Steadily on the increase in political argumentation since then, the argumentum ad hominem has been carefully refined as an instrument of "oppo (...) tactics" and "going negative" by the public relations experts who now craft political campaigns at the national level. It has been so prominently used in the major political campaigns, debates, and advertisements of the past few years that there has even been a reaction against it--a feeling that we have gone too far in this direction and that some kind of restraint is needed. 1 But there has been no evidence of such restraint in the argumentation used in recent campaigns. Perhaps what might be helpful is a better understanding on the part of voters and campaigners of how to evaluate ad hominem arguments critically.How does the ad hominem argument really work as a way of molding public opinion, why is it so often so effective, and how can it be defended against? How can it be evaluated as a clearly identifiable type of argument, by some kind of objective standards, in a way that can be applied to particular cases? These appear to be tough questions, but recent research has made some not inconsiderable progress toward answering them.The purpose of this article is to present a new case study of a type of argument commonly used in political discourse, a case study that makes use of the dialectical normative framework for identifying and evaluating personal attack (ad hominem) arguments that is developed in a series of works by Henry W. Johnstone Jr. (1952); Alan Brinton (1985, 1995); Frans H. van Eemeren and Rob Grootendorst (1984, 1995); Erik C. W. Krabbe and Douglas N. Walton (1993), Walton (1989, chap. 6; 1998); and van Eemeren, Grootendorst, Francisca Snoeck Henkemans et al. (1996). This particular case, although typical of so many ad hominem arguments currently [End Page 101] in use in political discourse, has some special features that turn out to be quite interesting not only in showing how the dialectical framework applies to cases, but also in advancing our knowledge of how the ad hominem type of argument works in political argumentation in a democratic system for which the media reportage of events is a big factor in influencing voting. 1. Framework for analysis and evaluation Although the argumentum ad hominem, or personal attack argument, has been traditionally treated as a fallacy in logic, recent research in argumentation (as cited above) shows that, in many cases,--including cases in political argumentation--ad hominem arguments, as used in conversational arguments, are not fallacious. Research has shown that, while some personal attack arguments can definitely be judged fallacious, many others are quite reasonable (when evaluated in the appropriate context), while still others should be evaluated as weak (insufficiently supported) but not fallacious. As shown in this case study, the real function of an ad hominem argument (when properly used) is to attack an arguer's credibility in order to criticize the argument she advocates.Before going any further, it is necessary to define some terminology brought to use in the research cited above. An ad hominem argument is the use of personal attack in a dialogue exchange between two parties, where the one party attacks the character of the other party as bad, in some respect, and then uses this attack as a basis for criticizing the other party's argument. An argument is fallacious if it is a special baptizable (Johnson 1987) type of argument that is used by one party in a dialogue exchange in such a way that it blocks or interferes with the collaborative realization of the goal of the type of dialogue in which the two participants are supposed to be engaged (Walton 1995). This is another volume in the continuing series published under the auspices of Tulane University. It contains eight articles. Ramona Cormier’s article "The Concept of Isolation in Contemporary Aesthetic Theory" uses the term isolation in accordance with Langer’s definition. In order to develop her point Cormier distinguishes between the historicity of an art work and the historiography of the work. On the basis of this she discusses briefly the attitudes of Jerome Schiller, Clive Bell, T. S. Eliot, Jerome Stolnitz, Roger (...) Fry, George Dickie. Shannon DuBose remarks in "Poesis and Cosmos" that "... views advanced [on art] in The Republic loom larger than need be in discussion of Plato’s theory of art; they should be balanced with suggestions advanced in other dialogues, particularly The Timaeus." One cannot agree more with this need for balance. Professor Feibleman’s article "The Art of the Philosophy of Art" is not so much a discussion of the philosophy of art as it is a discussion of the artist, the role of art in society, the relation of art to other areas of a culture in which art specifically exists. John Glenn, Jr. has written on "Kierkegaard on the Unity of Comedy and Tragedy." I do not agree with all his interpretations of Kierkegaard but his article is interesting. Harold N. Lee in "Action, Perception and Art" rethinks a position he held in the original edition of his Perception and Aesthetic Value. He now holds that "... the two views of the nature of art can be shown to be essentially related and not only externally so...." Marian L. Paulson writes an article, "Structures in Art Media," where she suggests that perhaps the problem of structural relations among art media may find a solution if one takes account of the Jungian notion of the racial unconscious, especially in the resolution of the tensions between anima and animus and between the