Niklas Luhmann verwendet in seiner soziologischen Systemtheorie offenbar etwas, das er den Büchern des englischen Mathematikers George Spencer Brown entnimmt. Dessen Formenkalkül ist für Luhmann, wie Günther Schulte treffend bemerkt, “Mädchen für alles, mit dem er nicht nur in der Lage ist Teezukochen, sondern auch Auto oder Straßenbahn zu fahren”. Der erste Blick in Spencer Browns Laws of Form vermittelt einen anderen Eindruck: nichts scheinen sie mit soziologischer Systemtheorie zu tun zu haben. Der vorliegende Text bearbeitet hieran anknüpfend eine (...) recht bescheidene Frage, die sich gleichwohl jedem Luhmann-Leser schon einmal gestellt haben dürfte: Was wollen die Laws of Form und was will Luhmann mit ihnen? Als Antwort ergibt sich, nach Zurückverfolgung der relevanten Fußnoten, eine gute und eine schlechte Nachricht. Die schlechte Nachricht ist, daß die Lektüre der Laws of Form offenbar niemandem wirklich weiterhelfen kann, auch Luhmann selbst nicht. Die gute ist folglich, daß dem Luhmann-Leser die Notwendigkeit erspart bleibt, einen so dunklen, weil sparsamen Kalkül zu verstehen. Das meiste nämlich, was Luhmann den Laws of Form angeblich entnimmt, steht auf den zweiten Blick nicht darin. Er wird es also ohnehin durch andere Texte begründen müssen. (shrink)

In der Auseinandersetzung mit der Semantik Alteuropas hat Niklas Luhmann darauf verwiesen, dass der Begriff der menschlichen Lebensform in der antiken Semantik jenen Platz besetzt hält, an dem eigentlich ein Gesellschaftsbegriff zu entwickeln wäre (I). Der Beitrag geht der Frage nach, ob der zeitgenössische Begriff der menschlichen Lebensform, der eine tragende Bedeutung in der post-wittgensteinianischen Philosophie besitzt, dadurch erhellt werden kann, dass man ihn als funktionales Äquivalent des Gesellschaftsbegriffs versteht. Anhand von Wittgensteins Philosophischen Untersuchungen wird nachgezeichnet, dass der Begriff (...) sich in der Tat als ein begriffliches Angebot für die Frage nach der »Realität des Sozialen schlechthin« auffassen lässt (II, III). Die heutigen Verwendungen des Begriffs weisen dabei allerdings noch immer jene Gefahren auf, die Luhmanns Vorbehalte gegenüber der antiken Semantik begründeten: die Gefahr, die unerreichbare Einheit des Sozialen zu reifizieren und die in einem solchen Begriff zu entfaltenden Probleme vorschnell zu verdecken (IV). Diesen Gefahren steht zugleich ein spezifisches Problematisierungspotential gegenüber, das den Begriff der Lebensform gegenüber dem Gesellschaftsbegriff auszeichnet. Dieser Begriff erlaubt die besondere Akzentuierung eines zentralen Problems des Sozialen: des Problems der Einheit der Differenz von Individuum und Gesellschaft, das immer schon gelöst ist, wenn soziale Operationen geschehen, und das zugleich darin als unlösbares insistiert (V). Niklas Luhmann is widely recognized as one of the most original thinkers in the social sciences today. This major new work further develops the theories of the author by offering a challenging analysis of the relationship between society and the environment. Luhmann extends the concept of "ecology" to refer to any analysis that looks at connections between social systems and the surrounding environment. He traces the development of the notion of "environment" from the medieval idea--which encompasses both human and (...) natural systems--to our modern definition, which separates social systems from the external environment. In Luhmann's thought, human beings form part of the environment, while social systems consist only of communications. Utilizing this distinctive theoretical perspective, Luhmann presents a comprehensive catalog of society's reactions to environmental problems. He investigates the spheres of the economy, law, science, politics, religion, and education to show how these areas relate to environmental issues. Ecological Communication is an important work that critically examines claims central to our society--claims to modernity and rationality. The article discusses Hannes Kuch's critique of a prominent assumption liberal theories of justice make: norms guiding economic behavior and political-moral norms are to be considered separately. Against this assumption, Kuch argues in his study ‘Economy, Democracy and Liberal Socialism’ that the economic sphere plays a central role in enabling and realizing democratic justice. In doing so, Kuch problematizes the fact that the economic sphere in its current form has a predominantly negative influence on the moral education of subjects. Following (...) on from this, Kuch ascribes a normative primacy to the political sphere, while he ascribes an empirical primacy to the economic sphere with regard to the moral education of subjects. The commentators criticize Kuch's position to the effect that it postulates a problematic contrast between an amoral economic sphere and an idealized moral political sphere. Besides an internal logical-argumentative problem, this contrast proves to be particularly problematic with regard to the analysis of real-political and global-economic power relations. The commentators therefore argue for a more differentiated analysis that recognizes the moral ambivalence of the two spheres and their morally formative and destructive potential. (shrink)

Zusammenfassung: Der Beitrag systematisiert, kontextualisiert und evaluiert den eigentumstheoretischen Hintergrund der derzeit breit geführten Debatte um bezahlbaren Wohnraum in deutschen Großstädten. Ausgehend von der These, dass hinter der sogenannten ‚Wohnungskrise‘ eigentlich eine ‚Bodenkrise‘ steht, werden drei zentrale Konflikte um die politische Rahmung des Eigentums an Boden diskutiert: die Frage nach dem Gebrauch, der Verwertung und dem Eigentumsschutz. Dabei werden die normativen Potentiale eines immanenztheoretischen, apriorisch pflichtgebundenen Eigentumsverständnisses für eine zeitgemäße Wohnraum- und Bodenpolitik ausgelotet.

