In medieval Switzerland, war prayers were an important ritual that was performed both before battle and after a victory. Swiss troops prayed the Lord’s Prayer and the Hail Mary five times each, kneeling down and stretching out their arms in a prescribed posture. This posture, together with the quintuple repetition of the prayers, evokes the Passion of Christ and his five wounds. The Swiss troops thought of the correct performance of this prayer ritual as crucial for their military success. The (...) Swiss battle prayer also partly constituted a tactical means that was employed to scare or delude enemies unfamiliar with the ritual. From the early 16th century onwards, German humanist scholars criticized this prayer ritual as an act of superstition and uttered their disconcertment concerning the underlying belief of the Swiss that they were God’s chosen people. In the course of the late Middle Ages, vagrant people (and in particular those who were poor and needy) increasingly came to be regarded as a burden by the resident communities of the area of modern Switzerland, a phenomenon with parallels elsewhere in Europe. This is especially apparent in the harsher penal actions applied to them; most cases for communal high justice concerned foreign delinquents. Alongside the gradual development of Switzerland from complex confederate network to structured state, the Tagsatzung, the (...) diet and therefore central institution of towns and cantons, played an important role in the development of defence mechanisms against the vagrant poor. Even though the Tagsatzung as an institution was relatively weak, it was the place where political decision makers met and exchanged ideas, not least about poverty and welfare. Joint federal decisions relating to the defence against the vagrant poor can be found from 1470 onwards. This is also where the principle of welfare according to place of provenience was first propagated. However, constant reissues of the defence mechanisms against the foreign poor suggest that the decisions of the diet were not very effective. (shrink)

With small to modest sample sizes and complex models, maximum likelihood estimation of confirmatory factor analysis models can show serious estimation problems such as non-convergence or parameter estimates outside the admissible parameter space. In this article, we distinguish different Bayesian estimators that can be used to stabilize the parameter estimates of a CFA: the mode of the joint posterior distribution that is obtained from penalized maximum likelihood estimation, and the mean, median, or mode of the marginal posterior distribution that are (...) calculated by using Markov Chain Monte Carlo methods. In two simulation studies, we evaluated the performance of the Bayesian estimators from a frequentist point of view. The results show that the EAP produced more accurate estimates of the latent correlation in many conditions and outperformed the other Bayesian estimators in terms of root mean squared error. We also argue that it is often advantageous to choose a parameterization in which the main parameters of interest are bounded, and we suggest the four-parameter beta distribution as a prior distribution for loadings and correlations. Using simulated data, we show that selecting weakly informative four-parameter beta priors can further stabilize parameter estimates, even in cases when the priors were mildly misspecified. Finally, we derive recommendations and propose directions for further research. (shrink)

In three experiments, we investigated the computational complexity of German reciprocal sentences with different quantificational antecedents. Building upon the tractable cognition thesis (van Rooij, 2008) and its application to the verification of quantifiers (Szymanik, 2010) we predicted complexity differences among these sentences. Reciprocals with all-antecedents are expected to preferably receive a strong interpretation (Dalrymple et al., 1998), but reciprocals with proportional or numerical quantifier antecedents should be interpreted weakly. Experiment 1, where participants completed pictures according to their preferred interpretation, provides (...) evidence for these predictions. Experiment 2 was a picture verification task. The results show that the strong interpretation was in fact possible for tractable all but one-reciprocals, but not for exactly n. The last experiment manipulated monotonicity of the quantifier antecedents. (shrink)

