The opioid epidemic has claimed the lives of more than 183,000 individuals since 1999 and is now the leading cause of accidental death in the United States. Meanwhile, rates of incarceration have quadrupled in recent decades, and drug use is the leading cause of incarceration. Medication-assisted treatment or MAT is the gold standard for treatment of opioid use disorder. Incarcerated individuals with opioid use disorder treated with methadone or buprenorphine have a lower risk of overdose, lower rates of hepatitis C (...) transmission, and lower rates of re-incarceration. Despite evidence of improved outcomes, many jails and prisons do not offer MAT to individuals with opioid use disorder. This seems partly due to a scientifically unjustified preference for an abstinence-only treatment approach. The absence of MAT in prisons and jails results in poor outcomes for individuals and poses a public health threat to communities. Furthermore, it disproportionately harms poor communities and communities of color. Health care providers in prisons and jails have an ethical obligation to offer MAT to individuals with opioid use disorder to mitigate risk of infectious diseases, opioid overdose and health disparities associated with incarceration. This article argues that correctional institutions violate the Eighth Amendment when they refuse to establish MAT programs and prevent doctors from exercising medical judgment to properly treat incarcerated people with OUD.

In 1892, near Trinil on the island of Java, laborers under the direction of the expatriate Dutch physician‐anatomist Eugène Dubois uncovered fossil bones that, Dubois believed, belonged to a single member of a hitherto‐undiscovered species. Dubois named the species Pithecanthropus erectus , a reflection of his steadfast belief in its transitional role in human evolution. The fossil, popularly known as “Java Man,” is now classified as Homo erectus—a species not fully human but far closer to us than Dubois envisioned.Dubois and (...) Pithecanthropus have been covered before: briefly in Carl Swisher, Garniss Curtis, and Roger Lewin's Java Man and at length in Bert Theunissen's Eugene Dubois and the Ape‐Man from Java . Pat Shipman's interests are more strictly biographical: Dubois as a family man, as a European in Southeast Asia, and as a scientist struggling to establish a career and a reputation. The Man Who Found the Missing Link weaves together the multiple threads of a complex life: extensive travels, eclectic scientific interests, tempestuous relations with colleagues, and a slowly disintegrating marriage. It vividly conveys Dubois's near‐obsession with the Pithecanthropus erectus fossils and his tenacity in defending their significance. Shipman tells the story almost exclusively from Dubois's point of view and almost exclusively in the present tense, sacrificing authorial distance for immediacy. The book often reads, therefore, as if it were Dubois's own memoir, “as told to” Shipman.Lavishly produced by a major trade publisher, Shipman's book is clearly aimed at readers who have enjoyed the work of Dava Sobel, Bella Bathurst, and Simon Winchester. Taken on those terms, it succeeds admirably. Like Sobel's Longitude and Winchester's The Map That Changed the World , it is a vigorous tale of an embattled scientific maverick who triumphs despite repeated setbacks. Like them, it succeeds both as literature and as a character study.Historians interested in the book for professional reasons will find it less satisfying. It is full of recounted conversations and descriptions of unvoiced thoughts and feelings—these elements are the heart of the book's literary style and essential to its characterization of Dubois. The sparse and sketchy endnotes make it impossible, however, to determine the sources of this material or to draw clear lines between contemporary accounts, after‐the‐fact recollections, the author's inferences, and outright speculations. Shipman writes, in one alarming example, that “Dubois is something else, something extraordinary, the coolies conclude. He is a chosen man. Clearly he has been given a special role or dharma through a divine revelation: that is the only possible explanation” . With no endnote to explain the source of this insight into the coolies' thoughts, readers are left to wonder if it is Dubois's own imperialist fantasy, reported as if it were fact.Shipman also does little to relate Dubois to the scientific world of his day. Coverage of the culture of colonial science, Dutch scientific institutions, and turn‐of‐the‐century debates over human evolution is scant. Scientists like Henry Fairfield Osborn, Ales Hrdlicka, and Ralph Von Koenigswald are introduced with only vague indications of their interests, status, or intellectual commitments. Hominid fossils other than Pithecanthropus erectus receive little more attention; even the Neanderthals, on whom Shipman has coauthored an authoritative book, are accorded only a handful of pages. All of this makes it difficult to assess whether Dubois's experiences were typical of the times, places, and fields in which he worked. It also undercuts Shipman's claim that Dubois, by his dogged insistence on the “missing link” status of Pithecanthropus erectus, forced his fellow scientists to confront the reality of human evolution. This study explores the impact of mood on individuals’ ethical decision-making processes through the Graham [Graham, J. W.: 1986, Research in Organizational Behavior 8, 1–52] model of Principled Organizational Dissent. In particular, the research addresses how an individual’s mood influences his or her willingness to report the unethical actions of a colleague. Participants’ experienced an affectively charged, unrelated event and were then asked to make a decision regarding whistle-blowing intentions in a public accounting context. As expected, negative mood was associated (...) with lower intentions to report the unethical actions of others to a superior within the organization. The Graham model, which proposes that reporting intentions are impacted by the three determinants of seriousness, personal responsibility and cost, was employed to more clearly understand the nature of the affect–reporting intention relationship. The role of affect was explained by demonstrating that two determinants mediate the relationship between mood and whistle-blowing intentions. Specifically, as seriousness and responsibility have a positive impact on reporting intentions, the reduction of these perceptions by negative mood reduces the intent to report. The negative impact of personal cost on reporting intentions was significant, although not as a mediator of mood. (shrink)

