This introduction to the Common Knowledge symposium titled “Comparative Relativism” outlines a variety of intellectual contexts where placing the unlikely companion terms comparison and relativism in conjunction offers analytical purchase. If comparison, in the most general sense, involves the investigation of discrete contexts in order to elucidate their similarities and differences, then relativism, as a tendency, stance, or working method, usually involves the assumption that contexts exhibit, or may exhibit, radically different, incomparable, or incommensurable traits. Comparative studies are required to (...) treat their objects as alike, at least in some crucial respects; relativism indicates the limits of this practice. Jensen argues that this seeming paradox is productive, as he moves across contexts, from Lévi-Strauss's analysis of comparison as an anthropological method to Peter Galison's history of physics, and on to the anthropological, philosophical, and historical examples offered in symposium contributions by Barbara Herrnstein Smith, Eduardo Viveiros de Castro, Marilyn Strathern, and Isabelle Stengers. Comparative relativism is understood by some to imply that relativism comes in various kinds and that these have multiple uses, functions, and effects, varying widely in different personal, historical, and institutional contexts that can be compared and contrasted. Comparative relativism is taken by others to encourage a “comparison of comparisons,” in order to relativize what different peoples—say, Western academics and Amerindian shamans—compare things “for.” Jensen concludes that what is compared and relativized in this symposium are the methods of comparison and relativization themselves. He ventures that the contributors all hope that treating these terms in juxtaposition may allow for new configurations of inquiry. (shrink)

Recent work in neuroimaging suggests that some patients diagnosed as being in the persistent vegetative state are actually conscious. In this paper, we critically examine this new evidence. We argue that though it remains open to alternative interpretations, it strongly suggests the presence of consciousness in some patients. However, we argue that its ethical significance is less than many people seem to think. There are several different kinds of consciousness, and though all kinds of consciousness have some ethical significance, different (...) kinds underwrite different kinds of moral value. Demonstrating that patients have phenomenal consciousness — conscious states with some kind of qualitative feel to them — shows that they are moral patients, whose welfare must be taken into consideration. But only if they are subjects of a sophisticated kind of access consciousness — where access consciousness entails global availability of information to cognitive systems — are they persons, in the technical sense of the word employed by philosophers. In this sense, being a person is having the full moral status of ordinary human beings. We call for further research which might settle whether patients who manifest signs of consciousness possess the sophisticated kind of access consciousness required for personhood. (shrink)

Implicit attitudes are mental states that appear sometimes to cause agents to act in ways that conflict with their considered beliefs. Implicit attitudes are usually held to be mere associations between representations. Recently, however, some philosophers have suggested that they are, or are very like, ordinary beliefs: they are apt to feature in properly inferential processing. This claim is important, in part because there is good reason to think that the vocabulary in which we make moral assessments of ourselves and (...) of others is keyed to folk psychological concepts, like ‘belief’, and not to concepts that feature only in scientific psychology: if implicit attitudes are beliefs there is a prima facie case for thinking that they can serve as the basis for particular kinds of moral assessment. In this paper I argue that while implicit attitudes have propositional structure, their sensitivity and responsiveness to other mental representations is too patchy and fragmented for them to properly be considered beliefs. Instead, they are a sui generis kind of mental state, a state I dub patchy endorsements. (shrink)

According to one influential view, advanced by Jonathan Adler, David Owens and Susan Hurley, epistemic akrasia is impossible because when we form a full belief, any apparent evidence against that belief loses its power over us. Thus theoretical reasoning is quite unlike practical reasoning, in that in the latter our desires continue to exert a pull, even when they are outweighed by countervailing considerations. I call this argument against the possibility of epistemic akrasia the subsumption view. The subsumption view accurately (...) reflects the nature of reasoning in a range of everyday cases. But, as I show, it is quite false with regard to controversial questions, like philosophical disputes. In these, evidence against our best judgments continues to exert a hold on us. Thus, the claimed disanalogy between practical and theoretical reasoning fails. (shrink)

Consciousness, or its lack, is often invoked in debates in applied and normative ethics. Conscious beings are typically held to be significantly more morally valuable than non-consious, so that establishing whether a being is conscious becomes of critical importance. In this paper, I argue that the supposition that phenomenal consciousness explains the value of our experiences or our lives, and the moral value of beings who are conscious, is less well-grounded than is commonly thought. A great deal of what matters (...) to us and about us can be explained by functional and representational properties that may not be sufficient for phenomenal consciousness. I conclude with some reflections on how these claims might affect debates in ethics. (shrink)

The following is a transcript of the interview I (Yasuko Kitano) conducted with Neil Levy (The Centre for Applied Philosophy and Public Ethics, CAPPE) on the 23rd in July 2009, while he was in Tokyo to give a series of lectures on neuroethics at The University of Tokyo Center for Philosophy. I edited his words for publication with his approval.

This enlightening new introduction examines the history and development of moral relativism, considering the arguments for and against, and also covering such key topics as terrorism, and the rights of women in oppressive cultures.

