Elias wrote in both English and German, and in all his work runs to 14 books and around 90 other essays, along with poems and numerous interviews. The 18 volumes of the collected works contain many writings not previously published in English, and a small number never published before. All of the texts have thoroughly checked and revised, by editors who have a deep knowledge of Elia's thinking; they have inserted many clarifications, cross-references and explanatory notes.

Die derzeitigen Methoden zum Erhalt der Fertilität sind experimentell, mit therapeutischer Unsicherheit und gesundheitlichen Risiken belastet, dennoch werden sie zunehmend nachgefragt. Die mit dem Angebot fertilitätserhaltender Maßnahmen verbundene derzeitige Beratungspraxis wird in dem hier vorliegenden Beitrag aus ethischer Perspektive hinterfragt. The articles in this Festschrift for the leading German expert on Kant, Norbert Hinske, show how richly productive this has been for scholars. Leading Italian, Japanese, Russian and German representatives of research on Kant have provided contributions to it. What is particular significant for the history of Kant's life and development, which has to be completely rewritten in this regard, is a newly discovered letter, reprinted in facsimile for the first time, from J. E. Biester to J. N. Tetens, which proves that Prussian Minister of Culture v. Zedlitz initially did not appoint Kant but rather Tetens to the position in Halle. This paper explores the relevance of the debate about ethical expertise for the practice of clinical ethics. We present definitions, explain three theories of ethical expertise, and identify arguments that have been brought up to either support the concept of ethical expertise or call it into question. Finally, we discuss four theses: the debate is relevant for the practice of clinical ethics in that it (1) improves and specifies clinical ethicists' perception of their expertise; (2) contributes to improving the perception (...) of moral competence of non-ethicists; (3) gives insight into complementary styles of argumentation of ethicists and non-ethicists; and (4) contributes to the awareness of the problem of profession-building of (clinical) ethicists. Carey's book on conceptual change and the accompanying argument that children's biology initially is organized in terms of naïve psychology has sparked a great detail of research and debate. This body of research on children's biology has, however, been almost exclusively been based on urban, majority culture children in the US or in other industrialized nations. The development of folkbiological knowledge may depend on cultural and experiential background. If this is the case, then urban majority culture children may prove to (...) be the exception rather than the rule, because plants and animals do not play a significant role in their everyday life. Urban majority culture children, rural majority culture children, and rural Native American children were given a property projection task based on Carey's original paradigm. Each group produced a unique profile of development. Only urban children showed evidence for early anthropocentrism, suggesting that the co-mingling of psychology and biology may be a product of an impoverished experience with nature. In comparison to urban majority culture children even the youngest rural children generalized in terms of biological affinity. In addition, all ages of Native American children and the older rural majority culture children gave clear evidence of ecological reasoning. These results show that both culture and expertise play a role in the development of folkbiological thought. (shrink)

Reflective equilibrium has been criticized for various reasons ever since the publication of Rawls’ A Theory of Justice. Recent empirical research into moral decision-making poses new challenges to RE because it questions the reliability of moral intuitions. This research might discredit moral intuitionism in general and RE in particular insofar as it ascribes epistemic value to moral intuitions. These findings suggest, for instance, that moral intuitions vary with cultural background, gender or framing. If it could be shown that all or (...) certain kinds of moral intuitions are unreliable, this would diminish the plausibility of the claim that they provide good reasons to believe in the truth of their content, especially given the growing evidence that professional philosophers are just as biased and susceptible to distorting factors as lay people. In this paper I critically discuss three recent defenses of RE against this unreliable intuitions objection. Two of these defenses argue that the UIO misses its target, because RE does not depend on intuitions, or because the relevant considered judgments in RE are not intuitions. The third defense grants that RE depends on intuitions and that some Rawlsian considered judgments are intuitions. But it argues that the notion of considered judgments can be revised, and that wide reflective equilibrium has the means to adopt the criticism because it can use information about unreliable intuitions and exclude those from further consideration. I argue that the first two defenses do not succeed. The third defense is the most promising one. However, I argue that this defense also fails. In this defense, RE is not a distinctive moral epistemic theory: different versions of RE would be conceivable, all of which are deeply problematic. I conclude with a discussion of the broader philosophical implications of the UIO, specifically whether or not accepting the UIO would warrant skepticism regarding moral knowledge. (shrink)

