The study is aimed to test the governing-law anchor in the comparative analysis of legal terminology to harmonize the clash of legal cultures in legal translation. It is considered as an adjustment to a juritraductological approach to legal translation which invites legal translators to merge the tools of jurilinguistics, comparative law and traductology in the comparative analysis of legal concepts before selecting a suitable translation solution (Monjean-Decaudin, in: Research methods in legal translation and interpreting, Routledge, 2019). Rather than (...) transposing a text from a source law system to a target law system, legal translators are believed to operate in the bi-semiotic environment of two legal cultures as navigators of their recipients toward understanding the legal concepts under the governing law of the document. To this end a comparative conceptual analysis, that correlates with the parametrization method (Matulewska in Stud Logic Gramm Rhetor 45:161–174, 2016), should be anchored in the analysis of the source law concepts (Šarčević in New Approach to Legal Translation, Kluwer Law International, The Hague, 2000). First, the componential and taxonomic analyses were used to identify conceptual markers/parameters of source concepts to serve as tertia comparationis for the subsequent search of their functional equivalents in the target legal culture. Source concepts and their functional equivalents were subsequently subject to a comparative componential analysis aimed to reveal a degree of their match based on which coinage operations were activated in selecting suitable translation strategies. We hypothesized that the change in the governing-law perspective would trigger changes in translation solutions. The governing-law-anchored process of comparative analysis was detailed and exemplified by the analysis of the conceptual field of Homicide in the Slovak law, English law, and the US Model Penal Code. The objective of this study was to explore the participants’ processing strategies on the mere exposure effect, object decision priming and explicit recognition. In Experiments 1, we observed that recognition and the mere exposure effect for unfamiliar three-dimensional objects were not dissociated by plane rotations in the same way as recognition and object decision priming. However, we showed that, under identical conditions, prompting analytic processing at testing produced a large plane rotation effect on recognition and the mere exposure effect similar (...) to that observed for object decision priming . Furthermore, inducing a non-analytic processing strategy at testing produced a reduced plane rotation effect on recognition and object decision , similar to that observed for the mere exposure effect. Autism and early-onset schizophrenia share common dimensions of social communication deficits. The possible role of common genetic factors has to be seriously considered, such as the serotonin transporter gene that influences the severity of social communication impairments (negative symptoms) and hallucinations (positive symptoms). Autism and the negative syndrome of schizophrenia might be at one extreme of a continuum, and paranoid schizophrenia (positive symptoms) at the other extreme.

