The lex talionis of the Old Testament has been widely perceived—understandably, but mistakenly—as a barbaric law of retribution in kind. It is better understood as a seminal expression of restraint and proportionality as moral principles of punishment. This has been recognized from the earliest times. Over the intervening centuries, the lex talionis has lost neither its moral significance nor its penal relevance. This is reflected in H.L.A. Hart's synthesis of modern retributivist and utilitarian theories of punishment and, again, in contemporary (...) Canadian law through the recognition of proportionality as the fundamental principle of sentencing under the Criminal Code. The tension between this fundamental principle and Canada's increasing resort to mandatory minimum sentences of imprisonment is examined briefly in this light. (shrink)

Assigning the appropriate moral status to different stages of human development is an urgent problem in bioethics. Many philosophers have attempted to assess developmental events using strict ontological principles to determine when a developing entity becomes essentially human. This approach is not consistent with recent findings in reproductive and stem cell biology, including the discovery of the plasticity of early embryonic development and the advent of induced pluripotent stem cells. Mass drug screening offers a deceptively simple solution to the problem of drug use among workers. Even a very effective test is subject to error. In any given group of tested individuals, some will unavoidably be falsely accused. Even though scientific tests appear to provide efficient solutions to social and legal problems, these tests should not be accepted unless they also meet our standards for fair dealing.

The thesis is examined that medical schools tend to recruit those who, because of a single-minded pursuit of admission, lack the breadth of interest and the social experience necessary for the development of a socially sensitive and emotionally mature personality. This negative characterization, labeled “the premed syndrome,” has been linked to a perceived lack of physician concern for patients, interpersonal warmth, and humanitarian care. Many writers have sought to outline Wesley’s conception of how human beings obtain revelational knowledge. In this regard, the use of what has been dubbed the Wesleyan quadrilateral continues to remain widespread in both the academy and the pulpit. However, this presentation of Wesley’s thought has received severe criticism from the late William Abraham, philosopher of religion and Methodist commentator. He has proposed the creation of a new subdiscipline in epistemology for examining theology. This view has prompted a handful of (...) attempts to extrapolate John Wesley’s epistemology of theology from his various writings. The present essay will contribute to this discussion by examining Wesley’s approach to these questions. In doing so, it explores mainly the function and place of nature in Wesley’s theological reflections. Drawing mainly upon Wesley’s A View of the Wisdom of God in Creation, this essay shows that the natural world played an important, neglected role in Wesley’s epistemology of theology.Contribution: This article contributes to a new subdiscipline in epistemology for examining theology by presenting a new perspective on John Wesley by exploring the role of nature in his thought. Offering an epistemological–theological interpretation of John Wesley, this article fits well within the scope of HTS Teologiese Studies/Theological Studies, particularly this subsection. (shrink)

Collective trauma refers to psychological effects that are experienced by a group of people in response to shared traumatic conditions. Farmers represent a unique population that is chronically exposed to potentially traumatic events and conditions particular to the agricultural industry. Farming communities in Iowa have experienced the farm crisis of the 1980s, decades of extreme weather events, rapidly fluctuating markets, trade wars, rising input costs, farm bankruptcies and foreclosures, and high rates of farmer suicides. Exposure to such conditions can potentially (...) have dramatic effects on the people who experience them and the communities they live in. While research exists examining the behavioral health aspects of stress in farmers, no studies have examined the lived experiences of farmers within the framework of collective trauma and its effects on decision-making. To investigate how Iowa farmers perceive their own experiences of these potential types of collective trauma, this study conducted in-depth semi-structured interviews with farmers and farmer-oriented behavioral health experts. Particular focus is placed on how collective trauma affects individual farmers, their families, and their farming communities, as well as how this type of trauma impacts farm management decisions and sustainability outcomes. Qualitative data were analyzed using a grounded theory approach to develop a theoretical framework describing how collective trauma, in the form of environmental, financial, and community threats, impacts farm management decisions and, in turn, affects environmental, economic, and social sustainability outcomes. Potential implications for how agricultural policy can potentially address the effects and systemic causes of trauma are discussed. (shrink)

In recent years, William J. Abraham has suggested the creation of a new subdiscipline for examining the epistemology of theology. This article provides an overview of this proposal, highlighting some of the philosophical concepts, such as ‘Aristotelian epistemic fit’ and particularism, that Abraham drew upon when formulating this approach. It then proceeds to an examination of Abraham’s application of these ideas to his preferred theological scheme, canonical theism. Morris argue that, despite the general consensus within philosophy, Descartes was neither a proponent of dualism nor guilty of the many crimes of which he has been accused by twentieth century philosophers.