A number of philosophers have argued in recent years that we are each, typically, responsible for our characters; for what we are, as well as what we do. This paper demonstrates that this is true only of the basically virtuous person; the basically vicious are not responsible for their characters. I establish this claim through a detailed examination of the conditions upon the attribution of moral responsibility. Most accounts of moral responsibility claim that it is only appropriately attributed to an (...) agent if she exercises control over the action, omission or consequence for which she is held responsible; it is therefore natural to think that we are responsible for our characters only if we exercise a sufficient degree of the right kind of control over their contents. Accordingly, I devote the first half of the paper to establishing that only the basically virtuous person exercises the requisite control. It is a condition upon responsibility for bringing about a consequenc! e that we are capable of understanding the value of that consequence obtaining or failing to obtain; I show that the vicious are unable to understand this value. I then turn to an examination of various non-control conceptions of responsibility for character; I show that all fail. Responsibility for character requires control, but only those who are already basically virtuous exercise the requisite degree of control. (shrink)

Second-language learners rarely arrive at native proficiency in a number of linguistic domains, including morphological and syntactic processing. Previous approaches to understanding the different outcomes of first- versus second-language learning have focused on cognitive and neural factors. In contrast, we explore the possibility that children and adults may rely on different linguistic units throughout the course of language learning, with specific focus on the granularity of those units. Following recent psycholinguistic evidence for the role of multiword chunks in online language (...) processing, we explore the hypothesis that children rely more heavily on multiword units in language learning than do adults learning a second language. To this end, we take an initial step toward using large-scale, corpus-based computational modeling as a tool for exploring the granularity of speakers' linguistic units. Employing a computational model of language learning, the Chunk-Based Learner, we compare the usefulness of chunk-based knowledge in accounting for the speech of second-language learners versus children and adults speaking their first language. Our findings suggest that while multiword units are likely to play a role in second-language learning, adults may learn less useful chunks, rely on them to a lesser extent, and arrive at them through different means than children learning a first language. Cytogenetic research has had a major impact on the field of reproductive medicine, providing an insight into the frequency of chromosomal abnormalities that occur during gametogenesis, embryonic development and pregnancy. In humans, aneuploidy has been found to be relatively common during fetal life, necessitating prenatal screening of high‐risk pregnancies. Aneuploidy rates are higher still during the preimplantation stage of development. An increasing number of IVF laboratories have attempted to improve pregnancy rates by using preimplantation genetic diagnosis (PGD) to ensure that (...) the embryos transferred to the mother are chromosomally normal. This paper reviews some of the techniques that are key to the detection of aneuploidy in reproductive samples including comparative genomic hybridization (CGH). CGH has provided an unparalleled insight into the nature of chromosome imbalance in human embryos and polar bodies. The clinical application of CGH for the purposes of PGD and the future extensions of the methodology, including DNA microarrays, are discussed. The principle of respecting patient autonomy underpins the concept and practice of informed consent. Yet current approaches to consent often ignore the ways in which the exercise of autonomy is deeply epistemically dependent.In this paper, we draw on philosophical descriptions of autonomy ‘scaffolding’ and apply them to informed consent in medicine. We examine how this relates to other models of the doctor–patient relationship and other theories (eg, the notion of relational autonomy). A focus on scaffolding autonomy reframes the justification for (...) existing ways of supporting decisions. In other cases, it suggests a need to rethink how, when and where professionals obtain consent. It may highlight the benefit of technology for supporting decisions.Finally, we consider the implications for some high-stakes decisions where autonomy is thought to be critical, for example, termination of pregnancy. We argue that such decisions should not be free from all sources of influence—rather they should be protected from undesired influence. (shrink)

Procura-se responder à questão colocada por Arthur Prior, em seu artigo ?Thank Goodness That?s Over? , acerca do caráter problemático do significado de um certo tipo de proposições indexadas temporalmente no quadro de teorias que recusam a realidade do tempo. Para tanto, defende-se a hipótese de que essas proposições são irredutíveis a proposições não (...) temporalizadas, seu sentido sendo determinado pelo caráter adverbial dos indexadores temporais e pela função de expressar estados subjetivos referencialmente opacos . Essa função, por sua vez, seria determinante para a constituição do mental enquanto tal e para a realidade do domínio prático. // The article proposes a conception of the flow of consciousness based on a non-materialistic metaphysical model of naturalization of consciousness, inspired in Spinoza's philosophy. I will try to answer Arthur Prior’s question (Thank Goodness That's Over, 1959) concerning the problematic character of the meaning of a certain type of propositions containing temporal indexes for the theories that refuse the reality of time. My hypothesis is that those propositions cannot be reduced to tenseless ones since their meaning is determined by the adverbial character of the temporal indexes and since they express subjective referentially opaque states (that are taken to be close to the Spinozistic concept of affection). I will also show that their function is crucial for the constitution of the mental and for the reality of the practical domain. (shrink)