This article argues that Hannah Arendt’s essay “Civil Disobedience” contains a critique of white constitutionalism. A close reading of Arendt’s comments on the failure of Reconstruction to durably found Black citizenship reveals that the anti-Blackness of her account does not consist in ignoring the racialization of constitutional order but, to the contrary, in a dismissal of Black politics due to the limitations of a white constitutional heritage. In “Civil Disobedience,” Arendt thus stood on the edge of an insight that she (...) failed to develop more fully: Black movements had brought to light the limitations that racial domination places on the “augmentation” of America’s founding principles. For Arendt, the notion of the “principle” is meant to mediate the novelty of action with the durability of order. But to the extent that she views American institutions as defined by the “inherited crime” of slavery, feedback across temporal strata—between a principle in past, present, and future—is structurally blocked. The symbolic whiteness of citizenship undermines institutional durability, as it generates a crisis of constitutional authority for all. Tracing the sources behind Arendt’s pessimistic vision, the article demonstrates echoes between her account and the literature on which she relied: Tocqueville; Stanley Elkins; and, possibly, W. E. B. Du Bois. It concludes with a reading of Arendt’s commentary on Reconstruction as the attempt to recover a lost moment of foundation, an unredeemed promise of refounding. (shrink)

Over the last decade, the increased use of work teams within organizations has been one of the most influential and far-reaching trends to shape the business world. At the same time, corporations have continued to struggle with increased unethical employee behavior. Very little research has been conducted that specifically examines the developmental aspects of employee ethical decision-making in a team environment. This study examines the impact of a team leader’s perceived integrity on his or her subordinates’ behavior. The results, which (...) came from a survey of 245 MBA students functioning for 2 years in a work team environment, indicate an interaction between leader integrity and team member ethical intentions. Germany's leading contemporary social theorist provides a definitive analysis of art as a social and perceptual system which not only represents an important intellectual step in discussions of art but also an important advance in systems theory. Luhmann insists on the radical incommensurability between psychic systems (perception) and social systems (communication). This paper develops an empirically grounded, processual view of corporate social performance (CSP) by analyzing how internal organizational processes affect a firm’s social performance. Based on two case studies, we argue that changes in a firm’s social performance are triggered by continuously reoccurring instances of poor fit between the firm’s routines and its institutional environment. We propose that reactive change processes, initiated by stakeholder critique threatening the organization’s legitimacy, will result in isomorphic type of social performance changes. In comparison, proactive (...) change processes, initiated by slack resources, are more likely to result in nonisomorphic type of social performance changes. Furthermore, we propose that top-down driven processes will result in structural social performance changes in the direction of internationally influential stakeholders’ demands, while bottom-up driven processes will result in output social performance changes in the direction of locally influential stakeholders’ demands. This paper provides an account of the paradoxes of teaching democracy, the paradoxes of being a citizen in a liberal democracy, and the insights that can be gained from the model of citizenship that T.H. Green promoted. Green thought citizenship was predicated on the twin foundations of the community and the common good. Freedom for Green means individual self-determination coupled with recognition of the dependency relations between individuals and the community. Green is noteworthy not only as a theorist but also (...) as an active contributor to the development of public schools in England. A consideration of his arguments provides a model for educating citizens, addresses the paradoxes of democracy in education, and reveals elements of his philosophy that are relevant to educational issues today. Bien que les théoriciens du « retour du politique»s’efforcent de penser l’agir selon ses propres termes, c’est-à-dire en l’absence de fondements philosophiques, ils invoquent fréquemment des récits eurocentriques au sujet de l’histoire occidentale pour justifier la force critique de leur mode de pensée. La première partie de cet article met en évidence ce provincialisme du politique tel qu’il est en jeu chez Claude Lefort et Cornelius Castoriadis. Dans un deuxième moment, je présente la rencontre entre Socialisme ou Barbarie et la (...) tendance Johnson Forest, autour de C. L. R. James et Grace Lee Boggs, comme une occasion de dépasser ce provincialisme, en