The central objection to neo-Lockeanism about persons is the too many thinkers problem: NLP ends up with an absurd multiplication of thinkers. Sydney Shoemaker attempts to solve this problem by arguing that the person and the animal do not share all of the same physical properties. This, according to him, leads to the idea that mental properties are realized in the person’s physical properties only. The project of this paper is to reject Shoemaker’s physicalist solution to the too many (...) thinkers problem. I first argue that his physicalism fails to explain why two physically indistinguishable objects differ in their persistence conditions and physical properties. I then argue that Shoemaker illicitly treats the case of the person and the case of the animal differently, first in regard to cerebral function and its relation to mental properties, and second in regard to brainstem function and its relation to biological properties. This shows that Shoemaker’s solution actually undermines his entire argument. (shrink)

The neo-Lockean justification of the highly unequal distribution of income in capitalist societies is based upon two key premises: that people are the rightful owners of their labor and talents, and that the external world was, in the state of nature, unowned, and therefore up for grabs by people, who could rightfully appropriate parts of it subject to a ‘Lockean proviso.’ The argument is presented by Nozick. Counter-proposals to Nozick’s, for the most part, have either denied the premise that people (...) should morally be viewed as the owners of their talents, or have challenged Nozick’s Lockean proviso.Rawls, and to a more limited extent Ronald Dworkin, deny self-ownership. As Rawls writes: ‘…the difference principle represents, in effect, an agreement to regard the distribution of natural talents as a common asset … The naturally advantaged are not to gain merely because they are more gifted, but only to cover the costs of training and education and for using their endowments in ways that help the less fortunate as well. No one deserves his greater natural capacity nor merits a more favorable starting place in society.’ Behind the Rawlsian veil of ignorance, those who deliberate about justice are deprived of knowledge about characteristics whose distribution is morally arbitrary. In Dworkin’s proposal for resource egalitarianism, agents calculate the insurance policy they would hypothetically ask for, were they denied knowledge of what talents they will draw in the birth lottery. Compensation for unequal talents is, according to Dworkin, properly made by taxing and transferring income according to the way it would have been distributed as a consequence of such insurance. Dworkin’s veil of ignorance is thin, because agents in the appropriate posture for deliberating about income distribution know their preferences and attitudes toward risk, but not their talents. For both Rawls and Dworkin, the self-ownership premise is challenged by constructing a veil of ignorance in which people are deprived of knowledge of certain personal characteristics, knowledge of which would bias their opinions, from a moral viewpoint. In ‘Animalism versus Lockeanism: a Current Controversy’, The Philosophical Quarterly, 48 (1998), pp. 302–18, Harold Noonan examined the relation between animalist and neo‐Lockean theories of personal identity. As well as presenting arguments intended to support a modest compatibilism of animalism and neo‐Lockeanism, he advanced a new proposal about the relation between persons and human beings which was intended to evade the principal animalist objections to neo‐Lockean theories. I argue both that the arguments for compatibilism are without force, and (...) that Noonan’s new neo‐Lockean proposal is inadequate. (shrink)

My purpose is to explore the possible lines of reply available to a defender of the neo‐Lockean position on personal identity in response to the recently popular ‘animalist’ objection. I compare the animalist objection with an objection made to Locke by Bishop Butler, Thomas Reid and, in our own day, Sydney Shoemaker. I argue that the only possible response available to a defender of Locke against the Butler–Reid–Shoemaker objection is to reject Locke's official definition of a person as a thinking, (...) intelligent thing and replace it with the concept of the self– the object of self‐reference – and that this response is equally obligatory for the neo‐Lockean in replying to the animalist. I explore other possibilities, including the position that there is no sense in talking about personal identity at all. (shrink)

