What happens when collectivity and law intersect? Lisa Hahn and Markus Hasl outline the state of research on this question and add new answers offered by this special issue. On the one hand, the search for interdisciplinary encounters shows that law is both means and object of collective legal struggles. In doing so, collectives shape law. On the other hand, law (re)produces collectives through categorization and personalization; it juridifies. In doing so, it oscillates between productivity and destructiveness. This paper proposes a systematic framework for the analysis of tensions in corporate sustainability. The framework is based on the emerging integrative view on corporate sustainability, which stresses the need for a simultaneous integration of economic, environmental and social dimensions without, a priori, emphasising one over any other. The integrative view presupposes that firms need to accept tensions in corporate sustainability and pursue different sustainability aspects simultaneously even if they seem to contradict each other. The framework proposed in this paper (...) goes beyond the traditional triad of economic, environmental and social dimensions and argues that tensions in corporate sustainability occur between different levels, in change processes and within a temporal and spatial context. The framework provides vital groundwork for managing tensions in corporate sustainability based on paradox strategies. The paper then applies the framework to identify and characterise four selected tensions and illustrates how key approaches from the literature on strategic contradictions, tensions and paradoxes—i.e., acceptance and resolution strategies—can be used to manage these tensions. Thereby, it refines the emerging literature on the integrative view for the management of tensions in corporate sustainability. The framework also provides managers with a better understanding of tensions in corporate sustainability and enables them to embrace these tensions in their decision making. (shrink)

This volume in the series celebrates the philosophy of American Donald Davidson, whose process covers different types of philosophy. Admired for developing a system based on his theory of mind and language, he considers two of his most central interests to be the concepts of truth and objectivity.

Argumentation is pervasive in everyday life. Understanding what makes a strong argument is therefore of both theoretical and practical interest. One factor that seems intuitively important to the strength of an argument is the reliability of the source providing it. Whilst traditional approaches to argument evaluation are silent on this issue, the Bayesian approach to argumentation (Hahn & Oaksford, 2007) is able to capture important aspects of source reliability. In particular, the Bayesian approach predicts that argument content and source (...) reliability should interact to determine argument strength. In this paper, we outline the approach and then demonstrate the importance of source reliability in two empirical studies. These experiments show the multiplicative relationship between the content and the source of the argument predicted by the Bayesian framework. (shrink)

The notion of “the burden of proof” plays an important role in real-world argumentation contexts, in particular in law. It has also been given a central role in normative accounts of argumentation, and has been used to explain a range of classic argumentation fallacies. We argue that in law the goal is to make practical decisions whereas in critical discussion the goal is frequently simply to increase or decrease degree of belief in a proposition. In the latter case, it is (...) not necessarily important whether that degree of belief exceeds a particular threshold (e.g., ‘reasonable doubt’). We explore the consequences of this distinction for the role that the “burden of proof” has played in argumentation and in theories of fallacy. (shrink)

This paper offers a critique of sustainability reporting and, in particular, a critique of the modern disconnect between the practice of sustainability reporting and what we consider to be the urgent issue of our era: sustaining the life-supporting ecological systems on which humanity and other species depend. Tracing the history of such reporting developments, we identify and isolate the concept of the ‘triple bottom line’ (TBL) as a core and dominant idea that continues to pervade business reporting, and business engagement (...) with sustainability. Incorporating an entity’s economic, environmental and social performance indicators into its management and reporting processes, we argue, has become synonymous with corporate sustainability; in the process, concern for ecology has become sidelined. Moreover, this process has become reinforced and institutionalised through SustainAbility’s biennial benchmarking reports, KPMG’s triennial surveys of practice, initiatives by the accountancy profession and, particularly, the Global Reporting Initiative (GRI)’s sustainability reporting guidelines. We argue that the TBL and the GRI are insufficient conditions for organizations contributing to the sustaining of the Earth’s ecology. Paradoxically, they may reinforce business-as-usual and greater levels of un-sustainability. (shrink)

The luck argument raises a serious challenge for libertarianism about free will. In broad outline, if an action is undetermined, then it appears to be a matter of luck whether or not one performs it. And if it is a matter of luck whether or not one performs an action, then it seems that the action is not performed with free will. This argument is most effective against event-causal accounts of libertarianism. Recently, Franklin (Philosophical Studies 156:199–230, 2011) has defended event-causal (...) libertarianism against four formulations of the luck argument. I will argue that three of Franklin’s responses are unsuccessful and that there are important versions of the luck challenge that his defense has left unaddressed. (shrink)

