This article advocates employing John Stuart Mill's harm principle to set the boundary for unregulated free speech, and his Greatest Happiness Principle to regulate speech outside that boundary because it threatens unconsented-to harm. Supplementing the harm principle with an offense principle is unnecessary and undesirable if our conception of harm integrates recent empirical evidence unavailable to Mill. For example, current research uncovers the tangible harms individuals suffer directly from bigoted speech, as well as the indirect harms generated by the systemic (...) oppression and epistemic injustice that bigoted speech constructs and reinforces. Using Mill's ethical framework with an updated notion of harm, we can conclude that social coercion is not justified to restrict any harmless speech, no matter how offensive. Yet certain forms of speech, such as bigoted insults, are both harmful and fail to express a genuine opinion, and so do not deserve free speech protection. (shrink)

Melina Constantine Bell (2021) argues that J. S. Mill's harm principle permits society to coercively interfere with the use of bigoted insults, since these insults are harmful on “a more expansive, modern, conception of harm.” According to Bell, these insults are harmful in virtue of their contributing to detrimental objective states like health problems. I argue that people with illiberal dispositions might have intense and sustained negative subjective reactions to behavior that the harm principle ought to protect, (...) reactions intense enough to affect their health or other objective interests. Bell's way of thinking about harm therefore has illiberal implications. Yet I agree with her that bigoted insults should be regarded as harmful. I therefore propose an alternative way of understanding harm according to which subjective pain is a harm when it is intentionally caused. (shrink)

Recent scholarship on John Stuart Mill has illuminated his arguments about the normative legitimacy of imperial rule. However, it has tended to ignore or downplay his extensive writings on settler colonialism: the attempt to create permanent "civilized" communities, mainly in North America and the South Pacific. Mill defended colonization throughout his life, although his arguments about its character and justification shifted over time. While initially he regarded it as a solution to the "social problem" in Britain, he increasingly came to (...) argue that its legitimacy resided in the universal benefits—civilization, peace, and prosperity—it generated for humanity. In the final years of his life Mill seemed to lose faith in the project. Finally recognizing the prevalence of colonial violence and the difficulty of realizing his grand ambitions, yet refusing to give up on colonization altogether, his colonial romance gave way to a form of melancholia. Developments in neuroscience have raised the possibility that pharmaceuticals may be used to enhance memory, mood, and attention in people who do not have an illness or disorder, a practice known as “cognitive enhancement.” We describe historical experiences with two medicinal drugs for which similar enhancement claims were made, cocaine in the late 19th and early 20th centuries, and amphetamines in the mid 20th century. These drugs were initially introduced as medicinal agents in Europe and North America before becoming more (...) widely used for a variety of purposes, including what would nowadays be considered cognitive enhancement. Their trajectory of use conformed to the typical use cycle of psychotropic drugs. There was an initial steep rise in prescribing for medical use, followed by expanded nonmedical use that was fueled by enthusiasm for the drugs’ effects. As the number of regular users increased, problems related to use (such as addiction) became apparent, societal concern increased, and laws were passed banning nonmedical use and eventually, medical use. This historical experience draws attention to the adverse side effects of enhancement use that only become apparent with regular, wide-scale use of a drug. We highlight the similarities between the enthusiasms for cocaine and amphetamines and the current enthusiasms for using prescription stimulants for cognitive enhancement. We argue bioethicists should not encourage the cognitive enhancement use of drugs such as methylphenidate in the absence of evidence on the efficacy and safety of their use for cognitive enhancement purposes. The opioid epidemic has claimed the lives of more than 183,000 individuals since 1999 and is now the leading cause of accidental death in the United States. Meanwhile, rates of incarceration have quadrupled in recent decades, and drug use is the leading cause of incarceration. Medication-assisted treatment or MAT is the gold standard for treatment of opioid use disorder. Incarcerated individuals with opioid use disorder treated with methadone or buprenorphine have a lower risk of overdose, lower rates of hepatitis C (...) transmission, and lower rates of re-incarceration. Despite evidence of improved outcomes, many jails and prisons do not offer MAT to individuals with opioid use disorder. This seems partly due to a scientifically unjustified preference for an abstinence-only treatment approach. The absence of MAT in prisons and jails results in poor outcomes for individuals and poses a public health threat to communities. Furthermore, it disproportionately harms poor communities and communities of color. Health care providers in prisons and jails have an ethical obligation to offer MAT to individuals with opioid use disorder to mitigate risk of infectious diseases, opioid overdose and health disparities associated with incarceration. In the article “Nudging and Informed Consent”, Cohen argues that the use of “nudging” by physicians in the clinical encounter may be ethically warranted because it results in an informed consent where obligations for beneficence and respect for autonomy are both met. However, the author's overenthusiastic support for nudging and his quick dismissal of shared decision-making leads him to assume that “soft” manipulation is un-problematic and that “wisdom” on the side of medical professionals will suffice to guard against abuse. Opposing (...) this view, we propose that: 1) patient preferences and values should not be boiled down to rational or irrational decisions based on cognitive reasoning alone, 2) potential threats to the physician-patient must be mitigated and could be minimized by employing alternative strategies that acknowledge the impact of cognitive heuristics in shaping decision-making but maintain transparency and trust, and 3) patient preferences and values can be legitimately influenced only under specific circumstances. The latter include: (1) exhaustion of other means; (2) evidence that nudging is effective in a specific context; (3) evidence of clear and active public misinformation (e.g., industry promoting smoking); (4) explicit pubic dialogue between various stakeholders including medical professional societies about nudging; (5) upholding shared decision-making as a preferred approach; and (6) a rich understanding of clinical reality beyond the simple dichotomy of beneficence-autonomy. It is estimated that more than half of all online transactions are abandoned before completion. This paper investigates the psychological factors that influence online shopping behavior, with a view to improving transactional success rates. Through a critical review of the literature, we identify a range of factors which predict abandonment of online shopping, highlighting affective and motivational dimensions in addition to processing style and characteristics of the consumer, device, and product. We conclude that online purchasing and payment systems that boost (...) consumers’ motivation to buy and prevent or attenuate negative affective states will demonstrate the greatest rates of transactional success. However, with rapid advancement in technology, continued research is needed to fully understand the potential impact on future online purchasing behavior. (shrink)

A weak form of intuitionistic set theory WST lacking the axiom of extensionality is introduced. While WST is too weak to support the derivation of the law of excluded middle from the axiom of choice, we show that bee.ng up WST with moderate extensionality principles or quotient sets enables the derivation to go through.