This article challenges E.P. Thompson's definition of ‘moral economy’ as a traditional consensus of crowd rights that were swept away by market forces. Instead, it suggests that the concept has the potential of improving the understanding of modern civil society. Moral economy was a term invented in the eighteenth century to describe many things. Thompson's approach reflects only a minor part of this conceptual history. His understanding of moral economy is conditioned by a dichotomous view of history and by the (...) acceptance of a model according to which modern economy is not subject to moral concerns. It is on principle problematic to confine a term conjoining two concepts as general as ‘moral’ and ‘economy’ to a specific historical and social setting. Recent approaches that frame moral economy as an emotively defined order of morals are also misleading since they do not address economic issues in the way they are commonly understood. The topic of this book is 'creation'. It breaks down into discussions of two distinct, but interrelated, questions: what does the universe look like, and what is its origin? The opinions about creation considered by Norbert Samuelson come from the Hebrew scriptures, Greek philosophy, Jewish philosophy, and contemporary physics. His perspective is Jewish, liberal, and philosophical. It is 'Jewish' because the foundation of the discussion is biblical texts interpreted in the light of traditional rabbinic texts. It is 'philosophical' because (...) the subject matter is important in both past and present philosophical texts, and to Jewish philosophy in particular. Finally, it is 'liberal' because the authorities consulted include heterodox as well as orthodox Jewish sources. The objective of this article is to analyse and compare four methods of ethical case deliberation. These include Clinical Pragmatism, The Nijmegen Method of ethical case deliberation, Hermeneutic dialogue, and Socratic dialogue. The origin of each method will be briefly sketched. Furthermore, the methods as well as the related protocols will be presented. Each method will then be evaluated against the background of those situations in which it is being used. The article aims to show that there is not one (...) ideal method of ethical case deliberation, which fits to all possible kinds of moral problems. Rather, as each of the methods highlights a limited number of morally relevant aspects, each method has its strengths and weaknesses as well. These strengths and weaknesses should be evaluated in relation to different types of situations, for instance moral problems in treatment decisions, moral uneasiness and residue, and the like. The suggestion arrived at on the basis of the findings of this paper is a reasonable methodological plurality. This means that a method can be chosen depending on the type of moral problem to be deliberated upon. At the same time it means, that by means of a method, deliberation should be facilitated. The moral psychologist Joshua Greene has proposed a number of arguments for the normative significance of empirical research and for the unreliability of deontological intuitions. For these arguments, much hinges on the combination of various components of Greene's research – namely the dual-process theory of moral judgement, ‘personalness’ as a factor in moral decision-making, and his functional understanding of deontology and consequentialism. Incorporating these components, I reconstruct three distinct arguments and show that the Personalness Argument for the claim that empirical (...) research can advance normative ethics and the Combined Argument against deontology are both sound and interesting in themselves. They do not, however, cast doubt on traditional deontology or reserve a specific role for neuroscience. The Indirect Route argument overcomes some of the other arguments’ limitations. It is, however, invalid. I conclude by pointing out the broader philosophical relevance of Greene's arguments as shedding light on second-order morality. (shrink)

In lieu of an abstract, here is a brief excerpt of the content:The Destruction of the Seven Nations in Deuteronomy and the Mimetic Theory Norbert Lohfink Hochschule Sankt Georgen, Frankfort The book of Deuteronomy is a narrative with two narrative voices which do not necessarily present the same perspective, the one of the narrator, the other ofMoses. By employing the technique of showing rather than telling, the narrator allows his Moses to articulate a new design of the world in (...) the Deuteronomic law. Although mimetic theory may be important to our understanding of both perspectives, I will focus here solely on that world presented by Moses' speeches.1 A brief summary of my essay "Opfer und Säkularisierung im Deuteronomium" (Sacrifice and Secularization in Deuteronomy), in whose final section I found it necessary to tum to René Girard's mimetic model for clarification of the evidence, provides the basis for the revision and expansion of that study which follows. Deuteronomy—a new conception of the sacred My essay was in the form of a debate with the secularization thesis of Moshe Weinfeld, whose point ofdeparture is the Deuteronomic centralization of sacrifice in Jerusalem.2 In Deuteronomy and the Deuteronomic School, Weinfeld argues that all sacrifice as well as everything sacral was abolished throughout the land, that the sacred was restricted to the central cultus and all else became the profane. Although I cannot review those assumptions here, it is important to point out that the evidence is more complicated than Weinfeld seems to admit. In the book of Deuteronomy, we see that sacrifice indeed is abolished throughout the land. Less apparent is the fact that that restriction extends also to the rituals of sacrifice practiced by the central cultus. There is no mention of such rituals in Deuteronomy. A close study of the text reveals that they in fact have undergone a subtle transformation. The 14 centralization laws which describe the pilgrimage to the central sanctuary are presented in a literary form that resembles a ritual (see the tables in Lohfink 1992, 25-31). The high point of that pilgrimage is not the slaughter and offering of animals but the joy of a common meal. The killing of the animals is relatively insignificant in the light of the celebration of Israel's existence "before the countenance of YHWH." The Israel that celebrates this festival is moreover a society where there are neither poor nor needy. This ideal society constitutes in Deuteronomy the true sacred. By comparison with the older, archaic-cultic, understanding of this sacred the transferrai of the world-reality of the society 'Israel' into the sacred appears to imply its disintegration. But this is not the case. Deuteronomy embodies an extension of the sacred, not its demise. It presents a new interpretation of the phenomenon. The process of transforming the meaning of the sacred is mirrored in designation of Israel, indeed all of Israel, as qadosh 'holy'. It is no longer the priests alone who are considered holy but the entire population. Deuteronomic law is framed by statements that name Israel as "a people holy to the LORD your God" (7:6; 26:19) and that promise the holiness of Israel as a future blessing (28:9).3 Now 'holiness' always means the marking of a partial realm out of a greater realm which becomes thereby the 'profane'. This is what is meant in Deuteronomy. The nation of Israel is 'holy' in contrast to the other 'nations;' it is, according to 7:6, the "people for his own possession out of all the peoples that are on the face of the earth." In 26: 18ff. this rhetorical formula splits into two discrete references, the one stating that Israel wül be "a people for His own possession," the other that "He will set you high above all the nations He has made."
