This book discusses and provides insight on the legal and ethical dilemmas of managing those with Fetal Alcohol Spectrum Disorder (FASD). This book provides a clear perspective for those clinicians and legal professionals who are working with those with this disorder, and correspondingly increases their understanding when arranging effective supports for this population. Historically, the primary focus on FASD has been on children. However, this is a lifelong disorder, and the implications of this disorder become even more prominent and complex (...) in adulthood. Those with this condition can struggle with impulsiveness, and a host of cognitive difficulties. This correspondingly impacts their independence and employability, and produces an elevated risk for homelessness and other residential issues, involvement in substance use, being exploited, development of behavioural issues, and subsequent legal difficulties. Their cognitive difficulties result in challenges for legal systems around the world to understand their issues, and to design appropriate remedial strategies, recommendations for treatments and supports, and even for understanding the failure of many of these individuals to be able to change their behaviours effectively. This produces various legal and ethical dilemmas, which are discussed in detail in this volume by 28 authors from Europe, New Zealand, and North America. These include discussions regarding the rights of the unborn child, the alcohol industry's duty to warn, whether small amounts of alcohol during pregnancy can be condoned, and even the current use of involuntary hospitalization for addicted mothers. Other chapters discuss the need for training on FASD for front line officers, use of lies during interrogation of those with FASD, medical and legal interventions for offenders with FASD, access to diagnostic services and follow-up supports, and whether FASD can be considered a mitigating factor for sentencing. Furthermore, caregivers also provide their stories regarding the daily dilemmas that are faced in raising those with FASD. (shrink)

Save for Anthropologists, few social scientists have been among the participants in the discussions about the appropriate structure of a ‘Universal Darwinism’. Yet evolutionary theorizing about cultural, social, and economic phenomena has a long tradition, going back well before Darwin. And over the past quarter century significant literatures have grown up concerned with the processes of change operating on science, technology, business organization and practice, and economic change more broadly, that are explicitly evolutionary in theoretical orientation. In each of these (...) fields of study, the broad proposition put forth by Darwin that change proceeds through a process involving variation, systematic selection, renewed variation... has proved both persuasive and powerful. On the other hand, the evolutionary processes involved in these areas differ in essential ways from those we now know are operative in the evolution of biological species. The objective of this essay is to highlight those differences, which a ‘Universal Darwinism’ needs to encompass, if it is to be broad enough to be a theory that is applicable to the evolution of human cultures as well as evolution in biology. Alexander Miller has recently considered an ingenious extension of Frank Jackson and Philip Pettit's account of 'program explanation' as a way of defending non-reductive naturalist versions of moral realism against Harman's explanatory criticism. Despite the ingenuity of this extension, Miller concludes that program explanation cannot help such moral realists in their attempt to defend moral properties. Specifically, he argues that such moral program explanations are dispensable from an epistemically unlimited point of view. I show that Miller's argument for this negative (...) claim is inadequate, and that he has, in spite of himself, identified a promising defence of moral realism. (shrink)

When the evidence leaves us with a choice among hypotheses of unequal strength, how is the choice to be made?Caution would counsel us to choose the weakest, the hypothesis that asserts the least, since it is the least likely to fail us later. But the principle of maximum safety quickly reduces to absurdity; for it always dictates the choice of a hypothesis that does not go beyond the evidence at all.

: Burnout is a psychology syndrome of emotional exhaustion, depersonalization, and reduced personal accomplishment. The participants of this study are nurses who have been working at intensive care unit at least for one year. Data were obtained using questionnaire and processed using spearman correlation. Results indicate that are negative relationship between emotional exhaustion and depersonalization with perceived support from colleagues. However, this research finds no relationship between reduced personal accomplishment and perceived support from colleagues. The thesis is two-fold: to show that to be human is to have a nature disposed to inalienable conflict of interests, and to show that creativity is the best principle by which to organize interests.

A proof of ‘correctness’ for a mathematical algorithm cannot be relevant to executions of a program based on that algorithm because both the algorithm and the proof are based on assumptions that do not hold for computations carried out by real-world computers. Thus, proving the ‘correctness’ of an algorithm cannot establish the trustworthiness of programs based on that algorithm. Despite the (deceptive) sameness of the notations used to represent them, the transformation of an algorithm into an executable program is a (...) wrenching metamorphosis that changes a mathematical abstraction into a prescription for concrete actions to be taken by real computers. Therefore, it is verification of program executions (processes) that is needed, not of program texts that are merely the scripts for those processes. In this view, verification is the empirical investigation of: (a) the behavior that programs invoke in a computer system and (b) the larger context in which that behavior occurs. Here, deduction can play no more, and no less, a role than it does in the empirical sciences. (shrink)

