Increases in international travel and migratory flows have enabled infectious diseases to emerge and spread more rapidly than ever before. Hence, it is increasingly easy for local infectious diseases to become global infectious diseases (GIDs). National governments must be able to react quickly and effectively to GIDs, whether naturally occurring or intentionally instigated by bioterrorism. According to the World Health Organisation, global partnerships are necessary to gather the most up-to-date information and to mobilize resources to tackle GIDs when necessary. Communicable (...) disease control also depends upon national public health laws and policies. The containment of an infectious disease typically involves detection, notification, quarantine and isolation of actual or suspected cases; the protection and monitoring of those not infected; and possibly even treatment. Some measures are clearly contentious and raise conflicts between individual and societal interests. In Europe national policies against infectious diseases are very heterogeneous. Some countries have a more communitarian approach to public health ethics, in which the interests of individual and society are more closely intertwined and interdependent, while others take a more liberal approach and give priority to individual freedoms in communicable disease control. This paper provides an overview of the different policies around communicable disease control that exist across a select number of countries across Europe. It then proposes ethical arguments to be considered in the making of public health laws, mostly concerning their effectiveness for public health protection. (shrink)

The Exchange of Words is a philosophical exploration of human testimony, specifically as a form of intersubjective understanding in which speakers communicate by making themselves accountable for the truth of what they say. This account weaves together themes from philosophy of language, moral psychology, action theory, and epistemology, for a new approach to this basic human phenomenon.

In this paper I address the relationship between Hegel and Heidegger from the perspective of the dialectic between end and beginning. After the introduction, in the second part of the paper I analyze Hegel’s position in the history of being as the beginning of the end of metaphysics. Afterwards I address Heidegger’s interpretation of the beginning of Hegel’s Logic, showing how the essential beginning is the end of the completed system. In the fourth part of the text, I discuss how (...) Heidegger wants to position himself in relation to Hegel, mainly examining their different interpretation of negativity and initiality. I will argue that the key word for understanding their different positions is “event”. Whereas Hegel’s system leaves no room for any beginning as event, but every beginning is reabsorbed by the finished and concluded system, for Heidegger thought must time and time again make itself initial and evential. The aim of this paper is to analyse teledildonics from a phenomenological perspective in order to show the possible effects they will have on ourselves and on our society. The new way of using digital technologies is to merge digital activities with our everyday praxes, and there are already devices which enable subjects to be digitally connected in every moment of their lives. Even the most intimate ones are becoming mediated by devices such as teledildonics which digitally provide a tactual (...) stimulation allowing users to have sexual intercourse through them. The efforts made in order to provide such an intertwinement of our everyday lives and digital technologies are evident, but the effects produced by them are not clear at all. This paper will analyse these technologies from a phenomenological perspective in order to understand their effects on the constitution of the subjects and on our society at the intimate level. In the present article, I introduce Husserl’s analyses of ‘natural causality’ and ‘volitional causality’, which are collected in the volume ‘Wille und Handlung’ of the Husserliana edition Studien zur Struktur des Bewußtseins. My aim is to show that Husserl’s insight into these phenomena enables us to understand more clearly both the specificity of, and the relation between, the motivational nexus belonging to the sphere of the will in contrast with the causal laws of nature. In light of this understanding, in (...) the last part of the article I reflect on whether and to what extent there is, in fact, an ontological and epistemological compatibility between volitional causality and natural causality. Background: Compassion fatigue is recognized as impacting the health and effectiveness of healthcare providers, and consequently, patient care. Compassion fatigue is distinct from “burnout.” Reliable measurement tools, such as the Professional Quality of Life scale, have been developed to measure the prevalence, and predict risk of compassion fatigue. This study reviews the prevalence of compassion fatigue among healthcare practitioners, and relationships to demographic variables. Methods: A systematic review was conducted using key words in MEDLINE, PubMed, and Ovid databases. Data were (...) extracted from a total of 71 articles meeting inclusion criteria, from studies measuring compassion fatigue in healthcare providers using a validated instrument. Quantitative and qualitative data were extracted and compiled by three independent reviewers into an evidence table that included basic study characteristics, study strength and quality determination, measurements of compassion fatigue, and general findings. Meta-analysis, where data allowed, was stratified by Professional Quality of Life version, heterogeneity was quantified, and pooled means were reported with 95% confidence interval. A table of major study characteristics and results was created. Ethical consideration: This paper contains no primary data obtained directly from research participants. Data obtained from previously published resources have been acknowledged within references. Psychological distress, particularly compassion fatigue, can be insidious, no health profession is immune, and may significantly impact the ability to provide care. Results: A total of 71 studies were included. Compassion fatigue was reported across all practitioner groups studied. Relationships to most demographic variables such as years of experience and specialty were either not statistically significant or unclear. Variability in reporting of Professional Quality of Life results was found. Interpretation: Compassion fatigue exists across diverse practitioner groups. Prevalence is highly variable, and its relationship with demographic, personal, and/or professional variables is inconsistent. Questions are raised about how to mitigate compassion fatigue. (shrink)

