Discussions on the Anthropocene as the geology of mankind imply the question whether globalized technology such as energy technologies or A.I. ought to be first and foremost conceptualized as a strategy of the human in relation to nature or as a strategy of some humans over others. I argue that both positions are mirrored in the philosophy and sociology of technology through the concepts of technology as an extension and as a fetish. The extension concept understands technology as an extension (...) of the human body and its capabilities, resulting in a local ‘inward’ perspective. The fetish concept offers a contrary ‘outward’ perspective by drawing attention to the global socio-material context of modern technology. Despite their differences, I argue that both concepts share an underlying operation principle of technology as functional simplification. Technology always involves a functional simplification of physical as well as social causality. Sociologists and philosophers of technology would do well not to give primacy to the former as it leads to the belief in technology as a universal tool that neglects how technology is not embedded in but consists of (unequal) social arrangements. No discussion of academic freedom, research integrity, and patient safety could begin with a more disquieting pair of case studies than those of Nancy Olivieri and David Healy. The cumulative impact of the Olivieri and Healy affairs has caused serious self examination within the biomedical research community. The first part of the essay analyses these recent academic scandals. The two case studies are then placed in their historical context—that context being the transformation of the norms of science through increasingly close (...) ties between research universities and the corporate world. After a literature survey of the ways in which corporate sponsorship has biased the results of clinical drug trials, two different strategies to mitigate this problem are identified and assessed: a regulatory approach, which focuses on managing risks associated with industry funding of university research, and a more radical approach, the sequestration thesis, which counsels the outright elimination of corporate sponsorship. Kant's Reason develops a novel interpretation of Kant’s conception of reason and its philosophical significance, focusing on two claims. First, it argues that Kant presents a powerful model for understanding the unity of theoretical and practical reason as two manifestations of a unified capacity for theoretical and practical understanding (or “comprehension”). This model allows us to do justice to the deep commonalities between theoretical and practical rationality, without reducing either to the other. In particular, through it, we see why the (...) activities of both theoretical and practical reason are governed by a version of the Principle of Sufficient Reason, while also seeing why reason is essentially autonomous. At the same time, Kant's Reason also reads Kant as presenting us with a compelling picture of the role that reason (as a capacity or power) should play in a systematic approach to foundational philosophical questions. In doing so, it argues for an account of the fundamental norms that apply to rational beings that treats as fundamental neither substantive reasons or values nor merely structural rationality, but instead a robust conception of reason as a power or capacity — namely, the capacity for theoretical and practical understanding. The result is a form of “rational constitutivism” – one which contrasts both with the forms of “reasons fundamentalism” that are currently fashionable and the forms of “agency-first constitutivism” that have dominated much of Kantian metaethics. In this sense, the aim of the book is to vindicate Kant’s insistence that his philosophy represents nothing more or less than reason’s implicit self-understanding coming to explicit and systematic self-consciousness. This essay develops an interpretation of Kant’s conception of the faculty of reason as the capacity for what he calls "comprehension" (Begreifen). In doing so, it first discusses Kant's characterizations of reason in relation to what he describes as the two highest grades of cognition—insight and comprehension. Then it discusses how the resulting conception of reason relates to more familiar characterizations as the faculty for inference and the faculty of principles. In doing so, it focuses on how the idea of (...) reason as aiming at comprehension expresses the modesty about reason that is essential to Kant’s critical philosophy. It concludes by showing how this grounds an elegant account of the unity of theoretical and practical reason—one that does justice both to the "primacy" that Kant assigns to practical reason and the fact that this "primacy" is grounded in a more basic unity. In broad outlines, the first of these claims that beliefs and other cognitive states, on their own, can never motivate a new desire, intention, or action. Rather, on this view, what motivates us to desire, intend, or act is always the cooperation of some desire (or other conative state) with such cognitive states. Thus, on HTM, practical motivation is always the product of two fundamentally distinct categories of mental states operating in conjunction with one another.

