This article identifies the principal signs forming the language of investment law and arbitration, isolating for each of them its signifier and its signified in light of how such signs are used by arbitrators, practitioners and scholars. In light of this analysis, investment arbitration is assessed from a semiotic standpoint in order to verify whether it is possible, under this perspective, to consider international investment law as a multilateralised branch of international law, with a common language, customs and rules rightly (...) referred to by international arbitral tribunals, or if the term “international investment law” is merely a conventional expression that simply groups together a plurality of micro-systems with no significant link among each other to justify the arbitrators' establishment of a de facto system of precedent and the constant reference to a non-existent body of international law rules on foreign investment. The philosophical analysis of mathematical explanations concerns itself with two different, although connected, areas of investigation. The first area addresses the problem of whether mathematics can play an explanatory role in the natural and social sciences. The second deals with the problem of whether mathematical explanations occur within mathematics itself. Accordingly, this entry surveys the contributions to both areas, it shows their relevance to the history of philosophy and science, it articulates their connection, and points to the philosophical pay-offs to (...) be expected by deepening our understanding of the topic. That words express a conceptual content is uncontroversial. This does not entail that their content should break down neatly into a grammatical part, relevant for language and to be analyzed in linguistic terms, and a conceptual part, relevant for cognition and to be analyzed in psychological terms. Various types of empirical evidence are reviewed, showing that the conceptual content of words cannot be isolated from their linguistic properties, because it is affected and shaped by them. The view of words as (...) labels or containers for a non-linguistic conceptual content stems from a naive disregard of the complex and structured nature of lexical knowledge. On the contrary, knowledge of language is shown not just to organize and categorize conceptual content in a way not reducible to non-linguistic cognition, but also to affect its scope, as the range of verbalized concepts is both limited by abstract templates and expanded by productive word formation. This suggests that lexical knowledge is a distinctively linguistic dimension of conceptualization, and that words do not so much label or package concepts, as provide an inner form for conceptual knowledge. According to the orthodox account developed by Kaplan, indexicals like I, you, and now invariably refer to elements of the context of speech. This essay argues that the orthodoxy is wrong. I, you, and the like are shifted by certain modal operators and hence can fail to refer to elements of the context, for example, I can fail to refer to the speaker. More precisely, indexicals are syntactically akin to logical variables. They can be free, in which case they work, (...) roughly, on the Kaplan model. But they can also be bound: this happens, in a systematic fashion, when they are in the scope of epistemic modals or attitude verbs. The new view has two interesting philosophical consequences. First, it vindicates a broadly Fregean perspective on referential expressions, essentially refuting the idea that indexicals are rigid designators. Second, it suggests a new picture of the interaction between context and linguistic meaning: compositional semantics does not need to look at the context and hence has no need for a context parameter. What were the earliest reactions to Gödel's incompleteness theorems? After a brief summary of previous work in this area I analyse, by means of unpublished archival material, the first reactions in Vienna and Berlin to Gödel's groundbreaking results. In particular, I look at how Carnap, Hempel, von Neumann, Kaufmann, and Chwistek, among others, dealt with the new results.

Anti-realist epistemic conceptions of truth imply what is called the knowability principle: All truths are possibly known. The principle can be formalized in a bimodal propositional logic, with an alethic modality ${\diamondsuit}$ and an epistemic modality ${\mathcal{K}}$, by the axiom scheme ${A \supset \diamondsuit \mathcal{K} A}$. The use of classical logic and minimal assumptions about the two modalities lead to the paradoxical conclusion that all truths are known, ${A \supset \mathcal{K} A}$. A Gentzen-style reconstruction of the Church–Fitch paradox is presented (...) following a labelled approach to sequent calculi. First, a cut-free system for classical bimodal logic is introduced as the logical basis for the Church–Fitch paradox and the relationships between ${\mathcal {K}}$ and ${\diamondsuit}$ are taken into account. Afterwards, by exploiting the structural properties of the system, in particular cut elimination, the semantic frame conditions that correspond to KP are determined and added in the form of a block of nonlogical inference rules. Within this new system for classical and intuitionistic “knowability logic”, it is possible to give a satisfactory cut-free reconstruction of the Church–Fitch derivation and to confirm that OP is only classically derivable, but neither intuitionistically derivable nor intuitionistically admissible. Finally, it is shown that in classical knowability logic, the Church–Fitch derivation is nothing else but a fallacy and does not represent a real threat for anti-realism. (shrink)