Moral and legal philosophy are too entangled: moral philosophy is prone to model interpersonal moral relationships on a juridical image, and legal philosophy often proceeds as if the criminal law is an institutional reflection of juridically imagined interpersonal moral relationships. This article challenges this alignment and in so doing argues that the function of the criminal law lies not fundamentally in moral blame, but in regulation of harmful conduct. The upshot is that, in contrast to interpersonal relationships, the criminal law (...) cannot lose its standing to blame through institutional analogues of hypocrisy, complicity, and meddling. Rather, certain forms of structural and severe historical and contemporary injustice point to the question of the overall legitimacy of state authority. (shrink)

In this paper we discuss the role that individual and collective acts of interpretation play in shaping a metaphysics of food. Our analysis moves from David Kaplan’s recent contention that food is always open to interpretation, and substantially expands its theoretical underpinnings by drawing on recent scholarship on food and social ontology. After setting up the terms of the discussion (§1), we suggest (§2) that the contention can be read subjectively or structurally, and that the latter can be given three (...) sub-readings. We then lay out (§3) three case studies that, we submit, any viable theory of a metaphysics of food should be able to account for. We show that one structural reading—based on the idea of negotiation—swiftly accommodates for the three case studies. We thus conclude that this reading is most promising for charting a metaphysics of food. (shrink)

BackgroundObtaining consent has become a standard way of respecting the patient’s rights and autonomy in clinical research. Ethical guidelines recommend that the child’s parent/s or authorised legal guardian provides informed consent for their child’s participation. However, obtaining informed consent in paediatric research is challenging. Parents become vulnerable because of stress related to their child’s illness. Understanding the views held by guardians and researchers about the consent process in Malawi, where there are limitations in health care access and research literacy will (...) assist in developing appropriate consent guidelines.MethodsWe conducted 20 in-depth interviews with guardians of children and research staff who had participated in paediatric clinical trial and observational studies in acute and non-acute settings in the Southern Region of Malawi. Interviews were audio-recorded, transcribed verbatim, and thematically analysed. Interviews were compared across studies and settings to identify differences and similarities in participants’ views about informed consent processes. Data analysis was facilitated by NVIVO 11 software.ResultsAll participants across study types and settings reported that they associated participating in research with therapeutic benefits. Substantial differences were noted in the decision-making process across study settings. Guardians from acute studies felt that the role of their spouses was neglected during consenting, while staff reported that they had problems obtaining consent from guardians when their partners were not present. Across all study types and settings, research staff reported that they emphasised the benefits more than the risks of the study to participants, due to pressure to recruit. Participants from non-acute settings were more likely to recall information shared during the consent process than participants in the acute setting.ConclusionThe health care context, culture and research process influenced participants’ understanding of study information across study types and settings. We advise research managers or principal investigators to define minimum requirements that would not compromise the consent process and conduct study specific training for staff. The use of one size fits all consent process may not be ideal. More guidance is needed on how these differences can be incorporated during the consent process to improve understanding and delivery of consent.Trial registration Not applicable. (shrink)

