Evidence-Centered Design (ECD) is a framework for the design and development of assessments that ensures consideration and collection of validity evidence from the onset of the test design. Blending learning and assessment requires integrating aspects of learning at the same level of rigor as aspects of testing. In this paper we describe an expansion to the ECD framework (termed e-ECD) such that it includes the specifications of the relevant aspects of learning at each of the three core models in the (...) ECD, as well as making room for specifying the relationship between learning and assessment within the system. The framework proposed here does not assume a specific learning theory or particular learning goals, rather it allows for their inclusion within an assessment framework, such that they can be articulated by researchers or assessment developers that wish to focus on learning. Both traditional accounts of hope and some of their recent critics analyze hope exclusively in terms of attitudes that a hoper bears towards a hoped-for prospect, such as desire and probability assignment. I argue that all of these accounts misidentify cases of despair as cases of hope, and so misconstrue the nature of hope. I show that a more satisfactory view is arrived at by noticing that in addition to the aforementioned attitudes, hope involves a characteristic attitude towards an external (...) factor, on whose operation the hoper takes the prospect's realization to depend causally. This article explores Gerardus van der Leeuw’s view of phenomenology of religion. The phenomenological method he defended is basically a hermeneutical approach in which an observer relates personally and even existentially to the “phenomena” (s)he studies in order to determine their essence (Wesensschau). In his anthropology (that reflects on the basic structure of human beings) a similar way of relating to the world is discussed: the “primitive mentality” that is characterized by the “need to participate” (besoin de participation). Both phenomenology (...) and mentalité primitive imply a critique of modern scholarship. This fundamental criticism of the prevailing (historical) approach in the humanities including religious studies explains the growing distance between van der Leeuw and the majority of scholars of religion in the decades after his death in 1950. In this work, the author formulates a critique of widely accepted mereological assumptions, presents a new conception of wholes as ‘Unities’, and demonstrates the advantages of this new conception in treating a variety of metaphysical puzzles (such as that of Tibbles the cat). More generally he suggests that conceiving wholes as Unities offers us a new way of understanding the world in non-reductive terms.

The paper focuses on the complex relations between aesthetics and phenomenology as they show themselves within the core locus of their interplay—the realm of the visible and the invisible. To do so, the paper examines a specific case study, a Rembrandt painting—A Woman Bathing in a Stream (1654)—through which the discussion illuminates the interconnected and inseparable relationship between aesthetics and phenomenology in relation to Merleau-Ponty’s ontology of the visible and the invisible. The reading addresses both dimensions of the visible: the (...) essential intersubjective aspect of life and its complex visual representation in art. To achieve this, the paper first explores Merleau-Ponty’s late aesthetic ontology—a phenomenology that perceives the aesthetic realm, particularly the visible domain, as originating from human corporeal existence, thereby redefining the act of seeing and the concepts of the visible and the invisible; I show the manner in which invisible elements permeate our visual experience in the Rembrandt painting and in seeing as such. The paper also reveals the unique ontological role of painting and the painter in unveiling the aesthetic world, and in guiding the philosopher toward a vision that true philosophy—phenomenology—must embrace. The paper concludes by rethinking the significance of aesthetics, and especially, the arts, to phenomenological thought, and the necessity of phenomenology to aesthetic thought. (shrink)

This essay offers a new understanding of Merleau-Ponty's notion of the Other, the problem that revolves around it, and its far-reaching repercussions by shedding light on aspects that usually go unnoticed in the interpretation of his late thought in these regards. I show how Merleau-Ponty's emerging ontology in his late writings opens anew, in a complex manner, the problem of the Other, transforming it in a way that dismantles, to begin with, traditional epistemological questions regarding the Other, as well as (...) principal difficulties regarding the Other's appearance within the realm of phenomena which have occupied phenomenology from its very beginning. I demonstrate how Merleau-Ponty's late writings in fact bind the problem of the Other with the question regarding the very limits of phenomenology and the realm of meaning as a whole. (shrink)

