This book stems from more than 30 years of experience in the development of practical law enforcement ethics training. It is written based on the real-world application of a wide variety of approaches to enhancing ethics awareness and decision-making skills. There has been an explosion of efforts to increase the emphasis on ethics in law enforcement. The most effective of these efforts involve our law enforcement officers themselves in (1) sharing ideas, experiences, and wisdom with each other and (2) analyzing (...) long-term consequences in a risk-free learning environment, before the need arises for making actual decisions or engaging in conduct. Accomplishing those objectives can be attempted with a variety of formats, presentations, and approaches. Instead of being shown how to “teach” ethics, readers will be given material and ideas on how to enhance existing ethics awareness and ethics skills with their personnel. Readers are provided with pointers on talking with staff, not “at” them, in order to foster awareness about how ethical values and standards to which they already subscribe apply in real-world law enforcement decision-making and conduct. A unique aspect of this text is that it is written primarily for line sergeants and lieutenants to use with their own in-service personnel. It contains material that is designed to be easy-to-present and non-intimidating. It is adaptable to briefings of limited duration as well as longer training sessions. There is substantial content to enable an agency to maintain an on-going program of recurrent, short-but-meaningful discussions with and among personnel. Most importantly, it is practical and down-to-earth–not theoretical or abstract. Also, the book is based on the belief that with a combination of interest and practice, any sergeant or lieutenant, or any officer or deputy, can overcome any self-perceived weakness and become an accomplished “ethics awareness discussion leader.” In addition to its primary audience, the book will also be a helpful resource for field-training officers, senior officers, non-sworn personnel, and law enforcement executives. One widely used method for allocating health care resources involves the use of cost-effectiveness analysis (CEA) to rank treatments in terms of quality-adjusted life-years (QALYs) gained. CEA has been criticized for discriminating against people with disabilities by valuing their lives less than those of non-disabled people. Avoiding discrimination seems to lead to the ’QALY trap’: we cannot value saving lives equally and still value raising quality of life. This paper reviews existing responses to the QALY trap and argues that all (...) are problematic. Instead, we argue that adopting a moderate form of prioritarianism avoids the QALY trap and disability discrimination. (shrink)

Among psychologists, it is widely thought that infants well under age 3, monkeys, apes, birds, and dogs have been shown to have rudimentary capacities for representing and attributing mental states or relations. I believe this view to be mistaken. It rests on overinterpreting experiments. It also often rests on assuming that one must choose between taking these individuals to be mentalists and taking them to be behaviorists. This assumption underestimates a powerful nonmentalistic, nonbehavioristic explanatory scheme that centers on attributing action (...) with targets and on causation of action by interlocking, internal conative, and sensory states. Neither action with targets, nor conative states, nor sensing entails mentality. The scheme can attribute conative states and relations, efficiency, sensory states and relations, sensory retention, sensory anticipation, affect, and appreciation of individual differences. The scheme can ground explanations of false belief tests that do not require infants or nonhuman animals to use language. After the scheme is explained and applied, it is contrasted with other, superficially similar schemes proposed in the literature---for example, those of Gergely and Csibra, Wellman and Gopnik, Perner and Roessler, Flavell, and Apperly and Butterfill. Central to Fischer and Ravizza's theory of moral responsibility is the concept of guidance control, which involves two conditions: (1) moderate reasons-responsiveness, and (2) mechanism ownership. We raise a worry for Fischer and Ravizza's account of (1). If an agent acts contrary to reasons which he could not recognize, this should lead us to conclude that he is not morally responsible for his behaviour; but according to Fischer and Ravizza's account, he satisfies the conditions for guidance control and is therefore (...) morally responsible. Although the free-will reply to divine hiddenness is often associated with Kant, the argument typically presented in the literature is not the strongest Kantian response. Kant’s central claim is not that knowledge of God would preclude the possibility of transgression, but rather that it would preclude one’s viewing adherence to the moral law as a genuine sacrifice of self-interest. After explaining why the Kantian reply to hiddenness is superior to standard formulations, I argue that, despite Kant’s general skepticism about theodicy, (...) his insights pertaining to hiddenness also provide the foundation for a new theodicy that merits serious attention. Commentators such as Terence Irwin (1999) and Christopher Shields (2006) claim that the Ring of Gyges argument in Republic II cannot demonstrate that justice is chosen only for its consequences. This is because valuing justice for its own sake is compatible with judging its value to be overridable. Through examination of the rational commitments involved in valuing normative ideals such as justice, we aim to show that this analysis is mistaken. If Glaucon is right that everyone would endorse Gyges’ behavior, (...) it follows that nobody values justice intrinsically. Hence, the Gyges story constitutes a more serious challenge than critics maintain. (shrink)