Contract cheating, or plagiarism via paid ghostwriting, is a significant academic ethical issue, especially as reliable methods for its prevention and detection in students’ assignments remain elusive. Contract cheating in academic assessment has been the subject of much recent debate and concern. Although some scandals have attracted substantial media attention, little is known about the likely prevalence of contract cheating by students for their university assignments. Although rates of contract cheating tend to be low, criminological theories suggest that people who (...) employ ghostwriters for their assignments are likely to re-offend, and little is known about re-offence rates in this form of academic misconduct. We combined previously-collected datasets and conducted additional, and previously-unreported, analyses on self-report measures of contract cheating prevalence. We found that few students, on aggregate, ever engaged in contract cheating but this varied substantially among samples. Of those who ever engaged in contract cheating, 62.5% did so more than once. The data also suggested that engagement in contract cheating is influenced by opportunity. These figures may help policy makers, and researchers who are creating contract cheating detection methods, to estimate base rates of contract cheating and the likelihood of re-offence. (shrink)

Historians should not use their own up-to-date methodologies to judge the rationality or correctness of the research strategies of scientists in history. For the history of science is, in part, the history of the rational growth of methodology and the historian's own up-to-date methodology is, in part, a product of the scientific revolutions of the past. Historians who use their own methodologies to judge the rationality of past research strategies are being too wise after the event. I show, using the (...) case of Charles Darwin, how we can judge the rationality and correctness of research strategies and revolutions without being too wise after the event. I do this by rejecting the idea that methodologies double as rationality theories and by drawing instead on Popper's competing view of rationality as critical debate. (shrink)

In this paper I defend the view that a zygote is a human from the fission objection that is widely thought to be decisive against the view. I do so, drawing upon a recent discussion of this issue by John Burgess, by explaining in detail the metaphysical position the proponent of the view should adopt in order to rebut the objection.

According to the parent analogy, as a caretaker’s goodness, ability and intelligence increase, the likelihood that the caretaker will make arrangements for the attainment of future goods that are unnoticed or underappreciated by their dependents also increases. Consequently, if this analogy accurately represents our relationship to God, then we should expect to find many instances of inscrutable evil in the world. This argument in support of skeptical theism has recently been criticized by Dougherty. I argue that Dougherty’s argument is incomplete, (...) for there are two plausible ways of construing the parent analogy’s conclusion. I supplement Dougherty’s case by offering a new argument against the parent analogy based on failed expectations concerning the amount of inscrutable evils encountered in the world. Consequently, there remains a significant empirical hurdle for skeptical theism to overcome if it is to maintain its status as a defeater for our reliability when tracking gratuitous evils. (shrink)

The recently proposed Cognitive Experiential Leadership Model (CELM) states that leaders’ preference for rational thinking and behavioral coping will be related to their level of transformational leadership. The CELM was based on research that principally used cross-sectional self-report methods. Study 1 compared both self-ratings and follower-ratings of leadership styles with leaders’ self-rated thinking styles in 160 leader-follower dyads. Study 2 compared both self-ratings and coworker-ratings of leadership styles with leaders’ self-rated thinking styles for 74 leaders rated by 607 coworkers. In (...) both Studies, leaders’ rational thinking, imaginative thinking, and behavioral coping correlated positively with their self-rated transformational leadership. However, only behavioral coping, but not rational thinking, was correlated with follower-rated (FR) transformational leadership in Study 1, and thinking styles were unrelated to other-rated transformational leadership in Study 2. These results partly support and partly challenge the CELM. Practically, this study suggests that leadership may be improved by leaders developing their capacity for behavioral coping. (shrink)

In this note I firstly give a formulation of Berkeleyean Idealism in modern anti‐realist terms. Secondly, I supply a reading of Berkeley that serves to do three things: 1. It makes clear that the formulation of the position in modern terms is acceptable. 2. It offers a revealing insight into the reasons why Berkeley accepted the position. 3. It allows us to see that these reasons are, in fact, bad ones.