esquissant une contre-histoire à la fois partagée et divisée au sein des espaces transnationaux de l’Atlantique noir. Enfin, une troisième partie organise un dialogue entre le « retour du politique » et des contributions récentes en théorie décoloniale qui, s’inspirant de Merleau-Ponty, visent à repenser l’universel au-delà de ses enchevêtrements avec la domination coloniale. This essay explores the modernist aesthetic involved in creating a fictive, nostalgic, childhood experience. Evoking the experience of childhood through fiction is as close to actually reliving childhood as we can get. The author argues that it is possible to actually transport the reader into not only the idealized world of childhood, but more so into an embodied experience of childhood through the use of different kinds of narrative and stylistic configurations. In a stylistic and narratological analysis of three modernist (...) novels, Virginia Woolf’s The Waves, Tarjei Vesaas’ The Ice Palace [Is-slottet] and William Faulkner’s The Sound and the Fury, the author explores the different ways that literature can create the very experience of childhood through literary style. The strategies involved in establishing a fictive experience of childhood extend from narratological choices such as free indirect style, strict focalization through a child in the narrative to the use of a child-like temporality, the hyperbolic use of phenomena, and an emphasis of the sensorial aspects of perception. abstract Even though much research has been devoted to studies of safety, the concept of safety is in itself under‐theorised, especially concerning its relation to epistemic uncertainty. In this paper we propose a conceptual analysis of safety. The paper explores the distinc‐tion between absolute and relative safety, as well as that between objective and subjective safety. Four potential dimensions of safety are discussed, viz. harm, probability, epistemic uncertainty, and control. The first three of these are used in the proposed definition (...) of safety, whereas it is argued that control should not be included in a reasonable definition of safety. It is shown that strictly speaking, an objective safety concept is not attainable. Instead, an intersubjective concept is proposed that brings us as close as possible to an objective concept. Moore's Open Question Argument has been heavily debated ever since it was presented over 100 years ago. In the current paper, it is argued that for the realist, and contrary to the received view by many theorists in the debate, the argument in fact lends strong support for non-naturalism. In particular, David Brink's naturalist defense utilizing direct reference theory is scrutinized. It is argued that an application of direct reference to moral kinds, rather than defusing the Open Question Argument, actually (...) underscores the non-naturalist conclusion. The naturalist argument depends heavily on the analogue between natural kinds and moral kinds. It is argued that the Open Question Argument provides prima facie evidence against the idea that moral kinds are natural kinds, and that the naturalist arguments do not overturn this evidence. Moreover, it is argued that similar reasons to those which render direct reference unviable for moral terms also meet two further potential objections against the Open Question Argument, and it is concluded that the argument carries considerable force against the moral naturalist. Thick concepts provide a focal point for several important issues in ethical theory. Separatists argue that the descriptive and evaluative elements of a thick concept can be separated out. Non-separatists deny this and claim that there are no descriptive boundaries delimiting a thick concept. A common strategy for both camps in the debate has been an appeal to armchair intuitions of various everyday thick concepts. My alternative strategy consists in a closer study of the professional practice of risk analysis. As (...) a well-developed practice, it provides substantial material for analysis. Moreover, its central concepts of risk and safety are typically seen as scientific concepts fitting the separatist analysis. Still, I argue that there are several evaluative aspects in risk and safety ascription that are hard to account for on a separatist analysis. I consider three separatist strategies, and conclude that they all fail. The result is a corroboration of the general non-separatist thesis put forward by theorists such as John McDowell and Bernard Williams. (shrink)

