Canada has recently published a new Clinical Practice Guideline on the diagnosis and management of brain death. It states that consent is not necessary to carry out the interventions required to make the diagnosis. A supporting article not only sets out the arguments for this but also contends that ‘UK laws similarly carve out an exception, excusing clinicians from a prima facie duty to get consent’. This is supplemented by the claim that recent court decisions in the UK similarly confirm (...) that consent is not required, referencing two judgements in _Battersbee_. We disagree with the authors’ interpretation of the law on consent in the UK and argue that there is nothing in _Battersbee_ to support the conclusion that consent to testing is not necessary. Where there is a disagreement about testing for brain death in the UK, court authorisation is required. (shrink)

The reality of current clinical practice in the UK is that where a patient’s family refuses to agree to testing for brain stem death (BD), such cases will ultimately end up in court. This situation is true of both adults and children and reinforced by recent legal cases. While recourse to the courts might be regrettable in such tragic cases, if public trust in the medical diagnosis of BD is to be maintained all aspects of the process must be conducted (...) in a way that is transparent and open to scrutiny. This is not an ‘ineffective expenditure’ of resources, but an essential element of a human rights-compliant legal system. (shrink)

The decision of the House of Lords in Gillick v West Norfolk Area Health Authority carved out a safe space for competent minors to confidentially access sexual and reproductive health care and advice in the UK. Ireland is one of the few common law jurisdictions that has not endorsed Gillick or a similar mature minor doctrine, nor has it securely legislated for the right to consent of those aged 16 and 17 years. The legal lacuna created by this deficiency has (...) left young persons in Ireland seeking sexual and reproductive healthcare, and the clinicians who provide this, in a challenging place. While this void has been partially filled with policy statements by bodies such as the Irish College of General Practitioners and the Health Service Executive, nonetheless the legal shortcomings leave both a sense of insecurity, and real world difficulties for adolescents seeking to access to sexual and reproductive healthcare. ObjectiveMost young adults diagnosed with breast or gynecologic cancers experience adverse reproductive or sexual health outcomes due to cancer and its treatment. However, evidence-based interventions that specifically address the RSH concerns of young adult and/or LGBTQ+ survivor couples are lacking. Our goal is to develop a feasible and acceptable couple-based intervention to reduce reproductive and sexual distress experience by young adult breast and gynecologic cancer survivor couples with diverse backgrounds.MethodsWe systematically adapted an empirically supported, theoretically grounded couple-based intervention to address (...) the RSH concerns of young couples coping with breast or gynecologic cancer through integration of stakeholder perspectives. We interviewed 11 couples with a history of breast or gynecologic cancer to review and pretest intervention materials. Three of these couples were invited to review and comment on intervention modifications. Content experts in RSH and dyadic coping, clinicians, and community advisors participated throughout the adaptation process.ResultsFindings confirmed the need for an online, couple-based intervention to support young couples experiencing RSH concerns after breast or gynecologic cancer. Qualitative themes suggested intervention preferences for: A highly flexible intervention that can be tailored to couples’ specific RSH concerns; Active steps to help members of a dyad “get on the same page” in their relationship and family building plans; A specific focus on raising partners’ awareness about how cancer can affect body image and physical intimacy; and Accessible, evidence-based information about RSH for both partners. These results, along with feedback from stakeholders, informed adaptation and finalization of the intervention content and format. The resulting virtual intervention, Opening the Conversation, includes five weekly sessions offering training to couples in communication and dyadic coping skills for addressing RSH concerns.ConclusionThe systematic adaptation process yielded a theory-informed intervention for young adult couples facing breast and gynecological cancers, which will be evaluated in a randomized controlled trial. The long-term goal is to implement and disseminate Opening the Conversation broadly to reach young adult couples with diverse backgrounds who are experiencing RSH concerns in cancer survivorship. They are, however, also arguably failing humanity when their impact is measured against the level of progress being made in stimulating the societal changes needed to address challenges like climate change. In this research we used a novel futures-oriented and participatory approach that asked what future envisioned knowledge systems might need to look like and how we might get there. To genuinely be a creative force in supporting longevity of human and non-human life on our planet, the shift in knowledge systems will probably need to be at the scale of the enlightenment and speed of the scientific and technological revolution accompanying the second World War. She hoped to sell select pieces from her famed wardrobe (...) in order to supplement her income, which was, at the time, rather meager. Accompanying the recently widowed socialite was her self-described “modiste” and “confidante ” Elizabeth Keckley, a formerly enslaved African American dressmaker who had been “intimately associated” with Lincoln for years.1 Despite the various measures undertaken to ensure the scheme’s success, including attempts to extort monied East Coast Republicans and strategic appeals to the press, it ultimately proved fruitless. Political nemeses seized on the opportunity to publicly mock Lincoln, who was seen as an “extravagant and improper” social climber, for her “pecuniary embarrassment,” treating the public auction of her clothing as a spectacle akin to the World Fair.2 Eventually, the former First Lady was forced to retreat to her home in Chicago, leaving Keckley behind to tend to her affairs. 