Nurses often play crucial roles on teams involved in providing care to infants and families in the context of child protection services, making them well‐placed to research topics concerning these groups. Developed by North American legal scholar Martha Fineman in 2008, a contemporary macro‐legal‐political theory with potential to inform studies related to the nexus between healthcare and law is ‘vulnerability theory.’ Conceiving vulnerability as a universal, inevitable, and enduring aspect of the human condition, it contends that the onus is on (...) the State to respond to universal vulnerability by ensuring institutions and structures do not confer unfair advantage or disadvantage. When access to rights is particularly difficult, a ‘targeted group approach’ should be considered as well as consideration of the notion that responses to vulnerability have the potential to increase vulnerability. This paper outlines the background of vulnerability theory, explaining its key tenets and criticisms, before considering how it might be useful to inform studies focused on infants in out of home care. The literature on epistemic injustice has thus far confined the concept of testimonial injustice to speech expressions such as inquiring, discussing, deliberating, and, above all, telling. I propose that it is time to broaden the horizons of testimonial injustice to include a wider range of expressions. Controversially, the form of communication I have in mind is non-verbal expression. Non-verbal expression is a vital, though often overlooked, form of communication, particularly for people who have certain neurocognitive disorders. Dependency upon non-verbal expression (...) is a common feature of some forms of neurocognitive disorders such as ‘intellectual disabilities’, autism and late-stage dementia. According to the narrow definition of testimonial injustice currently championed in the literature, people who express non-verbally are exempt from testimonial injustice. However, when we consider cases where meaningful communications from non-verbal people are dismissed or ignored in virtue of identity prejudice, there seems to be a distinct testimonial harm at play. Using late-stage dementia as a case study, I argue that the definition of testimonial injustice should be expanded to include all communicative practices, whether verbal or non-verbal, to encompass the epistemic harms inflicted upon some of the most marginalised in our society. For the first time in history, man began to cease, like other animals, to be essentially predatory on his environment, despoiling and exhausting it, and began instead to make it progressively more productive and more able to support his own kind. Thomas Robert Malthus lived well into this productive century, but his thinking remained in the past, (...) as did that of his contemporary, David Ricardo, and his successors, the Classical Economists, including even J.S. Mill. In this essay Spencer Heath carefully refutes Ricardo’s argument in support of Malthus and stresses the importance of understanding man not in terms of his animal nature, but in terms of his uniquely human potential; that is, his evolving, creative nature. In this highly original study of the nature of performance, Spencer Golub uses the insights of Ludwig Wittgenstein into the way language works to analyze the relationship between the linguistic and the visual in the work of a broad range of dramatists, novelists, and filmmakers, among them Richard Foreman, Mac Wellman, Peter Handke, David Mamet, and Alfred Hitchcock. Like Wittgenstein, these artists are concerned with the limits of language’s representational capacity. For Golub, it is these limits that give Wittgenstein’s (...) thought a further, very personal significance—its therapeutic quality with respect to the Obsessive Compulsive Disorder from which he suffers. Underlying what Golub calls “performance behavior” is Wittgenstein’s notion of “pain behavior”—that which gives public expression to private experience. Until recently Spencer's posthumous reputation rested almost excusively on his social and political thought, which has itself frequently been subject to serious misrepresentation. The Study of Sociology, by English philosopher, biologist, anthropologist, and sociologist, Herbert Spencer, was originally published in 1873. Spencer was known for his contributions to evolutionary theory and for applying it outside of biology, to the fields of philosophy, psychology, and within sociology. In particular, this work is a survey of the foundations of sociology, by one of its founders. Within which he applies the idea of natural selection to the group survival and institutional structures.

Perhaps a part of what makes expertise so inspiring to the curious researcher is the possibility of appropriating the structural components of skilled action to draw a roadmap towards their achievement that anyone might be able to follow. Accordingly, the purpose of this essay is to shed light upon the role that creativity plays in the production and environment of skilled action to that foregoing end. In doing so, I suggest that the lessons to be learned from recent empirical research (...) on creativity has much to offer to the cognitive science of skill and expertise. Experts are able to bring their intelligence to bear in controlling fast and seemingly automatic actions by utilizing a form of control often called ‘intelligent automaticity.’ In this spirit, I argue that the environment of intelligently automatic action control curates a similarly ideal environment for the processes of creativity. Moreover, insofar as creativity is ideally operative within the environment of expert action control, I argue further that creativity functions as one representative form of ‘intelligence’ embedded within otherwise fluid, and automatic expert actions. Creativity is able to do so even without conscious representation through the powers of incubated cognition. (shrink)

This paper develops an argument against causal decision theory. I formulate a principle of preference, which I call the Guaranteed Principle. I argue that the preferences of rational agents satisfy the Guaranteed Principle, that the preferences of agents who embody causal decision theory do not, and hence that causal decision theory is false.

This commentary presents indirect support for Corballis's claim that language evolved out of a gestural system in our evolutionary past. Specifically, it presents behavioral and neurological evidence that present-day speech and gesture continue to be tightly integrated in language production and comprehension.

