Lending Initiative, was proposed which took into account these concerns. However, the Association of Payment Clearing Service (APACS), the trade body of the credit industry, then effectively destroyed the proposal. This article describes an attempt to address the challenges in the credit card industry with the initiation of the RLI, reflected in stakeholder discourse and in the context of a wider concern expressed by the involved stakeholders in terms of the need for greater responsibility in the banking industry’s lending practices. At a time of renewed interest in analogue gaming, as scholars are looking beyond the digital and virtual for the first time since the inception of game studies in the 1990s, Material Game Studies not only supports the importance of the turn to the analogue, but proposes a materiality of play more broadly. Recognizing the entanglement of physical materiality with (...) cultural meaning, the authors in this volume apply a range of theoretical approaches, from material eco-criticism to animal studies, to examine games and play as existing within worlds of matter. Studies suggest college students/adult learners interacting with current search tools like Google display tendency to power-browse and adhere to page-ranking order in choosing sources to supplement writing. Such limitations may limit critical reflectivity. We present a tool, ThoughtShuffler which allows users to malleably alter neighborhoods of keywords and presents results as arrays of cards and collections that can be compared and contrasted. We conducted binary qualitative coding of essays produced by 39 users divided into experimental and control conditions and computed (...) a one-tailed t-test to understand if using ThoughtShuffler produced greater likelihood for higher-order reflectivity expressed in writing about efficacy of varied healthcare models in the US, compared to the use of Google to write about the same prompt. Our results suggest that updating search engine interfaces to afford capacity for lateral reading may present potential to augment reflective information search. (shrink)

There is a tendency in decision‐making research to treat uncertainty only as a problem to be overcome. But it is also a feature that can be leveraged, particularly in social interaction. Comparing the behavior of profitable and unprofitable poker players, we reveal a strategic use of information processing that keeps decision makers unpredictable. To win at poker, a player must exploit public signals from others. But using public inputs makes it easier for an observer to reconstruct that player's strategy and (...) predict his or her behavior. How should players trade off between exploiting profitable opportunities and remaining unexploitable themselves? Using a recent multivariate approach to information theoretic data analysis and 1.75 million hands of online two‐player No‐Limit Texas Hold'em, we find that the important difference between winning and losing players is not in the amount of information they process, but how they process it. In particular, winning players are better at integrative information processing—creating new information from the interaction between their cards and their opponents’ signals. We argue that integrative information processing does not just produce better decisions, it makes decision‐making harder for others to reverse engineer, as an expert poker player's cards act like the private key in public‐key cryptography. Poker players encrypt their reasoning with the way they process information. The encryption function of integrative information processing makes it possible for players to exploit others while remaining unexploitable. By recognizing the act of information processing as a strategic behavior in its own right, we offer a detailed account of how experts use endemic uncertainty to conceal their intentions in high‐stakes competitive environments, and we highlight new opportunities between cognitive science, information theory, and game theory. Gotthard Deutsch (1859–1921) taught at Hebrew Union College in Cincinnati from 1891 until his death, where he produced a card index of 70,000 ‘facts’ of Jewish history. This article explores the biography of this artefact of research and poses the following question: Does Deutsch’s index constitute a great unwritten work of history, as some have claimed, or are the cards ultimately useless ‘chips from his workshop’? It may seem a curious relic of positivistic history, but closer examination allows us to (...) interrogate the materiality of scholarly labor. The catalogue constitutes a total archive and highlights memory’s multiple registers, as both a prosthesis for personal recall and a symbol of a ‘human encyclopedia’. The article argues that this mostly forgotten scholar’s work had surprising repercussions: Deutsch’s student Jacob Rader Marcus (1896–1995) brought his teacher’s emphasis on facticity to the field of American Jewish history that he pioneered, catapulting a 19th-century positivism to the threshold of the 21st century. Deutsch’s index was at an inflection point of knowledge production, created as historians were shifting away from ‘facts’ but just before new technologies (also based on cards) enabled ‘big data’ on a larger scale. The article thus excavates a vision of monumentality but proposes we look past these objects as monuments to ‘heroic’ scholarship. Indeed, Deutsch’s index is massive but middling, especially when placed alongside those of Niklas Luhmann, Paul Otlet, or Gershom Scholem. It thus presents a necessary corrective to anointing such indexes as predecessors to the Internet and big data because we must keep their problematic positivism in perspective. (shrink)

