In spite of the considerable literature nowadays existing on the issue of the moral exclusion of nonhuman animals, there is still work to be done concerning the characterization of the conceptual framework with which this question can be appraised. This paper intends to tackle this task. It starts by defining speciesism as the unjustified disadvantageous consideration or treatment of those who are not classified as belonging to a certain species. It then clarifies some common misunderstandings concerning what this means. Next, (...) it rejects the idea that there are different kinds of speciesism. Such an idea may result from confusion because there are (1) different ways in which speciesism can be defended; and (2) different speciesist positions, that is, different positions that assume speciesism among their premises. Depending on whether or not these views assume other criteria for moral consideration apart from speciesism, they can be combined or simple speciesist positions. But speciesism remains in all cases the same idea. Finally, the paper examines the concept of anthropocentrism, the disadvantageous treatment or consideration of those who are not members of the human species. This notion must be conceptually distinguished from speciesism and from misothery (aversion to nonhuman animals). Anthropocentrism is shown to be refuted because it either commits a petitio principia fallacy or it falls prey to two arguments: the argument from species overlap (widely but misleadingly known as “argument from marginal cases”) and the argument from relevance. This rebuttal identifies anthropocentrism as a speciesist view. (shrink)

En Dialéctica negativa, Adorno justifica históricamente la necesidad de que la teoría crítica de la sociedad adopte la forma de filosofía. Esta transformación representa un cambio profundo desde la tradición marxista y tiene gran trascendencia para el desarrollo de la teoría crítica en el presente. En este artículo se busca clarificar los argumentos sociohistóricos que llevan a Adorno a redirigir el pensamiento crítico hacia la filosofía, sustentados en una crítica inmanente a la teoría de Marx y a la filosofía de (...) la identidad de Hegel. También se examinará la importancia de la crítica inmanente para la Escuela de Frankfurt, enfocándose en aspectos que son esenciales para comprender su desarrollo y significado. Este análisis establecerá las bases para abordar la tesis de Adorno sobre necesidad histórica de la filosofía en la formulación de una dialéctica negativa. Finalmente, se tratará la disyuntiva que surge al confrontar la teoría crítica de Adorno con la de Moishe Postone, es decir, si se debe concebir a la teoría crítica como una teoría social o como una filosofía dialéctica negativa. An individual's health, genetic, or environmental-exposure data, placed in an online repository, creates a valuable shared resource that can accelerate biomedical research and even open opportunities for crowd-sourcing discoveries by members of the public. But these data become “immortalized” in ways that may create lasting risk as well as benefit. Once shared on the Internet, the data are difficult or impossible to redact, and identities may be revealed by a process called data linkage, in which online data sets are matched (...) to each other. Reidentification, the process of associating an individual's name with data that were considered deidentified, poses risks such as insurance or employment discrimination, social stigma, and breach of the promises often made in informed-consent documents. At the same time, re-ID poses risks to researchers and indeed to the future of science, should re-ID end up undermining the trust and participation of potential research participants. The ethical challenges of online data sharing are heightened as so-called big data becomes an increasingly important research tool and driver of new research structures. Big data is shifting research to include large numbers of researchers and institutions as well as large numbers of participants providing diverse types of data, so the participants’ consent relationship is no longer with a person or even a research institution. In addition, consent is further transformed because big data analysis often begins with descriptive inquiry and generation of a hypothesis, and the research questions cannot be clearly defined at the outset and may be unforeseeable over the long term. In this article, we consider how expanded data sharing poses new challenges, illustrated by genomics and the transition to new models of consent. We draw on the experiences of participants in an open data platform—the Personal Genome Project—to allow study participants to contribute their voices to inform ethical consent practices and protocol reviews for big-data research. La literatura occidental, de acuerdo con Harold Bloom, tiene un par de pilares: las obras homéricas y la tradición judeocristiana: la Biblia. Esta herencia sigue viva en este siglo. Actualmente estamos inmersos en un mundo en el que las redes sociales son parte de nuestra cotidianidad, por esa razón, en este artículo me interesa mostrar tres series de minificciones que se encuentran en Museo de nimiedades (2022) de José Juan Aboytia, así como el tratamiento que este autor les da. Dichas (...) series son las siguientes: lo bíblico, lo literario y las redes sociales. Aunque éstas no son las únicas que se hallan en el volumen, las destaco por los distintos elementos que aportan para el estudio de la minificción: la brevedad, el humor, el des-género que señala Violeta Rojo, la intertextualidad, la crítica social y las posibilidades de lectura que obligan al lector a ser un participante activo. ABSTRACTColin Hay's constructivist institutionalism and Vivien A. Schmidt's discursive institutionalism are two recent attempts to theorize ideas as potential explanations of institutional change. This new attention to the causal role of ideas is welcome, but Hay and Schmidt do not take into consideration the constitutive and structural aspects of ideas. Instead they reduce ideas to properties of individual conscious minds, scanting the respects in which ideas are intersubjectively baked into the practices shared by individuals. This aspect of ideas—arguably, the institutional (...) side of ideas—is developed in post-structuralist thought, which therefore demands a place in ideational research. (shrink)