Despite recognizing many adverse impacts, the climate science literature has had little to say about the conditions under which climate change might threaten civilization. Discussions of the mechanisms whereby climate change might cause the collapse of current civilizations has mostly been the province of journalists, philosophers, and novelists. We propose that this situation should change. In this opinion piece, we call for treating the mechanisms and uncertainties associated with climate collapse as a critically important topic for scientific inquiry. I offer a new analysis of Aristotle's concept of an accidental cause. Using passages fromMetaphysics Δ and Ε, as well as Physics II, I argue that accidental causes are causally inert. After defending this reading against some objections, I draw some conclusions about Aristotle's basic understanding of causation.

Locke’s argument for God’s immateriality in _Essay_ IV x is usually interpreted as involving a principle that in some way prohibits the causation of thought by matter. I reject these causal readings in favor of one that involves a principle which says a thinking being cannot be composed out of unthinking parts. This Composition Principle, as I call it, is crucial to understanding how Locke’s theistic argument can succeed in the face of his skepticism about the substance of matter and (...) the cause of thought, as well as his belief in the possibility of thinking matter. Emotional clarity and attention to emotions represent the extent to which people understand and attend to their own emotions, respectively, and are broad facets of emotional awareness, alexithymia, and emotional intelligence. To examine the extent to which these two constructs are associated, we conducted a meta-analysis of studies including well-validated self-report measures of trait clarity and attention to emotion. Clarity and attention were moderately, positively associated. Assessment instrument, but not sample gender or age, moderated the association between clarity and attention. (...) Analyses of between-study heterogeneity and publication bias suggested that results were valid and generalizable. We discuss potential causes of the association between clarity and attention, and elaborate on the implications of our results for emotion regulation, well-being, and psychopathology. (shrink)

Hudson has formulated two local deterministic theses and argued that both are incompatible with freedom. We argue that Hudson has half the story right. Moreover, reflection on Hudson’s theses brings out an important point for debates about freedom generally: that instead of focusing on the notion of entailment, debates about freedom should focus on the notions of explanation and sourcehood. Hudson’s theses provide an excellent case study for why the latter notions ought to take precedence over the former in debates (...) about freedom. (shrink)

This paper extends Corporate Social Responsibility (CSR) scholarship to focus on issues of sexual harassment and sexual violence. Despite a significant body of work on gender and CSR from a variety of feminist perspectives, long-standing evidence of sexual harassment and sexual violence in business, particularly in global value chains, and the rise of the #MeToo movement, there has been little scholarship focused specifically on these issues in the context of CSR. Our conceptual paper addresses this gap in the literature through (...) two key contributions. First, we extend the theoretical base of CSR scholarship by drawing upon and explicating radical feminist theory, a resource that has been underutilized in the field to date. This theoretical perspective is well placed to offer insights around the issues of sexual harassment and sexual violence, and to explain the centrality of these concerns to the gender equality agenda in business and in CSR. Second, building upon insights from radical feminism, and from research on CSR and human rights, we explicate a business and human rights approach to sexual harassment, sexual violence and CSR. We point to ways in which this approach might be more effective in addressing these issues than previously adopted strategies and suggest directions for future research arising from our analysis. According to the Humean Best Systems Account, laws are generalizations in the best systematization of non-modal matters of fact. Recently, it has become popular to interpret the notion of a best system pragmatically. The _best_ system is sensitive to our interests—that is, to our goals, abilities, and limitations. This account promises a metaphysically minimalistic analysis of laws, but I argue that it is not as minimalistic as it might appear. ‘Everyone who now reads and writes in the West, of whatever racial background, sex or ideological camp, is still a son or daughter of Homer.’ While the extent to which this claim is accurate has been disputed, it is not wrong in our own day to grant the highest honours for ongoing influence to the author of theIliad. All the more so in Late Antiquity, a period frequently viewed as hermetically isolated from the classical world, but which resolutely viewed itself (...) as part of that unbroken cultural and literary continuum. One of those who made repeated use of Homer's epic was the Emperor Julian, one of the most prolific writers among Rome's emperors. In the fourth centurya.d., Homer's influence was still predominant, not only being Julian's favourite and most frequently cited author but also forming for Libanius of Antioch ‘one of the pillars of rhetorical teaching’. Despite Glen Bowersock's statement that Julian's many writings offer unique insight into his character and disposition, Julian is still a historical character who is not easy to ‘know’. Julian's life was shaped by the murder of his father, brothers and uncles by a cabal involving, if not orchestrated by, his cousin Constantius II. This was followed by the removal of his trusted confidant Salutius, again by Constantius. These experiences exhibit an unusual phenomenon, in that, when Julian referred to them, they were prefaced by a spate of Homeric allusions. Julian's wrath at people taken from him was both genuine and politically useful, but the expression of it was dangerous enough that he expressed it obliquely in the language of Homer. These citations and allusions, drawn primarily from theIliad, were far more than Julian's flaunting of his education, but were rather a tool for subtly conveying his desired message, a message with strong political tones. I will treat these passages in the order in which Julian wrote them, although that places the events reminisced about in the reverse order. (shrink)