From one perspective, the fundamental notions of point-set topology have to do with sequences (of points or of numbers) and their limits. A broad class of epistemological questions also appear to be concerned with sequences and their limits. For example, problems of empirical underdetermination–which of a collection of alternative theories is true–have to do with logical properties of sequences of evidence. Underdetermination by evidence is the central problem of Plato’s Meno [Glymour and Kelly 1992], of one of Sextus Empiricus’ many (...) skeptical doubts, and arguably it is the idea in Kant’s antinomies, for example of the infinite divisibility of matter [Kelly 1995, Ch.3]. Many questions of methodology, or of the logic of discovery, have to do with sequences and their limits, for example under what conditions Bayesian procedures, which put a prior probability distribution over alternative hypotheses and possible evidence and form conditional probabilities as new evidence is obtained, converge to the truth ([Savage 1954], [Hesse 1970], [Osherson and Weinstein 1988], [Juhl 1993]). Some analyses of “S knows that p” seem to appeal to properties of actual and possible sequences of something–for example Nozick’s proposal that knowledge of p is belief in p produced by a method that would not produce belief in p if p were false and would produce belief in p if p were true. Even questions about finding the truth under a quite radical relativism, in which truth 1 depends on conceptual scheme and conceptual schemes can be altered, have been analyzed as a kind of limiting property of sequences [Kelly et al. 1994]. A familiar slogan in the literature on temporal experience is that ‘a succession of appearances, in and of itself, does not amount to an experience of succession’. I show that we can distinguish between a strong and a weak sense of this slogan. I diagnose the strong interpretation of the slogan as requiring the support of an assumption I call the ‘Seems→Seemed’ claim. I then show that commitment to this assumption comes at a price: if we accept it, we either (...) have to reject the extremely plausible idea that experience is as it seems, or we are forced to provide an account of temporal experience that isn’t compatible with the phenomenology. I conclude by noting that the only plausible interpretation of the slogan is the weak interpretation, and outline a positive account of temporal experience, according to which an appearance of succession requires a succession of appearances. In this paper, I investigate whether Spinoza theory of intellect can be considered as an Averroistic, Themistian or Alexandrian theory of intellect. I identify key doctrines of these theories that are argumentatively and theoretically independent from Aristotelian hylomorphism and thus can be accepted by someone rejecting hylomorphism. Next, I argue that the textual evidence is inconclusive: depending on the reading of Spinoza's philosophy accepted, Spinoza's theory of intellect can or cannot be considered as an Averroistic theory.

Aujourd’hui, bon nombre de philosophes des sciences ou d’universitaires semblent penser que leur expertise peut éclairer les débats publics. Le premier empirisme logique peut apparaître comme un modèle de philosophie des sciences politiquement pertinent. Dans ses travaux sur la « dépolitisation» de l’empirisme logique, George Reisch a aidé à prendre conscience de l’agenda politique (de certaines composantes) du Cercle de Vienne, agenda qui a disparu dans les États-Unis d’après-guerre, sous la pression de l’anti-communisme. L’étude du cas d’Edgar Zilsel, un sociologue (...) des sciences membre de l’aile gauche radicale du Cercle de Vienne, montre cependant que l’empirisme logique ne peut pas être considéré aussi facilement comme politique. Certes, Zilsel était un intellectuel politiquement engagé, mais il n’était pas un philosophe des sciences politiquement engagé: son intention n’était pas d’intervenir dans les débats publics ou de soutenir des causes publiques en vertu de son statut académique (il n’en avait pas) ou de son expertise professionnelle (il en avait une). Je soutiens en outre que les débats contemporains sur la place de la science dans la société, menés par des universitaires qui, soucieux de leur impact sur les questions de société, conceptualisent l’influence sociale en termes de motifs et de valeurs individuels, ne correspondent pas au point de vue des empiristes logiques de gauche: ceux-ci cherchaient à fournir une explication sociologique de la science et s’attachaient davantage aux déterminants structuraux qu’aux motifs individuels. Ainsi, même si l’empirisme logique peut être vu comme un modèle de philosophie des sciences politiquement pertinent, il pointe, à mon sens, dans une direction différente de celle généralement prise par ses héritiers d’aujourd’hui. In medizinethischen Kontexten bezeichnet der Ausdruck „Odysseus-Verträge“ Selbstbindungen, die in der vorausschauenden Bitte von Patienten an ihre Ärzte bestehen, eigene spätere Behandlungspräferenzen nicht zu befolgen. Umstritten ist jedoch, ob eine vorhergehende Anweisung ein Handeln gegen den Patientenwillen in der aktualen Behandlungssituation rechtfertigt. In diesem Beitrag wird die Frage nach der Verbindlichkeit von Odysseus-Anweisungen erörtert. Zunächst wird gezeigt, dass die Befolgung einer Odysseus-Anweisung eine Form des paternalistischen Handelns darstellt und die Frage nach der Verbindlichkeit von Odysseus-Anweisungen daher in diejenige nach der (...) Rechtfertigung paternalistischen Handelns zu überführen ist . Im Folgenden wird als Rechtfertigungsmodell für paternalistisches Handeln ein Zustimmungsmodell verteidigt , dem zufolge eine paternalisierende Maßnahme durch die antizipierte spätere Zustimmung des Patienten zu dieser Maßnahme gerechtfertigt wird . Nach einer Erörterung des Einwandes, dass damit die besonderen normativen Probleme von Odysseus-Anweisungen aus dem Blick geraten , werden abschließend Fälle untersucht, in denen aufgrund eines irreversiblen Kompetenzverlustes keine spätere Zustimmung zur paternalisierenden Maßnahme mehr möglich ist. In diesen Fällen, so die These, ist ein paternalistisches Handeln gegen den aktualen Patientenwillen nicht gerechtfertigt; kommt es hier also zu einem Konflikt zwischen dem in der Vorausverfügung dokumentierten und dem aktualen Patientenwillen, ist letzterer zu respektieren .In the context of medical ethics, the term „Ulysses contract“ denotes an advance directive by means of which a patient binds himself for the future by instructing a doctor to act against his foreseen future preferences. There is some controversy, however, about whether a person’s prior decisions should be regarded as mandatory for the doctor even when they conflict with her present desires. In this contribution, I address the questions whether and under what circumstances Ulysses instructions should be regarded as binding. In Part , I attempt to show that observing a Ulysses instruction means acting paternalistically and that therefore the question whether Ulysses contracts ought to be respected should be transformed into the question how paternalistic action can be justified. Parts and are concerned with the justification of paternalistic action. On the basis of a conception of welfare as being tied to the person’s interests and preferences, I defend a consent-based model of justification . More specifically, I suggest that the patient’s anticipated later consent to a precedent paternalistic action should count as its justification . In what follows, I attempt to rebut the objection that this account does not do justice to the specific normative problems of Ulysses contracts . Finally, I examine cases in which, due to an irreversible loss of competence, a paternalistic action cannot be assented to by the patient. I argue that in these cases, acting against the patient’s present wishes cannot be justified. If in such a case a patient’s present request runs contrary to the past request expressed in the advance directive, the former should be respected. (shrink)