In recent years, the receipt and the perception of information has changed in ways which have fueled fears about the fates of our democracies. However, real information on these possibilities or the direction of these changes does not exist. Into this gap, Hahn and colleagues bring the power of Condorcet's (1785) Jury Theorem to show that changes in our information networks have affected voter inter‐dependence so that it is likely that voters are now collectively more ignorant even if individual (...) voter competence remains unchanged. Empirical evidence challenges many of the assumptions that underlie traditional philosophical and commonsense conceptions of human agency. It has been suggested that this evidence threatens also to undermine free will and moral responsibility. In this paper, I will focus on the purported threat to moral responsibility. The evidence challenges assumptions concerning the ability to exercise conscious control and to act for reasons. This raises an apparent challenge to moral responsibility as these abilities appear to be necessary for morally responsible agency. (...) I will argue that this challenge collapses once the underlying conditions on moral responsibility are specified in sufficient detail. I will argue, in other words, that the empirical evidence does not support a challenge to the assumption that we are, in general, morally responsible agents. In the final section, I will suggest that empirical research on human agency is nevertheless relevant to various questions about moral responsibility. (shrink)

Discussions of psychological measurement are largely disconnected from issues of measurement in the natural sciences. We show that there are interesting parallels and connections between the two, by focusing on a real and detailed example (temperature) from the history of science. More specifically, our novel approach is to study the issue of validity based on the history of measurement in physics, which will lead to three concrete points that are relevant for the validity debate in psychology. First of all, studying (...) the causal mechanisms underlying the measurements can be crucial for evaluating whether the measurements are valid. Secondly, psychologists would benefit from focusing more on the robustness of measurements. Finally, we argue that it is possible to make good science based on (relatively) bad measurements, and that the explanatory success of science can contribute to justifying the validity of measurements. Many groups of closely related species have reticulate phylogenies. Recent genomic analyses are showing this in many insects and vertebrates, as well as in microbes and plants. In microbes, lateral gene transfer is the dominant process that spoils strictly tree‐like phylogenies, but in multicellular eukaryotes hybridization and introgression among related species is probably more important. Because many species, including the ancestors of ancient major lineages, seem to evolve rapidly in adaptive radiations, some sexual compatibility may exist among them. Introgression and (...) reticulation can thereby affect all parts of the tree of life, not just the recent species at the tips. Our understanding of adaptive evolution, speciation, phylogenetics, and comparative biology must adapt to these mostly recent findings. Introgression has important practical implications as well, not least for the management of genetically modified organisms in pest and disease control. (shrink)

The two main domains of high culture - the arts and the sciences - seem to be completely different, simply unrelated. Is there any sense then in talking about culture in the singular as a unity? A positive answer to this question presupposes that there is a single conceptual scheme, in terms of which it is possible to articulate both the underlying similarities and the basic differences between these domains. This article argues that - at least in respect of ‘classical’ (...) modernity - there is such a framework: the normatively conceived Author-Work-Recipient relation. It allows the disclosure of the paradoxical unity of culture: its two main realms are constituted as polar opposites and thus as strictly complementary. Through such an organization, culture could fulfil an affirmative, compensatory role. At the same time however, it also allowed culture to acquire the character of social critique, a function realized through the antagonistically opposed projects of Enlightenment and Romanticism - projects whose illusions are now evident. That is, the semantic value of a complex representation is determined by the semantic value of their parts and the way they are put together. Dating back to the late 19th century, the principle of compositionality has regained wide attention recently. Curiosity is a wonder of the human mind. It goes to the heart of modernity, as a driving force for learning, novel insights, and innovation, both for individuals and communities. In societies dependent on science and development, finding out what promotes or hampers curiosity and wonder in school curricula and science education is accordingly essential. In this conceptual article, I suggest a framework for curiosity-based science education and I explore options for its wellbeing and development during preschool, preadolescence, and adolescence. In preschool, curiosity and wonder are triggered by perceptive beauty rather than by facts, and a method emphasizing maximism as a complementary factor in preschool science education is proposed. In prepuberty, curiosity is encouraged by exploring the diversity of the world. Facts and clear-cut knowledge constitute a firm foundation for scientific thinking. In high school, curiosity is ignited by means of a better balance between models and phenomenology. Criticism has arisen over the one-sided use of models in high school science education, which limits scientific thinking to frameworks defined by the actual model. Possible solutions to maintain students’ curiosity and ideas to improve the balance between phenomenology and models are discussed. (shrink)

