Le respect de la vie privée et de l’intimité est un droit reconnu aux usagers des services de santé et des services sociaux par différents codes d’éthique, par la Charte des droits et libertés de la personne du Québec et par la Loi sur les services de santé et les services sociaux. Pour autant, la signification que prend ce droit demeure incertaine. Il n’y a pas une signification, mais bien des significations. S’appuyant sur un important travail d’observation dans deux comités (...) d’éthique clinique situés dans des établissements de santé et de services sociaux, les auteurs présentent et analysent ici un certain nombre de situations litigieuses dans lesquelles une interprétation du droit à la vie privée et à l’intimité a été faite. Au terme de l’exercice, il ressort entre autres que, selon les situations analysées, les discussions qui se font dans les CÉC conduisent à des modalités différentes (« déplacement et hiérarchisation », « opposition et évitement », « ouverture et compromis », « élargissement et remise en question ») qui ont pour effet de changer le regard porté sur l’usager et plus spécifiquement de faire comprendre son point de vue. En outre, si le droit à la vie privée et à l’intimité contribue à modifier l’interprétation que l’on se fait d’une situation ou des usagers, il est lui-même objet d’interprétation. C’est la diversité de sens qu’il peut prendre qui lui préserve son pouvoir d’interroger. (shrink)

Québec's complaint examination system has devoted considerable effort to supporting dissatisfied users who may wish to register complaints. It is open to question, however, whether this level of effort has, in fact, aided users in filing their complaints, and whether, once filed, the intake and processing of complaints has been rigorous and fair. Has the intake and handling of complaints at least improved? This is the question we shall attempt to answer here by presenting the results of our study concerning (...) the impact of the Complaint Assistance and Support Centers (CAAPs) on the intake of complaints. The results show that the Québec complaint examination system and its Complaint Assistance and Support Centers help make complaints more admissible and ensure that each complaint is examined. However, the system is also hindered by differences and conflicting interpretations among the various stakeholders regarding the legitimacy of complaints, respect for users’ rights, and the mission of the system. Although complaint examination systems seek to encourage users to express their points of view, users’ voices are still only partly audible. (shrink)

Residents’ councils in Quebec’s residential and long-term care centres have the mandate to promote the improvement of living conditions for residents, to assess their level of satisfaction, and to defend their rights. Based on two studies on the autonomy of councils, we examined how committees can express themselves on topics other than those the management is already aware of, to reveal various previously unknown aspects of the services, and to voice unexpressed concerns. We are especially interested in what makes management (...) receptive, or not, to what the committee members say. The councils’ ability to express them selves is, in fact, inseparable from its capacity to listen to the management teams, and we seek to determine the conditions required to perform this dual capacity. The punishment of social misconduct is a powerful mechanism for stabilizing high levels of cooperation among unrelated individuals. It is regularly assumed that humans have a universal disposition to punish social norm violators, which is sometimes labelled “universal structure of human morality” or “pure aversion to social betrayal”. Here we present evidence that, contrary to this hypothesis, the propensity to punish a moral norm violator varies among participants with different career trajectories. In anonymous real-life conditions, future teachers punished a talented (...) but immoral young violinist: they voted against her in an important music competition when they had been informed of her previous blatant misconduct toward fellow violin students. In contrast, future police officers and high school students did not punish. This variation among socio-professional categories indicates that the punishment of norm violators is not entirely explained by an aversion to social betrayal. We suggest that context specificity plays an important role in normative behaviour; people seem inclined to enforce social norms only in situations that are familiar, relevant for their social category, and possibly strategically advantageous. Cette recherche apporte des repères majeurs pour mieux saisir la place de Nietzsche dans une phénoménologie de la vie, tout en éclairant le rapport des deux philosophes à la Grèce et au christianisme. Si Nietzsche est tout particulièrement l’auteur qui sert de point d’appui à M. Henry pour remettre en question l’approche grecque de la phénoménalité, c’est parce que le philosophe allemand incarne précisément le retour à la Grèce tragique de l’époque archaïque, si bien que l’exception que ce dernier représente (...) dans la philosophie occidentale tient au fait qu’il met en œuvre des présupposés phénoménologiques différents de ceux de la Grèce idéaliste. La référence positive à Nietzsche chez M. Henry est toutefois suivie d’une période dans laquelle M. Henry prendra ses distances avec le philosophe allemand. Certes, ces deux penseurs de la vie consacrent leur dernière philosophie au christianisme, mais ils le font selon des logiques bien différentes. (shrink)