For over a century now, American scholars (among others) have been debating the merits of “bad Samaritan” laws — laws punishing people for failing to attempt easy and safe rescues. Unfortunately, the opponents of bad Samaritan laws have mostly prevailed. In the United States, the “no-duty-to-rescue” rule dominates. Only four states have passed bad Samaritan laws, and these laws impose only the most minimal punishment — either sub-$500 fines or short-term imprisonment. -/- This Article argues that every state should criminalize (...) bad Samaritanism. There are three main reasons. First, criminalization is required by the supreme value that we place on protecting human life, a value that motivates laws against both homicide and manslaughter. Second, criminalization is recommended by the “proportionality principle” — i.e., the principle that a law’s level of punishment should be directly proportional to the moral severity of the offense. Third, criminalization would yield a number of significant benefits, including helping to minimize needless deaths and injuries and providing society with an institutional outlet for its outrage against bad Samaritans. -/- Still, many objections have been leveled against bad Samaritan laws. This Article will argue that while some of these objections — for example, the objections involving foundational criminal law principles such as the actus-reus requirement, the harm principle, and causation — are all easily refuted, five other objections are not. These five objections involve pragmatic considerations such as the difficulties with obtaining evidence against bad Samaritans and psychological considerations such as people’s understandable reasons for not wanting to “get involved.” This Article will then put these five objections into reflective equilibrium with the moral arguments for bad Samaritan laws and conclude that while bad Samaritanism should indeed be criminalized, the punishment that convicted bad Samaritans receive should be mild — certainly milder than the level of punishment recommended by the “proportionality principle.” The corollary of this conclusion is that the criminal law should sometimes abandon the proportionality principle. Ned Block has influentially distinguished two kinds of consciousness, access and phenomenal consciousness. He argues that these two kinds of consciousness can dissociate, and therefore we cannot rely upon subjective report in constructing a science of consciousness. I argue that none of Block's evidence better supports his claim than the rival view, that access and phenomenal consciousness are perfectly correlated. Since Block's view is counterintuitive, and has wildly implausible implications, the fact that there is no evidence that better supports it (...) than the rival view should lead us to reject it. The euthanasia literature typically discusses the difference between “active” and “passive” means of ending a patient’s life. Physician-assisted suicide differs from both active and passive forms of euthanasia insofar as the physician does not administer the means of suicide to the patient. Instead, she merely prescribes and dispenses them to the patient and lets the patient “do the rest” – if and when the patient chooses. One supposed advantage of this process is that it maximizes the patient’s autonomy with respect (...) to both her decision to die and the dying process itself. Still, despite this supposed advantage, Oregon is the only state to have legalized physician-assisted suicide. After summarizing the most important Supreme Court opinions on euthanasia (namely, Cruzan v. Director, Missouri Dep’t of Health; Vacco v. Quill; Washington v. Glucksberg; and Gonzales v. Oregon), this paper argues that while there are no strong ethical reasons against legalizing physician-assisted suicide, there are some very strong policy reasons for keeping it criminal in the other forty-nine states. How linguistic structures evolve so as to become easier to process is addressed by Isbilen and Christiansen for the Now‐or‐Never bottleneck. The authors suggest that this fundamental challenge in language processing is coped with by rapid compression of the transient linguistic input into chunks then to be passed on. As linguistic structures that can be chunked more easily tend to stabilize and proliferate, language evolves to fit learners’ cognitive capabilities.

Peter Baumann uses the Monty Hall game to demonstrate that probabilities cannot be meaningfully applied to individual games. Baumann draws from this first conclusion a second: in a single game, it is not necessarily rational to switch from the door that I have initially chosen to the door that Monty Hall did not open. After challenging Baumann's particular arguments for these conclusions, I argue that there is a deeper problem with his position: it rests on the false assumption that what (...) justifies the switching strategy is its leading me to win a greater percentage of the time. In fact, what justifies the switching strategy is not any statistical result over the long run but rather the "causal structure" intrinsic to each individual game itself. Finally, I argue that an argument by Hilary Putnam will not help to save Baumann's second conclusion above. (shrink)

In this paper, I introduce the notion of a Frankfurt Enabler, a counterfactual intervener poised, should a signal for intervention be received, to enable an agent to perform a mental or physical action. Frankfurt enablers demonstrate, I claim, that merely counterfactual conditions are sometimes relevant to assessing what capacities agents possess. Since this is the case, we are not entitled to conclude that agents in standard Frankfurt-style cases retain their responsibility-ensuring capacities. There is no principled rationale for bracketing counterfactual interveners (...) in standard Frankfurt-style cases, but admitting their relevance when they are Frankfurt enablers. I argue that the intuition that we ought to bracket counterfactual interveners is, at bottom, an expression of a mistaken internalist view about the mental. (shrink)

Dynamic systems theory (DS) provides tools for exploring how simpler elements can interact to produce complex psychological configurations. It may, as Lewis demonstrates, provide means for explicating relationships between two reductionist approaches to overlapping sets of phenomena. The result is a description of psychological phenomena at a level that begins to achieve the richness we would hope to achieve in examining psychological life as it is experienced and explored in psychoanalysis.