Black Panther, directed by Ryan Coogler, became one of the highest grossing films of all time. It also received a lot of critical attention for its direct engagement with black experience and black politics. It speaks to the legacy of slavery and the exploitation of African-Americans and the ongoing post-colonial struggle represented most starkly by the Black Lives Matter Movement. However, the film was also criticised for supposedly leaving that radical black politics behind, even demonising it in its lead antagonist, (...) Killmonger, and instead proposing a liberal, reformist agenda very much in keeping with current forms of sovereign power, bolstered under the current neoliberal regime by the charity of billionaires. To some extent this is understandable, but it is also a very limited reading of what happens in the film and does a disservice to the radical dissent that the character of Killmonger represents. To address this, the paper uses the concept of sovereignty and asks how superheroes can help us unpack this concept. It argues that rather than seeing superheroes as vigilantes, thinking of them as sovereigns helps us unpack the complex knot of law, authority and violence that is key to understanding it. In particular it draws on Agamben’s discussion of sovereignty and the politics of the exception, and how this might be relevant to Fanon’s work on counter-colonial violence to show how the film remains true to radical protest throughout. On the way it also addresses the important cultural politics of the original comic. (shrink)

Trent Dougherty argues (contra Jonathan Matheson) that when taking into consideration the probabilities involving skeptical theism (ST) and gratuitous evils, an agent may reasonably affirm both ST and that gratuitous evils exist. In other words, Dougherty thinks that assigning a greater than .5 probability to ST is insufficient to defeat the commonsense problem of evil. I argue that Dougherty’s response assumes, incorrectly, that ST functions solely as an evidential defeater, and that, when understood as a closure of inquiry defeater, ST (...) may still defeat reasonable belief in gratuitous evils, even in the face of strong evidence that gratuitous evils exist. This article seeks to conceptualize global counterterror actor types by examining the designated terrorist organizations lists of six countries; the United States, the United Kingdom, Australia, Canada, Russia, and China. It is argued that these countries should be placed into one of three distinct categories: Trendsetters, Trend Followers, and Individual Players. Being able to classify countries according to these categories is important for global policymakers. It raises awareness of the differences between countries, and emphasizes that “one-fits-all” policies are inappropriate and (...) have little chance of achieving global endorsement. (shrink)