As spectators we perceive Oedipus, in Sophocles's Oedipus the King, 1 as one who upon discovering the identity of (...) his father and mother affirms that he bears guilt for killing the former and committing incest with the latter, and we typically concur in some vague way with his affirmation. 2 We do not, after all, think that his affirmation is merely the consequence of some confusion about morals on his part, and that he would have been more justified in treating his discovery with a light conscience. Furthermore, it seems that our conception of his greatness is intimately bound up with our being acquainted with him as someone who acted so as to render himself profoundly guilty in this way. What is paradoxical is that moral taint would be expected to reduce our admiration for a character and our attribution of greatness to it. Why then should noteworthy paradigms of greatness of character be morally tainted characters? Can we make sense of the idea that some kinds of guiltiness might be constitutive of greatness of character?As it is well-known, Aristotle says that in order for a tragedy best to achieve its desired effect, it should portray a protagonist "who is not pre-eminent in moral virtue, who passes to bad fortune not through vice or wickedness, but because of some hamartia...." 3 The term "hamartia" is variously translated as "piece of ignorance," "miscalculation," and "error of judgment," but as O. B. Hardison notes, it must be treated as designating a moral flaw, because it renders the protagonist [End Page 260] less than "pre-eminent in moral virtue." 4 However, even if the term is interpreted as covering what I have described as the moral taint associated with greatness of character, it should be clear that Aristotle does not provide here an answer to my question. At best he can be viewed as explaining why morally tainted characters of this sort are crucial to achieving tragic effect. He is not explaining how it is that such characters can be viewed as paradigms of greatness.I propose not to treat this paradox in its most general form, but rather by confining my attention to an interesting subclass of cases. What I have in mind are cases in which a protagonist finds himself or herself in what I shall call circumstances of tragic conflict. Such circumstances determine that a choice must be made between two (or perhaps more) courses of action, even though each of the courses involves the violation of an important moral claim, or the destruction of a crucial value. As spectators or readers, we typically perceive the protagonist as emerging with a heavy burden of guilt (much in the way noted above regarding Oedipus), and we recognize that he or she was bound to emerge guilty, no matter which course of action would have been chosen. Cases such as that of Agamemnon (bearing guilt for the sacrifice of his daughter Iphigenia in Aeschylus's Agamemnon), 5 of Jephthah (again bearing guilt for the sacrifice of his daughter, in Judges 11), 6 and of Orestes (bearing guilt for the murder of his mother Clytemnestra in Euripides's Orestes) 7 belong quite uncontroversially to this subclass. 8These protagonists make difficult choices, and carry them out with courage and resolution, qualities which explain to some extent our perception of them as possessing greatness of character. But in making their choice, they necessarily render themselves guilty, whether or not they have made the correct choice (assuming there is a correct choice in the circumstances). This essay outlines the transformation of the ostensibly mundane example of two hands touching each other in Husserl’s Ideas II into the pivotal concept in Merleau-Ponty’s ontology of flesh and notion of embodied subjectivity. By focusing on the contexts in which the example appears in the works of Husserl and of Merleau-Ponty, it seeks to explicate Merleau-Ponty’s fascination with Husserl’s example, its role in the development of his own thought and in the conceptual shift in his late works on the (...) body. I explore the various stages in the metamorphosis of Husserl’s example of touching hands, originally used merely to differentiate the sense of touch from that of sight, into Merleau-Ponty’s radical concept of flesh that overturns “our idea of the thing and the world, and... results in an ontological rehabilitation of the sensible.”. Many believe that the ethical problems of donation after cardiocirculatory death (DCD) have been "worked out" and that it is unclear why DCD should be resisted. In this paper we will argue that DCD donors may not yet be dead, and therefore that organ donation during DCD may violate the dead donor rule. We first present a description of the process of DCD and the standard ethical rationale for the practice. We then present our concerns with DCD, including the following: (...) irreversibility of absent circulation has not occurred and the many attempts to claim it has have all failed; conflicts of interest at all steps in the DCD process, including the decision to withdraw life support before DCD, are simply unavoidable; potentially harmful premortem interventions to preserve organ utility are not justifiable, even with the help of the principle of double effect; claims that DCD conforms with the intent of the law and current accepted medical standards are misleading and inaccurate; and consensus statements by respected medical groups do not change these arguments due to their low quality including being plagued by conflict of interest. Moreover, some arguments in favor of DCD, while likely true, are "straw-man arguments," such as the great benefit of organ donation. The truth is that honesty and trustworthiness require that we face these problems instead of avoiding them. We believe that DCD is not ethically allowable because it abandons the dead donor rule, has unavoidable conflicts of interests, and implements premortem interventions which can hasten death. These important points have not been, but need to be fully disclosed to the public and incorporated into fully informed consent. These are tall orders, and require open public debate. Until this debate occurs, we call for a moratorium on the practice of DCD. (shrink)