shadow and transcendence. The article "Truth in Art" by Louise N. Roberts discusses one of the many ways in which the expression "truth in art" may be considered. The author in this case shows how paintings may present a truth in a way quite different from verbal statements. Plato, in his dialog Charmides, presents the question of how society can determine whether a person who claims superior expertise in a particular field of knowledge does, in fact, possess superior expertise. In the modern era, society tends to answer this question by funding institutions (universities) that award credentials to certain individuals, asserting that those individuals possess a particular expertise; and then other institutions (the journalistic media and government) are expected to defer to the credentials. When, however, the sequential (...) reasoning and theorizing and conclusion-stating of generation after generation of credential-bearing experts (i.e., scientists) leads to the assertion of the truth of statements that large segments of society find to be in conflict with the statements of persons who have earned credentials of expertise bestowed by an alternative institutional structure (i.e., religious teachers), representatives of the people are put to a choice. And when the conflicting statements present substantial implications for the moral and sexual behavior of people in the society, addressing the conflict brings into play not only the highest intellectual speculations and analyses, but also the most animal emotions and motivations. This paper, taking the form of a dialog, presents a scientist (Avram Codosia) named after an ancient Jewish patriarch and makes him a supplicant to a U.S. Senator (Helen Astartian) named after a pagan goddess. The stakes turn out to be not merely financial and intellectual, but personal and moral, involving the scientist's son (Isaac), an art student, and the senator's niece (Halia), a philosophy student. In a four-phase encounter, the paper hopes to offer some innovative observations on age-old issues and to stimulate productive new thinking on questions that too often seem to be debated by means of repetitions of the same old points. Many revisionist historians today try to make the late President Andrew Jackson out to be something that he was not—that is, a man of all the people. In our uninhibited, polarized culture, the truth should mean something. Therefore, studying the character of someone like Andrew Jackson should be fully investigated, and researched, as this work attempts to do. Indeed, this article tells us that we should not accept lies and conspiracy theories as the truth. Such revisionist history comes into sharp (...) focus in Bradley J. Birzer’s latest book, In Defense of Andrew Jackson. Indeed, his efforts are surprisingly wrong, as he tries to give alternative explanations for Jackson’s corrupt life and political malfeasance. Hence, the lawlessness of Andrew Jackson cannot be ignored or “white washed” from American history. More important, discrediting the objective truth about Andrew Jackson, and his blatant misuse of executive power as the U.S. President should never be dismissed, like his awful treatment of Blacks and other minorities in the United States. It should have been important to Birzer to get his story right about Andrew Jackson, with a more balanced approach in regards to the man. Finally, Jackson should have tried to eliminate Black slavery in his life time, not embrace it, based on the ideas of human dignity and our common humanity. To be brutally honest, it is one thing to disagree with Andrew Jackson; but it is quite another to feel that he, as President of the United States, was on the side of all the American people during his time, because it was not true. Perhaps the biggest question is: Could Andrew Jackson have made a positive difference for every American, even Black slaves and Native Americans? (shrink)

Law search is fundamental to legal reasoning and its articulation is an important challenge and open problem in the ongoing efforts to investigate legal reasoning as a formal process. This Article formulates a mathematical model that frames the behavioral and cognitive framework of law search as a sequential decision process. The model has two components: first, a model of the legal corpus as a search space and second, a model of the search process that is compatible with that environment. The (...) search space has the structure of a “multi-network”—an interleaved structure of distinct networks—developed in earlier work. In this Article, we develop and formally describe three related models of the search process. We then implement these models on a subset of the corpus of U.S. Supreme Court opinions and assess their performance against two benchmark prediction tasks. The first is to predict the citations in a document from its semantic content. The second is to predict the search results generated by human users. For both benchmarks, all search models outperform a null model with the learning-based model outperforming the other approaches. Our results indicate that through additional work and refinement, there may be the potential for machine law search to achieve human or near-human levels of performance. (shrink)