Still today it remains unclear whether Galileo ever climbed the leaning tower of Pisa in order to drop bodies from its top. Some believe that he established the principle of equal speeds for falling bodies by means of an ingenious thought experiment. However, the reconstruction of that thought experiment circulating in the philosophical literature is no more than a cartoon. Can governments keep the pace of global markets? It is a defining characteristic of the present times, tested and measured within multiple studies, that we are living in an increasingly interconnected economy in which giant companies emerge and compete presenting new goods and products at a global scale. The competing environment of international markets produces quickly growing creatures that old nation-states struggle to understand, monitor and, consequently, regulate. In this regard, the selection process taking place in the market seems to (...) be far more effective and greedy than the selection process we apply to our governments. In this paper I discuss the basic theoretical mechanisms for the persistence of wealth concentration, introducing a general game-theoretical framework to connect governance, market economy, and wealth distribution, and to rethink democracy and fairness in policy-making, especially with the aim of global sustainability governance. A consistency default is a propositional inference rule that asserts the consistency of a formula in its consequence. Consistency defaults allow for a straightforward encoding of domains in which it is explicitely known when something is possible. The logic of consistency defaults can be seen as a variant of cumulative default logic or as a generalization of justified default logic; it is also able to simulate Reiter default logic in the seminormal case. This paper is the first of a series of three articles that present the syntactic proof of the PA-completeness of the modal system G, by introducing suitable proof-theoretic objects, which also have an independent interest. We start from the syntactic PA-completeness of modal system GL-LIN, previously obtained in [7], [8], and so we assume to be working on modal sequents S which are GL-LIN-theorems. If S is not a G-theorem we define here a notion of syntactic metric d(S, G): we (...) calculate a canonical characteristic fomula H of S (char(S)) so that ⊢G ∼ H → (∼S) and ⊢GL-LIN ∼ H, and the complexity σ of ∼ H gives the distance d(S, G) of S from G. Then, in order to produce the whole completeness proof as an induction on this d(S, G), we introduce the tree-interpretation of a modal sequent Q into PA, that sends the letters of Q into PA-formulas describing the properties of a GL-LIN-proof P of Q: It is also a d(*, G)-metric linked interpretation, since it will be applied to a proof-tree T of ∼ H with H = char(S) and σ(∼ H) = d(S, G). In this article, I draw upon the ‘post-Kantian’ reading of Hegel to examine the consequences Hegel’s idea of God has on his metaphysics. In particular, I apply Hegel’s ‘recognition-theoretic’ approach to his theology. Within the context of this analysis, I focus especially on the incarnation and sacrifice of Christ. First, I argue that Hegel’s philosophy of religion employs a distinctive notion of sacrifice (kenotic sacrifice). Here, sacrifice is conceived as a giving up something of oneself to ‘make room’ for the (...) other. Second, I argue that the idea of kenotic sacrifice plays a fundamental role in Hegel’s account of Christ. Third, I conclude by sketching some of the consequences of Hegel’s idea of a God who renounces his own divinity for an idealistically conceived metaphysics. My main thesis is that the notion of incarnation is conceived by Hegel as the expression of a spirit that advances only insofar as it is willing to withdraw and make room for the other. A kenotic reading of the Hegelian notion of the incarnation is also useful in terms of a clarification of the dispute between ‘left Hegelians’ and ‘right Hegelians’ concerning the status of the idea of God in Hegel’s philosophy. Summary This article presents three hitherto unpublished letters by Frank Plumpton Ramsey on the foundations of mathematics with commentary. One of the letters was sent to Abraham Fraenkel and the other two letters to Heinrich Behmann. The transcription of the letters is preceded by an account that details the extent of Ramsey's known contacts with mathematical logicians on the Continent.

An algebraization of the notion of topology has been proposed more than 70 years ago in a classical paper by McKinsey and Tarski, leading to an area of research still active today, with connections to algebra, geometry, logic and many applications, in particular, to modal logics. In McKinsey and Tarski’s setting the model theoretical notion of homomorphism does not correspond to the notion of continuity. We notice that the two notions correspond if instead we consider a preorder relation \( \sqsubseteq (...) \) defined by \(a \sqsubseteq b\) if _a_ is contained in the topological closure of _b_, for _a_, _b_ subsets of some topological space. A _specialization poset_ is a partially ordered set endowed with a further coarser preorder relation \( \sqsubseteq \). We show that every specialization poset can be embedded in the specialization poset naturally associated to some topological space, where the order relation corresponds to set-theoretical inclusion. Specialization semilattices are defined in an analogous way and the corresponding embedding theorem is proved. Specialization semilattices have the amalgamation property. Some basic topological facts and notions are recovered in this apparently very weak setting. The interest of these structures arises from the fact that they also occur in many rather disparate contexts, even far removed from topology. (shrink)