Dignity plays a crucial role as both a fundamental value and as an end state in the process of humanizing organizational cultures, workplaces and relationships. However, despite its significance, it has yet to be addressed properly in the growing discourse on humanistic capitalism and management, and indeed in business ethics as a whole. The aim of this work is to analyze the constitution of a new collective subject thanks to wearable computers. Wearable computers are emerging technologies which are supposed to become pervasively used in the near future. They are devices designed to be on us every single moment of our life and to capture every experience we have. Therefore, we need to be prepared to such intrusive devices and to analyze potential effect they will have on us and our society. Thanks to (...) a phenomenological and postphenomenological analysis, we will show how these technologies are able to generate a new collective subject with its different collective needs and appetites by merging the living body of many subjects into one. Nicola Lacey presents a new approach to the question of the moral justification of punishment by the State. She focuses on the theory of punishments in context of other political questions, such as the nature of political obligation and the function and scope of criminal law. Arguing that no convincing set of justifying reasons has so far been produced, she puts forward a theory of punishments which places the values of the community at its centre.

In this article we argue that the social value of health research should be conceptualized as a function of both the expected benefits of the research and the priority that the beneficiaries deserve. People deserve greater priority the worse off they are. This conception of social value can be applied for at least two important purposes: in health research priority setting when research funders, policy-makers, or researchers decide between alternative research projects; and in evaluating the ethics of proposed research proposals (...) when research ethics committees assess whether the social value of the research is sufficient to justify the risks and burdens to research participants and others. In assessing how far a proposed research project will advance the interests of people who are more disadvantaged, research priority setters and RECs should examine the diseases that the research targets and the type of research. Just as certain diseases impose a greater burden on people who are more disadvantaged, so certain types of intervention and forms of research are more likely to benefit people who are more disadvantaged. We outline which populations are likely to be representative of the global worst off and identify what types of health research, and which disease categories, are priorities for these populations. A common view is that self-identity is essential to objects if anything is. Itself a substantive metaphysical view, this is a position of some import in wider debates, particularly in connection with such problems as physicalism and personal identity. In this article I challenge the view. I distinguish between two accounts of essence, the modal and the definitional, and argue that self-identity is essential to objects on the former but not on the latter. In so doing, I first present Husserl’s universal characterization of action (_Handlung_) as a volitional process (_willentlicher Vorgang_). Then, after clarifying what it means for a process to have a character of volitionality (_Willentlichkeit_), I illustrate the various types (...) of actions, which Husserl distinguishes as ‘straightforward’ (_schlicht_) or ‘deciding’ (_entscheidend_), ‘primary’ (_primär_) or ‘secondary’ (_sekundär_), ‘inner’ (_innere_) or ‘outer’ (_äußere_), ‘immediate’ (_unmittelbar_) or mediate (_mittelbar_), ‘simple’ (_einfach_) or ‘compound’ (_zusammengesetzt_). This attitude was closely connected with the situation of science and philosophy, both of which, a century ago, spoke the language of necessity. Science believed that the facts of nature formed an endless chain of cause and effect, each link of which was determined by the preceding one and in turn infallibly determined the following one, so as to make a rigid system from which no part or element of reality could escape. Science believed that causality in its most rigorous (...) and deterministic sense was the only valid principle that explained natural phenomena; and it measured the success of its work to the extent that it discovered this necessary causal connection. On the other hand, the two great trends of philosophy, positivism and idealism, spoke a similar language: positivism extended causal determinism to the entire scope of reality, and idealism replaced it with a dialectical-rational determinism which was not less necessitating. It is true that these two trends were engaged in bitter controversy, the one speaking of nature or matter, the other of spirit or reason; the one placing mankind, the other infinite Reason, as the ultimate aim and climax of the development of reality. But in spite of their polemics and controversies, the horizon in which both these trends moved was the same: that of necessity. Everything that happens, in nature or in history, must necessarily happen. Every phenomenon, every event, every characteristic or determination of reality is exactly what it should be by virtue of the infinite principle that governs reality itself. This infinite principle was interpreted by positivism in terms of mechanical causality, and by idealism in terms of dialectic rationality; but this diversity of interpretation made no difference on the fundamental point, which was the necessity of reality as such. This necessity meant that any fact or happening, in nature or in history, was fully justified by the mere fact that it was a fact or a happening: at that particular point of the uninterrupted chain of facts, it was the only thing that could and should have happened. Accordingly, each fact or event was an improvement and a progress over the preceding ones, and in turn anticipated a further progress. Progress itself seemed necessary and infallible; and those events which seemingly belied it were actually a promise or a preparation for a greater future progress. (shrink)