The career of the American photographer Carleton E. Watkins spanned more than fifty years. It is his giant photographs of Yosemite, from the "best general view," that most effectively articulate his artistic vision. The J. Paul Getty Museum holds more than fourteen hundred pictures by Watkins, making him the best-represented nineteenth-century photographer in the collection. In Focus: Carleton Watkins features approximately fifty of these works, including mammoth plates, stereographs, albumen prints, and cabinet and boudoir cards. GilnerSince it has been more than forty years since I last wrote a paper in comparative religion, I have chosen not to attempt a scholarly paper. Rather, after a biographical sketch, I will discuss examples of Jewish texts that underpin my choice to pursue a path that includes practices drawn from the teachings of Tibetan Buddhism, and explain how (...) I plan to teach these practices within traditional Jewish settings.I grew up in Brooklyn, New York, in a Jewish family that identified with the Conservative movement. When I turned five, I was sent to a modern Orthodox yeshiva. For three and a half hours each morning, first five, then six days a week, I studied a comprehensive Jewish curriculum—taught in modern Hebrew—which included Bible, commentaries, Talmud, history, grammar, and the laws and customs of Ashkenazic Jewry. At fourteen, I left the yeshiva to attend a nondenominational Christian prep school. This seemingly radical change in schools and religious traditions occasioned no significant intellectual conflicts or spiritual anxieties. By fourteen, I sensed that religion was something people were born into; it was one of the cards life dealt you at birth.My sophomore year at Emory University saw the beginning of my interest in Buddhism. I began to practice Sōtō Zen sitting (zazen), and, in my readings, stumbled upon the koan Mu, which occupied my attention in and out of meditation for several years. I became a religion major and was particularly interested in modern Japanese religions. However, my advisor discouraged me from pursuing this interest in graduate school and suggested I build further on my strong traditional Jewish education, which is how I came to Hebrew Union College in 1972 to pursue a PhD in biblical and ancient Near Eastern studies.It was at that time that I began to practice Transcendental Meditation, and, subsequently, the TM Sidhis program, a practice that took, on average, three hours per day, and four and a half hours on days when I did group practice. Not finding a job teaching Bible led me to library school, after which I returned to Hebrew Union College in 1977 to work as a librarian. I became involved in interfaith community outreach, and lectured, led Bible study groups, and conducted Passover seders at local [End Page 27] churches, toward the goal of enhancing interfaith dialogue and understanding in the community. At this time I was fortunate to become friends with Paul Knitter, then a professor at Xavier University.In 1997, after twenty-five years of dedicated twice-daily practice, it became clear to me that I was "attached" to my TM meditation program and that this attachment was hindering my growth. I put my TM Sidhis practice aside and went back to zazen. Soon, I became associated with the Dzogchen organization led by Lama Surya Das, and trekchö became my basic practice. As a member of the online "three-year mandala program," I received a cassette-based education in various Tibetan meditation practices, which included my first experiences with visualization, as part of Tara and Machigma practices.In 2001, I learned of many unfilled requests sent to Hebrew Union College by small congregations asking for students to lead High Holidays services, so I volunteered. Even critics of Christian theories of pluralism, most prominently Pope Benedict XVI, have acknowledged the significance of Knitter’s strategic integration of perspectives (...) from liberation theology into what is sometimes an overly abstract field of inquiry. Colleagues active in Buddhist-Christian studies hold Knitter in especially high esteem as a writer, teacher, translator, [End Page 211] editor, self-described interreligious theologian, and unapologetic person of faith. This book, his first major publication since accepting the Paul Tillich chair at Union Theological Seminary, offers a uniquely first-person reflection on the spiritual fruits of a career profoundly and provocatively shaped by two religious traditions.Written for a popular audience, the book, the author says, has been in the works “for the past forty years” (p. xv). Instead, it is an introspective analysis of the internal dialogue that virtually all participants in interreligious affairs recognize as the