A coherent practice of mens rea (‘guilty mind’) ascription in criminal law presupposes a concept of mens rea which is insensitive to the moral valence of an action’s outcome. For instance, an assessment of whether an agent harmed another person intentionally should be unaffected by the severity of harm done. Ascriptions of intentionality made by laypeople, however, are subject to a strong outcome bias. As demonstrated by the Knobe effect, a knowingly incurred negative side effect is standardly judged intentional, whereas (...) a positive side effect is not. We report the first empirical investigation into intentionality ascriptions made by professional judges, which finds (i) that professionals are sensitive to the moral valence of outcome type, and (ii) that the worse the outcome, the higher the propensity to ascribe intentionality. The data shows the intentionality ascriptions of professional judges to be inconsistent with the concept of mens rea supposedly at the foundation of criminal law. (shrink)

This chapter sheds light on a response to experimental philosophy that has not yet received enough attention: the reflection defense. According to proponents of this defense, judgments about philosophical cases are relevant only when they are the product of careful, nuanced, and conceptually rigorous reflection. The chapter argues that the reflection defense is misguided: Five studies (N>1800) are presented, showing that people make the same judgments when they are primed to engage in careful reflection as they do in the conditions (...) standardly used by experimental philosophers. In a series of ten preregistered experiments (N=2043), we investigate the effect of outcome valence on judgments of probability, negligence, and culpability – a phenomenon sometimes labelled moral (and legal) luck. We found that harmful outcomes, when contrasted with neutral outcomes, lead to increased perceived probability of harm ex post, and consequently to increased attribution of negligence and culpability. Rather than simply postulating a hindsight bias (as is common), we employ a variety of empirical means to demonstrate that the outcome-driven (...) asymmetry across perceived probabilities constitutes a systematic cognitive distortion. We then explore three distinct strategies to alleviate the hindsight bias and its downstream effects on mens rea and culpability ascriptions. Not all are successful, but at least some prove promising. They should, we argue, be taken into consideration in criminal jurisprudence, where distortions due to the hindsight bias are likely considerable and deeply disconcerting. (shrink)

This article explores whether perspective taking has an impact on the ascription of epistemic states. To do so, a new method is introduced which incites participants to imagine themselves in the position of the protagonist of a short vignette and to judge from her perspective. In a series of experiments, perspective proves to have a significant impact on belief ascriptions, but not on knowledge ascriptions. For belief, perspective is further found to moderate the epistemic side-effect effect significantly. It is hypothesized (...) that the surprising findings are driven by the special epistemic authority we enjoy in assessing our own belief states, which does not extend to the assessment of our own knowledge states. We present an argument against physicalism in two steps: 1) Physics reduces the world to a mathematical structure; 2) The notion of 'structure' only makes sense when carried by something and interpreted by something else. Physicalism does not allow such a carrier and interpreter at a fundamental level, hence it must be wrong. An extended notion of Mind is presented as the fundamental 'hardware' which is necessary by the argument. In particular, qualia correspond to the 'monitor component' of mind. Some (...) ideas are presented on how to extend this mind-matter relation to a more elaborate picture: (1) A system of two complementary reductionisms (one physical, the other mental) may hint toward a deeper reality in which mind and the physical world are closely entangled. (2) A division of mind into a conscious 'monitor' and an unconscious 'processor' is suggested using the analogy of dreams. Finally, the problem of Solipsism and the existence of 'minds other than my own' is discussed. (shrink)

It is a common intuition that at least in some cases disagreement has skeptical consequences: the participants are not justified in persisting in their beliefs. I will argue that the currently popular non-dialectical and individualistic accounts of justification, such as evidentialism and reliabilism, cannot explain this intuition and defend the dialectical conception of justification that can explain it. I will also argue that this sort of justification is a necessary condition of knowledge by relying on Craig's genealogy of the concept (...) of knowledge. I will then respond to the accusation that the dialectical conception leads to radical skepticism. My response is partly concessive. It does lead to skepticism in areas where controversy prevails, such as philosophy, politics and religion, but this sort of skepticism is quite intuitive. Finally, I deal with the objection that my defense of skepticism about philosophy is self-refuting. (shrink)

