The administration or recognition of religious courts is a form of religious accommodation present in many constitutional states today commonly analysed in legal pluralism terms. This article contributes to the further analysis of the relationship between legal pluralism and rights in religiously diverse societies by examining the status of state religious courts and their interaction with state non-religious courts. In particular, I examine what Cover calls “jurisdictional redundancies” between the courts and conceptualize the allocation of power between religious and non-religious (...) courts as a potentially productive site of interlegality. In doing so, I support concurrent jurisdictional allocations, arguing that exclusive jurisdiction could result in what I call an interlegal gap, whereby instead of inter-penetration of norms and production of reconciliatory principles, there is a justice gap whereby litigants may find themselves unable to obtain appropriate legal recourse including when neither court is willing to assume jurisdiction over the matter. This requires us to see the relationship between religious courts and non-religious courts through the more mundane but more practical lens of jurisdictional overlaps and competition, rather than through the more abstract framing of normative or even civilizational clashes. Accordingly, I argue that concurrent jurisdiction and interlegality have greater potential to strike a balance between individual and group rights and could be more protective of religious diversity. In other words, I argue for a closer, rather than a more separate, relationship between religious and non-religious courts, while denying that a hierarchical relationship where religious courts are subordinated to non-religious courts is the only way to protect rights. Research has shown that individuals with high levels of psychopathic personality traits are likely to cause harm to others in the workplace. However, there is little academic literature on the potentially adaptive outcomes of corporate psychopathy, particularly because the “boldness” psychopathy domain has largely been under-acknowledged in this literature. This study aimed to elaborate on past findings by examining the associations between psychopathy, as operationalized using scales from the relatively new triarchic model of psychopathy, and both adaptive and maladaptive workplace (...) behaviors. Participants were 343 working community adults who completed a series of self-report questionnaires that measured psychopathy and various workplace behaviors, including counterproductive work behaviors, tactics of influence, unethical decision-making, leadership strategies, team play, and creativity. Structural equation modeling was used to estimate the associations between latent constructs of boldness, meanness, and disinhibition, and the eight different constructs related to workplace behaviors. It was found that boldness preferentially predicted the use of soft tactics of influence, adaptive leadership, and team play, and negatively predicted passive leadership. Meanness predicted unethical decision-making, poor team play, and hard tactics of influence. Disinhibition positively predicted CWB and passive leadership. Meanness also moderated the association between disinhibition and CWB, in that greater scores on both psychopathy domains indicated greater levels of CWB. These findings provide conceptual support for the triarchic model, including the “boldness” domain, which measures adaptive aspects of psychopathy in addition to maladaptive ones, as well as suggest that not all individuals high on psychopathy would be an overt menace to the workplace. In this paper, we respond to a recent article by Edwin Jesudason regarding the ethical problems associated with kindness in healthcare. Jesudason contends that kindness contributes to unkind outcomes such as discrimination and systemic problems in healthcare. We disagree with his above assertion by forwarding three arguments. First, we question his association of kindness with favouritism through his conflation of favour with favouritism. We counter that doing someone a favour does not necessarily mean that preferential treatment is involved. Second, we (...) object to his interpretation of discretionary kindness as possessing ‘circumscribed scope’, that is, doing favours to the ingroup and leaving out others. We maintain that the discretionary element of kindness does not denote inclusivity and instead refers to the judgement and prudence needed for a person to act kindly in specific circumstances. Our third argument concerns Jesudason’s emphasis on kindness as an action. By focussing on kind acts, he has inadvertently overlooked kindness as a moral value, attitude and inclination of a person. Overall, Jesudason has provided an inadequate explanation of kindness as a virtue. We suggest that a kind person does not promote or condone unkind outcomes such as prejudice, abuses and structural problems in healthcare. Instead, such a person goes beyond discrete kind acts and ingroup loyalty to actively demonstrate compassion, generosity and assistance towards those in need in a spontaneous and consistent manner. This article offers a novel interpretation of enacted knowledge through the lens of Wang Yangming’s theory of the unity of knowledge and action. By framing Wang’s concept of knowledge within an enactive model, it advances a holistic perspective that integrates mind, body, and world, as well as knowledge and action, into a unified whole. To bridge historical analysis with contemporary philosophical discourse, this article engages in dialogue with Harvey Lederman’s introspective model, offering a complementary framework that, together, provides a more (...) precise and comprehensive understanding of Wang’s philosophy. Moving beyond Lederman’s dichotomy of correspondence and identity, I introduce a third interpretation of ‘unity’: the Continuum Thesis. This interpretation places a more fundamental focus on the original condition of moral knowledge, presenting it as a singular entity that inherently integrates the distinct aspects of knowledge and action. By asserting that ‘action just is knowledge’, Wang indeed affirmed their original unity. (shrink)