The proliferation of multistakeholder initiatives (MSIs) over the past years has sparked an intense debate on the political role of corporations in the governance of global business conduct. To gain a better understanding of corporate political behavior in multistakeholder governance, this article investigates how firms construct a political identity when participating in MSIs. Based on an in-depth case study of the Accord on Fire and Building Safety in Bangladesh—an MSI established after the collapse of the Rana Plaza garment factory complex (...) in 2013 to improve working conditions in the Bangladeshi garment industry—we introduce the construct of a political CSR (corporate social responsibility) identity (PCSRI) and explore how firms construct their PCSRIs in MSIs. Employing a qualitative, inductive theory-building method, we analyze interviews and archival data to develop a framework that elucidates how companies construct their PCSRIs within a continuum ranging from conservative to progressive. We show that constructing a PCSRI involves enacting specific, yet interrelated, political strategies that are themselves shaped by several forces over time. This article contributes to the literature by providing a political perspective on organizational identity construction that extends the emerging integrative perspective in political corporate social responsibility (PCSR) research. We suggest that MSIs should be conceptualized as inherently political governance mechanisms that are driven by multidirectional and dynamic political processes of identity construction. Our study shows that corporate political engagement in MSIs is a more nuanced and complex phenomenon than presently theorized. (shrink)

This paper presents an approach of unsupervised learning of clusters from a citation database, and applies it to a large corpus of articles in philosophy to give an account of the structure of the discipline. Following a list of journals from the PhilPapers-archive, 68,152 records were downloaded from the Reuters Web of Science-Database. Their citation data was processed using dimensionality reduction and clustering. The resulting clusters were identified, and the results are graphically represented. They suggest that the division of analytic (...) and Continental philosophy in the considered timespan is overstated; that analytical, in contrast to Continental philosophy does not form a coherent group in recent philosophy; and that metaphors about the disciplinary structure should focus on the coherence and interconnectedness of a multitude of smaller and larger subfields. Foundational investigations in quantum mechanics, both experimental and theoretical, gave birth to the field of quantum information science. Nevertheless, the foundations of quantum mechanics themselves remain hotly debated in the scientific community, and no consensus on essential questions has been reached. Here, we present the results of a poll carried out among 33 participants of a conference on the foundations of quantum mechanics. The participants completed a questionnaire containing 16 multiple-choice questions probing opinions on quantum-foundational issues. Participants included physicists, philosophers, (...) and mathematicians. We describe our findings, identify commonly held views, and determine strong, medium, and weak correlations between the answers. Our study provides a unique snapshot of current views in the field of quantum foundations, as well as an analysis of the relationships between these views. (shrink)

It is increasingly common to suggest that the combination of evolutionary theory and normative realism leads inevitably to a general scepticism about our ability to reliably form normative beliefs. In what follows, I argue that this is not the case. In particular, I consider several possible arguments from evolutionary theory and normative realism to normative scepticism and explain where they go wrong. I then offer a more general diagnosis of the tendency to accept such arguments and why this tendency should (...) be resisted. (shrink)

Artificial intelligence increasingly executes tasks that previously only humans could do, such as drive a car, fight in war, or perform a medical operation. However, as the very best AI systems tend to be the least controllable and the least transparent, some scholars argued that humans can no longer be morally responsible for some of the AI-caused outcomes, which would then result in a responsibility gap. In this paper, I assume, for the sake of argument, that at least some of (...) the most sophisticated AI systems do indeed create responsibility gaps, and I ask whether we can bridge these gaps at will, viz. whether certain people could take responsibility for AI-caused harm simply by performing a certain speech act, just as people can give permission for something simply by performing the act of consent. So understood, taking responsibility would be a genuine normative power. I first discuss and reject the view of Champagne and Tonkens, who advocate a view of taking liability. According to this view, a military commander can and must, ahead of time, accept liability to blame and punishment for any harm caused by autonomous weapon systems under her command. I then defend my own proposal of taking answerability, viz. the view that people can makes themselves morally answerable for the harm caused by AI systems, not only ahead of time but also when harm has already been caused. In the following I discuss the debate between epistemological internalists and externalists from an unfamiliar meta-epistemological perspective. In doing so, I focus on the question of whether rationality is best captured in externalist or internalist terms. Using a conception of epistemic judgments as “doxastic plans,” I characterize one important subspecies of judgments about epistemic rationality—focusing on the distinctive rational/functional role these judgments play in regulating how we form beliefs. Then I show why any judgment that plays this role should be (...) expected to behave the manner internalists predict. In this way, I argue, we can explain why our basic toolbox for epistemic evaluation includes an internalist conception of rationality. (shrink)

In this paper, I present a brief (and more than a little potted) history of the concepts of reason, rationality, reasonableness, and reasons in modern European philosophy and consider whether this history might support the "Anscombean" conclusion that, "The concepts of rationality and reasons ought to jettisoned if this is psychologically possible; because they are survivals, or derivatives from survivals, from an earlier conception of psychology and philosophy which no longer generally survives, and are only harmful without it.".