There are many similarities in both form and content between the path Diotima described in order to reach Beauty through Eros which we encounter in Plato's Symposion dialogue and the tenets of the Anatolian Sufism which is a religion of love. Rather than investigating whether there is any organic connec-tion between the two approaches or the channels through which such a connec-tion is established, this study aims to show the two approaches in light of each other. Im Zentrum des Buches steht ein kurzer Traktat des Albinos, der sogenannte Prologos. Albinos ist geistesgeschichtlich dem Mittelplatonismus zuzuordnen, der Phase des antiken Platonismus, die dem um 250 n.Chr. einsetzenden Neuplatonismus Plotins vorausging. Der antike Autor fuhrt den Leser seines Prologos mit folgenden Fragen an die Dialoge Platons heran: Was ist ein Dialog? In welche Typen lassen sich die Platonischen Dialoge einteilen? Mit welchem Dialog soll das Studium der Platonischen Dialoge beginnen? Welche Anordnung der Dialoge ist Platons Philosophie angemessen? Der (...) Prologos wurde in der alteren Forschung aus verschiedenen Grunden vernachlassigt: Zum einen glaubte man, die philosophische Position des Albinos besser aus dem umfangreicheren Didaskalikos, der ihm zunachst zugewiesen wurde, rekonstruieren zu konnen; zum anderen sahen die meisten Forscher in dem Prologos nur eine schlecht gearbeitete Zusammenfassung (Epitome). Diese Vorurteile grundeten auf der Monographie "Der Platoniker Albinos und der falsche Alkinoos", die J. Freudenthal 1879 publizierte. Seit einigen Jahren wird der Didaskalikos jedoch wieder Alkinoos, einem nur in den Handschriften auftauchenden und ansonsten unbekannten Autor, zugewiesen. Somit wurde der Weg fur eine unvoreingenommene Neubewertung des Prologos frei.Das Buch beginnt mit einem Uberblick uber die Forschungsgeschichte zum Prologos. Ein Durchgang durch Leben, Werk und Lehren des Albinos mundet in eine Einordnung des Traktats unter die Testimonien zu Albinos und dessen Lehrer Gaios. In einem dritten Abschnitt wird in dem Buch die zentrale Frage diskutiert, worum es sich bei dem Prologos handelt, um ein Exzerpt oder eine Epitome. Aus einer philologischen und philosophiehistorischen Untersuchung der Textstellen, die von Freudenthal in seiner oben erwahnten Monographie als verderbt beanstandet wurden, geht hervor, dass es sich bei dem Prologos um ein Exzerpt und nicht um eine Epitome handelt. In einem vierten Kapitel wird mittels eines formalen und funktionalen Vergleichs des Prologos mit spateren Einfuhrungsschriften dessen spezifischer Charakter herausgearbeitet: Der Prologos gibt sich als unkorrigierte Mitschrift einer Vorlesung zu erkennen und gewahrt als solche Einblick in den Horsaal eines Platonikers der Kaiserzeit. In einem langeren funften Abschnitt wird die handschriftliche Uberlieferung dargelegt und kritisch betrachtet. Reis beschreibt hier ausfuhrlich 21 griechische Handschriften und eine lateinische Ubersetzung unter kodikologischen, historischen und palaographischen Gesichtspunkten. Die Verflechtung der Textgeschichte mit derjenigen Platons und spaterer Platoniker macht diese Untersuchung wunschenswert. Die Abhangigkeit der Handschriften voneinander wird ermittelt, worauf eine kritische Edition des Prologos folgt. EDITORS’ INTRODUCTION BACKGROUND We are experiencing an unprecedented period where wide ranging and disruptive major global change is taking place around us. In this context, the theme of Mindful Leadership and Sustainable Development provides a point of reference and pathway for understanding the contemporary chaotic situations. These disruptive changes challenge our understanding and meaning of humanity and truly question whether or not, we are able to live in a society where justice, equality, peace, and prosperity abound. In the Buddhist light, (...) a focus is placed on understanding the Buddhist teachings to develop solutions for dealing with these wide-ranging problems. Both the scope of change and the response from a Buddhist approach are core to the content of this volume. It is of paramount importance that any investigation and development of solutions for the changes taking place, require guidance from the Buddhist philosophy. As a starting point for discussion, an initial focus is placed on providing a thorough and critical understanding of the character and context of change. In doing so, we also seek to clarify and outline the nature of a Buddhist approach. In completing this review, it is productive to see that given the complex issues being dealt with, the papers do generate different frameworks and viewpoints within the broad term of “approach.” The frameworks based on the Buddha´s teachings are not fully fixed and agreed upon by all. Therefore, our term “approach” refers to a set of arrangements and viewpoints that act to inspire further discussion and development. Given the above context, this volume is a collection of conference papers presented and published for the panel on the first sub-theme of UNDV 2019 on Mindful Leadership for Sustainable Peace on 13 May 2019 at the Tam Chuc International Convention Center, Ha Nam, Vietnam. The panel commemorates the occasion of the 16th United Nations Day of Vesak Celebrations 2019. Through the contributions of participants and their papers at this workshop, this volume provides a diverse and rich range of thinking and wisdom rather than more traditional mainstream thinking or conventional wisdom. Treating the Buddha’s teachings as a basic theoretical reconstruction, we examine the relationships between societies and Buddhism. We combine the analyses of the conflicts, trends and dynamics affecting future global development with focused studies on a range of policy areas for improving societies. In the Buddhist light, our two most crucial aims in this period of disruption are to greatly increase the influence and impact of Buddhism as our foremost duty; and that the Buddhist