The main focus of this essay is to closely engage with the role of scientist-subjectivity in the making of objectivity in Lorraine Daston and Peter Galison’s book Objectivity, and Daston’s later and earlier works On Scientific Observation and The Moral Economy of Science. I have posited four challenges to the neo-Kantian and Foucauldian constructions of the co-implication of psychology and epistemology presented in these texts. Firstly, following Jacques Lacan’s work, I have argued that the subject of science constituted by the (...) mode of modern science suffers from paranoia. It is not the fear of subjectivity interfering with objectivity but the impossibility of knowing the truth of the real that causes paranoia. Here, I have argued that it is not the ethos of objectivity that drives epistemology as Daston and Galison suggest, but the pathos of paranoia. The second challenge builds upon Kant’s own denial that the perfect correspondence between the human will and the moral law is possible. Kant himself thought that an ethical human act is impossible without the component of “pathology.” This questions Daston and Galison’s argument that there is always ethical imperative at the core of epistemic virtue. The third challenge contests the way Daston and Galison take appearance for being in their application of the Foucauldian concept of technologies of the self in modeling the master scientist-self. The fourth challenge questions the notion of the psychological and unconscious in the making of epistemology in Daston’s later and earlier work. Against this background, I aim to make a claim that understanding and disclosing “entities” in the scientific domain presupposes an understanding of “being” in general. My goal is to open up the discussion for an alternative conception of the scientist-subject and thereby an affective and existential formulation of science. (shrink)

Neo-Mandaic is among the rarest and most seriously endangered languages of the world. Two extant Neo-Mandaic dialects, those of the cities of Ahvaz and Khorramshahr in southwestern Iran, are spoken by a few hundred adherents of Mandaeism, an indigenous gnostic religion of Lower Mesopotamia. Previous transcribed texts in the dialect of Ahvaz mostly deal with Mandaean culture and include Classical Mandaic vocables that are not used in the vernacular. The present annotated text is entirely colloquial, being a sample of daily (...) speech amongst speakers of the dialect and reflecting a typical conversation between two Neo-Mandaic speakers in a situation where one is receiving his relative as a guest. It is, moreover, the first Neo-Mandaic text that involves a female informant. (shrink)

This article articulates a neo-pragmatist theory of human rights by drawing and expanding upon the American classical pragmatism of G.H. Mead. It characterizes this neo-pragmatist theory of rights by its anti-foundationalist, relational, fictive, and constitutive nature, and begins by providing a reconstruction of Mead’s social pragmatist approach to rights, a contribution systematically ignored by contemporary sociologists of rights. Next, it details the cost of this disciplinary oblivion by examining how much neo-pragmatism, critical theory, and legal consciousness studies have meanwhile gained (...) by engaging with Mead’s work on rights. Finally, it discusses the contributions of this historical-theoretical exercise to the rapidly growing sociology of rights, and shows that by supplementing the neo-Meadian approach with a recent interpretation of Hobbes’s fictional theory of politics, there appear to be substantive gains in the empirical study of the origins, consequences, meaning, and denial of rights. This article attempts to explain through the lens of the Five Relationships the meaning of Joseon neo-Confucian view which emphasized relationship development as the aim and contents of education. In neo-Confucianism, education is the task of guiding learners in cultivating and unfolding capabilities in the relationships of everyday life. Within the context of neo-Confucianism, the development of competency in relationships was another expression of the educational goal of actualizing the ‘original nature’ including of the four virtues. This paper is intended to be a homage to the philosopher Ludovieo GEYMONAT, deceased in Milano the 29-XI-1991. It presents his contribution to the introduction of the neopositivism in Italy, in the thirties; the posterior planning of an epistemology strongly influenced by the History of Science; and the continous dialogue with the neopositivism, behind that GEYMONAT has embraced the dialectic materialism, as a philosophic general frame.