Lady Lovelace’s notes on Babbage’s Analytical Engine never refer to the concept of surprise. Having some pretension to ‘originate’ something—unlike the Analytical Engine—is neither necessary nor sufficient to being able to surprise someone. Turing nevertheless translates Lovelace’s ‘this machine is incapable of originating something’ in terms of a hypothetical ‘computers cannot take us by surprise’ objection to the idea that machines may be deemed capable of thinking. To understand the contemporary significance of what is missed in Turing’s ‘surprise’ translation of (...) Lovelace’s insight, one needs to distinguish between trivial surprises and those events, propositions or encounters that lead us to question our understanding of ourselves or what surrounds us. Only some of these non-trivial surprises are the product of originality endeavours. Not only is it uncommon for surprises to track such endeavours, the type of autonomy that would be required on the part of ‘digital computers’ for originality and surprise to intersect in that way goes far beyond the operational autonomy that can be achieved by ‘learning machines’. This paper argues that a salient translation of Lovelace’s originality insight—for contemporary and future ‘learning machines’—is an upside-down version of Turing’s surprise question: can computers be surprised by us in a non-trivial, ‘co-produced’ way? ‘The regulation of gender in menopause theory’ offers a critical commentary on some key theories of menopause experience. It aims to show that the theorisation of menopause keeps to the same epistemic and ideological lines as hegemonic understandings of gender identity. Narratives of menopause has become one of the means by which one can learn to cite women’s gender correctly. In reverse, relating menopause experience against the grain of established narratives is becoming the means by which one may resist epistemic (...) bias and dominant ideology of gender. Moreover, I am proposing that while menopause experience is an important aspect of gender identity formation and its resistance, it is also becoming a new area for identity politics in general, and more particularly the site of dissident narratives. Some studies report that the sport context increases the risk of exposure to sexual violence for athletes. In contrast, others indicate a protective effect of sport participation against sexual violence, particularly among varsity athletes. Studies of sexual violence towards varsity athletes are limited by their failure to include control groups and various known risk factors such as age, graduate level, gender and sexual identity, disability status, international and Indigenous student status, and childhood sexual abuse. The purpose of the present study (...) is to fill in these gaps to determine whether varsity athletes are at greater risk than non-athletes of sexual violence towards them or whether, on the contrary, involvement in a varsity sport is coherent with the Sport Protection Hypothesis. Data for this article come from the ESSIMU study, a broad survey of students, professors, and other employees at six francophone universities regarding sexual violence on university campuses. A total of 6,485 students with complete data on sexual violence, athlete status, and gender were included in the study. From this total, 267 participants identified themselves as varsity athletes. Data were analyzed using a series of logistic regressions on each form of violence using athlete status as a predictor and characteristics associated with sexual violence victimization or distinguishing between varsity athletes and non-athletes as confounding variables. When considering all confounding variables in the regression analyses on four yearly incidence rates of sexual violence, the results revealed that being a varsity athlete did not significantly increase the risk of exposure to sexual violence at university. These non-cognitive aspects of expertise can be what distinguishes the merely competent from the truly brilliant. Yet habits can also be what makes us blind to important features of the world we inhabit. This book develops an in-depth account of habit to understand its impact upon the way moral decisions are made in a professional context. The use of airbrushed “thin ideal” models in advertising creates major ethical challenges: This practice deceives consumers and can be harmful to their emotional state. To inform consumers they are being deceived and reduce these negative adverse effects, disclaimers can state that the images have been digitally altered and are unrealistic. However, recent research shows that such disclaimers have very limited impact on viewers. This surprising result needs further investigation to understand how women who detect that images have been airbrushed (...) are still harmed by them. Three studies reported in this article address this question. The authors identify a typology, based on a combination of three emotional reactions experienced by women who are exposed to the airbrushed thin ideal. In further analyses, they investigate how detection of airbrushing—whether spontaneous or with the help of a disclaimer—relates to these emotional reactions and women’s attitudes to altered images. Results show that detection of airbrushing does not systematically protect women from either wanting to look like airbrushed thin models or the negative emotions triggered by exposure to thin ideal images, nor does it always generate defensive reactions toward ads using such images. Women who detect that images have been airbrushed may still process these images as realistic. In addition to discussing this irrational process of self-deception, this article suggests policy interventions to prevent it. (shrink)

The main purpose of this article is to bring into relief the difficulties faced by generous interpretations of the Kantian problem of poverty and to propose an alternative interpretation which (a) agrees with some generous interpretations that Kant's juridical treatment of poverty is to be understood by analogy with his juridical treatment of slavery, but which (b) departs from generous interpretations in general by arguing that this analogy is not to be understood in terms of “dependence” as such, but in (...) terms of “depersonification.” More specifically, it argues that what makes slavery and poverty unjust for Kant is not that they entail a human being finding herself (completely) dependent on the choice of another human being, but that they entail a human being being deprived of her juridical personality. The Kantian problem of poverty is ultimately a problem of juridical depersonification, and this problem of juridical depersonification does not arise in all (complete) dependence relations. (shrink)

This paper aims to highlight the role played by uncertainties in global justice theories. It will start by identifying four kinds of uncertainties that could potentially have an impact on the nature, content and very existence of global duties: first, uncertainties regarding the causes of global injustices; second, uncertainties regarding the consequences of global justice initiatives; third, uncertainties pertaining to the 'imperfect' character of certain global duties; and fourth, uncertainties regarding the conduct of others. It will discuss each of these (...) uncertainties in turn, with particular attention to their normative implications, their distinctively 'global' source, and the possibility of their being addressed. It will conclude with some reflections on how the normative issues raised by uncertainties related to spatial distance compare to those raised by uncertainties related to temporal distance. (shrink)

