Nurses often play crucial roles on teams involved in providing care to infants and families in the context of child protection services, making them well‐placed to research topics concerning these groups. Developed by North American legal scholar Martha Fineman in 2008, a contemporary macro‐legal‐political theory with potential to inform studies related to the nexus between healthcare and law is ‘vulnerability theory.’ Conceiving vulnerability as a universal, inevitable, and enduring aspect of the human condition, it contends that the onus is on (...) the State to respond to universal vulnerability by ensuring institutions and structures do not confer unfair advantage or disadvantage. When access to rights is particularly difficult, a ‘targeted group approach’ should be considered as well as consideration of the notion that responses to vulnerability have the potential to increase vulnerability. This paper outlines the background of vulnerability theory, explaining its key tenets and criticisms, before considering how it might be useful to inform studies focused on infants in out of home care. Taking Hobbesian logic as my starting point, I argue that Hobbesian diffidence, one of the causes of quarrel in the state of nature, does not disappear once the citizens enter civil society. Rather, diffidence is merely contained by the sovereign. Following Alice Ristroph, I argue that diffidence comes to shape what citizens demand of the state/sovereign in the criminal law. However, I show that Ristroph does not fully appreciate that the concept of diffidence is a racialized one, and as such, (...) race underlies how the citizens understand their own diffidence, what citizens demand of the sovereign, and how they demand it. Further, because diffidence itself is racialized, criminal law need not make explicit appeals to race. Once racialized diffidence becomes embedded in the criminal law, it remains there regardless of any conscious racial animus. I show that racial profiling is a prime example of how this racialized diffidence manifests. Thus, I present Hobbesian diffidence as a framework from which to understand racial oppression. This paper is primarily an application of Hobbes to contemporary issues rather than an exegesis and analysis of Hobbes’s views. (shrink)

The central problem for pragmatics is that sentence meaning vastly underdetermines speaker’s meaning. The goal of pragmatics is to explain how the gap between sentence meaning and speaker’s meaning is bridged. This paper defends the broadly Gricean view that pragmatic interpretation is ultimately an exercise in mind-reading, involving the inferential attribution of intentions. We argue, however, that the interpretation process does not simply consist in applying general mind-reading abilities to a particular (communicative) domain. Rather, it involves a dedicated comprehension module, (...) with its own special principles and mechanisms. Pragmatic processes crucially rely on background or contextual information supplied by the hearer, which may significantly affect the outcome of the comprehension process. Construed as a branch of cognitive psychology, pragmatics is the study of the cognitive systems apart from the I‐language and the parser which enable speaker and hearer (or communicator and audience) to co‐ordinate on the intended interpretation, and this is how we propose to treat it here. This chapter considers some of Noam Chomsky's suggestions about how the (...) cognitive systems underlying human abilities might be investigated. It discusses his reasons and consider how far this skepticism may be due to his particular conception of pragmatics. The chapter outlines an approach to pragmatics that seems to be compatible with his general methodology and is based on an alternative conception of pragmatics that we sketch out. (shrink)

Chiappe and Kukla argue that relevance theory fails to solve the frame problem as defined by Fodor. They are right. They are wrong, however, to take Fodor’s frame problem too seriously. Fodor’s concerns, on the other hand, even though they are wrongly framed, are worth addressing. We argue that Relevance thoery helps address them.

This article examines when deceptive withholding of information is ethically acceptable in research. The first half analyses the concept of deception. We argue that there are two types of accounts of deception: normative and non-normative, and argue that non-normative accounts are preferable. The second half of the article argues that the relevant ethical question which ethics committees should focus on is not whether the person from whom the information is withheld will be deceived, but rather on the reasonableness of withholding (...) the information from the person who is deceived. We further argue that the reasonableness of withholding information is dependent on the context. The last section examines how the context of research should shape our judgements about the circumstances in which withholding information from research participants is ethically acceptable. We argue that some important features of research make it more difficult to justify withholding information in the context of research than elsewhere. (shrink)