The problematics of alienation have played a rather significant role in the discussions\nabout the sense and relevance of Marxism which have taken place in\nthe last twenty years. &dquo;Back to Marx&dquo; was at least one of the main slogans of\nthat ideological/intellectual movement, which evolved both in the East and\nWest from the mid-fifties and which is sometimes referred to as the trend of\n&dquo;humanist&dquo; Marxism. The idea of a &dquo;Marx-Renaissance&dquo; was undoubtedly\ndirected first of all against the completely petrified framework of institutionalized\nMarxism, turned into (...) a &dquo;religion of state&dquo; legitimating the domination\nof a bureaucratic apparatus over the population of East European societies.\nThe &dquo;rediscovery&dquo; and &dquo;rehabilitation&dquo; of the young Marx, the emphasis on\nthe continuity of his thought, meant not only a reintroduction of a number\nof categories, problems and ideas, which were thought fruitful in their critical\ninsight into contemporary conditions and which the impoverished and distorted\nversion of Marxism in official communist ideology (deliberately) failed\nto take into account: it also meant a global challenge to the appropriation of\nthe Marxian tradition by an apologetic ideology, which disguised its positivistic\ncontent through the form of an old-fashioned, dogmatic metaphysics; it\nwas an attempt to recover the critical/emancipatory meaning of this tradition\nwithin the realities of the twentieth century. It was in this context that the\nnotion of &dquo;alienation&dquo; again reappeared -- as a concept through which one\ncould articulate an attitude which was critical simultaneously of Western\ncapitalist and so-called &dquo;socialist&dquo; Eastern societies. Within the framework of\nEast European realities even the rather abstract character of this notion found\nin young Marx, was well suited to the theoretical vagueness and the practical\nlimitations of this new-found leftist criticism of home-societies. Most work addressing clinical workers' professional responsibilities concerns the norms of conduct within established professional–patient relationships, but such responsibilities may extend beyond the clinical context. We explore health workers' professional responsibilities in such “informal” encounters through the example of a doctor witnessing the misdiagnosis and mistreatment of a serious long-term condition in a television documentary, arguing that neither internalist approaches to professional responsibility nor externalist ones provide sufficiently clear guidance in such situations. We propose that a mix of both approaches, (...) emphasizing the noncomplacency and practical wisdom of virtue ethics, but grounding the normative authority of virtue in an external source, is able to engage with the health worker's responsibilities in such situations to the individual, the health care system, and the population at large. One main challenge of non-platonist philosophy of mathematics is to account for the apparent objectivity of mathematical knowledge. Cole and Feferman have proposed accounts that aim to explain objectivity through the intersubjectivity of mathematical knowledge. In this paper, focusing on arithmetic, I will argue that these accounts as such cannot explain the apparent objectivity of mathematical knowledge. However, with support from recent progress in the empirical study of the development of arithmetical cognition, a stronger argument can be provided. I will (...) show that since the development of arithmetic is (partly) determined by biologically evolved proto-arithmetical abilities, arithmetical knowledge can be understood as maximally intersubjective. This maximal intersubjectivity, I argue, can lead to the experience of objectivity, thus providing a solution to the problem of reconciling non-platonist philosophy of mathematics with the (apparent) objectivity of mathematical knowledge. Her most fundamental idea is that the intentionality of inner and outer representations can be understood in analogy to biological functions. The article explores the relationship between visual culture and the fight for visibility and attention in contemporary society. It draws on a concept of visual culture which not only sees the rising significance of the visual and the proliferation of images as its defining traits, but also the fact that, today, people are—to a much higher degree—both consumers as well as producers of images. Based on this definition, it is argued that in visually oriented communication and media societies, the anthropologically (...) fundamental need for attention manifests itself as a fight for visibility which takes on the form of ever more extreme forms of public self-display. Furthermore, a portrait of two social figures—the star and the voyeur—will serve as further analysis and description of the social trends which can be tied to the emergence of today's visual culture. The article will close by discussing attention and visibility in terms of inclusion and exclusion and by proposing an analytical model for differentiating four modes of existence in a visual culture. This volume provides an overview of the most recent developments in empirical investigations of morality and assesses their impact and importance for ethical thinking. It involves contributions of scholars both from philosophy, theology and empirical sciences with firm standings in their own disciplines, but an inclination to step across borders-in particular the one between the world of facts and the world of norms. Human morality is complex, and probably even messy-and this clean distinction becomes blurred whenever one looks more closely (...) at the various components that enable and influence our moral actions and ethical orientations. In that way, morality may indeed be located between facts and norms-and an empirically informed ethics that is less concerned with analytical purity but immerses into this moral complexity may be an important step to make the contributions of ethics to this world more valuable and relevant. Genomic, transcriptomic, and developmental studies in spiders now reveal that the arthropodPax6homologseyelessandtwin of eyelessact as ancestral determinants of the ocular head segment in chelicerates, which clarifies deep gene regulatory and structural homologies and recommends more unified terminologies in the comparison of arthropod visual systems. Following this phylotypic stage, chelicerate visual (...) system development differs fundamentally from other arthropods during the compartmentalization of the ocular segment in that eye and optic neuropil primordia originate independently from each other. Comparative analyses of this phase identified further gene regulatory homologies but also major differences, most notably the possibly compensatory replacement ofPax6byPax2in lateral eye specification. Historically, the problem of realism has often been viewed as an extension of the problem of the external world. At the same time, the assumption has often been made that realism is appropriate to some domains, while antirealism is appropriate to others. I here sketch a neutral realism that rejects both of these assumptions and thereby allows us to treat the realism debate independently of the debate over naturalism. The starting point of neutral realism is indeed neutral with respect to (...) any metaphysical commitment to the existence of some single totality of objects or facts, or to any unified all-encompassing domain that might be identified with nature. The resulting view is shown to open up new prospects for the treatment of the actuality of ethical or aesthetic values as well as for the question of the metaphysical relationship between concrete and abstract entities. Adorno’s extended conception of ‘culture industry’ renders the usual criticism of his views as ‘elitist’ meaningless. The same expansion creates, however, logical strains and contradictions in his analysis of the character and function of the culture industry: a strain in its ‘psychosocial’ and ‘status compulsion’ interpretation. In his late work Adorno attempts to solve this contradiction, but at a heavy price, by creating a conceptual barrier between pleasure and happiness.