Famously, in the second Critique, Kant claims that our consciousness of the moral law provides us with sufficient grounds for the attribution of freedom to ourselves as noumena or things-in-themselves. In this way, while Kant insists that we have no rational basis to make substantive assertions about things-in-themselves from a theoretical point of view, it is rational for us to assert that we are noumenally free from a practical one. This much is uncontroversial. What is controversial is the cognitive relation (...) to things-in-themselves that is possible from a practical point of view. Interpreters have tended to regard such “practical cognition” of things-in-themselves as a poor step-cousin of its theoretical counterpart — as a sort of mere “rational faith” unworthy of comparison with genuine theoretical knowledge or cognition. Recent work on these issues has begun to shift this picture. But this reassessment is in its early stages and remains highly controversial. My aim here is to take this tendency and push it farther than most have generally been willing to go - at least with respect to our practical self-understanding as noumenally free agents. Indeed, I believe that, far from representing an impoverished cousin of theoretical cognition and knowledge, our practical awareness of ourselves as free possesses the central marks of cognition and knowledge in Kant’s sense of these terms, albeit on practical grounds. Thus, it is no surprise that Kant is willing to speak of our consciousness of the moral law as enabling genuine cognition of noumenal freedom. (shrink)

This article comments on the recent study “CEO hubris and firm pollution: state and market contingencies in a transitional economy” of Zhang et al. :459–478, 2020) in this journal. We very much appreciate the valuable initiative of Zhang et al. to study the potential effect of CEO characteristics on corporate pollution. At the same time, we are concerned with the authors’ interpretation of the regression results and their operationalization of CEO hubris. We hope to contribute to the literature on managerial (...) hubris in two ways. First, we repair the authors’ inferences and conclusions about the actual effect of CEO hubris on firm pollution with respect to their conflicting regression results. Second, we unpack and clarify the authors’ vulnerable operationalization of CEO hubris. We hope to stimulate more research on the relationship between CEO hubris and firm pollution, and managerial hubris more generally through a more rigorous operationalization and measurement of hubris. In the chapter on Observing Reason in the Phenomenology, as well as in §368 of the Philosophy of Nature, Hegel deals with the life sciences of his time. There, he labels the methodology of its representatives, namely zoology and comparative anatomy, as external teleology. In this paper I want to show that by doing so he is actually discussing a general kind of functionalism. Thereby, I want to highlight a line of thought in Hegel's texts which represents a productive reading (...) of external teleology contrary to a destructive reading on which scholars have mainly focussed. It has recently been argued that certain areas of discourse, such as discourse about matters of taste, involve a phenomenon of ‘‘ faultless disagreement ’’ that rules out giving a standard realist or contextualist semantics for them. Thus, it is argued, we are left with no choice but to consider more adventurous semantic alternatives for these areas, such as a semantic account that involves relativizing truth to perspectives or contexts of assessment. I argue that the sort of faultless disagreement present (...) in these cases is in fact compatible with a realist treatment of their semantics. Then I briefly consider other considerations that might be thought to speak against realism about these areas of discourse. I conclude with the tentative suggestion that realism about matters of taste is far more plausible than most philosophers believe today. (shrink)