heart of the global ecumenical encounter. Knitter’s book serves as something of an apologia for what is known today as dual religious belonging or hyphenated religious identity. The author concludes his text with this intriguing but not surprising spiritual self-portrait: both lifelong baptized Christian and “card-carrying Buddhist” (p. 216). The Brain Death Reconsidered – Is It a Tenable Concept? Since 1968 it has been recognized in the medical practice that irreversible coma connected with apnea can serve as a criterion of human death. This approach was first introduced in the so called Harvard Protocol. As a result of the work of this commission, the brain-based criteria of human death were quickly legally introduced in America and in most countries in the world. The only symptom on which death can be (...) pronounced is, according to this new definition, the absence of spontaneous brain function. However, the acceptance of the new definition of death did not eliminate the old one completely. In many states both old and new definitions of death are legally valid. Practically, in these countries the alternative definition of death functions alongside the old one and diagnosis of death can be based both on the cardiac/respiratory and brain symptoms. One of the few exceptions proved to be Japan. The law in this country does not provide a uniform answer to the question of what human death is. Instead, it allows people to choose between traditional death and brain death. The law states that if a person wants to be an organ donor after brain death has occurred, he or she must record that intention on a donor card or label beforehand. Those who object to brain death and transplantation do not need donor cards. They are considered to be alive until the heart stops beating. In this way the Japanese law respects the opinion of 20-40% of the society who do not believe in the brain death. The opinion of the same percentage of people in Western societies who oppose BD is ignored by their legal systems. Initially the concept of BD did not cause a lot of controversy but this situation changed in the nineties of the last century. Since then many authors have criticized the validity of the brain-based criteria of death. They maintain that it is impossible to declare the absence of all the functions of the whole brain on the basis of the clinical tests supposed to detect it. There may be present some level of consciousness in brain death (BD) patients and therefore, they may feel pain. It is significant that 27% of the members of the teams which perform the excision of the heart for transplantation think that they are killing a living person and that in many countries during this operation a normal general anesthesia is required because of the vivid reaction of the body of the patient. The opponents of the brain death theory stress that the accurate examination of the so-called brain dead persons shows the persistence of the functions of significant parts of their brains. There are EEG waves recorded in 20-40% of BD patients. Event related potentials (ERP) show the reaction to verbal and non-verbal stimuli and the hormone production by the brain tissue can be detected in many BD people. The proper treatment could not only significantly prolong lives of the BD patients, but around 60% of possible donors with the lowest result of 3 in Glasgow Coma Scale could be restored to normal life if their brain edema is properly treated. This treatment should be based on the therapeutic hypothermia connected with the application of the thyroid hormones, whose level is usually too low in the patients with the brain injury. There is a growing lack of consensus regarding the issue of brain death, especially among physicians. Some regard brain death as a biological one, some as the death of the person but not of the human body, and the rest, as a definition accepted by the society, which doesn’t require other legitimacy than the freely chosen criteria. The brain death concept is also criticized from the philosophical point of view. The strength of the brain death theory was based on the premise that the brain is the integrating center of the body. According to this argument, the death of the brain means that the organism ceases to exist for it is no longer a functioning whole. To this argument the opponents of the brain death concept say that this question is not a question a priori but an empirical one and that the empirical data validate the opposite opinion, which says that the bodies of brain dead patients are alive. Some widely known cases show that even the real death of the entire brain means the death of the body and, therefore, may not signify the death of a human person. The integration of the body is the function of the organism as a whole and not of a single organ, even if this organ is the brain. This point of view can be confirmed by the opinion of St. Thomas Aquinas who says that the soul is primarily and per se connected with the body as a whole as the proportionate perfectible and only secondarily with the parts of the body, according to their ordination to the whole. So, the death of any single organ does not preclude the union of the soul with the rest of the body as a living