Family Values shows how the various contradictions at the heart of Western conceptions of maternity and paternity problematize our relationships with ourselves and with others. Using philosophical texts, psychoanalytic theory, studies in biology and popular culture, Kelly Oliver challenges our traditional concepts of maternity which are associated with nature, and our conceptions of paternity which are embedded in culture. Oliver's intervention calls into question the traditional image of the oppositional relationship between nature and culture, maternal and paternal. Family (...) Values also undercuts recent returns to the rhetoric of a "battle between the sexes" by analyzing the conceptual basis of these descriptions in biological research and the presuppositions of such suggestions in philosophy and psychoanalysis. In Subjectivity without Subjects, well-known philosopher and feminist theorist Kelly Oliver looks at aspects of popular culture, film, science, and law to examine contemporary notions of paternity and maternity. Oliver studies the roles of paternal responsibility, virility, and race in such events as the Million Man March and the Promise Keeper's movement and suggests alternative ways to conceive of self-other relations and the subjective identity at stake in them. In addition she offers a detailed analysis of particular works (...) by such well-known filmmakers as Polanski, Bergman, and Varda in developing a theory of identity that opens the subject to otherness and difference. Following Max Horkheimer, I will first attempt to reconstruct an anthropology that essentially wants to be understood as critical social research. I will then pursue the question of humanism in critical theory. In doing so, I want to show that a reference to a normatively substantive humanism does actually exist in critical theory. On the other hand, I want to show that this humanism is anything but unambiguously and systematically formulated but has been reflected and articulated differently by different representatives (...) of critical theory. The two examples I will refer to here are Theodor W. Adorno and Erich Fromm. I will define Adorno’s humanism as ‘dialectical humanism’, whereas Fromm’s humanism could be described as ‘emphatic humanism’. My reading, however, attempts to interrogate the two positions as to their complementarity. Not ‘Adorno or Fromm’, but ‘Adorno and Fromm’ is the motto that guides me. Finally, I will relate this complementary reading of both approaches in such a way that the possibility of a ‘Critical Humanism’ can be derived from it, which above all also wants to be understood as a sociological research program. A brief introduction to the first issue of the Journal of Analytic Theology.