The brand personality of nonprofit service organizations is a focal cue for individuals engaging in pro-social behavior. However, the positive effect of brand personality on donors’ intention to engage pro-socially may be affected in cases in which NPOs provide monetary incentives to those donors. Relying on social exchange theory, the authors examine how monetary incentives and brand personality commonly affect the intention to donate and whether this effect varies based on the perceived trustworthiness of the NPO. The results of two (...) experimental studies show that branding and incentivizing decisions should not be developed independently because monetary incentives do indeed undermine the positive effects of brand personality on the intention to donate. However, the effectiveness of incentives varies with the perceived level of trust in the NPO: highly trusted NPO services are harmed by monetary incentives, whereas less-trusted NPOs may even benefit. They are addressed to ascetics, fuqarāʾ and ṣūfī, residing in the great mosque of Damascus, and devoted to reading the Qurʾān and praying at the tomb of prophet Zakariyyāʾ. This veneered shrine or ziyāra had been ignored until now, although it was known and it is common knowledge nowadays, that some rituals took place around the location where the head of John the Baptist, known in the lands of Islamic world as Yaḥyā (...) b. Zakariyyāʾ, was kept. Our research seeks to present aspects of the rituals held in the tomb of Zakariyāʾ, arguing that it was initially established with an impetus from Saladin, then thrived under his ayyubid successors, to start dwindling until it was abandoned by the end of the mamluk era. From the 1981 “Sexuality and Solitude” to the 1982 “Le combat de la chasteté” to the 1984 History of Sexuality, Volume 2, Michel Foucault’s published works have long recognized the influence of the historian of late antiquity, Peter Brown. With the 2018 publication of Foucault’s draft of Les Aveux de la chair (Confessions of the Flesh) bearing no mention of Brown, the depth of this influence requires further elaboration. Despite Brown not appearing in the “Index of Modern Authors,” Confessions of (...) the Flesh reflects Foucault’s debt to Brown for his readings of Augustine of Hippo and his conceptualizations of sexuality and subjectivity. Analyzing archival evidence alongside biographical narratives helps us better understand Brown’s vital influence as Foucault was shifting his History of Sexuality project, his archival practices, and his genealogy of subjectivity. Appreciating the textual and conceptual engagement between Foucault and Brown thus illuminates not only Confessions of the Flesh as Volume 4 in the History of Sexuality series but also the conceptual and methodological developments of both scholars in their disciplinary intersections. In its hegemonic definition, biopolitical governmentality is characterised by a seemingly infinite capacity of expansion, susceptible to colonise the landscape and timescape of the living present in the name of capitalistic productivity. The main trait of biopower is its normative, legal and political plasticity, allowing it to reappropriate critiques and resistances by appealing to bioethical efficacy and biological accuracy. Under these circumstances, how can we invent rebellious forms-of-life and alternative temporalities escaping biopolitical normativity? In this essay, I interrogate the theoretical (...) presuppositions of biopolitical rationality. I provide a deconstruction of the conceptual and temporal structures upholding the notion of biopolitics, in view of laying the ground for new forms of resistance. The articulation between life and power has a long philosophical history, which has been largely ignored by social theorists and political thinkers using biopolitics as an interpretative model. I re-inscribe this model within the tradition of critical materialism, by articulating Foucault’s ‘critical ontology’ to recent philosophical works on biological plasticity (Malabou). In these discourses, the logic of biopower depends on a representation of life – ‘the living’ – as living present. Biopower finds itself anchored in the authority of the present, that is to say, of being-as-presence (ontology); it sustains presentist definitions of life and materiality, be it under the form of a ‘plastic’ ontology. By drawing on Derrida’s notions of ‘spectrality’ and ‘life-death’ and Francesco Vitale’s work on ‘biodeconstruction’, I deconstruct these discourses on life and materiality and attempt to dissociate them from their ontological grounding, in order to suggest new paths of resistance to biopower. In particular, I follow the tracks of “the monster” in the work of Foucault, Derrida and Malabou. Foucault tells us that the monster is a singular figure, parasitic and subversive, beckoning a life beyond life, at once organic and non-organic, located at the limit between the normal and the exceptional, and exceeding the scope of biopolitical normativity in both theoretical and practical terms. It exists at the intersection of what Foucault names “the symbolics of blood” and “the analytics of sex”. As such, it materialises a self-transformative dimension of the living which remains, I argue, inadequate to Malabou’s representation of plasticity. The monstrous is a self-deconstructive motif calling for another biopolitical rationality, before or beyond ontological reductions or reconstructions. (shrink)