This article offers a critical reading of what Julia Kristeva calls ‘woman’s primary homosexuality’ and discusses homophobia in Kristeva’s work. If we are to draw conclusions on the merits and limitations of Kristeva’s theories of sexuality, homophobia needs to be assessed within the aesthetic and ethical contexts that typify Kristeva’s overall oeuvre. The article shows that we can apply Kristeva’s semiotic/symbolic model of signification to sexuality and argues for the construction of ‘primary homosexuality’ as the manifestation of resistance to authorized (...) sexual identity. The article also shows why the political demands to recognize lesbianism as a valid form of sexuality and especially as an intelligible lifestyle go against Kristeva’s understanding of what resistance entails. Recent research suggests that women react to idealized female models in advertising as they would react to real-life sexual rivals. Across four studies, we investigate the negative consequences of this imaginary competition on consumers’ mate-guarding jealousy, indirect aggression, and drive for thinness. A meta-analysis of studies 1–3 shows that women exposed to an idealized model report more mate-guarding jealousy and show increased indirect aggression, but do not report a higher desire for thinness. Study 4 replicates these findings and reveals that (...) the main driver of aggression is the sexually provocative attitude of the model, rather than her thin body size. The ethical implications of these findings for advertising are discussed in light of recent concerns about female bullying, online, and in the workplace. (shrink)

Autant que la position de la femme dans la société, le principe de la matrilinéarité juive est révélateur des normes qui régissent le lien social. Le système de filiation matrilinéaire s’est installé dans le judaïsme sur la base de l’interprétation du dit talmudique affirmant Ton fils né d’une idolâtre n’est pas ton fils mais le sien (Qid. 68b). Il entérinait un processus enclenché quelques siècles plus tôt, à l’époque de la Mishna, autour du premier siècle de l’ère, mettant un terme (...) à la longue tradition biblique qui ne percevait de filiation que patrilinéaire, et instaurait, ce faisant, un modèle de transmission de la judéité qui perdure jusqu’à nos jours. Cette transformation majeure était-elle due à une évolution interne de la pensée rabbinique rationalisant la judéité au regard des affiliations? Ou à des contraintes extérieures liées à l’imposition de nouvelles réglementations du statut de la personne? Les deux hypothèses d’interprétations sont débattues – et parfois se rejoignent – dans les recherches menées sur la filiation ou l’identité juive. Cet article examine les conditions de la transmission de l’identité de la personne, telles qu’elles ont été traitées et définies au long des siècles par l’institution de normes juridiques et sociales régulant la filiation, la conversion et l’héritage, toutes normes qui éclairent les évolutions du statut de la femme dans l’histoire du judaïsme entre l’Antiquité tardive et le Moyen Âge. This article approaches world poverty from the perspective of rectificatory justice and investigates whether the global rich can be said to have special obligations toward the global poor on the grounds that they have been harming them. The focus rests on the present situation, and more specifically on Thomas Pogge's thesis of a causal link between world poverty and the conduct of present citizens (and governments) in wealthy countries. I argue that, if Pogge does not want his position to boil (...) down to an institutional version of the ‘negative causation'-thesis – according to which one can cause harm simply by failing to alleviate it – and if he wants it to be accepted by those he seeks to convince – namely right-libertarians – he must specify that it is enough for institutions to be just that they do not actively deprive their members of the means of subsistence, even if many of them still do not have the capacity to enjoy the means of subsistence. The use of female AI agents, such as vocal assistants, chatbots and robots, is on the rise, but the indiscriminate feminization of these AI agents poses novel ethical concerns about their impact on gender relations in society. This conceptual article argues that AI agents, even virtual ones, can display sexed cues (bodies, faces, and voices) beyond mere gendered cues (e.g., names, pronouns, hairstyle) and questions how assigning artificial female gender and sex to AI agents can harm women and transform gender (...) power dynamics. Grounded in the Social Shaping of Technology and Technofeminism with an existentialist feminist lens, this work parallels the scrutiny that the use of gendered and sexed cues in female advertising models has faced over past decades to critique the deceptive practice of linking artificial gender and sex in female AI agents. It suggests that by restricting a narrow view of gender to a narrow view of biological sex, the use of female AI agents limits women’s self-concepts by binding their identities to deceptive, narrow body/face/voice-centric scripts, while facilitating covert manipulation, enforcing harmful stereotypes, amplifying objectification, and exacerbating gender power imbalances. This research offers ethical guidelines for the further development of AI agents based on transparency, justice, and care, addressing this new form of surveillance capitalism and sexual oppression, and providing insights to create a more authentic, equitable, and caring technological landscape.