whole. Moreover, the terms such as “consciousness” and “person” should not be identified. The term such as “human living nonpersons”, proposed by some bioethicists and referring to the people without consciousness has not been accepted in the official documents concerning BD. Bodies of the BD people are alive, therefore, it is not right to use the term “brain death” to describe the state of these patients, but rather the term “brain failure” should be used. As the result, according to some authors, the dead donor rule should be abolished. The Catholic Church stresses the sacredness of the human life from the beginning to the end. Therefore She requires that there be no doubts that the donor in BD is really dead. Because of the lack of consensus among physicians, philosophers and theologians, the popes John Paul II and Benedict XVI decided to continue the scientific research and discussion concerning BD between the representatives of various disciplines. All of the people gathered here have wished one another “Happy New Year” and settled on cushions in the big meeting hall. Both fireplaces are lit, and the many little white cards with the names of each person who died last year are arranged on the mantels over the fireplaces and on a table in the center of the room. Paul, our teacher for the evening, (...) says a few simple and wise words about impermanence and about being of service and then explains tonight's process: we, the volunteers in attendance, will pick up the cards, either by choosing a specific patient's name or at random, and take them one by one to the fires, dropping them in and saying something about each deceased person. There is only one “race”: the human race; to think otherwise is like still believing that the earth is flat. But “racism” is a different matter. It exists as a system of beliefs and prejudices that people differ along biological and genetic lines and (...) that one’s own group is superior to another group. When these beliefs and prejudices are coupled with power—especially the power to negatively affect the lives of those perceived to be inferior—we have a serious problem. And no one should downplay or underestimate the harm that such an ideology inflicts upon everyone who participates in it. According to one African American professor of social work, “America’s history is inextricably bound to this racist ideology. From the codifying of slavery, to the belief in ‘Manifest Destiny,’ to the treatment of ‘illegal immigrants,’ many of America’s actions continue to conflict with its creed that ‘All men are created equal.’”1Over the past decade or so, I have written a number of pieces that focus upon racism in America and racism in so-called American Buddhism.2 Being African American myself, my reasons for this focus may perhaps be clear though not necessarily inevitable. I have written on a number of other topics: Buddhist philosophical discourses and life stories of Buddhist “saints,” for example. In my writings on racism, I have tried to communicate something of the emotional and psychic toll it takes to live in this country as a person of color. In a number of these writings, I have called myself a “Baptist-Buddhist,” and thus this is also one of my “dual belongings,” one of my “multiple identities.”When I speak of racism, I am not concerned with garnering pity, or playing the “race card” of guilt, or telling you, from some assumed position of superiority on the matter, that there is simply no way for you to understand this toll. I certainly cannot speak for all African Americans, or even for most of them. Early on in the process of writing this paper, I emailed Jung and Paul to say that I found the title of the panel both much too broad and much too narrow. “Too broad” because one person cannot possibly channel and/or verbalize the countless instances of suffering endured by African Americans (and more broadly, by persons of color) throughout space and over centuries in this country owing to slavery and its aftermath. And “too narrow” [End Page 97] because, ultimately, we want to do more than just rehash our many sufferings. We don’t want to wallow in victimhood. We want to move on—from the recognition of that immense suffering, seen and unseen—and to go out into the world and act to bring about social, economic, and ecological justice. That’s what we are called upon to do: to form a new community wherein there is compassion and caring for one another, where there is love and peace, nonviolence, reconciliation, and justice.So, even though I am quite frankly tired—as are so many people of color—of being the “token” African American who can add visible “diversity” to a group in order to show that it is now more “inclusive” than before, nevertheless, in this so-called postracial society where we have a black president and the demographic of “person of color” now comprises an actual majority of the United States’ population, I must still rise to say that, sadly, racism is not dead in this country! Its painful vestiges exist, and those vestiges are far from being either innocent or unharmful.I truly believe that—for African Americans, in particular—it is the trauma and the legacy of slavery that haunts us in the deepest recesses of our souls. In his Farewell