This paper introduces the concept of business-related conspiracy theories. Drawing on Aristotelian virtue ethics and undertaking a narratological and ethical analysis of 28 BrCTs found online, I emphasize that BrCTs are narratives with structures rooted in other latent macro- and meta-narratives, including centuries-old myths. In particular, I reconstruct the fictional world of BrCTs – one in which CSR and social contracts have failed – before identifying eight different types of actors as which people can morally situate themselves in their relationships (...) with business. Finally, I elaborate on the actors’ performances and their use of external and legitimate forces to end the story. The paper concludes with a discussion of potential future research to help combat BrCTs, as well as a call for the critical study of political CSR. (shrink)

Nietzsche has the reputation of being a virulent misogynist, so why are feminists interested in his philosophy? The essays in this volume provide answers to this question from a variety of feminist perspectives. The organization of the volume into two sets of essays, "Nietzsche's Use of Woman" and "Feminists' Use of Nietzsche," reflects the two general approaches taken to the issue of Nietzsche and woman. First, many debates have focused on how to interpret Nietzsche's remarks about women and femininity. Are (...) all of Nietzsche's comments to be read literally, or is he being ironic, perhaps even parodying and subverting stereotypes about women? Second, is his philosophy useful to feminist theory? Can we separate his philosophy from his seemingly derogatory remarks about women? Some view his critiques of dualism and essentialism as well as his perspectivism and social constructivism as adumbrating later feminist positions. This study examines whether journalists and bloggers label paid content. In Germany, as in many other countries, advertorials have to be designated as advertising to enable the target audience to identify the promotional character of the content. This applies both to the traditional mass media and to blogs, for which advertorials provide a key source of income. To date, there have been no empirical findings on the designation practice based on a comparison of journalists and bloggers. The present study presents (...) an online survey in Germany completed by 936 journalists and 463 bloggers in 2017. The results indicate that, in fact, bloggers do not label advertorials less frequently than journalists do: 91.6 % of bloggers and 91.7 % of journalists stated that they label paid content as advertising. For Ricoeur, fatherhood promises equality through contracts, while for Levinas, fatherhood promises singularity beyond the law. The tension between equality and singularity, between law and something beyond the law, is what is at stake in Derrida’s The Gift of Death. There, (...) Derrida describes ethics as a paradox between the universal and the individual, between equality and singularity. Kierkegaard’s reading of the story of Abraham and Isaac from Genesis is the centerpiece of Derrida’s analysis. If we read The Gift of Death, with its focus on this story of father and son, in relation to Ricoeur and Levinas on the question of fatherhood, it reads as the culmination of a dialectical tension between the two. And if we read the Abraham story as a legend about father-son relations rather than just a parable of faith, The Gift of Death appears to uncover not just the paradoxical logic of ethics but also the uncompromising logic of patriarchy and paternal authority.Paternity Begets FraternityIn “Fatherhood: from Phantasm to Symbol” Ricoeur describes fatherhood as a battle of wills struggling for recognition. He brings together what he calls the different perspectives of psychoanalysis, phenomenology, and religion in order to rearticulate the oedipal situation as a process of recognition (rather than a structure) which moves from the father as phantasm to the father as symbol and replaces images of real murder with symbolic sacrifice. Through his dialectical analysis, Ricoeur himself attempts to articulate a recognition of fatherhood that moves us away from the phantasm of the father as castrator to the symbol of the father as compassionate. Relying on Hegelian dialectics, Ricoeur outlines a movement from psychoanalysis’s fantastic image of an omnipotent father who must be killed so that the son might live, through Phenomenology of Spirit’s master-slave dialectic, to the Christian religious representation of the loving father sacrificing Himself through His son for the sake of all His children. In this higher stage of the dialectic of paternity, the murder of the father is replaced by his sacrifice. Oddly, however, Ricoeur’s dialectic remains at the level of the master-slave fight to the death, where—without the Hegelian resolution—the only options available to insure the recognition of the father by the son (or the son by the father) are murder or suicide. For Ricoeur, recognition requires death, symbolic if not imaginary, whereas Hegel insists that recognition comes only when the master and slave are willing to risk death but also realize the necessity of avoiding it; mutual recognition cannot be maintained if one of the parties is dead.For Ricoeur, recognition does not necessitate avoiding death but rather moving away from the realm of the family and the body to the level of the social and the law. In order for the father-son relationship to be one of mutual recognition, the father must sacrifice his absolute authority so that the son might also participate in it. The goal of recognition is equality, which can be achieved only through social contracts that abstract from the particulars of embodied familial relations. One such social operation is designation, [End Page 45] which is removed from the realm of the bodily drives that motivate the oedipal scenario. Designation requires the sublimation of bodily drives into abstract laws that can equalize bodies by turning them into symbols.The move from psychoanalysis to Christianity is a move from a domestic family to a social family: through God the Father’s sacrifice of His son, we all become members of the Christian family; we all become children of God. For Ricoeur, it is not that God is the Father because He gives the Law. Rather, the law, the covenant or contract, enables Him to be recognized as father [490]. Ricoeur implicitly rejects the Lacanian association of the Father with the Law or the Name. He claims that there is no Name of the Father. “Father” is not a name but a designation [Ricoeur 485]. In [STU 00, KUT 03] we introduced a family of ‘modal' languages intended for talking about distances. These languages are interpreted in ‘distance spaces' which satisfy some of the standard axioms of metric spaces. Among other things, we singled out decidable logics of distance spaces and proved expressive completeness results relating classical and modal languages. The aim of this paper is to axiomatize the modal fragments of the semantically defined distance logics of [KUT 03] and give a new proof of (...) their decidability. (shrink)

