This selection of articles by Lewis E. Hahn addresses the philosophical school of contextualism and four contemporary American philosophers: John Dewey, Henry Nelson Wieman, Stephen C. Pepper, and Brand Blanshard. Stressing the relatively recent contextualistic worldview, which he considers one of the best world hypotheses, Hahn seeks to achieve a broad perspective within which all things may be given their due place. After providing a brief outline, Hahn explains contextualism in relation to other philosophies. In his opening (...) chapter, as in later chapters, he expresses contextualism as a form of pragmatic naturalism. In spite of Hahn’s high regard for contextualism, however, he does not think it would be good if we were limited to a single worldview. “The more different views we have and the more different sources of possible light we have, the better our chances that some of these cosmic maps will shed light on our world and our place in it.”. May 11, 2023, marked the end of the federal COVID-19 Public Health Emergency (PHE). During the PHE, regulatory flexibilities allowed telehealth to more effectively connect physicians providing care and patients seeking it. This paper discusses the implications of the end of the PHE on telehealth coverage, payment, reimbursement, and licensure, and exposes inconsistencies and inequities in extant state regulations.

Incomprehensible en dehors du contexte socio-politique viennois de ces annees, elle porte aussi un programme de reconstruction rationnelle qui, au dela du langage de la science, devait toucher tous les secteurs de la vie. Plus complexe qu'il n'y parait, ce programme contient, en reference a Wittgenstein, son prestigieux representant a cote d'Einstein et Russell, une mise en garde contre differentes formes d'irrationalismes, qui est d'actualite. Why wasn’t Hume a sceptic about matters of taste? He was a thoroughgoing sceptic about fundamental matters in traditional metaphysics, such as cause, causal necessitation, inductive inferences, the self, even external objects. Yet, without exception, Hume’s aesthetics is read as abruptly reversing his sceptical position and promoting a timeless and objective standard for judging beauty. I reject the dominant approach for displacing the gains of his scepticism. To impute to Hume knowledge of a standard that depends essentially on a relation (...) to certain persons makes him sound more like an idealist than an empiricist philosopher with naturalistic leanings. Instead, I read his aesthetic naturalism against the background of his sceptical commitments, by reconstructing his dilemma of taste along the lines of his general scepticism about cause. I argue that he deduces ‘that’ an unknown standard is operative, but in a qualified sense not ruled out by his scepticism. (shrink)

This book examines how legal causation inference and epidemiological causal inference can be harmonized within the realm of jurisprudence, exploring why legal causation and epidemiological causation differ from each other and defining related problems. The book also discusses how legal justice can be realized and how victims’ rights can be protected. It looks at epidemiological evidence pertaining to causal relationships in cases such as smoking and the development of lung cancer, and enables readers to correctly interpret and rationally use the (...) results of epidemiological studies in lawsuits. The book argues that in today’s risk society, it is no longer possible to thwart the competence of evidence using epidemiological research results. In particular, it points out that the number of cases that struggle to prove a causal relationship excluding those using epidemiological data will lead to an increase in the number of lawsuits for damages that arise as a result of harmful materials that affect our health. The book argues that the responsibility to compensate for damages that have actually occurred must be imputed to a particular party and that this can be achieved by understanding causal inferences between jurisprudence and epidemiology. This book serves as a foundation for students, academics and researchers who have an interest in epidemiology and the law, and those who are keen to discover how jurisprudence can bring these two areas together. Information generally comes from less than fully reliable sources. Rationality, it seems, requires that one take source reliability into account when reasoning on the basis of such information. Recently, Bovens and Hartmann (2003) proposed an account of the conjunction fallacy based on this idea. They show that, when statements in conjunction fallacy scenarios are perceived as coming from such sources, probability theory prescribes that the “fallacy” be committed in certain situations. Here, the empirical validity of their model was assessed. The (...) model predicts that statements added to standard conjunction problems will change the incidence of the fallacy. It also predicts that statements from reliable sources should yield an increase in fallacy rates (relative to unreliable sources). Neither the former (Experiment 1) nor the latter prediction (Experiment 3) was confirmed, although Experiment 2 showed that people can derive source reliability estimates from the likelihood of statements in a manner consistent with the tested model. In line with the experimental results, model fits and sensitivity analyses also provided very little evidence in favor of the model. This suggests that Bovens and Hartmann’s present model fails to explain fully people’s judgements in standard conjunction fallacy tasks. (shrink)

So impassioned is the debate on occasion, and so high the feelings, that even the tools of regulatory analysis have become part of the combat.To some, the term cost-benefit analysis, for example, is virtually a swearword, a nefarious tool used by big business to undermine regulations aimed at benefiting the people at large. To others, it is the mechanism for achieving more effective regulation (...) at less cost.This new book on the subject of reforming regulation is aimed at increasing the light and turning down the heat. It consists of an introduction and nine chapters written by scientists, public policy analysts, and economists on various aspects of regulation and regulatory analysis.The book advances the latest knowledge and evidence on risk analysis, cost-benefit analysis, and related techniques for improving regulation--all based on experience and data accumulated over the quarter century since regulation in the areas of environment, health, and safety became a major player on the governmental stage. The strengths and limitations of those analytical tools are an important part of the portrait that is painted, but a common thesis is that, properly used, the tools can be helpful in getting better regulatory results. Reflective equilibrium is a proposal to justify general norms (not only moral norms) by adjusting them to a pre-systematic practice. The paper investigates the method of constructing a reflective equilibrium as a method for ‘disappointed connoisseurs’ with regard to alternative ways of justification. The example of no-smoking norms that have emerged within the last twenty years serves several purposes: It is used to illustrate under which conditions requests for justification arise and to investigate which role a worked-out practice can play (...) in the justification of general norms. Additionally, the construction of a reflective equilibrium with respect to a no-smoking norm shows the necessity of implementing systematic considerations in the process of justification. The paper closes with some remarks concerning the characteristic quality of justification one can achieve by the method of reflective equilibrium. (shrink)