to Reason, Paul Feyerabend advocates radical pluralism in all intellectual endeavors and disputes the widely held belief that all issues can and should be resolved rationally. For Feyerabend, it is desirable that mutually incompatible approaches to scientific and scholarly research proliferate. Even an approach that one's favored school of thought dismisses as loony is likely to yield ideas and factual observations that its derogators will find of value and would otherwise have missed. To derive intellectual benefit (...) from an alternative tradition, one need not accept its premises and values; likewise, to ignore uncongenial ideas, one is not obliged to construct a refutation of than, which is just as well, since such a refutation usually can be constructed only by stacking the cards against adversaries about whom one is grossly ignorant. This article contends that the evolution toward interdisciplinary collaboration that we are witnessing in the sciences must also occur in the humanities to ensure their very survival. That is, humanists must be open to working with scientists and social scientists interested in similar research questions and vice versa. Digital humanities is a positive first step. Complexity science should be the next step. Even though much of the ground-breaking work in complexity science has been done in the natural sciences and mathematics, (...) it can, if critically adapted, provide the needed metaphor for a broad integration of disciplines, humanistic and otherwise. Given its almost a-disciplinary nature, a complexity approach to the research problems in the humanities necessarily breaks down silos. Moreover, it can restore and reframe the seamless intellectual fabric sought by researchers before the atomization of the various disciplines in the nineteenthcentury academy. (shrink)

Despite significant advances in various special areas in the study of language, the question of what the basic nature of the theory of a language is remains controversial and unclear. In this paper we propose to rectify this situation and argue for a general perspective — one which only a few theorists have explicitly endorsed — by showing that it is at once theoretically illuminating and empirically plausible. This perspective consists of the following claims: that the most basic theory of (...) a language is a theory of communication viz., of understanding and production; that a theory of communication in this sense presupposes a theory of thought; that a grammar is most fruitfully thought of as a component of a theory of communication; and that so-called theories of meaning form a rather heterogeneous group, some of which being fragments of grammars, others being theories of thought, and still others being what are sometimes referred to as theories of reference. Alice Dunbar-Nelson is mostly remembered as a poet, activist, and ex-wife of Paul Laurence Dunbar. Her volume The Goodness of St. Rocque and Other Stories (1899) has been largely overshadowed as a result. Yet, the collection contains a portfolio of heroines analogous and contemporaneous to the famed New Woman figure of the fin de siècle. In this article, I consider Dunbar-Nelson’s heroines in light of their New Woman-esque agency and autonomy as they find remedies and power in objects and (...) materials steeped in New Orleans’s cultural heritage. Ceded neither social nor political self-governance nor domestic comfort, this article reads these transcendental, metaphysical objects as sources of self-care. With close analysis of “The Goodness of St. Rocque,” “Tony’s Wife,” and “Little Miss Sophie,” I argue that Dunbar-Nelson’s protagonists exert influence over their lives, specifically in the negotiation of romantic relationships, through voodoo charms, Catholic candles, tarot cards, sewing machines, and knitting needles. Covering courtship, break-ups, and unhappy marriages, I demonstrate the ways in which these empowering spiritual objects respond to health concerns, including malnutrition and domestic violence, in turn, situating them as alternatives to patriarchal and historically racist medical institutions. Valorizing the cultural milieu of New Orleans and the customs of the Caribbean and European heritage, and thereby conveying Dunbar-Nelson’s resistance to white and male supremacist ideologies in late-nineteenth-century Southern America, the article ultimately assesses the parallels with (predominantly white) New Woman fiction, through shared themes of fraught heterosexual dynamics and women’s declining health. The book Chronicle of Separation is an attempt to write on Derrida, to Derrida and from Derrida on the basis of a pathetic experience, which, in various ways, describes and enacts the pathetic experience of deconstruction itself. The book tackles the weight of emotions that is at the heart of deconstructive reading, treating deconstruction's weak, fragile and parasitic mode of thinking as a deconstruction of emotion, on emotion and as emotion. Chronicle of Separation examines these themes beginning with a descriptive (...) and an analytic reading of Derrida's Memoirs: For Paul de Man and The Post Card, as embodiments of deconstruction's melancholic friendship which inscribes its disillusioned love in what it calls the 'postal condition'. The book then moves on to a feminization of Derrida, experimenting in different modes of writing. It firstly discusses Fred Zinneman's film Julia about a mournful friendship between women. Then it performs a deconstructive meditation on the anorexic person suggesting that anorexia constitutes a paradoxical embodiment of deconstruction. The concluding chapter presents a complete incorporation of Derrida into a fictional text that re-writes the biblical Book of Ruth. (shrink)