In the absence of effective judicial remediation mechanisms after business-related human rights violations, companies themselves are expected to establish remediation procedures for affected victims and communities. This is a challenge for both companies and victims since comprehensive company-based grievance mechanisms are currently missing. In this paper, we explore how companies can provide effective remediation after human rights violations. Accordingly, we critically assess two different approaches to conflict resolution, alternative dispute resolution and restorative justice, for their potential to provide dialogue-based, non-judicial (...) remediation. We argue that remedy through agreement-driven ADR mechanisms risks marginalizing the interests and concerns of victims and affected community members, particularly in weak institutional contexts. Hence, we develop a dialogue-driven framework for corporate remediation of human rights violations grounded on RJ principles. This restorative framework provides a comprehensive CGM that focuses on the harms and needs of victims and aims at restoring justice through restorative dialogue. Based on a prompt discovery and a thorough investigation of the grievance, companies should design and prepare the remediation process together with victims, offenders and affected community members. Through restorative dialogue with the affected parties about the circumstances and impacts of the wrongdoing, companies can repair the harm, regain legitimacy amongst stakeholders as well as transform their business practices to avoid future human rights violations. In order to build on the information that was obtained in the course of the first study, a follow-up survey was conducted first by phone and subsequently in a written form between August and October 2014. We contacted 1.858 hospitals in all of Germany for the follow-up survey by phone. In cases where a hospital had not participated in the first study, the willingness to participate in the follow-up survey was established in advance. The survey’s dispatch was ensured in the (...) case of acceptance. The same structured survey was used as a research tool. The data of the first study and the follow-up survey were merged and evaluated. 654 surveys could be evaluated altogether. Our survey by phone revealed that 912 hospitals in all of Germany have at least one form of clinical ethics consultation available. The health care ethics committee is the most frequently implemented structure of clinical ethics consultation. The implementation of clinical ethics consultation is dependent on sponsorship and hospital size. Recommendations to deliver structures of clinical ethics consultations have a smaller influence on the implementation compared to the certification by KTQ respectively proCum Cert. The rate of implementation in regard to the structures of clinical ethics consultation has steadily increased for years. The establishment of clinical ethics consultation in German hospitals should be further promoted. It would be desirable further to develop suitable juridical regulations in order to implement clinical ethics consultation as well as structural parameters. (shrink)

This article explores the moral complexities and inconsistencies in the perception of fish welfare; mainly, that fish lack the ability to suffer and, therefore, exist outside of humanity’s moral horizon. The science behind fish sentience has advanced to the point where a serious discussion on the human-fish relationship is warranted. It is argued that enough scientific evidence exists to provide evidence for fish sentience and suffering. However, for those unconvinced in light of the lack of both scientific and popular consensus, (...) the precautionary principle, where we treat fish as if they may suffer, will ultimately be advocated as an appropriate approach to fish welfare. Metaethical constructivism is one of the main movements within contemporary metaethics – especially among those with Kantian inclinations. But both the philosophical coherence and the Kantian pedigree of constructivism are hotly contested. In the first half of this article, I first explore the sense in which Kant's own views might be described as constructivist and then use the resulting understanding as a guide to how we might think about Kantian constructivism today. Along the way, I hope to suggest that a (...) fairly diverse range of views within contemporary metaethics – including some without any explicit allegiance to Kant – may be thought of as pursuing a version of the resulting strategy. There is a crisis of valuation practices in the current academic life sciences, triggered by unsustainable growth and “hyper-competition.” Quantitative metrics in evaluating researchers are seen as replacing deeper considerations of the quality and novelty of work, as well as substantive care for the societal implications of research. Junior researchers are frequently mentioned as those most strongly affected by these dynamics. However, their own perceptions of these issues are much less frequently considered. This paper aims at contributing to a better (...) understanding of the interplay between how research is valued and how young researchers learn to live, work and produce knowledge within academia. We thus analyze how PhD students and postdocs in the Austrian life sciences ascribe worth to people, objects and practices as they talk about their own present and future lives in research. We draw on literature from the field of valuation studies and its interest in how actors refer to different forms of valuation to account for their actions. We explore how young researchers are socialized into different valuation practices in different stages of their growing into science. Introducing the concept of “regimes of valuation” we show that PhD students relate to a wider evaluative repertoire while postdocs base their decisions on one dominant regime of valuing research. In conclusion, we discuss the implications of these findings for the epistemic and social development of the life sciences, and for other scientific fields. (shrink)