AimsTo examine attitudes towards physician-assisted suicide (PAS) among physicians in Sweden and compare these with the results from a similar cross-sectional study performed in 2007.ParticipantsA random selection of 250 physicians from each of six specialties (general practice, geriatrics, internal medicine, oncology, surgery and psychiatry) and all 127 palliative care physicians in Sweden were invited to participate in this study.SettingA postal questionnaire commissioned by the Swedish Medical Society in collaboration with Karolinska Institute in Stockholm. ResultsThe total response rate was 59.2%. Slightly (...) fewer than half [47.1% (95% CI 43.7–50.5)] of the respondents from the six specialties accepted PAS, which is significantly more than accepted PAS in the 2007 study [34.9% (95% CI 31.5–38.3)]. Thirty-three percent of respondents were prepared to prescribe the needed drugs. When asked what would happen to the respondent’s own trust in healthcare, a majority [67.1% (95% CI 63.9–70.3)] stated that legalizing PAS would either not influence their own trust in healthcare, or that their trust would increase. This number is an increase compared to the 2007 survey, when just over half [51.9% (95% CI 48.0–55.2)] indicated that their own trust would either not be influenced, or would increase.ConclusionsThe study reveals a shift towards a more accepting attitude concerning PAS among physicians in Sweden. Only a minority of the respondents stated that they were against PAS, and a considerable proportion reported being prepared to prescribe the needed drugs for patient self-administration if PAS were legalized. This book involves an in-depth analysis of the ethical, political and philosophical issues related to health-oriented screening programs.

Ever since the inception of its academic career, sociology has approached its subject-matter in two different ways; one positivist, the other critical. Important theories, such as those of Karl Marx or Emile Durkheim, have always emphasized either one of these perspectives, but could never completely ignore the other one. The result was that as an empirical science, sociology has been interested in latent structures, while as critical theory, it has pointed out that social reality is not what it seems to (...) be. Therefore, all attempts at building a unified theory of society on the basis of the critical/positivist distinction had to lead into the paradox of treating appearance and reality, or latent and manifest structures, as one and the same thing. This situation is now changing in radical ways which sociology has yet to appreciate. I am referring to recent interdisciplinary discussions about theories of self-referential systems, autopoietic system closure, the second-order cybernetics of observing systems, and constructivist epistemology and information processing. We can draw upon these recent discussions in order to understand society as a self-observing system that defines its own identity while, at the same time, leaving an "unmarked space" for the possibility to describe society in quite different ways. This article explores one central assumption that is guiding large portions of contemporary (analytic) moral philosophy: the idea that moral philosophy has to be forward-looking and action-guiding. By paying attention to a number of examples, it is argued that this guiding assumption flies in the face of important aspects of actual moral life. Moral situations are not (always) of the nature that we can plan for them, and reason about them in advance. Rather, the moral reality, or the moral contexts, (...) are often such that the moral situation is created in the scene, and hence something that is only available to reflect upon in hindsight. There are, at least, two central reasons why this is so: The first is that the sense, meaning, of the actions and the concepts we use in reflection about them, are not locked beforehand, and our understanding of them are formed in the process. The second reason is that moral situations come about in a responsive, rather than planned, way. That is, we discover our moral world by means of our reactive interactions, rather than in theoretical reflection that aims to produce “anticipated beliefs.” Thus, this article suggests a way of exploring morality’s backward-looking nature that does not misrepresent moral reality. This article reads the work of Luiz Gama (1830-1882), the Brazilian abolitionist, former slave, and self-taught lawyer, as both theorizing and enacting a politics of institutional prefiguration. Against oligarchic domination by slave-owning elites and the monarchical rule of the Brazilian Emperor, Gama defended a radical republican vision of the law: the ‘right of revolution’ (direito de revolução), which he saw as already being practiced in acts of resistance. Repurposing the legal pluralism of Friedrich Carl von Savigny for emancipatory politics, Gama’s (...) provocation – his insurgent legality – consisted in envisioning the resistance of the enslaved as an inaugural site for a republican order in the making. More than strategically mobilizing law in freedom suits, Gama presented the self-organization of maroons as both defending usurped rights, inherited from Roman law, and laying the foundations of an emergent republic. Drawing on broader currents of plebeian republicanism in the Atlantic world, he conceptualized the resistance of the enslaved as a ‘civic virtue.’ Gama’s insurgent legality thereby recasts the relation between prefigurative politics and institutional forms, questioning dichotomies of resistance and order, rupture and durability. Beyond nineteenth-century Brazil, Gama’s institutional thought speaks to debates in contemporary radical democratic and republican theory. (shrink)