This book explores a neglected philosophical question: How do groups of interacting minds relate to singular minds? Could several of us, by organizing ourselves the right way, constitute a single conscious mind that contains our minds as parts? And could each of us have been, all along, a group of mental parts in close cooperation? Scientific progress seems to be slowly revealing that all the different physical objects around us are, at root, just a matter of the right parts put (...) together in the right ways: How far could the same be true of minds? This book argues that we are too used to seeing the mind as an indivisible unity and that understanding our place in nature requires being willing to see minds as composite systems, simultaneously one conscious whole and many conscious parts. In thinking through the implications of such a shift of perspective, the book relates the question of mental combination to a range of different theories of the mind (in particular panpsychism, functionalism, and Neo-Lockeanism about personal identity) and identifies, clarifies, and addresses a wide array of philosophical objections (concerning personal identity, the unity of consciousness, the privacy of experience, and other issues) that have been raised against the idea of composite minds. The result is an account of the metaphysics of composition and consciousness that can illuminate many different debates in philosophy of mind, concerning split brains, collective intentionality, and the combination problem, among others. We argue that animalism is the only materialist account of personal identity that can account for the autonomy that we typically think of ourselves as possessing. All the rival materialist theories suffer from a moral version of the problem of too many thinkers when they posit a human person that overlaps a numerically distinct human animal. The different persistence conditions of overlapping thinkers will lead them to have interests that conflict, which in many cases prevents them both from autonomously forming (...) and acting on the same intentions. These problems are exacerbated by problems of self-reference plaguing the overlapping thinkers. We contend that the impossibility of simultaneous autonomous action by animals and persons provides a reason to favor animalism over Neo-Lockeanism, Four-Dimensionalism, Constitution theory, and brain-size views of the person. We anticipate and reject arguments that the autonomy of the person and the animal can be shown to be compatible by relying upon either the Parfitian thesis that identity isn’t what matters or claiming that animals acquire the interests of the person they constitute. I consider whether there is a plausible conception of personal identity that can accommodate the ‘Multiplicity Thesis’ (MT), the thesis that some ways of creating and deploying multiple distinct online personae can bring about the existence of multiple persons where before there was only one. I argue that an influential Kantian line of thought, according to which a person is a unified locus of rational agency, is well placed to accommodate the thesis. I set out such a line of thought (...) as developed by Carol Rovane, and consider the conditions that would have to be in place for the possibility identified by MT to be realised. Animalism is the theory that we are animals: in other words, that each of us is numerically identical to an animal. An alternative theory maintains that we are not animals but that each of us is constituted by an animal. Call this alternative theory neo-Lockean constitutionalism or Lockeanism for short. Stephan Blatti (2012) offers to advance the debate between animalism and Lockeanism by providing a new argument for animalism. In this note, we present our own objection to Blatti's (...) argument, and argue that Carl Gillett's earlier reply misses the fundamental problem. We also use Blatti's argument to illustrate a common methodological error, namely, uncritical deference to best theories from other disciplines. (shrink)

Research has shown that individuals with high levels of psychopathic personality traits are likely to cause harm to others in the workplace. However, there is little academic literature on the potentially adaptive outcomes of corporate psychopathy, particularly because the “boldness” psychopathy domain has largely been under-acknowledged in this literature. This study aimed to elaborate on past findings by examining the associations between psychopathy, as operationalized using scales from the relatively new triarchic model of psychopathy, and both adaptive and maladaptive workplace (...) behaviors. Participants were 343 working community adults who completed a series of self-report questionnaires that measured psychopathy and various workplace behaviors, including counterproductive work behaviors, tactics of influence, unethical decision-making, leadership strategies, team play, and creativity. Structural equation modeling was used to estimate the associations between latent constructs of boldness, meanness, and disinhibition, and the eight different constructs related to workplace behaviors. It was found that boldness preferentially predicted the use of soft tactics of influence, adaptive leadership, and team play, and negatively predicted passive leadership. Meanness predicted unethical decision-making, poor team play, and hard tactics of influence. Disinhibition positively predicted CWB and passive leadership. Meanness also moderated the association between disinhibition and CWB, in that greater scores on both psychopathy domains indicated greater levels of CWB. These findings provide conceptual support for the triarchic model, including the “boldness” domain, which measures adaptive aspects of psychopathy in addition to maladaptive ones, as well as suggest that not all individuals high on psychopathy would be an overt menace to the workplace. The different psychopathy traits may also interact with each other to predict different types or levels of workplace behaviors. (shrink)

The administration or recognition of religious courts is a form of religious accommodation present in many constitutional states today commonly analysed in legal pluralism terms. This article contributes to the further analysis of the relationship between legal pluralism and rights in religiously diverse societies by examining the status of state religious courts and their interaction with state non-religious courts. In particular, I examine what Cover calls “jurisdictional redundancies” between the courts and conceptualize the allocation of power between religious and non-religious (...) courts as a potentially productive site of interlegality. In doing so, I support concurrent jurisdictional allocations, arguing that exclusive jurisdiction could result in what I call an interlegal gap, whereby instead of inter-penetration of norms and production of reconciliatory principles, there is a justice gap whereby litigants may find themselves unable to obtain appropriate legal recourse including when neither court is willing to assume jurisdiction over the matter. This requires us to see the relationship between religious courts and non-religious courts through the more mundane but more practical lens of jurisdictional overlaps and competition, rather than through the more abstract framing of normative or even civilizational clashes. Accordingly, I argue that concurrent jurisdiction and interlegality have greater potential to strike a balance between individual and group rights and could be more protective of religious diversity. In other words, I argue for a closer, rather than a more separate, relationship between religious and non-religious courts, while denying that a hierarchical relationship where religious courts are subordinated to non-religious courts is the only way to protect rights. The paper presents an account of the concept of existence that is based on Brentano’s work. In contrast to Frege and Russell, Brentano took ‘exists’ to express a that subsumes objects and explained it with recourse to the non-propositional attitude of acknowledgment. I argue that the core of Brentano’s view can be developed to a defensible alternative to the Frege-Russell view of existence.