This article calls into question the charge that frequentist testing is susceptible to the base-rate fallacy. It is argued that the apparent similarity between examples like the Harvard Medical School test and frequentist testing is highly misleading. A closer scrutiny reveals that such examples have none of the basic features of a proper frequentist test, such as legitimate data, hypotheses, test statistics, and sampling distributions. Indeed, the relevant error probabilities are replaced with the false positive/negative rates that constitute deductive calculations (...) based on known probabilities among events. The paper argues that four-dimensionalism is incompatible with the existence of additively cumulative properties, including mass, volume, and electrical charge. These properties add up over disjoint objects: for example, the mass of a whole composed of two disjoint objects is a sum of the individual masses of the objects. The difficulty with such properties for four-dimensionalism stems from the way this theory makes persistence depend on the existence of disjoint objects at disjoint times. The principle of Summation, which is a technically sharpened version of the familiar claim that a whole is a sum of its parts, is presented by Peter van Inwagen as a trivial truth. I argue to the contrary, that it is incompatible with the natural assumption that a whole may gain or lose parts non-instantaneously. For, as I show, the latter assumption implies that something can be determinately a whole without being determinately a sum of parts, and this, in turn, (...) indicates the falsity of Summation. I point out that the tension between Summation and the possibility of non-instantaneous gain or loss of parts compels us to rethink the relations between the concepts of whole and sum, and may have far reaching consequences for the mereology of physical objects. The notion of bilattice was introduced by Ginsberg, and further examined by Fitting, as a general framework for many applications. In the present paper we develop proof systems, which correspond to bilattices in an essential way. For this goal we introduce the notion of logical bilattices. We also show how they can be used for efficient inferences from possibly inconsistent data. For this we incorporate certain ideas of Kifer and Lozinskii, which happen to suit well the context of our work. (...) The outcome are paraconsistent logics with a lot of desirable properties.1. Ariès traces Western man's attitudes toward mortality from the early medieval conception of death as the familiar collective destiny of the human race to the modern tendency, so pronounced in industrial societies, to hide death as if it were an embarrassing family secret.

Within the space of a few years, the idea of Responsible Research and Innovation, and its acronym RRI, catapulted from an obscure phrase to the topic of conferences and attempts to specify and realize it. How did this come about, and against which backdrop? What are the dynamics at present, and what do these imply for the future of RRI as a discourse, and as a patchwork of practices? It is a social innovation which creates opening in existing divisions of (...) moral labour, a notion that is explained with the help of the history of responsibility language. It is filled in for the present situation and ongoing developments. Some elements may stabilize and this creates a path into the future. There will be reductions of the originally open-ended innovation, some productive, others less so. This is a reason to regularly inquire into the value of the reductions and the directions the path is taking. (shrink)

Brain death is accepted in most countries as death. The rationales to explain why brain death is death are surprisingly problematic. The standard rationale that in brain death there has been loss of integrative unity of the organism has been shown to be false, and a better rationale has not been clearly articulated. Recent expert defences of the brain death concept are examined in this paper, and are suggested to be inadequate. I argue that, ironically, these defences demonstrate the lack (...) of a defensible rationale for why brain death should be accepted as death itself. If brain death is death, a conceptual rationale for brain death being equivalent to death should be clarified, and this should be done urgently. (shrink)

Longer-term developments shape the present and endogenous futures of institutions and practices of science and technology in society and their governance. Understanding the patterns allows diagnosis and soft intervention, often linked to scenario exercises. The book collects six articles offering key examples of this perspective, addressing ongoing issues in the governance of science and technology, including nanotechnology and responsible research and innovation. And adds two more articles that address background philosophical issues.

An ℵ1-Souslin tree is a complicated combinatorial object whose existence cannot be decided on the grounds of ZFC alone. But fifteen years after Tennenbaum and Jech independently devised notions of forcing for introducing such a tree, Shelah proved that already the simplest forcing notion—Cohen forcing—adds an ℵ1-Souslin tree. In this article, we identify a rather large class of notions of forcing that, assuming a GCH-type hypothesis, add a λ+-Souslin tree. This class includes Prikry, Magidor, and Radin forcing.

This discussion note offers a preliminary analysis of what recent developments in human germline gene editing tell us about the effectiveness of speculative and anticipatory modes of techno-ethics. It argues that the benefits of speculative discussions are difficult to detect thus far, and that pushing the focal point of ethical discourse well ahead of the current state of technology may prematurely undermine existing norms long before a broad consensus would justify moving beyond them.