In this article I argue that, if one is persuaded by the arguments of Emmanuel Levinas, the pursuit of something called ‘ethical feminism’ is rendered difficult, for, according to Levinas, there is a hiatus between ethics and politics in so far as politics does not flow from ethics. Indeed, politics obliges one to engage in the non-ethical, so that the ethical cannot be understood as a basis for feminist politics. I contend that one can argue that it is in the (...) way that the dangers of the non-ethical are handled that politics begins. If this is so, one can refigure the question of ethics within feminism. Ethics becomes a check on freedom and politics rather than its originary source. However, I argue, along with Michel Foucault and William Connolly, that ethical responses, while coming from the other, have also to be subjected to genealogical critique, so that their conditions of possibility are not naturalized. Referring to Hannah Arendt’s book Eichmann in Jerusalem, the Southern US fiction writer Flannery O’Connor expressed the effect of the revelations about the horrors of Nazi Germany as ‘haunting’. Taking this comment and her admiration of Arendt as a cue, this article rereads Flannery O’Connor’s fictional depiction of secular characters. Usually lauded or critiqued for her entanglement in ‘otherworldly’ concerns, here these concerns become comprehensible as much as political intervention as motivated by ‘religious’ belief. O’Connor’s frequently humorous use of her (...) fiction as a retort to the secular world was inflected by her reading of Eric Voegelin’s contemporary secularization thesis with its criticism of all ‘isms’. In this context, O’Connor’s admiration for Arendt becomes all the more intriguing (since Arendt’s interpretations of the human condition clashed with Voegelin’s), and allows one to stage a theoretical meeting in order to explore O’Connor’s depiction of the secular in relation to a speculative exploration of how Arendt might have responded to the fiction of O’Connor. Such a staging is accomplished here via a reading of O’Connor’s short story ‘The Lame Shall Enter First’ read against Arendt’s concerns, principally those expressed in The Human Condition. (shrink)

The cultural construction of motherhood represents women of low socioeconomic status as excessively fertile, placing them outside of the infertility discourse. Previous research on infertility reinforces poor women’s exclusion by focusing on the experiences of women receiving medical treatment, typically women of high SES. In this article, the author explores how 20 poor and working-class women negotiate their experiences of infertility. In-depth interviews expose the contextual experiences of infertility among women of low SES, specifically revealing the structural inequality apparent within (...) those experiences. The women are not passive objects of dominant discourses; they are active subjects in resisting, redefining, and accepting the discourses according to their contexts. Women of low SES are outsiders—within to dominant understandings and resolutions to infertility. Their unique insights not only provide a more nuanced understanding of infertility but they also begin to deconstruct the stratified system of reproduction. (shrink)

J. G. Ballard was one of the most original writers of the postwar era. Although he has drawn considerable attention from scholars across various fields, the character of his political thinking remains a puzzle. He has been claimed as both a radical and a conservative, while others suggest that his work expresses no distinct political stance. Drawing on a wide range of source materials, I argue that from the 1960s to the early years of the twenty-first century Ballard developed a (...) bold and intriguing account of liberalism grounded in insights drawn from surrealism and Freudian psychoanalysis. This was an idiosyncratic version of the liberalism of fear. The essay analyzes Ballard’s sociopolitical vision, focusing in particular on his account of human nature, social reality, totalitarianism, and the power of the imagination. (shrink)

This article addresses the activation of aesthetics through the examination of an acute sensitivity to melancholy and time permeating the literary and pictorial arts of Japan. In medieval court circles, this sensitivity was activated through a pervasive sense of aware, a poignant reflection on the pathos of things. This sensibility became the motivating force for court verse, and through this medium, for the mature projects of the ukiyo-e ‘floating world picture’ artist Katsushika Hokusai. Hokusai reached back to aware sensibilities, subjects (...) and conventions in celebrations of the poetic that sustained cultural memories resonating classical lyric and pastoral themes. This paper examines how this elegiac sensibility activated Hokusai’s preoccupations with poetic allusion in his late representations of scholar-poets and the unfinished series of Hyakunin isshu uba-ga etoki, ‘One hundred poems, by one hundred poets, explained by the nurse’. It examines four works to explain how their synthesis of the visual and poetic could sustain aware themes and tropes over time to maintain a distinctive sense of this aesthetic sensibility in Japan. is philosophy worthy of loyal service? Using Josiah Royce and Frank Oppenheim as guides, I will argue that philosophy is indeed a worthy and crucial loyalty. Its special cause will be considered here as a mode of what Royce terms a "loyalty to loyalty," as an infinite service of all specific truth-seeking activities undertaken by all communities of loyal individuals. Regarding them as individually valuable, philosophy champions them in their individuality and plays an interpretive function among them, so that specification (...) of truth-seeking in distinct domains leads to communicable discoveries valuable for all truth-seekers, as opposed to the discreteness, separation, and lifeless abstraction that can occur when...