ABSTRACTThe question of how to engage with stakeholders in situations of value conflict to create value that includes a plurality of conflicting stakeholder value perspectives represents one of the crucial current challenges of stakeholder engagement as well as of value creation stakeholder theory. To address this challenge, we conceptualize a discursive sharing process between affected stakeholders that is oriented toward discursive justification involving multiple procedural steps. This sharing process provides procedural guidance for firms and stakeholders to create pluralistic stakeholder value (...) through the discursive accommodation of diverging stakeholder value perspectives. The outcomes of such a discursive value-sharing process range from stakeholder value dissensus to low and increasing levels of stakeholder value congruence to stakeholder value consensus. Hence, this article contributes to the emerging literature on integrative stakeholder engagement by conceptualizing a procedural framework that is neither overly oriented towards dissensus nor consensus. Capitalist dynamics in knowledge production are not limited to situations in which economic interests influence researchers’ practices. Building on laboratory studies and the French “pragmatic” tradition in sociology, this article proposes an approach to tackle more pervasive capitalist logics at work in contemporary research and their consequences. It uses the term epistemic capitalism to denote the accumulation of capital, as worth made durable, through the act of doing research, in and beyond academia. In doing so, it conceptualizes capitalism primarily not (...) as a system of circulation and accumulation of monetary value but rather as a cultural way of producing, attributing, and accumulating specific forms of worth, which need not be monetary. Empirically, the article studies variants in epistemic capitalism by addressing the differing role of the accumulation of different forms of capital and the regimes connected to it in two institutional settings in Austria, academic life science laboratories and biotechnology start-up companies. Concluding, it argues that analytically dissociating the concept of capitalism from its link to economic value allows a finer-grained cultural analysis of the importance and effects of processes of accumulation in contemporary research. It ends with discussing the normative implications of these findings for debates about the commercialization of academia. (shrink)

Voluntariness is a necessary condition of valid consent. But determining whether a person consented voluntarily can be difficult, especially when people are subjected to coercion or manipulation, placed in a situation with no acceptable alternative other than to consent to something, or find themselves in an abusive relationship. This book presents a novel view on the voluntariness of consent, especially medical consent, which the author calls Interpersonal Consenter-Consentee Justification (ICCJ). According to this view, consent is voluntary if and only if (...) the process by which it has been obtained aligns with principles of interpersonal justification. ICCJ is distinctive because it explains voluntary consent neither as a 'psychological' concept indicative of the inner states of a person's mind (e.g. willingness or reluctance) nor as a 'circumstantial' concept indicative of a person's set of options. Rather, ICCJ explains the voluntariness of consent as an 'interpersonal' concept requiring the absence of illegitimate control within the interaction between the person giving consent and the person receiving it. In so doing, ICCJ further develops the notion of interpersonal justification, known from contractualist theories in moral philosophy, and introduces it to the debate on consent. The author employs a top-down approach, defending ICCJ's key characteristics on the basis of general theoretical arguments, as well as a bottom-up approach, supporting ICCJ in its application to clinical challenges such as nudging and manipulation, living organ donation, and clinical trials. Voluntary Consent will appeal to researchers and advanced students in normative ethics, bioethics, philosophy of law, behavioural psychology, and medicine. (shrink)

Dieses neuhumanistische Versprechen beinhaltete immer schon eine Distanz zu den sozial akzeptierten Wissensbeständen und Fähigkeitsprofilen. Deren Aneignung war nicht das Kriterium einer gelingenden Selbstbildung. Ein solches Verständnis von Bildung scheint nur sinnvoll, wenn soziale Ordnungsvorstellungen nicht als selbstverständlich geltende verstanden werden. Dass deren Begründung nicht nur aus der Sicht des sich bildenden Individuums, aber auch im Hinblick auf den Streit um das Richtige und Gültige problematisiert werden kann, verweist auf eine Verbindung (...) von Bildungs- und Demokratietheorie. Aktuelle Demokratie-theorien thematisieren die letztliche Unmöglichkeit der Begründung sozialer Ordnung und den daraus resultierenden Streit um Begründungsansprüche. Von hier aus erscheint die Frage sinnvoll, ob das Bildungsversprechen nicht zugleich einen politisch-demokratischen Einsatz enthält und wie man sich diesem (theoretisch und empirisch) nähern kann. This paper focuses on the use of ‘black box’ AI in medicine and asks whether the physician needs to disclose to patients that even the best AI comes with the risks of cyberattacks, systematic bias, and a particular type of mismatch between AI’s implicit assumptions and an individual patient’s background situation.Pacecurrent clinical practice, I argue that, under certain circumstances, these risks do need to be disclosed. Otherwise, the physician either vitiates a patient’s informed consent or violates a more general obligation (...) to warn him about potentially harmful consequences. To support this view, I argue, first, that the already widely accepted conditions in the evaluation of risks, i.e. the ‘nature’ and ‘likelihood’ of risks, speak in favour of disclosure and, second, that principled objections against the disclosure of these risks do not withstand scrutiny. Moreover, I also explain that these risks are exacerbated by pandemics like the COVID-19 crisis, which further emphasises their significance. (shrink)

