La catégorie moderne de la légalité vit depuis longtemps une profonde crise d'identité. Selon l'auteur, il ne s'agit pas simplement d'une crise d'effectivité, mais d'une crise bien plus profonde, qui ne se manifeste pas seulement par la dissiciation du modèle de la réalité, mais qui bouleverse le modèle théorique lui-même, signe d'une crise encore plus radicale qui concerne tout le paradigme juridique au sein duquel elle a été conçue.00Après avoir tracé les contours de ce paradigme et mis en lumière l'aporie (...) du princpe moderne d'égalité, l'Auteur nous montre, en s'appuyant sur la révolution constitutionnelle de l'après seconde guerre mondiale et en faisant le détour par les territoires du droit européen, que ceux qui semblent être des chemins interrompus de la légalité s'avèrent être, en réalité, les chemins encore peu explorés d'une nouvelle légalité dont il brosse le portrait. Depuis Droit, mythe et raison (1980) écrit avec Jacques Lenoble jusqu’aux récents À quoi sert le droit? Usages, fonctions et finalités (2016) ou Le droit, objet de passions (2018), François Ost ne cesse de questionner les rapports de nos sociétés au droit et la place de celui-ci dans nos sociétés contemporaines. Avec Le droit malgré tout, il s’agit de rendre hommage à l’œuvre et à la carrière d’une figure centrale de la théorie du droit contemporaine et aussi au fondateur, avec (...) le regretté Michel van de Kerchove, de ce que l’on appelle parfois « l’école de Saint-Louis ». Abordant les deux pôles de la dialectique à laquelle François Ost est si attaché - la critique et la reconstruction -, l’ouvrage propose un regard interdisciplinaire sur le droit, à travers les principaux thèmes qui ont nourri la pensée de l’auteur. Du statut épistémologique de la science du droit à un questionnement sur les fondements et l’avenir du droit et de la justice, des liens qu’entretiennent le droit et la littérature jusqu’à l’environnement saisi par le droit en passant par les « communs », les approches de ses collègues et amis sont toutes réflexives et critiques. En ce qu’elles sont soucieuses de soumettre le droit au regard des sciences sociales et, inversement, les normativités extra-juridiques au regard du droit, elles sont fidèles à la démarche de François Ost. Ce Liber Amicorum propose aussi un retour réflexif sur son œuvre par l’auteur lui-même, dans un entretien avec Manuel Atienza. Different definitions of bioethics in American and Italian literature are reported. It is argued that they refer to three different conceptions of the epistemological status of bioethics: the first conceives of it as an application of moral principles to biomedical problems, the second as a methodology for the working out of clinical judgement, the third as a broader and interdisciplinary public inquiry. It is suggested that each approach grasps a part of the truth, for each singles out one level of (...) the bioethical work. Bioethics is in fact a complex, three-level form of knowledge. The misunderstanding of this complexity has led to some confusion and to conflicts of attribution among those who are concerned with it. Christiansen & Chater (C&C) have taken the interactionist approach to linguistic universals to an extreme, adopting the metaphor of language as an organism. This metaphor adds no insights to five decades of analyzing language universals as the result of interaction of linguistically unique and general cognitive systems. This metaphor is also based on an outmoded view of classical Darwinian evolution and has no clear basis in biology or cognition.

For a long time, Parmenides has been considered the first real metaphysician in history, a theorist of a disembodied being, unreachable by the scientific knowledge of the world. In his Eleatic Lectures, Giovanni Cerri goes back to his renown interpretation of Parmenides as a scientist fully aware of the epistemological foundations of knowledge, and capable of foreshadowing the ultimate outcome of the evolution of science, that is, the discovery of being as a single homogeneous body. Cerri also shows that the (...) works of two other thinkers who were trained in the heart of the school of Elea itself support his interpretation: on the one hand Zeno, with his arguments against plurality; on the other hand Leucippus, the inventor of atomism. Ten scholars have been called to discuss this broad interpretation of a crucial page in the history of thought. Cerri replies to each of them in the final pages of the volume, engaging in a dense dialogue. (shrink)

Europe Kidnapped: Spanish Voices on Citizenship and Exile Exile and migration are once more central issues in the contemporary European predicament. This short article intends to discuss these questions elaborating on the ideas of two Spanish authors, a novelist, Max Aub, and a philosopher, María Zambrano, both marked by the tragic events of civil war and forced expatriation. Exile and migration in their existential perspective are meant as a prologue to the vindication of citizenship.

Populism, the Kingdom of Shadows, and the Challenge to Liberal Democracy Populism is a somehow intractable notion, since its reference is much too wide, comprising phenomena that are indeed in conflict between them, and moreover blurred, by being often used in an instrumental, polemical way. Such intractability is then radicalized through the two alternative approaches to populism, one that is more or less neutral, rooting in the political science tradition, and a second one, fully normative, though fed by political realism, (...) founding as it does on a specific political theory and project. In the article an alternative view is proposed, that of populism as the politics that is congruent with the increasing role played by ‘screens’, icons, and images in social relationships and indeed in political representation. In this way populism is approached as the specific way politics is done within the context of a digitalized société du spectacle. (shrink)

"The last remnant of physical objectivity of space-time" is disclosed, beyond the Leibniz equivalence, in the case of a continuous family of spatially non-compact models of general relativity. The physical individuation of point-events is furnished by the intrinsic degrees of freedom of the gravitational field, (viz, the "Dirac observables") that represent - as it were - the "ontic" part of the metric field. The physical role of the "epistemic" part (viz. the "gauge" variables) is likewise clarified. At the end, a (...) peculiar four-dimensional "holistic and structuralist" view of space-time emerges which includes elements common to the tradition of both substantivalism and relationism. The observables of our models undergo real "temporal change" and thereby provide a counter-example to the thesis of the "frozen-time" picture of evolution. (shrink)

The debate about the levels of selection has been one of the most controversial both in evolutionary biology and in philosophy of science. Okasha’s book makes the sort of contribution that simply will not be able to be ignored by anyone interested in this field for many years to come. However, my interest here is in highlighting some examples of how Okasha goes about discussing his material to suggest that his book is part of an increasingly interesting trend that sees (...) scientists and philosophers coming together to build a broadened concept of “theory” through a combination of standard mathematical treatments and conceptual analyses. Given the often contentious history of the relationship between philosophy and science, such trend cannot but be welcome. (shrink)

This issue of Itinera aims to address the connections between architecture and the performing arts in its various aspects and from multiple points of view. The growing emphasis on the performative character of artistic practices, namely, their ability to involve spectators directly and pervasively (Dixon 2007), imbues the relationship between architecture, the performing arts, and the spectator’s experience. The sharing of the scenic space by spectators and performers is essential for the co-production of a common energy which operates as a (...) “transforming force” and thereby opens up the shared experience of discovering oneself and the other as a union of the body and the mind (Fischer-Lichte 2004).