Guided by Basic Psychological Need Theory, we investigated the combined associations between need satisfaction and need frustration and their relations with theoretically relevant correlates including mindfulness, physical literacy, physical activity enjoyment, and physical activity. The participants were Singapore-based school students who completed a cross-sectional survey. The results of the latent profile analysis identified four distinct need profiles: profile 1–average satisfaction and frustration ; profile 2–low satisfaction, above average frustration; profile 3–very high satisfaction, very low frustration ; and profile 4–high satisfaction, (...) very high frustration. Among these, profile 3 was the most adaptive one; it had the highest levels of mindfulness, physical literacy, physical activity enjoyment, and moderate-to-vigorous physical activity. Experiences of need satisfaction countered the negative effects of need frustration on these correlates. These findings enhance our understanding of students’ psychological need experiences and highlight the need for investigating the combined associations between need satisfaction and need frustration. The article discusses the work of Boris Valentinovich Yakovenko, one of the most prominent representatives of Russian neo-Kantianism. The philosophy of Yakovenko is analyzed in the context of the German and Russian philosophical traditions of the early twentieth century - phenomenology and neo-Kantianism. Being a supporter of neo-Kantianism, Yakovenko devoted most of his research to questions of cognition. The article examines the foundations of criticism, directed by Yakovenko against modern gnosiological approaches. The unacceptability of these approaches consists in mixing different (...) types of being by Yakovenko. Yakovenko believes that Husserl's phenomenology focuses on the study of the process of psychological cognition, and it is impossible based on subjectivity to achieve objective knowledge. Cohen, in the opinion of Yakovenko, denying the possibility of a pure givenness of sensations, relativizes the very idea of existence, implying only science under it. Yakovenko calls his own ontological attitude transcendental pluralism. Transcendental pluralism recognizes the self-sufficiency and independence of each kind of Being, between which there is no connection. The cognition of this plurality of identities must be non-presumability and absolute and is possible, according to Yakovenko, in a special kind of intuition. This intuition Yakovenko called mystical, however, does not give its detailed description and justification. Nevertheless, an appeal to his philosophy allows us to actualize theoretical-cognitive problems that are of interest to us today: the problem of subjectivity and objectivity, the problem of non-presumability of knowledge, “pure givenness”, transcendence and immanence, the ratio of various types of intuitions in cognition, etc. (shrink)

In this article I will try to demonstrate the existence of points in common between the eternalist instances of Parmenidean philosophy and the Buddhist formulations made by some parts of the Abhidhamma, Nāgārjuna, and the Sarvāstivādins. These three philosophies have numerous points in common with Emanuele Severino’s formulations from the point of view of what is defined as neo-Parmenidism. The purpose of this article is to demonstrate that the points in common between these systems of thought are due to a (...) basic affinity which, despite having led them to emphasize different themes, present similar reasoning and logical consequences, which allow us to detect very strong points in common especially on issues related to the conception of reality as unique and indivisible in the form of an absolute totality, the eternity of Being, the interdependent nature of entities, and even the illusory perception of worldly reality. Since this text is only an introduction to the problem, I will examine the main issues, also analyzing the main problems to conclude with what I have found to be the actual points in common on which an interdisciplinary dialogue can be built between the problems raised by Severino through Parmenides and Nāgārjuna who from this point of view is more similar to the Sarvasarvādins than has been thought up to now. This essay offers an overview of Historicism by looking at its prominent figures in XX century. Starting from the first use of the term storicismo, the author highlights the substantial difference between Giovanni Gentile’s and Benedetto Croce’s historicistic perspectives, especially emphasized in the Thirties and the Forties . The author’s historical reconstruction then illustrates the “crisis” which Historicism had to face up to after the II World War, alighting the more significant cases of the anew sought “paradigm of historicity”, and (...) the interpretations of “Historicism” between the Sixties and the Seventies against which Pietro Piovani talked explicitly of a “New Historicism”. Starting from Piovani’s positions, Fulvio Tessitore and his school propose a radical form of critical and problematic neo-historicism which, recalling the outcomes of Weber’s Historismus in a strictly anti-metaphisical direction, is centered on the ideas of individuality, difference, ethical and gnoseological pluralism, understanding of the other, life. Não somente ele representa a caricatura de uma metafísica que gostaria de se fazer passar por ciência, mas esta ciência, ela mesma, aparece como a caricatura de uma racionalidade arrogante e dobrada sobre ela mesma. My research explores Maya perspectives on