Husserl’s official account of essence is modal. It is also, I submit, incompatible with the role that essence is supposed to play, especially relative to necessity, in his overall philosophy. In the Husserlian framework, essence should rather be treated as a non-modal notion. The point, while not generally acknowledged, has been made before (by Kevin Mulligan for one); yet the arguments given for it, though perhaps sound, are not Husserlian. In this paper I present a thoroughly Husserlian argument for that (...) claim, as well as a Husserlian essentialist account of necessity. I also discuss the role of grounding within the account. In this paper, the author suggest that the historical and institutional conditions of existence of the concepts which animate legal argumentation – like the historical and institutional conditions of existence of certain forms of law – are of interest not only in their own right, but also because they raise methodological issues for jurisprudence. These include questions about the relationship between concepts and the social phenomena which they purport to categorise; about the relationship between philosophical and other forms of legal (...) theory; and about how a jurisprudence largely dominated by philosophical methods may be brought into productive dialogue with other forms of theoretical analysis. Only by broadening both its horizons and its methods, the author argues, will jurisprudence be capable of illuminating not only doctrinal analysis within particular jurisdictions at particular times, but also comparative and historical scholarship. Wellner’s article aims at changing an essential element within phenomenology by introducing the idea of digital imagination. Assuming her thesis, I aim to raise two possible kinds of questions generated by the introduction of a technologically embedded imagination which is externalized.

As universities are increasingly called by their national governments for a more entrepreneurial management of public research results, they started to develop internal structures and policies to take a proactive role in the commercialisation of university research. For the first time, this paper presents a detailed chronicle of how country-level reforms on Intellectual Property Rights were translated into organisation-level mechanisms to regulate university-patenting activity. The analysis is based on the complete list of patent policies issued between 1993 and 2009 by (...) the population of Italian universities. Our evidence suggests that universities first dealt with legislative changes on IPRs by enacting isomorphic behaviours, then by creating a community of practices, and finally by leveraging on such community to influence government reforms on IP-related matters. We discuss our results in the light of institutional theory and public policy. (shrink)

Model checking, a prominent formal method used to predict and explain the behaviour of software and hardware systems, is examined on the basis of reflective work in the philosophy of science concerning the ontology of scientific theories and model-based reasoning. The empirical theories of computational systems that model checking techniques enable one to build are identified, in the light of the semantic conception of scientific theories, with families of models that are interconnected by simulation relations. And the mappings between these (...) scientific theories and computational systems in their scope are analyzed in terms of suitable specializations of the notions of model of experiment and model of data. Furthermore, the extensively mechanized character of model-based reasoning in model checking is highlighted by a comparison with proof procedures adopted by other formal methods in computer science. Finally, potential epistemic benefits flowing from the application of model checking in other areas of scientific inquiry are emphasized in the context of computer simulation studies of biological information processing.