Approaches to self‐management traditionally focus upon individual capacity to make behavioural change. In this paper, we use Bourdieu's concepts of habitus and capital to demonstrate the impact of structural inequalities upon chronic illness self‐management through exploring findings from 28 semi‐structured interviews conducted with people from a lower socioeconomic region of Adelaide, South Australia who have type 2 diabetes. The data suggests that access to capital is a significant barrier to type 2 diabetes self‐management. While many participants described having sufficient cultural (...) capital to access and assess health information, they often lacked economic capital and social capital in the form of support networks who promote health. Participants were often involved in social networks in which activities which are contrary to self‐management have symbolic value. As a consequence, they entered relationships with health professionals at a disadvantage. We conclude that structural barriers to self‐management arising from habitus resulting in the performance of health behaviours rooted in cultural and class background and limited access to capital in the form of economic resources, social networks, health knowledge and prestige may have a negative impact on capacity for type 2 diabetes self‐management. The subjective effects and therapeutic potential of the shamanic practice of journeying is well known. However, previous research has neglected to provide a comprehensive assessment of the subjective effects of shamanic-like journeying techniques on non-shamans. Shamanic-like techniques are those that demonstrate some similarity to shamanic practices and yet deviate from what may genuinely be considered shamanism. Furthermore, the personality traits that influence individual susceptibility to shamanic-like techniques are unclear. The aim of the present study was, thus, to investigate experimentally the (...) effect of shamanic-like techniques and a personality trait referred to as "ego boundaries" on subjective experience including mood disturbance. Forty-three non-shamans were administered a composite questionnaire consisting of demographic items and a measure of ego boundaries (i.e., the Short Boundary Questionnaire; BQ-Sh). Participants were randomly assigned to one of three conditions: listening to monotonous drumming for 15 minutes coupled with one of two sets of journeying instructions; or sitting quietly with eyes closed for 15 minutes. Participants' subjective experience and mood disturbance were retrospectively assessed using the Phenomenology of Consciousness Inventory (PCI) and the Profile of Mood States-Short Form, respectively. The results indicated that there was a statistically significant difference between conditions with regard to the PCI major dimensions of visual imagery, attention and rationality, and minor dimensions of imagery amount and absorption. However, the shamanic-like conditions were not associated with a major reorganization of the pattern of subjective experience compared to the sitting quietly condition, suggesting that what is typically referred to as an altered state of consciousness effect was not evident. One shamanic-like condition and the BQ-Sh subscales need for order, childlikeness, and sensitivity were statistically significant predictors of total mood disturbance. Implications of the findings for the anthropology of consciousness are also considered. (shrink)

Several recent systematic and targeted reviews have highlighted limitations in our understanding of talent in sport. However, a comprehensive profile of where the scientific research has focused would help identify gaps in current knowledge. Our goal in this scoping review was to better understand what others have done in the field of research, to summarize the constituent areas of research in a meaningful way, to help identify gaps in the research, and to encourage future research to address these gaps. Peer-reviewed (...) articles written in English that met several inclusion criteria were analyzed. A total of 1,899 articles were identified, and the descriptive findings revealed a relatively narrow focus of research on talent in sport. Specifically, the majority of examined articles focused on males only, the sport of soccer, perceptual cognitive variables, developing athletes, adult samples, and cross-sectional designs. For better or worse, the concept of talent remains a central element of how coaches, practitioners, and scientists think about athlete development. Findings from this scoping review highlight the continued need to explore issues related to talent identification, selection, and development in more diverse samples and contexts. There is also a clear necessity to focus on under-researched areas using alternative methodologies. (shrink)

The goal of this research is to explore implicit and explicit processes in shaping an individual’s characteristic behavioral patterns, that is, personality. The questions addressed are how psychological processes may be separated into implicit and explicit types, and how such a separation figures into personality. In particular, it focuses on the role of instinct and intuition in determining personality. This paper argues that personality may be fundamentally based on instincts resulting from basic human motivation, along with related processes, within a (...) comprehensive cognitive architecture. This approach is implemented as a computational model. Various tests and simulations show that this model captures major personality traits and accounts for empirical data. The work shows how a cognitive architecture with the implicit–explicit distinction may capture instinct, intuition, and personality. (shrink)

The question on guilt that Jaspers poses to the Germans was not only valid after the Holocaust, it can be raised to other peoples who must answer for the crimes committed by the state which act on behalf of the people that gave support to them. In this paper, I elaborate a notion of citizens’ political responsibility in order to argue to what extent—and under what circumstances—the citizens of a political community must respond for the deeds of the political institutions (...) that govern them. For that purpose, I try to explain Spinoza’s notion of political authority in relation to Jaspers’ notion of political guilt. This Spinozistic approach has the advantage of freeing us from moral guilt—a misleading notion in political arena as I will argue—but it demands from us a genuine self-reflective and therapeutic procedure that if applied to politics would reveal a different path from Jaspers’ guilt. The aim of this therapeutic is to bring about a profound change in the personal and political identity of both citizen and political community. (shrink)

We show that the statement “every universally Baire set of reals has the perfect set property” is equiconsistent modulo ZFC with the existence of a cardinal that we call virtually Shelah for supercompactness. These cardinals resemble Shelah cardinals and Shelah-for-supercompactness cardinals but are much weaker: if $0^\sharp $ exists then every Silver indiscernible is VSS in L. We also show that the statement $\operatorname {\mathrm {uB}} = {\boldsymbol {\Delta }}^1_2$, where $\operatorname {\mathrm {uB}}$ is the pointclass of all universally Baire (...) sets of reals, is equiconsistent modulo ZFC with the existence of a $\Sigma _2$ -reflecting VSS cardinal.