neo-traditional farming as a source of metabolic health and resilience to the global epidemic of type-two diabetes. This article is based on long-term ethnographic research and interviews in Maya Mountains Reservation communities in southern Belize, an area with low diabetes prevalence relative to national and global populations. Research participants see lower rates of diabetes in the MMR as the result of neo-traditional peasant and subsistence farming on ancestral lands. Good metabolic health represents the embodiment (...) of food systems that routinize healthy material and social relationships to the landscape. This research suggests that diabetes is endemic to modern food systems and proposes neo-traditional food ways as a societal antidote to nutritional disease. My research demonstrates and responds to a need for further disaggregated data on diabetes prevalence in Indigenous communities, contributes to the social scientific literature on the importance of small-scale agricultural models for community health, and provides a case study of success in diabetes prevention. I engage Maya perspectives with anthropological literature on embodiment and small-scale agriculture to suggest neo-traditional food ways as healthier alternatives to capitalist agricultural development. O presente artigo tem como objeto o historicismo, a abordagem filosófica que considera a história como um fator crucial para a configuração dos valores e crenças e critérios dos homens e mulheres. De modo mais específico, eu exploro nas páginas seguintes alguns problemas que cercam a abordagem historicista e sua relação com a ação política e o discurso filosófico. Faço isso através da análise do pensamento de dois filósofos cuja contribuição tem sido considerada muito importante para a filosofia política hodierna: (...) Cornélius Castoriadis e Richard Rorty. Ambos os autores, além de decididamente historicistas, desenvolveram sua obra a partir de crítica e releitura de alguns elementos filosofia hegeliana e os dois procuram oferecer uma alternativa para a filosofia marxista. A minha análise de Castoriadis acompanha a sua crítica ao “universalismo objetivista do marxismo” e a sua proposta de uma “ontologia histórica” para daí então comentar alguns possíveis problemas decorrentes do seu historicismo. Em seguida eu exploro as possíveis virtudes da filosofia de Castoriadis, apontadas por Richard Rorty, para em seguida mostrar como o próprio Rorty oferece uma possível saída aos impasses do historicismo de Castoriadis. The purpose of this paper is to explain the differences in perspectives on the human soul between scholastic philosophy and Neo-Confucianism through an analysis of Shin Hudam’s criticism on Lingyan Lishao, a work authored by Sambiasi in 1624. Shin Hu-dam, a prominent figure in the Gongseo school in late Choson, rejected the notion of the soul as a substantial form of human beings, drawing instead on the Neo-Confucian concept of the soul as a gathering of Qi. He further negates epistemology (...) of faculty psychology based on the concept of the mind as an interior whole. Moreover, he denounced the scholastic idea that the goal of the soul consists in achieving the supreme good, labeling it as heretical. Shin Hudam should be recognized for his historical significance in providing a theoretical basis for the critique of Western learning by the Neo-Confucian scholars in Choson, ensuring their response was not merely political or religious backlash but grounded in moral-psychological criticism. The disciplines within biology which have upheld neo-Darwinism are now in a state of Kuhnian crisis, the puzzle solving power of normal science being replaced with long debates about the interpretation of data, competition between rival articulations of the once universal paradigm, the re-opening of long solved problems, explicit discontent on the part of scientists and frequent appeals to philosophy and history. Similar features of distress are found when scientific research attempts to serve policy decisions. It is argued that the (...) dramatic reduction in the efficiency of the consensus building machinery of science in areas relevant to public policy and in periods of Kuhnian crisis are explained in the same way; by the scientists' loss of autonomy, the weakening of disciplinary boundaries, and the elevation of the degree of critical scrutiny to which conjectures are submitted. This article discusses how the persistence of child labor, especially in Brazil and the United States of America, constitutes a current facet of neo-colonialism. Cultivated as an educational and dignifying activity, exploited child labor persists and is naturalized. Schools, religions, and the legislation contribute to making the working class come to love and naturalize what in the past was understood as torture and punishment, thus jointly acting as a fundamental means of forming a new cultural form: the love of work. (...) Initially, the article discusses how the culture of work is historically founded and then argues against the idealist and postmodern explanations that naturalize it. The argument is based on the understanding that culture has a material basis and is linked to the production and social reproduction of life. Data from the empirical research on child labor in tobacco farming in Brazil and the USA reveal the persistence of the problem among Latino children and families. We conclude with the need to found a new culture for contemporary society, based on other social and economic relations, which allows the working class to free itself from what dominates and exploits it.