The article revisits the large n problem as it relates to the Jeffreys-Lindley paradox to compare the frequentist, Bayesian, and likelihoodist approaches to inference and evidence. It is argued that what is fallacious is to interpret a rejection of as providing the same evidence for a particular alternative, irrespective of n; this is an example of the fallacy of rejection. Moreover, the Bayesian and likelihoodist approaches are shown to be susceptible to the fallacy of acceptance. The key difference is that (...) in frequentist testing the severity evaluation circumvents both fallacies but no such principled remedy exists for the other approaches. (shrink)

The President of the European Bank for Reconstruction and Development examines three major ethical problems in the transition from post‐Communist Europe to a market economy and spells out the only real option for Western Europe. He delivered this address, which is reprinted with permission, at a Conference on Business and Moral Standards in Post Communist Europe held in London in November last year under the auspices of the Archdiocese of Westminster and sponsored by the Sedgwick Group and KPMG Peat Marwick.

Objective: Persuasive messages regarding fruit and vegetable consumption often meet defensive reactions from recipients, which may lower message effectiveness. Individual differences in emotion regulation and gender are expected to predict these reactions. In the working memory account of persuasion, inducing voluntary eye movements during the processing of the auditory persuasive information might prevent defensiveness and thereby increase message effectiveness.Methods: Participants in two independently recruited samples from the general population listened to a negatively framed auditory persuasive message advocating fruit and vegetable (...) consumption. Half of them were asked to keep following a regularly moving stimulus on their screen with their eyes. At pretest, the individual differences of cognitive self-affirmation inclination and gender were assessed to predict defensive reactions.Results: In Study 1, induced eye movements significantly increased self-reported consumption after 2 weeks when CSAI was low, but only in males, as indicated by a significant three-way interaction. With negative self-evaluative emotions as dependent variable, this three-way interaction was also significant, suggesting that induced eye movements prevented defensiveness in low CSAI males. Study 2 did not assess consumption but replicated the latter three-way interaction.Conclusion: The studies replicated our earlier findings regarding the moderating effects of individual differences in emotion regulation on persuasion, but they also revealed gender differences in persuasion that are related to the working memory. The working memory account of persuasion provides new theoretical as well as practical angles on persuasion to target individuals in persuasion to increase fruit and vegetable consumption. (shrink)

A certain argument has been given in the literature to the effect that generalism (the view that all facts about all possible worlds can (in principle) be given in general terms, that is, without resorting to nonqualitative thisnesses) excludes transworld identitism (the view that there are numerical identities through possible worlds). It follows from this argument, among other things, that transworld identitism entails Scotistic haecceitism (acceptance of nonqualitative thisnesses), and that generalists subscribing to de reism (the view that there are (...) true modal statements de re) are committed to counterpartism (the view that sameness through worlds is not numerical identity). The purpose of this paper is to resist the argument in question by constructing generalist transworld identitism, that is, by providing an account involving identities through possible worlds, without resorting to nonqualitative thisnesses. This remarkable book--the fruit of almost two decades of study--traces in compelling fashion the changes in Western attitudes toward death and dying from the earliest Christian times to the present day. A truly landmark study, The Hour of Our Death reveals a pattern of gradually developing evolutionary stages in our perceptions of life in relation to death, each stage representing a virtual redefinition of human nature. Starting at the very foundations of Western culture, the eminent historian Phillipe Aries shows how, (...) from Graeco-Roman times through the first ten centuries of the Common Era, death was too common to be frightening; each life was quietly subordinated to the community, which paid its respects and then moved on. Aries identifies the first major shift in attitude with the turn of the eleventh century when a sense of individuality began to rise and with it, profound consequences: death no longer meant merely the weakening of community, but rather the destruction of self. Hence the growing fear of the afterlife, new conceptions of the Last Judgment, and the first attempts (by Masses and other rituals) to guarantee a better life in the next world. In the 1500s attention shifted from the demise of the self to that of the loved one (as family supplants community), and by the nineteenth century death comes to be viewed as simply a staging post toward reunion in the hereafter. Finally, Aries shows why death has become such an unendurable truth in our own century--how it has been nearly banished from our daily lives--and points out what may be done to "re-tame" this secret terror. The richness of Aries's source material and investigative work is breathtaking. While exploring everything from churches, religious rituals, and graveyards (with their often macabre headstones and monuments), to wills and testaments, love letters, literature, paintings, diaries, town plans, crime and sanitation reports, and grave robbing complaints, Aries ranges across Europe to Russia on the one hand and to England and America on the other. As he sorts out the tangled mysteries of our accumulated terrors and beliefs, we come to understand the history--indeed the pathology--of our intellectual and psychological tensions in the face of death.