This essay intends to show, from a rigorous historical perspective, that Bruno's decision to die was the consistent and conscious result of a long and hard struggle fought against others as well as with himself. It was a struggle in which emerged as especially significant the particular mutual (...) – and not always fully understood – relationship between Giordano Bruno and Pope Clement VIII, above all during the final stage of the trial. Ce graffiti exprime à sa manière l'un des grands défis de la philosophie française de cette fin de siècle, à savoir celui de sa popularité. Car la philosophie est désormais au centre de la vie publique : elle trône dans les cafés, se fait une place dans l'entreprise et s'installe même dans (...) les cabinets privés. Mais ce qui ne laisse pas d'étonner, c'est l'écho qu'elle rencontre auprès d'un grand public avide de lectures philosophiques. Il convient de s'interroger sur cet engouement, ou plutôt d'interroger les philosophes à ce sujet, eux qui sont sans doute les mieux placés pour y répondre. " Précédés d'une introduction à l'œuvre des auteurs interviewés, les six entretiens réunis dans ce livre font le point à la fois sur la pensée de chacun d'eux et sur la situation générale de la philosophie française actuelle. El presente estudio identifica el lento forjamiento de un procedimiento de subjetivación cristiano que, creado a propósito del uso de las riquezas entre finales del siglo II y mediados del siglo III de nuestra era, empieza a imaginar que la circulación de riquezas entre los hombres y mujeres en la tierra permite atesorar riquezas en el cielo. Se trata de un procedimiento penitencial de transformación de sí que permitirá a los y las cristianas remitir el mal hecho y manifestar su (...) verdad mediante un peculiar uso de las riquezas. El estudio de este procedimiento de subjetivación puede abrir un nuevo capítulo para explorar la formación de un tipo de experiencia con base a “cierto modo de relación de uno consigo mismo y cierta relación entre el mal y la verdad”, que Michel Foucault estudia en _Las confesiones de la carne_. Dicha experiencia no será, sin embargo, una experiencia de la carne. Si seguimos a Clemente de Alejandría, esta experiencia sería la de la constitución de una vida sencilla por quien se dirige a ser espiritualmente pobre, mientras que si escuchamos a Cipriano de Cartago la llamaríamos simplemente la de la constitución de un sujeto misericorde. Al terminar el estudio propondré que esta experiencia de la pobreza espiritual o de la misericordia descansa en una profesión de fe no verbalizada que revela una copertenencia entre el acto de fe y el acto de verdad a partir de la reflexividad del sujeto sobre sí mismo. En otras palabras, sostendré que el uso penitencial de las riquezas, aunque no se verbalizara, se dirigía a realizar un acto reflexivo de verdad. (shrink)

__Neurotechnology and Direct Brain Communication__ focuses on recent neuroscientific investigations of infant brains and of patients with disorders of consciousness, both of which are at the forefront of contemporary neuroscience. The prospective use of neurotechnology to access mental states in these subjects, including neuroimaging, brain simulation and brain computer interfaces, offers new opportunities for clinicians and researchers, but has also received specific attention from philosophical, scientific, ethical and legal points of view. In the 1950’s Quine rejected the analytic/synthetic distinction insisting, instead,on language conceived of as a tool created by mankind for practical purposes, and this move allowed him to overcome the strictures of a purely analytic conception of language by resorting, instead, to the pragmatist tradition represented by thinkers like James, Peirce and Dewey and C.I. Lewis. In the subsequent phases of his philosophical development, however, his commitment to pragmatism became looser, maybe because Dewey and the other main fi gures of (...) American classical pragmatism always stress the practical side of the scientifi c enterprise, thus not giving too much importance to the construction of artificial languages. What kind of metaphysics, if any, cana pragmatically oriented philosopher consistently endorse? All we have to do is to envision a more modest concept of metaphysics. A pragmatist metaphysics can indeed be construed, provided we recall that metaphysics – just like science – evolves with the passing of time. An author like Rescher follows this path. Nowhere he presents his own system as giving the “final” answer to all metaphysical, epistemic or ethical interrogatives. After all, if science is no longer held to give the ultimate answers, why should such a burden be put on the philosopher’s shoulders? (shrink)