responsibility contributes to creating a new foundation for Mindful Leadership and Sustainable Development. EDITORS’ INTRODUCTION This volume is a collection of papers presented at the international workshop on “Buddhist Approach to Global Education in Ethics” which is being held on May 13, 2019, at International Conference Center Tam Chuc, Ha Nam, Vietnam on the occasion of the 16th United Nations Day of Vesak Celebrations 2019. The aim is to throw new light on the values of the global ethical system with a focus on the Buddhist approach in deepening our understanding of how Buddhist (...) ethics can deliver a social change in the globalized world. REVIEW OF CONTENTS Prof. P. D. Premasiri in his paper titled “Universally valid ethical norms of Buddhism applicable to global education in ethics” deals with hindrance in determining the basis for global education in ethics and providing undeniable facts about the diversity involved in ethical norms, principles and attitudes of various global communities. The author also discusses the characteristics of Buddhist teaching on a humanistic approach to the moral life with perceptions of enlightened humans, i.e. ‘Knowledgeable Persons’ (vi¤¤å purisà). The paper places further emphasis on the necessity to draw the attention of educators to train the minds of humans on ethical choices in accordance with such decisions. The paper entitled “Teaching Buddhist Ethics through the Life of the Buddha and Jesus” by Abraham Velez De Cea has proposed a new approach to the Buddhist ethical way of teaching and its application through interpretations of the Buddha’s life from the perspective of virtue ethics and meditation. The purpose is to heighten the Buddhist contribution being made to global education in ethical issues. The paper is divided into two parts, Buddhist ethics as a form of virtue ethics and secondly, interpretation of the Buddha’s teachings from the perspective of virtue ethics and meditation. (shrink)

Defect detection is a major concern in quality control of various products in industries. This paper presents two different machine-vision based methods for detecting defects on periodically patterned textures. In the first method, input defective image is split into several blocks of size same as the size of the periodic unit of the image and chi-square histogram distances of each periodic block with respect to itself and all other periodic blocks are calculated to get a dissimilarity matrix. This dissimilarity matrix (...) is subjected to Ward's hierarchical clustering to automatically identify defective and defect-free blocks. The second method of defect detection is based on Universal Quality Index which is a measure of loss of correlation, luminance distortion and contrast distortion between any two signals. Quality indices of a periodic block with respect to itself and all other periodic blocks are calculated to get a similarity matrix containing quality indices. Specific variances of the periodic blocks are derived from the quality index matrix through orthogonal factor model based on eigen decomposition. These variances are subjected to Ward's hierarchical clustering to automatically identify defective and defect-free blocks. Results of experiments on real fabric images with defects show that the defect detection methods based on chi-square histogram distance and universal quality index yield a success rate of 98.6% and 97.8% respectively. This article will explore pediatric consent through the analysis of a clinical case study using the principles of biomedical ethics approach. Application of the principles of autonomy, nonmaleficence, beneficence, and justice will be dissected in order to attempt to establish resolution of the ethical dilemma. The main conflict in this case study deals with whether the wishes of an adolescent for end-of-life care should be followed or should the desire of his parents outweigh this request. In terminal cancer, the hope (...) of early palliative care and dignity in dying serve as priorities in therapy. Application of the moral principles to both sides of the dilemma aided in providing an objective resolution to uphold pediatric consent. (shrink)

Being a pragmatic and not a referential approach to semantics, dialogi-cal logic does not understand semantics as mapping names, propositions and relationships into the real world to obtain an abstract counterpart of it, but as dealing (handeln) with them in a particular way. This allows a very simple formulation of free logic the core of which can be expressed in a nutshell, namely: in an argumentation, it sometimes makes sense to restrict the introduction of singular terms in the context of (...) quantification to a formal use o f them. That is, the proponent is allowed to use a constant if f this constant has been explicitly conceded by the opponent. More technically, we show a new, dialogical way to build free logic systems fo r first-order logic with classical and intuitionistic features and present their corresponding tableaux. I. F r e e logics ON DIALOGUES A ND ONTOLOGY THE DIAL OGICAL APPROACH TO FREE LOGIC The proposition "God does not exist" contains a paradox sometimes referred to as Plato's beard: if God does not exist and the proposition should be true, standard referential semantics fo r quantified logic fails to give meaning to the name "God". But, given compositionality, since the meaning of a sentence is combined from the meanings o f its parts,-G o d d o e s not exist" does not evaluate. It is easy to see that related difficulties appear in every formula that contains singular terms.