In Western medicine the interpretation prevails that mental illness is a psychological and/or biological disorder. Most important concepts in health psychology, such as sense of coherence, self‐efficacy, hope, or dispositional optimism are all very cognition and individual centered. In this individualized perspective, mental illness is constructed in such a way that it can be treated in a dyadic doctor–patient or therapist–patient relationship with the help of drugs or therapeutic techniques. In this article, I would like to develop a contrasting social (...) construction of mental illness. In Umbanda and Candomblé temples in Brazil, what is interpreted in the Western model as illness is understood as a “spiritual problem.” Here, the individual is constructed in relationship to the community, and individual health and healing is footed in moral‐spiritual orders. In presenting the details of my investigation, I will apply Grawe’s common factors as a foil for developing the link between mental illness and its social context. (shrink)

In this paper the role of incomprehensibility in the conceptualization of the DSM-IV definition of delusion is discussed. According to the analysis, the conceptual dependence of DSM-IV definition of delusion on incomprehensibility is manifested in several ways and infested with ambiguity. Definition of bizarre delusions is contradictory and gives room for two incompatible readings. Also the definition of delusion manifests internal inconsistencies and its tendency to account for delusions in terms of misinterpretation is bound to miss the content of the (...) traditional comprehension of delusionality. It is suggested that the ambiguities in defining delusions has to do with the question whether psychiatric practice is better accounted for in terms of the grammar of incorrectness or of incomprehensibility. The problematics of alienation have played a rather significant role in the discussions\nabout the sense and relevance of Marxism which have taken place in\nthe last twenty years. &dquo;Back to Marx&dquo; was at least one of the main slogans of\nthat ideological/intellectual movement, which evolved both in the East and\nWest from the mid-fifties and which is sometimes referred to as the trend of\n&dquo;humanist&dquo; Marxism. The idea of a &dquo;Marx-Renaissance&dquo; was undoubtedly\ndirected first of all against the completely petrified framework of institutionalized\nMarxism, turned into (...) a &dquo;religion of state&dquo; legitimating the domination\nof a bureaucratic apparatus over the population of East European societies.\nThe &dquo;rediscovery&dquo; and &dquo;rehabilitation&dquo; of the young Marx, the emphasis on\nthe continuity of his thought, meant not only a reintroduction of a number\nof categories, problems and ideas, which were thought fruitful in their critical\ninsight into contemporary conditions and which the impoverished and distorted\nversion of Marxism in official communist ideology (deliberately) failed\nto take into account: it also meant a global challenge to the appropriation of\nthe Marxian tradition by an apologetic ideology, which disguised its positivistic\ncontent through the form of an old-fashioned, dogmatic metaphysics; it\nwas an attempt to recover the critical/emancipatory meaning of this tradition\nwithin the realities of the twentieth century. It was in this context that the\nnotion of &dquo;alienation&dquo; again reappeared -- as a concept through which one\ncould articulate an attitude which was critical simultaneously of Western\ncapitalist and so-called &dquo;socialist&dquo; Eastern societies. Within the framework of\nEast European realities even the rather abstract character of this notion found\nin young Marx, was well suited to the theoretical vagueness and the practical\nlimitations of this new-found leftist criticism of home-societies. In this paper, it is argued that Ferguson’s (2003, Argumentation 17, 335–346) recent proposal to reconcile monotonic logic with defeasibility has three counterintuitive consequences. First, the conclusions that can be derived from his new rule of inference are vacuous, a point that as already made against default logics when there are conflicting defaults. Second, his proposal requires a procedural “hack” to the break the symmetry between the disjuncts of the tautological conclusions to which his proposal leads. Third, Ferguson’s proposal amounts (...) to arguing that all everyday inferences are sound by definition. It is concluded that the informal logic response to defeasibility, that an account of the context in which inferences are sound or unsound is required, still stands. It is also observed that another possible response is given by Bayesian probability theory (Oaksford and Chater, in press, Bayesian Rationality: The Probabilistic Approach to Human Reasoning, Oxford University Press, Oxford, UK; Hahn and Oaksford, in press, Synthese). Challenged by Charles Taylor, Andrea Kern and Jocelyn Benoist, Gabriel deftly refutes naturalism's metaphysical claim to epistemic exclusiveness.

Exception and authority are core themes of Kierkegaard’s and Nietzsche’s works. These themes are used as points of comparison in more recent studies on the two authors which focus on structural parallels developing the figure of the single one resp. the lonely one and on concepts of power with regard to religious and philosophical authority. Methodological difficulties relevant to the popular comparison of Kierkegaard and Nietzsche in general concern the interpretation of the totality, teleology and style of each works.