This provocative work provides a radical reassessment of the emergence and nature of Christian sexual morality, the dominant moral paradigm in Western society since late antiquity. While many scholars, including Michel Foucault, have found the basis of early Christian sexual restrictions in Greek ethics and political philosophy, Kathy L. Gaca demonstrates on compelling new grounds that it is misguided to regard Greek ethics and political theory—with their proposed reforms of eroticism, the family, and civic order—as the foundation of Christian sexual (...) austerity. Rather, in this thoroughly informed and wide-ranging study, Gaca shows that early Christian goals to eradicate fornication were derived from the sexual rules and poetic norms of the Septuagint, or Greek Bible, and that early Christian writers adapted these rules and norms in ways that reveal fascinating insights into the distinctive and largely non-philosophical character of Christian sexual morality. Writing with an authoritative command of both Greek philosophy and early Christian writings, Gaca investigates Plato, the Stoics, the Pythagoreans, Philo of Alexandria, the apostle Paul, and the patristic Christians Clement of Alexandria, Tatian, and Epiphanes, freshly elucidating their ideas on sexual reform with precision, depth, and originality. Early Christian writers, she demonstrates, transformed all that they borrowed from Greek ethics and political philosophy to launch innovative programs against fornication that were inimical to Greek cultural mores, popular and philosophical alike. The Septuagint's mandate to worship the Lord alone among all gods led to a Christian program to revolutionize Gentile sexual practices, only for early Christians to find this virtually impossible to carry out without going to extremes of sexual renunciation. The presence of easily accessible yet unpossessed evidence seems to matter epistemically. In this chapter I offer an inquiry-theoretic explanation of this datum. I argue that agents in the target cases fail to be competent inquirers and gather the relevant easily accessible evidence. This offers a deflationary explanation of the initial datum. I then show how to inflate this explanation to vindicate the thought that unpossessed evidence has defeating power over the justificatory status of one’s beliefs. The inflationary explanation rests (...) on two main planks. First, the subject who believes that p in the target cases ought to have gathered the target piece of evidence that bears on p. Secondly, such a duty is incompatible with justifiedly believing p. Along the way, the chapter offers a framework for thinking about zetetic competence, comments on the existence of epistemic duties of inquiry, and discusses the relationship between such duties and traditional epistemic norms of belief. Most scientific theories are globally inconsistent. Chunk and Permeate is a method of rational reconstruction that can be used to separate, and identify, locally consistent chunks of reasoning or explanation. This then allows us to justify reasoning in a globally inconsistent theory. We extend chunk and permeate by adding a visually transparent way of guiding the individuation of chunks and deciding on what information permeates from one chunk to the next. The visual representation is in the form of bundle diagrams. (...) We then extend the bundle diagrams to include not only reasoning in the presence of inconsistent information or reasoning in the logical sense of deriving a conclusion from premises, but more generally reasoning in the sense of trying to understand a phenomenon in science. This extends the use of the bundle diagrams in terms of the base space and the fibres. We then apply this to a case in physics, that of understanding binding energies in the nucleus of an atom using together inconsistent models: the liquid drop model and the shell model. We draw some philosophical conclusions concerning scientific reasoning, paraconsistent reasoning, the role of logic in science and the unity of science. (shrink)