I examine what Kant means when he appeals to different "standpoints". I argue that Kant seeks to contrast an empirical, anthropocentric standpoint with a normative, more than human standpoint. Against common interpretations, I argue that the normative standpoint is not confined to practical reason, since theoretical reason is concerned with what ought to be as well. Finally, I defend the coherence of Kant’s distinction against important objections.

We propose that rapid eye movement (REM) and slow-wave sleep contribute differently to the formation of episodic memories. REM sleep is important for building up invariant object representations that eventually recur to gamma-band oscillations in the neocortex. In contrast, slow-wave sleep is more directly involved in the consolidation of episodic memories through replay of sequential neural activity in hippocampal place cells.

The notion of compositionality was first introduced as a constraint on the relation between the syntax and the semantics of languages. It was later postulated as an adequacy condition also for other representational systems such as structures of mental concepts, computer programs, and even neural architectures. Syntax is compositional in that it builds more complex well-formed expressions recursively, on the basis of smaller ones, while semantics is compositional in that it constructs the meanings of larger expressions on the basis of (...) the meanings of smaller ones. Unless empirical linguistic or psychological evidence were to require it nothing else should be needed to understand language. Traditionally, the term compositionality is used in opposition to various forms of holism, with which compositionality is often said to be inconsistent. (shrink)

The Drosophila Bolwig organs are small photoreceptor bundles that facilitate the phototactic behavior of the larva. Comparative literature suggests that these highly reduced visual organs share evolutionary ancestry with the adult compound eye. A recent molecular genetic study produced the first detailed account of the mechanisms controlling differential opsin expression and photoreceptor subtype determination in these enigmatic eyes of the Drosophila larva. Here, the evolutionary implications are examined, taking into account the dynamic diversification of opsin genes and the spatial regulation (...) of opsin homolog expression in other insects. It is concluded that, consistent with their common evolutionary roots, the Drosophila larval and adult eyes use the same mechanisms for the regulation of opsin expression and photoreceptor cell fate specification. Strikingly, the structurally highly derived Bolwig organs retained a more ancestral state of opsin expression and regulation. Inconspicuous in size, the Drosophila larval eyes deliver useful lessons in the reconstruction of homology between neuronal cell types with gene expression data, and on the conservative nature of gene regulatory network evolution during the emergence of novel organs from ancestral templates.