How does an engagement with religious traditions (broadly construed) illuminate and complicate the task of thinking through the ethics of eating? In this introduction, we survey some of the many food ethical issues that arise within various religious traditions and also consider some ethical positions that such traditions take on food. To say the least, we do not attempt to address all the ethical issues concerning food that arise in religious contexts, nor do we attempt to cover every tradition’s take (...) on food. We look at just a few traditions and a few interesting writings on food ethics and religion: What do they say about the ethics of eating? Why do they say these things? Here we use the terms “food ethics” and “religion” ecumenically as big tents under which many importantly different sorts of things may be grouped. Among the wide range of food ethical issues we consider in this chapter, for example, are religious views about the ethics of keeping, hurting, and killing animals, killing plants, dominion over creation, wastefulness, purity, blessing, atonement, and the connection between food and character. We realize, moreover, that it might be a stretch to label some of the views engaged by selected readings in this chapter as “religious” on a stringent understanding of that term; Lisa Kemmerer’s “Indigenous Traditions,” for instance, addresses some views that are recognizably spiritual but perhaps not religious in a strict sense. We hope that our ecumenical usage of the term can bring these important traditions to bear on the discussion without reducing them to something they are not. (shrink)

There is an intriguing recent effort to develop a valid cosmological argument on the basis of quite minimal assumptions.1 Indeed, the basis of the new cosmological argument is so slight that it is likely to make even a conscientious theist suspicious – to say nothing of our vigilant atheists. In Section 1 we present the background assumptions and central premises of the new cosmological argument. We are sympathetic to the conclusion that there necessarily exists an intelligent and powerful creator of (...) the actual universe, but we show in Section 2 that the new cosmological argument cannot establish this claim. Specifically, we show by reductio ad absurdum that the new argument is unsound, and that every plausibly modified version of the argument is also unsound.2 We close our discussion with a diagnosis of what went wrong in the new cosmological argument. Our conclusion is that this intriguing new argument promises considerably more than it can show. (shrink)

The Company They Keep advances a new way of thinking about Supreme Court decision-making. In so doing, it explains why today's Supreme Court is the first ever in which lines of ideological division are also partisan lines between justices appointed by Republican and Democratic presidents.

The rhetorical career of Libanius of Antioch (a.d.314–c.393) spanned the reigns of a number of fourth-century emperors. Like many orators, he used the trope of the emperor as a pilot, steering the ship of state. He did this for his imperial exemplar Julian and in fact for his predecessor Constantius II as well. Julian sought to craft an identity for himself as a theocratic king. He and his supporters cast him as an earthly parallel to the Christ-like versions of Heracles (...) and Asclepius he constructed, which was arguably a co-opting of Christian and particularly Constantinian themes. In a public oration, Julian even placed himself in the role of Christ in the Temptation in the Wilderness. This kind of overtly Christian metaphor was not Libanius’ preferred idiom, however, and he wrote of Julian as another kind of chosen and divine saviour-figure, one with its roots in the golden age of Greek philosophy. The figure of the κυβερνήτης, the ‘pilot’ or ‘helmsman’, is a philosophical concept with roots in the thought of the pre-Socratics but most familiar from Plato. The uses of this metaphor by Julian and Libanius highlight the rhetorical strategy and self-presentation the emperor employed during his reign. (shrink)

In this essay, we respond to Dustin Crummett’s argument that one cannot consistently appeal to body count reasoning to justify being a single-issue pro-life voter if one is also committed to the usual response to the embryo rescue case. Specifically, we argue that a modified version of BCR we call BCR* is consistent with the usual response. We then move to address concerns about the relevance of BCR* to Crummett’s original thesis.