Según la concepción del daño de la muerte en función del interés relativo al momento, propuesta por Jeff McMahan, nuestro interés en vivir no viene determinado sólo por el valor de nuestra vida futura, sino también por los vínculos prudenciales que nos atan a ésta. McMahan sostiene que tales relaciones dependen de nuestra complejidad psicológica. Esta propuesta respalda algunas asunciones comunes acerca del daño de la muerte. Pero también cuestiona los planteamientos antropocéntricos acerca del valor comparativo de las vidas de (...) los seres humanos, pues toda una serie de seres humanos (como los bebés y aquellos con diversidad funcional intelectual notable) tienen unas capacidades psicológicas inferiores a las de muchos animales no humanos. Por otra parte, no está claro que la fuerza de las relaciones prudenciales venga de hecho determinada por la complejidad psicológica. According to the Time-relative Interest Account of the harm of death, which Jeff McMahan has proposed, our interest in living is not only determined by the value of our future life, but also by the prudential ties which bind us to it. McMahan maintains that such relations depend significantly on our psychological complexity. This proposal backs up some common assumptions as regards the harm of death. But it also questions anthropocentric views regarding the comparative value of the lives of human beings, since a number of humans (such as babies and those with significant intellectual disabilities) have psychological capacities below those of many nonhuman animals. Apart from this, it is not clear whether the strength of prudential relations is actually determined by psychological complexity. (shrink)

Contra esta manera de tratar los problemas en el ámbito de la filosofía de la psicología, se plantea la posibilidad de tomar muy en serio las criticas que hizo Husserl al naturalismo a partir de una cierta concepción de la historia de la ciencia y de la filosofía. RESUMENLa filosofía del derecho de Fichte supone una importante anomalía dentro del Idealismo Alemán, en especial por su problemático posicionamiento en relación con la filosofía del derecho de Kant y su reelaboración del derecho natural. Fichte publica el Fundamento del Derecho Natural según los principios de la Doctrina de la Ciencia en 1796, es decir, un año después de la publicación de Hacia la paz perpetua y un año antes de la publicación de los «Principios metafísicos de la doctrina del (...) derecho» de la Metafísica de las Costumbres. La formulación y fundamentación que lleva a cabo Fichte en esta obra del derecho natural es enteramente original y a la vez internamente problemática debido a la tensión que en ella se da entre la validez normativa de los principios del derecho y la realización positiva de los mismos. Ejemplo paradigmático de esta tensión lo ofrece la noción de «derecho originario» (Urrecht) que Fichte elabora a lo largo de su trabajo de 1796. Nuestra investigación se va a centrar en analizar esta noción de «derecho originario» en la doctrina del derecho de Fichte para desplegar una interpretación iusnaturalista de la misma con vistas a relativizar o por lo menos matizar las lecturas preeminentemente positivistasde la filosofía del derecho de Fichte.PALABRAS CLAVESIDEALISMO ALEMÁN, DERECHO NATURAL, PRINCIPIOS DEL DERECHOY DERECHO ORIGINARIOABSTRACTFichte's philosophy of right constitutes an anomaly within German Idealism, particularly due to its problematic positioning in relation to Kant's philosophy of right and his reworking of natural right. Fichte published Foundations of Natural Right in Accordance with the Principles of the Doctrine of Science in 1796, that is, a year after the publication of Towards Perpetual Peace and a year before the publication of «Metaphysical Principles of the Doctrine of Right», in Metaphysics of Morals. Fichte's formulation and substantiation in this work on natural right is entirely original and, at the same time, internally problematic due to the tension created between the regulatory validity of the principles of right and their positive realisation. A paradigmatic example of this tension can be seen in the notion of «primordial right» (Urrecht) developed by Fichte throughout his 1796 work. La permanencia y la graduación de la educación básica oficial impartida en Colombia es un tema de política pública educativa que abarca el ejercicio del derecho y las externalidades generadas por la formación de capital humano altamente calificado en una sociedad de bajos ingresos. Así, el objetivo de este trabajo fue analizar la elasticidad de la oferta de educación básica oficial mediante una revisión sistemática de términos relacionados con elasticidad oferta-demanda, bajo la premisa de que es un servicio gratuito; el (...) resultado determinó que la oferta es sensible al presupuesto, así como al número de docentes que atienden el servicio educativo, pero no evidencia relación con mejora en la calidad educativa. The term “speciesism” has played a key role in debates about the moral consideration of nonhuman animals, yet little work has been dedicated to clarifying its meaning. Consequently, the concept remains poorly understood and is often employed in ways that might display a speciesist bias themselves. To address this problem, this article develops a definition of speciesism in terms of discrimination and argues in favor of its advantages over alternative accounts. After discussing the key desiderata for a definition of discrimination (...) in general and speciesism in particular, a wide and evaluative account of speciesism is presented. According to it, speciesism is unjustified consideration or treatment of those who are not classified as belonging to a certain species. The article then discusses rival accounts, namely narrow and descriptive definitions of speciesism. The article argues that such accounts are problematic as they overly restrict the scope of phenomena that can be identified as speciesist and disrupt the continuity with other forms of discrimination such as racism and sexism.