This paper examines the relationship between modern theories of microeconomics and macroeconomics and, more generally, it evaluates the prospects of theoretically reducing macroeconomics to microeconomics. Many economists have shown strong interest in providing "microfoundations" for macroeconomics and much of their work is germane to the issue of theoretical reduction. Especially relevant is the work that has been done on what is called The Problem of Aggregation. On some accounts, The Problem of Aggregation just is the problem of reducing macroeconomics to (...) microeconomics. I show how to separate these problems and then try to determine to what extent particular kinds of solutions to The Problem of Aggregation succeed in reducing macroeconomics to microeconomics as well. I argue that reduction is not possible by this means given the current state of microeconomics. I also describe how reduction may be possible by means of (dis)aggregation if microeconomics is supplemented in a certain way with the results of experimental research on individual economic agents. BackgroundIn response to COVID-19 pandemic, the Government of Uganda adopted public health measures to contain its spread in the country. Some of the initial measures included refusal to repatriate citizens studying in China, mandatory institutional quarantine, and social distancing. Despite being a public health emergency, the measures adopted deserve critical appraisal using an ethics and human rights approach. The goal of this paper is to formulate an ethics and human rights criteria for evaluating public health measures and use it to (...) reflect on the ethical propriety of those adopted by the government of Uganda to contain the spread of COVID-19.Main bodyWe begin by illustrating the value of ethics and human rights considerations for public health measures including during emergencies. We then summarize Uganda’s social and economic circumstances and some of the measures adopted to contain the spread of COVID-19. After reviewing some of the ethics and human rights considerations for public health, we reflect upon the ethical propriety of some of Uganda’s responses to COVID-19. We use content analysis to identify the measures adopted by the government of Uganda to contain the spread of COVID-19, the ethics and human rights considerations commonly recommended for public health responses and their importance. Our study found that some of the measures adopted violate ethics and human rights principles. We argue that even though some human rights can sometimes be legitimately derogated and limited to meet public health goals during public health emergencies, measures that infringe on human rights should satisfy certain ethics and human rights criteria. Some of these criteria include being effective, strictly necessary, proportionate to the magnitude of the threat, reasonable in the circumstances, equitable, and least restrictive. We reflect on Uganda’s initial measures to combat the spread of COVID-19 and argue that many of them fell short of these criteria, and potentially limit their effectiveness.ConclusionThe ethical legitimacy of public health measures is valuable in itself and for enhancing effectiveness of the measures. Such legitimacy depends on the extent to which they conform to ethics and human rights principles recommended for public health measures. (shrink)

Over the past decade, support for reexamining and reconsidering the U.S. model of ethics review for protocols involving research with humans has grown, particularly for studies involving participants from multiple locales and organizations. The HMO Research Network received an infrastructure-building contract in 2004 that enabled us to evaluate issues in multi-institutional IRB review, examine possible changes, and propose a new model. We conducted key informant interviews and held meetings with IRB personnel, administrators, and researchers, eventually resulting in networkwide agreement to (...) pilot an alternative model of IRB review for minimal-risk, data-only studies that only entailed use of computerized data from our network sites. This article describes the organizational and interpersonal processes that led to the successful establishment of this alternative model, to inform other research consortia considering new multisite review models. El texto desarrolla -a modo de ensayo- un recorrido por el cuerpo como lugar, discurso y objeto de control, taxonomía a partir de lo cual se proponen tres operaciones posibles de desarrollar: el estudio de la memoria del cuerpo a partir de sus indicios; la comprensión histórica del ejercicio del cuerpo a partir de sus prolongaciones, y el análisis de las condiciones para el ejercicio del poder en medio de la tensión dominación-libertad. El autor plantea que las tres dimensiones desarrolladas (...) (cuerpo como lugar, como discurso y como poder) no son independientes entre sí, ya que componen un complejo sistema de relaciones que explican y encubren los significados de los vínculos del cuerpo a nivel social. Finalmente, el artículo plantea que el escenario del cuerpo constituye el punto de paso de todas las políticas con independencia de su origen, ya que en él se instala y proyecta la totalidad de la red social, siendo el principal objeto del gobierno y sus decisiones. : Bioethical discussion of justice in health care has been much enlivened in recent years by new developments in the theory of rationing and by the emergence of a strong communitarian voice. Unfortunately, these developments have not enjoyed much in the way of close engagement with feminist-inspired reflections on power, privilege, and justice. I hope here to promote interchange between "mainstream" treatments of justice in health care and feminist thought.

Philosophical Theology and East-West Dialogue is a unique philosophical and theological analysis of certain key interactions between Eastern and Western thinkers. The book on the one hand contrasts general traits of Eastern, Buddhist thought and Western, Greek thought. However, in doing so it focuses on influential philosophers and theologians who manifest particular instances of wider issues. The result is a careful examination of basic questions that offers both broad implications and concrete specificity in its approach. The book itself is an (...) instance of East-West dialogue. Independently of each other both authors had previously engaged in serious cross-cultural studies. The Japanese Inagaki had researched Western science and philosophy, then written in Japanese comparative studies of Japanese thought. The North American Jennings had researched Japanese theology. They brought these backgrounds together, dialoguing with each other until the present study emerged. Several creative Japanese thinkers, as well as important Westerners, are taken up. The study follows the lead of many Eastern impulses, but it also critically utilizes Western methods. Contemporary thinking on religious plurality is carefully examined. This new study is a must for those interested in philosophy and theology in general, and East-West interaction in particular. (shrink)

Elaine Sternberg's Just Business is one of the first book-length Aristotelian treatments of business ethics. It is Aristotelian in the sense that Sternberg begins by defining the nature of business in order to identify its end, and, thence, normative principles to regulate it. According to Sternberg, the nature of business is 'the selling of goods or services in order to maximise long-term owner value', therefore all business behaviour must be evaluated with reference to the maximisation of long-term owner value, constrained (...) only by considerations of ordinary decency and distributive justice. This stands in sharp contrast to recently popular 'stakeholder' approaches to business decision making. I argue that Sternberg's definition of business, particularly in its maximising and long-term conditions, is flawed, that her teleological method raises more questions than it solves, and that her Aristotelianism cannot be wedded happily to her libertarianism.