CoxHamlet’s Perfection, by William Kerrigan; xviii & 179pp. Baltimore: Johns Hopkins University Press, 1994, $29.95.While acknowledging that his reading of Hamlet is “idiosyncratic and unfashionable” (p. x), Kerrigan offers no apologies for it, asserting, instead, that tradition is worth vindicating, because “those who have been trained in a tradition may discard it, but those who come after, students of the discarders, will be simply oblivious” (...) (pp. 2–3). Putting all his cards on the table, Kerrigan acknowledges four influences in the tradition he defends: literary formalism, historical scholarship, intellectual history, and psychoanalysis (pp. xii–xiii).Hamlet criticism thus “begins with the Romantic Germans” (p. 1), and they eventually give rise to Freud, who “influences most of the criticism of our century” (p. 14), even when critics (like Eliot) disagree with him. Kerrigan’s reading of the tradition is illuminating, subtle, informed, and informative, and he uses it to establish his reading of the play, working within the tradition but extending it in hitherto unseen and insightful ways. Of course Hamlet delays for Kerrigan, but no one has ever explained his delay so carefully or with so many other factors taken into account. “This seems to me much the best reading yet of the delay,” Kerrigan asserts (p. 76), and one is inclined to assent, given the assumptions.But why make these assumptions? Kerrigan dismisses postmodern criticism: it is a symptom of “our current decadence” (p. 31) and has contributed “little to the elucidation of Hamlet” (p. xi). Since the elucidation of texts and characters is not the aim of postmodern critics, they unsurprisingly fail at what they do not attempt. Yet they follow a tradition established, for the most part, by Marx and Nietzsche, and Kerrigan does not explain why he venerates one of Paul Ricoeur’s “masters of suspicion,” namely Freud, and not the other two.In fact, many readers may feel that Kerrigan fails to avoid decadence himself. He relates his Oedipal explanation of Hamlet’s delay to the observation that Shakespeare never has anything good to say about cosmetics, even though he was a man of the theater. Kerrigan relates this “split,” in turn, to early traumas in Shakespeare’s life. The fact that Mary Shakespeare had lost two daughters before William’s birth means that she must have been overattentive to him as an infant, yet she must have weaned him nine months before birth of younger brother Gilbert, thus splitting William’s attitude toward her between resentment of her overattention and resentment of being displaced at the breast. Kerrigan finds evidence of the latter in Timon 4.3.114–20, where Timon inveighs against “milk-paps” as “horrible traitors” (p. 78). Never mind that these are virgin’s paps and that Timon’s emphasis is sexual, not maternal: breasts are traitors to Timon as sex objects, not as sources of nutrition. The critic’s confusion between virgin and maternal breasts perhaps explains why Kerrigan places Thaisa in a brothel in Pericles, rather than Marina (p. 80), but I am not sure what psychological explanation to offer for this particular split. [End Page 381]Kerrigan would do well to heed the postmodern insight that we all speak out of a specific tradition, with the attendant lesson that tolerance and mutual respect across traditions is imperative, since “ridiculous” and “mockable” are relative to context, as Corin points out to Touchstone.In privileging Freud, Kerrigan not only dismisses the heritage of Marx and Nietzsche but underestimates the importance of what lies behind all three. For the Romantic/Freudian tradition cannot claim to have originated either character analysis or individuality, which Kerrigan purports to value. “A man’s character is his fate,” Heraclitus says, perhaps generalizing from Homer, but the insight would eventually inform Aristotle’s notion of an ethics based on virtuous character, which in turn was Christianized by Thomas (where it complements the moral sense of individual worth that Hamlet acknowledges in the providential oversight of sparrows), and came to influence the Reformers in various ways. The paper discusses some aspects of the relationship between Feyerabend and Kuhn. First, some biographical remarks concerning their connections are made. Second, four characteristics of Feyerabend and Kuhn's concept of incommensurability are discussed. Third, Feyerabend's general criticism of Kuhn's Structure of Scientific Revolutions is reconstructed. Forth and more specifically, Feyerabend's criticism of Kuhn's evaluation of normal science is critically investigated. Finally, Feyerabend's re-evaluation of Kuhn's philosophy towards the end of his life is presented.