Residential subdivisions governed democratically by homeowners’ associations often fall short of their residents’ expectations. The fault may lie in the developers’ practice of subdividing rather than leasing residential land. Given the widespread success of land leasing in commercial real estate, subdividing residential land seems anomalous, and may be explained by a variety of public policies enacted since World War II that have constrained developers to subdivide rather than lease land for residential purposes. By promoting subdivision, these policies have subjected homeowners (...) to the obsessive rule making, conflict, and counterproductive decision making that characterize democratic institutions. Entrepreneurial management, on the other hand, as practiced in multi‐tenant commercial properties, has the potential of promoting true residential “community.”. (shrink)

This paper develops a form of moral actualism that can explain the procreative asymmetry. Along the way, it defends and explains the attractive asymmetry: the claim that although an impermissible option can be self-conditionally permissible, a permissible option cannot be self-conditionally impermissible.

I will discuss a variety of cases such that the subject's believing truly is somewhat of an accident, but less so than in a Gettier case. In each case, this is because her reasons are not ultimately undefeated full stop, but they are ultimately undefeated with certain qualifications. For example, the subject's reasons might be ultimately defeated considered in themselves but ultimately undefeated considered as a proper part of an inference to the best explanation that is undefeated without qualification. In (...) each section of the paper, I consider different qualifications and show how in each case we get an epistemic standing I call “coach-class knowledge”. First-class knowledge requires justifying reasons that are undefeated without qualification. Coach-class knowledge only requires qualified lack of defeat. I will use this distinction to bring debates over knowledge from falsehood and fake barns to an ecumenical resolution. In both cases, the subject enjoys coach-class rather than first-class knowledge. I will also show that the defeasible reasoning tradition can better account for graded accidental truth than safety theories. (shrink)

Genetic analysis of the signals within bacterial exported proteins have shown that the information required for proper localization is contained in both the amino‐terminal signal sequence and the mature protein. Several types of signal sequence mutations can be isolated, suggesting that the signal sequence may be involved in more than one step in the export process. Export information within the mature portion of the protein is present at several locations.

Simply by formulating a question about the nature of ancient Greek poetry or music, any modern English speaker is already risking anachronism. In recent years especially, scholars have reminded one another that the words ‘music’ and ‘poetry’ denote concepts with no easy counterpart in Greek. μουσική in its broadest sense evokes not only innumerable kinds of structured movement and sound but also the political, psychological and cosmic order of which song, verse and dance are supposed to be perceptible manifestations. Likewise, (...) ποίησις and the ποιητικὴ τέχνη can encompass all kinds of ‘making’, from the assembly of a table to the construction of a rhetorical argument. Of course, there were specifically artistic usages of these terms—according to Plato, ‘musical and metrical production’ was the default meaning of ποίησις in everyday speech. But even in discussions which restrict themselves to the sphere of human art, we find nothing like the neat compartmentalization of harmonized rhythmic melody on the one hand, and stylized verbal composition on the other, which is often casually implied or expressly formulated in modern comparisons of ‘music’ with ‘poetry’. For many ancient theorists the City Dionysia, a dithyrambic festival and a recitation of Homer all featured different versions of one and the same form of composition, a μουσική or ποιητική to which λόγοι, γράμματα and συλλαβαί were just as essential as ἁρμονία, φθόγγοι, ῥυθμός and χρόνοι. One debate that metaphysicians of race have been consumed with since the 1990s is what we can call the US race debate, which is the debate about what the nature and reality of race is according to the dominant ways that ‘race’ and race terms are used to classify people in contemporary American English. In 2014, I contributed a defence of biological racial realism in the US race debate that utilized new results about human genetic clustering from population genetics. In (...) this paper, I will show that all US race theories have been wrong, including my own. This is because, as I will argue, the correct US race theory has a radically pluralist form. This is an instance of a metametaphysical position that I call radical racial pluralism. After defending radical racial pluralism in the US race debate, I explore valuable implications of the view for philosophers of race. (shrink)