Large Language Models (LLMs) are generative AI systems capable of producing original texts based on inputs about topic and style provided in the form of prompts or questions. The introduction of the outputs of these systems into human discursive practices poses unprecedented moral and political questions. The article articulates an analysis of the moral status of these systems and their interactions with human interlocutors based on the Habermasian theory of communicative action. The analysis explores, among other things, Habermas's inquiries into (...) the analogy between human minds and computers, and into the status of atypical participants in the linguistic community such as genetically modified subjects and animals. Major conclusions are the LLMs seem to qualify as authors that originally participate in discursive practices but do display only a structurally derivative form of communicative competence and fail to meet the status of communicative agents. In this sense, while the contribution of AI writing systems in public discourse and deliberation can support the process of mutual understanding within the community of speakers, the human actors involved in the development, use, and diffusion of these systems share a collective responsibility for the disclosure of AI authorship and verification and adjudication of validity claims. Since the early 1990s, an increasing number of troops have been deployed in peacekeeping missions all around the world. The mixed success and high-profile failures of several missions have provided peacekeepers and scholars with a wealth of experience from which to generate knowledge and understand key lessons. In this article I use the Rwandan case to explore the issue of the use of force to protect unarmed civilians that have become the target of violence. In particular, I focus on the (...) moral responsibilities implied in such operations. I contend that in order for peacekeepers to be effective, they need to subscribe to, and be motivated by a peacekeeper ethos. The core element of this ethos is the protection of human life. Those peacekeepers who, through experience and education, internalize this ethos will be the best prepared for the difficult task they face. This article emphasizes the importance of sharpening moral autonomy among peacekeepers, in order to provide them with the skills they need to be more effective in saving lives. To illustrate this point, I analyze the slaughter of more than 2000 refugees at the ETO school in Kigali, Rwanda; a UN site protected by Belgian peacekeepers in 1994. (shrink)

This paper presents in outline Luigi Ferrajoli’s axiomatic and general theory of law, as developed in his lifelong work Principia Iuris . The first section focuses on the three main aspects of the theory: the methodological, the theoretical and the pragmatic, which respectively represent the theory’s syntax, semantics and its pragmatics. Ferrajoli identifies three deontic gaps of norms: firstly, the one between their validity and efficacy ; secondly, the one between their justice and validity ; and finally, and most importantly, (...) the one between validity and existence (i.e. normative force). The presence of such gaps is, according to Ferrajoli, the extraordinary innovation that entrenched constitutions have brought into modern legal systems, by establishing norms that are superior to statutes and case law. In this sense, all normative phenomena (except for the constitution itself) can be conceived both as norms and as facts. In the second section the role of juridical science is briefly discussed. It is usually maintained that a subject with manifestly contradictory beliefs is irrational. How can we account, then, for the intuitive rationality of dialetheists, who believe that some manifest contradictions are true? My paper aims to answer this question. Its ultimate goal is to determine a characterization of (or rather a constraint for) rational belief approvable by both the theorists of Dialetheism and its opponents. In order to achieve this goal, a two-step strategy will be adopted. First, a characterization of (...) rational belief applicable to non-dialetheist believers will be determined; this characterization will involve the semantic apparatus of Nathan Salmon’s Millian Russellianism but will get rid of the problematic and obscure notion of mode of presentation (guise in his own terminology), replacing it with a couple of novel devices, belief subsystems and cognitive coordination. Second, using ideas from Graham Priest, the leading proponent of Dialetheism, such a characterization will be modified, so as to devise a new one able to account for the intuitive rationality of both dialetheist and non-dialetheist believers. This article provides an overview of philosophical interpretations of Dostoevsky, focusing on readings that pay particular attention to his representation of the battle between good and evil, and postulating that said representation constitutes the essence of his works. The analysis maps this history of interpretations as developing within a specific framework: the dispute between interpreters who argue that good triumphs in Dostoevsky’s works and those who maintain that nihilism prevails in the end. In this context, the article submits its own (...) thesis: that a fundamental contradiction haunts the offer, in Dostoevsky’s works, of Christian salvation, and condemns Dostoevsky to defeat at the hands of his nihilists. Forms of contemporary life attest to the dissolution of the concept of the ‘people’ and the renewed importance of the idea of the ‘multitude’. Though they took center stage in the seventeenth century debate that spawned much of our ethico-political lexicon, these two notions are polar opposites. The ‘people’ is by its very nature centripetal. Converging towards a general will, it acts as an interface between citizens and the State. The ‘multitude’ is plural. Fleeing all political unity, it shuns negotiations (...) with the sovereign and refuses to delegate its rights to that power; it is a recalcitrant and disobedient entity with a taste for certain forms of non-representative democracy. For example, Hobbes claims that citizens in rebellion against the State represent “the multitude against the people.” But while Hobbes spotted the greatest hindrance to the workings of the State within this multitude, Spinoza found in it the roots of liberty. The political existence of ‘multiples’ as such has been stricken from the horizon of modernity: not only by Absolute State theorists, but also by Rousseau, the liberal tradition, and the socialist movement itself. Biomedicine is today transforming the human condition, but how such transformation is to be understood is a matter of debate. I seek to contribute to the debate by focusing on recent developments within a relatively novel subfield of gerontology which is engaged in the bio-molecular and bio-demographic characterization of the processes associated with the development of the organism from birth to death. I argue that these developments aid understanding of the conceptual difficulties confronting neo-Darwinian biological thought and poststructuralist social theory (...) as one decentres the organism and the other the subject.