However, there are real issues that the legal system will face as neurobiological studies continue to relentlessly probe the human mind. Wer das eigene Leben für sinnlos hält, wird oft auch die Ansicht haben, dass es besser wäre, nicht geboren worden zu sein. In diesem Beitrag wird untersucht, ob Äußerungen wie „Ich wäre lieber nicht geboren“ sinnvoll sind und ob sie sich begründen lassen. Im einleitenden Teil wird gezeigt, dass diese Äußerungen entgegen einer von manchen Philosophen vertretenen Ansicht nicht sprachwidrig sind. Im zweiten Teil wird David Benatars „Asymmetrieargument“ in modifizierter Form verteidigt. Benatar bringt dieses Argument zur Verteidigung der These vor, (...) dass es stets einen Schaden darstellt, in die Existenz zu gelangen. Es wird gezeigt, wie sich das Argument unter Beachtung der Differenz zwischen „jemanden eines Gutes berauben“ und „jemandem ein Gut vorenthalten“ verteidigen lässt. Im dritten Teil werden die praktischen Implikationen des modifizierten Asymmetrieargumentes ausbuchstabiert. Es führt nicht zu einem Anti-Natalismus, wohl aber zur These, dass es rational ist, die eigene Existenz zu bedauern. (shrink)

In der gegenwärtigen Abtreibungsdebatte ist viel von den sogenannten SKIP-Argumenten gegen die moralische Erlaubtheit der Abtreibung die Rede. Wenig beachtet wird dagegen das Argument der Existenzverhinderung. Dabei handelt es sich um ein interessenbasiertes Argument gegen die Abtreibung, dem zufolge Abtreibung moralisch falsch ist, weil damit die Entstehung eines voraussichtlich glücklichen Wesens verhindert wird. In diesem Beitrag wird das Argument systematisiert und mit einigen Einwänden sowie dem Vorwurf, kontraintuitive Konsequenzen nach sich zu ziehen, konfrontiert. Es zeigt sich, dass das Argument sich (...) gegen Einwände, die sich auf seine interessentheoretischen Grundlagen beziehen, verteidigen lässt und auch nicht daran scheitert, Abtreibung und Empfängnisverhütung in normativer Hinsicht gleichstellen zu müssen. Es erweist sich jedoch dort als angreifbar, wo es zur Begründung einer liberalen Position in Anspruch genommen wird. Unter Rückgriff auf dieses Argument lässt sich also eine konservative Position zur Abtreibungsproblematik begründen, die jedoch den notorischen Schwierigkeiten der SKIP-Argumente aus dem Weg geht. Written from the perspective of philosophy of liberation, this essay holds that the reform of basic human relationships and their cultural instantiation(s) is central to all serious societal change. The essay analyzes naive, mythological, and critical consciousness. It examines how these modes of consciousness are embodied in the health delivery system and then describes areas where practitioners and patients of critical consciousness might work for greater humanization of health care.

This book presents selected addresses presented before the Personalist Discussion Group meetings held in conjunction with the annual meetings of The American Philosophical Association, Eastern Division. It includes the central ideas of American Personalistic Idealism developed during the twentieth century, its major criticisms, and recent developments by philosophers who are either Personalistic Idealists of sympathetic to the position.