Consequentialists often assume rational monism: the thesis that options are always made rationally permissible by the maximization of the selfsame quantity. This essay argues that consequentialists should reject rational monism and instead accept rational pluralism: the thesis that, on different occasions, options are made rationally permissible by the maximization of different quantities. The essay then develops a systematic form of rational pluralism which, unlike its rivals, is capable of handling both the Newcomb problems that challenge evidential decision theory and the (...) unstable problems that challenge causal decision theory. In this article, we argue that dominant norms of demographic data are insufficient for accounting for the complexities that characterize many lesbian, gay, bisexual, transgender, and queer lives. Here, we draw from the responses of 178 people who identified as non-heterosexual or non-cisgender to demographic questions we developed regarding gender and sexual orientation. Demographic data commonly imagines identity as fixed, singular, and discrete. However, our findings suggest that, for LGBTQ people, gender and sexual identities are often multiple and in flux. (...) An overwhelming majority of our respondents reported shifting in their understandings of their sexual identities over time. In addition, for many of our respondents, gender identity was made up of overlapping factors, including the relationship between gender and transgender identities. These findings challenge researchers to reconsider how identity is understood as and through data. Drawing from critical data studies, feminist and queer digital media studies, and social justice initiatives like Data for Black Lives, we call for a reimagining of identity-based data as “queer data” or “data for queer lives.” We offer also recommendations for researchers to develop more inclusive survey questions. At the same time, we address the ways that queer perspectives destabilize the underlying logics of data by resisting classification and “capture.” For marginalized people, the stakes of this work extend beyond academia, especially in the era of algorithms and big data when the issue of who is or is not “counted” profoundly affects visibility, access, and power in the digital realm. If there are vague propositions, then the question arises whether it is rational to care intrinsically about the vague. This paper argues—contra Bacon (2018), the most comprehensive defence of vague proposition to date—that it is. Some things, such as pain, may be rational to care intrinsically about only if precise, but some things, such as truth, are rational to care intrinsically about even if vague.

In this paper, I will present a problem for reductive accounts of knowledge-undermining epistemic luck. By “reductive” I mean accounts that try to analyze epistemic luck in non-epistemic terms. I will begin by briefly considering Jennifer Lackey's (2006) criticism of Duncan Pritchard's (2005) safety-based account of epistemic luck. I will further develop her objection to Pritchard by drawing on the defeasible-reasoning tradition. I will then show that her objection to safety-based accounts is an instance of a more general problem with (...) reductive accounts of epistemic luck. In short, they face a dilemma: they can either fail to vindicate the intuitive verdicts about cases or they can illicitly appeal to the epistemic vocabulary they are trying to reduce. The upshot is that we can only understand epistemic luck in terms of the assessment of the subject's reasons and we can't give a reductive account of that. (shrink)

This book applies Heidegger’s writings to experimental fictions and film genres in order to study a being-there that performs itself beyond liveness and a future that is already here. Theatrical mise-en-scène is analyzed as a way of modeling the Heideggerian ontological-existential, exchanging a deeper presencing for the fictional “now” of liveness. The book is organized around ostensible objects that are in fact things-as-such and performs its theme via time-traveling, interruptions, decompositions, incompleteness, failure, geometric patterning, and above all black pages first (...) cited in Tristram Shandy. This is a nuanced, original work that combines unexpected sources with even more unexpected writing, imagery, and correspondences. It is part of Golub’s ongoing project of lyrically reimagining philosophy and the mise-en-scène of theatrical performance in light of one another. (shrink)

Haraway foregrounds many stories that we, in a late capitalist era, tell ourselves in order to justify, or not even notice, actions that are harmful to all living things. While I am mindful of Haraway’s excellent attention to the ways that ‘stories tell stories, thoughts think thoughts, and knots knot knots,’ I argue that we must take great care when we, as educators, blur the lines between facts and fiction; reality and art. When everything becomes a story—with some stories simply (...) being more compelling than other stories—we run the risk of contributing to the very sense of unmooring that has led us to the status quo where arctic icecaps are melting, living things are becoming extinct, and humans are suffering from man-made pollution. In this paper, I trouble the use of stories to draw attention to the ecological harm we have done to our earth. While stories can be powerful, there are risks associated with how we tell stories; and particular risks when we blur the lines between critical storytelling and the idea of something as ‘factual’. Storytelling, and blurring the lines between stories and facts, can have negative implications for our quest to generate a sense of ‘response-ability’ for our planet and all who live on it. In order to make that argument, I first talk about my own story and the ways that I have used stories in the classroom. I then touch on Haraway and her particular use of stories. I then foreground the practice of telling truths with stories by exploring the use of critical fiction and narrative inquiry. I conclude with implications for pedagogy. (shrink)

A collection of new essays on the influential medieval philosopher John Buridan, written by leading Buridan scholars. The volume places Buridan in his philosophical context and examines his writings on topics including logic, modal logic, paradoxes, metaphysics, epistemology, theory of knowledge, moral philosophy, and natural philosophy.

The commons is frequently taken to be a model of democracy. Yet, the problems of overuse and enclosure that plague common-pool resources suggest that democratic norms of inclusion, equality, and pluralism may not be realized in practice. Existing contractarian accounts of the democratic value of the commons tend to assume equality of power and clear boundaries between users and non-users. Alternative accounts that emphasize practices of commoning assume a shared social identity that appears incompatible with pluralism. These accounts provide little (...) insight into how common-pool resource regimes marked by inequalities of power might be democratized for the long-term. In contrast, I argue that the idea of treaty can serve as the basis for a democratic theory of the commons that justifies exclusion of those who would oppress marginalized groups, facilitates polycentric governance, and creates opportunities for deliberation and contestation. I illustrate the argument with reference to disputes over fisheries between the Mi’kmaq, non-Indigenous peoples, and the Canadian state. (shrink)