In this paper I take up the question of the nature of the doxastic attitudes we entertain while inquiring into some matter. Relying on a distinction between two stages of open inquiry, I urge to acknowledge the existence of a distinctive attitude of cognitive inclination towards a proposition qua answer to the question one is inquiring into. I call this attitude “hypothesis”. Hypothesis, I argue, is a sui generis doxastic attitude which differs, both functionally and normatively, from suspended judgement, full (...) belief, credences, and acceptance. In closing, I point to the epistemological significance of hypothesis. More specifically, I contend that holding an attitude of hypothesis enables us to respond rationally to peer disagreement, and I suggest that such an attitude offers a suitable articulation of the view, originally put forward by Philip Kitcher, that cognitive diversity in inquiry has epistemic benefits. This article presents a fairness principle for evaluating decision-making based on predictions: a decision rule is unfair when the individuals directly impacted by the decisions who are equal with respect to the features that justify inequalities in outcomes do not have the same statistical prospects of being benefited or harmed by them, irrespective of their socially salient morally arbitrary traits. The principle can be used to evaluate prediction-based decision-making from the point of view of a wide range of antecedently specified (...) substantive views about justice in outcome distributions. The recently published Guidelines on Disorders of Consciousness by the European Academy of Neurology and by the American Academy of Neurology in collaboration with the American Congress of Rehabilitation Medicine and the National Institute on Disability, Independent Living, and Rehabilitation Research stand as the most ambitious international attempts to provide clear and standardized recommendations to clinicians working with patients with DoCs. They offer an updated, timely, and wide-ranging list of recommendations for the diagnosis, prognosis, and clinical care of affected patients. (...) However, while commendable, the guidelines pose a number of questions including some related to the practical implementation of their recommendations. The paper introduces the Distributed Responsibility Model as a tool for maximizing the impact of recommendations in clinical practice. (shrink)

Permissivism is the view that, sometimes, there is more than one doxastic attitude that is perfectly rationalised by the evidence. Impermissivism is the denial of Permissivism. Several philosophers, with the aim to defend either Impermissivism or Permissivism, have recently discussed the value of (im)permissive rationality. This paper focuses on one kind of value-conferring considerations, stemming from the so-called “truth-connection” enjoyed by rational doxastic attitudes. The paper vindicates the truth-connected value of permissive rationality by pursuing a novel strategy which rests on (...) two main planks: first, there is a distinction between a fine-grained and a coarse-grained type-individuation of belief-forming methods. Secondly, different kinds of decision-theoretic reasoning, i.e. expected-accuracy reasoning and accuracy-domination reasoning, must be paired with a fine-grained and a coarse-grained type-individuation of methods, respectively. I argue that while the first pair is wholly irrelevant to the question of the truth-connection, the second affords the means to a permissivist explanation of the truth-connected value of rationality. The article investigates the significance of the so-called phenomenon of apparent faultless disagreement for debates about the semantics of taste discourse. Two kinds of description of the phenomenon are proposed. The first ensures that faultless disagreement raises a distinctive philosophical challenge; yet, it is argued that Contextualist, Realist and Relativist semantic theories do not account for this description. The second, by contrast, makes the phenomenon irrelevant for the problem of what the right semantics of taste discourse should be. Lastly, the (...) following dilemma is assessed: either faultless disagreement provides strong evidence against semantic theories; or its significance should be considerably downplayed. (shrink)

The present dissertation starts from the general claim that neuroscience is not neutral, with regard to theoretical questions like the nature of consciousness, but it needs to be complemented with dedicated conceptual analysis. Specifically, the argument for this thesis is that the combination of empirical and conceptual work is a necessary step for assessing the significant questions raised by the most recent study of the brain. Results emerging from neuroscience are conceptually very relevant in themselves but, notwithstanding its theoretical sophistication, (...) neuroscience is not sufficient to provide a complete interpretation or an appropriate understanding of their impact. Consequently, the present thesis starts from the need for an interdisciplinary and hybrid field of research, i.e. fundamental neuroethics. Within this framework, the thesis takes consciousness and related disorders and the addicted brain as illustrative cases of the potential fruitful collaboration between empirical and conceptual investigations. The general goal of the thesis is to contribute to the overall development of bridging the gap between empirical and conceptual understandings of consciousness. The first paper sets the theoretical framework, providing an empirically-based description of the brain with significant philosophical implications for an understanding of consciousness. The last three papers of the thesis try to apply the theoretical framework to illustrative cases. Papers II and III analyse the possible application of science and technology for an easier detection and clinical care of patients with disorders of consciousness, with particular attention to communication mediated by neurotechnology and the simulation of the conscious brain, respectively; paper IV provides a potentially new ethical analysis of addiction within the elaborated general conceptual framework. The conclusion of the thesis is that the impact of neuroscientific results needs that a dedicated conceptual approach reveals and investigates their conceptual meaning. This conceptual analysis is not exclusive but integrative and complementary to the empirical science. The case of consciousness, analysed from both an ethical and conceptual point of view, is highly illustrative in this respect. In the end, a conceptual/linguistic work of clarification is urgently needed. (shrink)