In natural kind debates, Boyd's famous Homeostatic Property Cluster theory (HPC) is often misconstrued in two ways: Not only is it thought to make for a normative standard for natural kinds, but also to require the homeostatic mechanisms underlying nomological property clusters to be uniform. My argument for the illegitimacy of both overgeneralizations, both on systematic as well as exegetical grounds, is based on the misconstrued view's failure to account for functional kinds in science. I illustrate the combination of these (...) two misconstruals with recent entries into the natural kind debate about emotions. Finally, I examine and reject Stich's "Kornblith-Devitt method" as a potential justification of these misconstruals. (shrink)

Guided by Basic Psychological Need Theory, we investigated the combined associations between need satisfaction and need frustration and their relations with theoretically relevant correlates including mindfulness, physical literacy, physical activity enjoyment, and physical activity. The participants were Singapore-based school students who completed a cross-sectional survey. The results of the latent profile analysis identified four distinct need profiles: profile 1–average satisfaction and frustration ; profile 2–low satisfaction, above average frustration; profile 3–very high satisfaction, very low frustration ; and profile 4–high satisfaction, (...) very high frustration. Among these, profile 3 was the most adaptive one; it had the highest levels of mindfulness, physical literacy, physical activity enjoyment, and moderate-to-vigorous physical activity. Experiences of need satisfaction countered the negative effects of need frustration on these correlates. These findings enhance our understanding of students’ psychological need experiences and highlight the need for investigating the combined associations between need satisfaction and need frustration. Lockean approaches to property take it that persons can unilaterally acquire private ownership over hitherto unowned resources. Such natural law accounts of property rights are often thought to be of limited use when dealing with the complexities of natural resource use outside of the paradigm of private ownership of land for agricultural or residential development. The tragedy of the commons has been shown to be anything but an inevitability, and yet Lockeanism seems to demand that even the most robust (...) common property arrangements be converted to privatized units. This often motivates a move away from natural law in the moral analysis of property rights. I argue however that it is not the deontological nature of Lockean principles that are at fault, but rather the manner of their application. Lockean theory often exhibits a bias in favour of private property: assuming that only private property can protect one’s interest in autonomy, and therefore asserting that each individual has a power of private acquisition. Starting with a claim against interference however enables us to mould the appropriate property rights to each individual’s particular interest in autonomy. This sometimes leads to private ownership, but often leads to various forms of commons. (shrink)

The Moscow Psychological Society, a learned society founded in 1885 at Moscow University, was the philosophic center of the revolt against positivism in the Russian Silver Age. In 1889 it began publication of Russia's first regular, specialized journal in philosophy, Questions of Philosophy and Psychology. By the end of its activity in 1922, the Psychological Society had included most of the country's outstanding philosophers and had played the major role in the growth of professional philosophy in Russia. ;While the Silver (...) Age mounted a broad-based revolt against positivism, neo-idealist philosophy in the Psychological Society was distinctive in the theoretical depth of its critique. For leading philosophers in the Society , neo-idealism was a compelling defense of the self against positivist reductionism and naturalism, a defense that took the form, moreover, of a modernized, theoretically explicit theism, in which the value of the person is rooted in transcendent being . In this, neo-idealism promoted not only the autonomization and professionalization of Russian philosophy but also the theoretical development of Russian liberalism. ;This dissertation argues: that a learned society of philosophers had special significance in Russia, where the frail social foundations of liberalism made its intellectual defense all the more imperative; that the Psychological Society, especially in its programmatic symposium, Problems of Idealism , was integrally involved in the Russian Liberation Movement; that the neo-idealist development of Russian liberalism drew heavily on Kant, in its substantiation of the possibility of personalism and in its critique of utopianism; and that the neo-idealist critique of utopianism, specifically in the responses of Psychological Society philosophers to their colleague, Vladimir Solov'ev, provides an excellent measure of the distinctiveness of neo-idealism relative to other currents in the Silver Age. This thesis introduces the Problem of Consciousness as an antinomy between Physicalism and Primitivism about the phenomenal. I argue that Primitivism is implausible, but is supported by two conceptual gaps. The ‘–tivity gap’ holds that physical states are objective and phenomenal states are subjective, and that there is no entailment from the objective to the subjective. The ‘–trinsicality gap’ holds that physical properties are extrinsic and phenomenal qualities are intrinsic, and that there is no entailment from the extrinsic to the (...) intrinsic. Stoljar’s Epistemic View (EV) suggests that we have a limited conception of the physical world, and that the apparent inexplicability of consciousness is merely a symptom of our ignorance. I argue that EV must satisfy two conditions which require it to specify the content of our ignorance. EV’s best hope is a Russellian appeal to our ignorance of intrinsic physical properties. After arguing in favour of this ignorance claim, I show how it undermines the –trinsicality gap. However, I suggest that the –tivity gap cannot be dealt with by the Russellian ignorance hypothesis, nor by any other version of EV. However, I then argue that the Russellian ignorance hypothesis can still be deployed as half of a hybrid account of the phenomenal. Representationalist theories of consciousness have difficulty with the –trinsicality gap, but show promise with the –tivity gap. Specifically, Kriegel’s Self-Representationalism indicates that there can indeed be an entailment from objective physical states to subjective phenomenal states. This paves the way for my hybrid account of consciousness: the subjectivity of a phenomenal state is the product of its self-representational structure, and the qualitative character of a phenomenal state is the product of the epistemically inaccessible intrinsic physical properties involved in its implementation.