A common complaint about Kantian ethics is that it cannot do justice to the social or intersubjective dimensions of human life – that, unlike Fichte, Hegel, or Marx, Kant remains caught within a fundamentally individualistic perspective on practical or moral questions. In this way, the objection goes, Kantian ethics leaves agents alienated from others around them and their larger community. While not entirely unnatural, I argue here that such concerns rest on a mischaracterization of where the most serious problems in (...) this region for Kant lie. Far from being too individualistic, the real worry about Kantian moral theory is that it may not be individualistic enough. In a contemporary context, where Kantian ethics is associated with the “self-constitution” of agents or the “separateness of persons”, the idea that it is insufficiently concerned with individual persons may come as a surprise. But it would not surprise Kant’s immediate successors like Fichte and Hegel. For this is where they often located the deepest problems facing Kant’s moral philosophy. As we will see, in making such points, they were in some ways closer to Kant’s own views than they recognized. Nonetheless, if this is right, Kantian ethics may in fact more anti-individualistic than many of the ethical systems that followed in his wake. And the most radical elements in Kant’s ethics might point, less to Fichte and Hegel, and more to figures like Schopenhauer who sought to develop a synthesis of Kant and ideas from South Asian philosophy. Perhaps, we might say, Kant has been sitting under the Bodhi tree all along? (shrink)

In this essay, I develop and defend a virtue‐theoretic conception of rationality as a capacity whose function is understanding, as opposed to mere truth or correctness. I focus on two main potential advantages of this view. First, its ability to explain the rationality of forms of explanatory reasoning, and second, its ability to offer a more unified account of theoretical and practical rationality.

In these comments I briefly discuss three aspects of the empiricist account of the epistemic role of experience that Anil Gupta develops in his Empiricism and Experience. First, I discuss the motivations Gupta offers for the claim that the given in experience should be regarded as reliable. Second, I discuss two different ways of conceiving of the epistemic significance of the phenomenology of experience. And third, I discuss whether Gupta's account is able to deliver the anti-skeptical results he intends it (...) to. I close by suggesting that, once fully fleshed out, Gupta's account is best understood in terms of the fusion of certain core ideas within both the empiricist and the rationalist traditions. Increasingly, transgender minors are seeking medical care such as puberty-suppressing or gender-affirming hormone therapies. Yet, whether these interventions should be performed at all is highly controversial. Some healthcare practitioners oppose irreversible interventions, considering it their duty to protect children from harm. Others view minors, like adults, as transgender individuals who must be protected from discrimination. The underlying ethical question is presented as a problem of priority. Is it primarily relevant that minors are involved? Or should decision makers focus on the (...) fact that they treat transgender individuals? The paper explores the relevance for medical practice. We provide results of an interview study with German healthcare professionals. We discuss the general question whether prioritization among different group memberships of the same person is ethically defensible. We conclude that priority conflicts between group memberships of the same person can be deceptive and should be addressed by an intersectional approach. Eventually, we discuss practical implications. Staff at a university hospital took part in a survey (January to June 2010) using a questionnaire with open and closed questions. Descriptive data for physicians and nurses (response rate = 13.5%, n = 101) are presented. Physicians and nurses reported similar high frequencies of ethical conflicts but rated the relevance of ethical (...) issues differently. Nurses stated ethical issues as less important to physicians than to themselves. Ethical conflicts were mostly discussed with staff from one’s own profession. Respondents predominantly expected the Clinical Ethics Committee to provide competent support. Mostly, nurses feared it might have no influence on clinical practice. Findings suggest that experiences of ethical conflicts might reflect interprofessional communication patterns. Expectations and objections against Clinical Ethics Committees were multifaceted, and should be overcome by providing sufficient information. The Clinical Ethics Committee needs to take different perspectives of professions into account. (shrink)