1. However, perhaps unsurprisingly, the book’s release had the exact opposite effect: Keckley’s literary disclosures were met with scorn, regarded by large swaths of white Americans, including some of the same people who had been most vocal in their condemnation of Mary Todd Lincoln, as constituting a set of socially impermissible transgressions of class, race, and gender. Sales of the book were subsequently suppressed, Keckley’s relationship with Lincoln (who had been caught off guard by the text’s release) came to an abrupt end, and there was even a brief, parodic pamphlet produced, titled Behind the Seams; by a Nigger Woman Who Took in Work from Mrs. Lincoln and Mrs. Davis, which cast the entire ordeal as a sort of (racist) cautionary tale.5 Given the clear disdain held for Lincoln by people across the political spectrum at the time, it can be difficult to make sense of the visceral reaction prompted by Keckley’s airing of the controversial figure’s dirty laundry (pun intended). Considering the ways Behind the Scenes implicitly challenged the fixity of hierarchical distinctions between Black and white, employee and employer, however, repudiation of the work might be understood as inevitable. This article proposes to think about the pedagogical engineering project of INSA Lyon, dedicated to the reform of teaching to respond to the socio-ecological transition, in the light of the thought and action of Gaston Berger, one of the main founders of this engineering school. If we retain that engineering requires a philosophy, the latter consists in an operation of “conversion of the gaze,” from transcendental idealism to pragmatism, implying an ethics of knowledge. This article explores André-Marie Ampère's autobiography in order to analyse the dynamics of science in early 19th century French institutions. According to recent works that have emphasised the value of biographies in the history of science, this study examines Ampère's public self-representation to show the cultural transformations of a life dedicated to science in post-revolutionary French society. With this aim, I have interpreted this manuscript as an outstanding example of the scientific rhetoric flourishing in early 19th century French Romanticism, which (...) celebrated the life and works of men of science by means of biographies. Following this approach, Ampère's account has been analysed in relation to certain commonplaces shared with other autobiographies of that time, such as his traumatic experience linked to the French Revolution. Finally, this article discusses Ampère's autobiography as revealing an emerging model of scientific personae, i.e. a new collective way of thinking, feeling and perceiving, which announced the category of the modern scientist. The #metoo movement has forced many fans to consider what they should do when they learn that a beloved artist has acted immorally. One natural thought is that fans ought to give up the artworks of immoral artists. In Why It's OK to Enjoy the Work of Immoral Artists, Mary Beth Willard argues for a more nuanced view. Enjoying art is part of a well-lived life, so we need good reasons to give it up. And it turns out good (...) reasons are hard to find. Willard show that it's reasonable to believe that most boycotts of artists won't succeed, so most of the time there's no ethical reason to join in. Someone who manages to separate the art from the artist isn't making an ethical mistake by buying and enjoying their art. She then considers the ethical dimensions of canceling artists and so-called "cancel culture," arguing that canceling is ethically risky because it encourages moral grandstanding. Willard concludes by arguing that the popular debate has overlooked the power of art to change our lives for the good. It's of course OK to decide to give up the artwork of immoral artists, but--as Willard shows in this provocative little volume--it's OK to continue to enjoy their art, as well. Developing and implementing artificial intelligence (AI) systems in an ethical manner faces several challenges specific to the kind of technology at hand, including ensuring that decision-making systems making use of machine learning are just, fair, and intelligible, and are aligned with our human values. Given that values vary across cultures, an additional ethical challenge is to ensure that these AI systems are not developed according to some unquestioned but questionable assumption of universal norms but are in fact compatible with the (...) societies in which they operate. This is particularly pertinent for AI research and implementation across Africa, a ground where AI systems are and will be used but also a place with a history of imposition of outside values. In this paper, we thus critically examine one proposal for ensuring that decision-making systems are just, fair, and intelligible—that we adopt a principle of explicability to generate specific recommendations—to assess whether the principle should be adopted in an African research context. We argue that a principle of explicability not only can contribute to responsible and thoughtful development of AI that is sensitive to African interests and values, but can also advance tackling some of the computational challenges in machine learning research. In this way, the motivation for ensuring that a machine learning-based system is just, fair, and intelligible is not only to meet ethical requirements, but also to make effective progress in the field itself. A main thread of the debate over mathematical realism has come down to whether mathematics does explanatory work of its own in some of our best scientific explanations of empirical facts. Realists argue that it does; anti-realists argue that it doesn't. Part of this debate depends on how mathematics might be able to do explanatory work in an explanation. Everyone agrees that it's not enough that there merely be some mathematics in the explanation. Anti-realists claim there is nothing mathematics can (...) do to make an explanation mathematical ; realists think something can be done, but they are not clear about what that something is. I argue that many of the examples of mathematical explanations of empirical facts in the literature can be accounted for in terms of Jackson and Pettit's [1990] notion of program explanation, and that mathematical realists can use the notion of program explanation to support their realism. This is exactly what has happened in a recent thread of the debate over moral realism. I explain how the two debates are analogous and how moves that have been made in the moral realism debate can be made in the mathematical realism debate. However, I conclude that one can be a mathematical realist without having to be a moral realist. (shrink)

St. Augustine of Hippo wrote the ’De Trinitate’ to explain to critics of the Nicene Creed how the Christian doctrine of the divinity and coequality of Father, Son, and Holy Spirit is present in Scripture. He also wanted to convince philosophers that Christ is the Wisdom they sought. Augustine’s third purpose was to correlate the biblical truth that all human persons are created to image God, a Trinity, a communion of love, with the first two Commandments of the Old and (...) New Testaments. Augustine succeeded in showing the need for combining faith and reason for a greater understanding of Scripture as well as for a greater understanding of the true nature and destiny of human persons. Augustine emphasized the scriptural revelation of God as Father, Son, and Holy Spirit, and used reason to convince philosophers that the one and three-Personed God is philosophically and logically defensible.