Objectives: Neuroplastic changes that drive recovery of shoulder/elbow function after stroke have been poorly understood. The purpose of this study was to determine the relationship between neuroplastic brain changes related to shoulder/elbow movement control in response to treatment and recovery of arm motor function in chronic stroke survivors.Methods: Twenty-three chronic stroke survivors were treated with 12 weeks of arm rehabilitation. Outcome measures included functional Magnetic Resonance Imaging (fMRI) for the shoulder/elbow components of reach and a skilled motor function test (Arm (...) Motor Abilities Test, AMAT), collected before and after treatment.Results: We observed two patterns of neuroplastic changes that were associated with gains in motor function: decreased or increased task-related brain activation. Those with significantly better motor function at baseline exhibited a decrease in brain activation in response to treatment, evident in the ipsilesional primary motor and contralesional supplementary motor regions; in contrast, those with greater baseline motor impairment, exhibited increased brain activation in response to treatment. There was a linear relationship between greater functional gain (AMAT) and increased activation in bilateral primary motor, contralesional primary and secondary sensory regions, and contralesional lateral premotor area, after adjusting for baseline AMAT, age, and time since stroke.Conclusions: Recovery of functional reach involves recruitment of several contralesional and bilateral primary motor regions. In response to intensive therapy, the direction of functional brain change (i.e., increase or decrease in task-related brain recruitment) for shoulder/elbow reach components depends on baseline level of motor function and may represent either different phases of recovery or different patterns of neuroplasticity that drive functional recovery. Actions that financially benefit one person may present risk to another person. For example, the payment incentives of portfolio managers and investors are often asymmetrical such that actions that benefit a portfolio manager can pose financial risk to clients. Despite the presence and potential harm of these asymmetries, few have addressed the question of who exploits these asymmetries and how to mitigate potential harm. Our study examined the effect of selfish personality traits (the Dark Triad) and interpersonal bonding on decision-making (...) for the self, another person, and another person with under reward asymmetry present. Results demonstrated that individuals higher in narcissism and psychopathy made risky decisions for themselves. However, when reward asymmetries were present, all three Dark Triad traits were associated with making riskier decisions for another person in order to benefit the self. There was also a significant interaction between interpersonal closeness generated through bonding and psychopathy such that bonding made the decision-making processes of those high in psychopathy less risky for others. These findings have implications for how different individuals with different relationships make self and other-based financial decisions, and how those decisions change when rewards are asymmetrical. In noise we hear the possibility of a signal, indeed different signals, and in the multiplicity of signals we hear noise. With variation and selection comes dynamic evolution, a contingent state, one that could be otherwise. The term ‘polemogenous’ (from the French, polémogène) means that which generates polemics. And polemics are creative. If everyone, every system, were to reason in the same way, there would be silence. Every remark would be redundant, having no informational value. Thus noise is not bad. (...) The essence of finance economics, like all that is social in nature, is a forming of meaning. Whatever cannot be formed meaningfully is not available to the system. This unavailability, as ‘noise’, is the dynamic difference (noise/information) that scintillates the system. Information, like morality, is polemogenous – it stirs contention. Without noise and the possibility of its conversion to information there would be no opportunities to exploit. This paper applies a systems theoretical understanding of observation to conceive of finance economics as the economy’s means of observing its noise and capitalizing on that polemic. Niklas Luhmann’s method is utilized to explicate some ideas on noise by financial economist Fischer Black, who suggests the incomprehensible is computable. This is finance. The fact that logical grounds, absolute deductions, and clear calculations are claimed to be rare in finance is no barrier to understanding it. Rather, this polyphonic and polemogenous information-selection is the ‘ground’ of finance, not as totalizing logic, but as different difference-production for the sake of deriving economic opportunity. Over time, according to popular and academic accounts, alternative trade initiatives [such as fair trade, organics, forest certification, and socially responsible investing ] almost invariably lose their oppositional stance and go mainstream. That is, they lose their alternative, usually peripheral, and often contrarian character. In this paper, I argue that this is not always the case and that the path to going mainstream is not always an unproblematic one. I observe that while scholars have documented various aspects of specific alternative (...) trade initiatives, little comparative work has been done to theorize their different trajectories. To advance the scholarship, I compare two alternative trade movements, fair trade and SRI, and develop three hypotheses—the relation motivations hypothesis, the material interests hypothesis, and the organization of credibility hypothesis—that explain why going mainstream has been so hotly contested in the fair trade movement but not the SRI movement. I articulate these hypotheses and evaluate their merits. (shrink)

A number of studies have tested the relationship between a corporation's social and ethical performance and its financial performance. In contrast, this is the first study to demonstrate a link between overall financial performance and an emphasis on ethics as an aspect of corporate governance. It identifies the 26.8 percent of the 500 largest U.S. public corporations that, in their annual report to shareholders, commit to ethical behavior toward their stakeholders or emphasize compliance with their code of conduct. The financial (...) performance of these corporations ranks higher than that of those who do not at a significance level of p = < 0.005, using the 1997 Business Week ranking which averages eight publicly-reported measures of historical financial performance. These findings should motivate more corporations to utilize the principles of Social and Ethical Accounting, Auditing and Reporting (SEAAR). (shrink)

The loss of life that resulted from the sinking of the fisheries training vessel EhimeMaru by the nuclear submarine USSGreeneville off Hawaii in February 2001 exemplifies the risks to United States–Japan alliance relations posed by US global military deployments. Following a pattern of incidents involving the US military in Japan itself, the collision violated Japanese expectations of benevolence from its stronger partner and put considerable pressure on the government to seek public apology and reassurance. This article examines the interplay of (...) culture, national security interests and domestic politics in framing both perceptions and diplomacy during the crisis. While differences at both the cultural and security levels complicated diplomacy, asymmetry in the respective domestic political stakes, combined with overriding and largely congruent security interests, helped the United States to provide Japan with the requisite reassurance. After a decade of alliance drift, both Japan and the United States were determined to forestall defection by their alliance partner. (shrink)
