In the common law world, Albert Venn Dicey is known as the high priest of orthodox constitutional theory, as an ideological and nationalistic positivist. In his analytical coldness, his celebration of sovereign power, and his incessant drive to organize and codify legal rules separate from moral values or political realities, Dicey is an uncanny figure. This book challenges this received view of Dicey. Through a re-examination of his life and his 1885 book Law of the Constitution, the high priest Dicey (...) is defrocked and a more human Dicey steps forward to offer alternative ways of reading his canonical text, who struggled to appreciate law as a form of reasoned discourse that integrates values of legality and authority through methods of ordinary legal interpretation. Each essay represents a major position within the exciting field of moral epistemology in which a proponent of the position presents and defends his or her view and locates it vis-a-vis competing views. The authors include established philosophers such as Peter Railton, Robert Audi, Richard Brandt, and (...) Simon Blackburn, as well as newer voices in the field. This article adds to the small but growing body of hate crime legal scholarship in the United Kingdom by examining the meaning of the term ‘hostility’ as prescribed under section 28 of the Crime and Disorder Act 1998. The article highlights the confusion which has occurred within the lower courts as to the distinction between section 28(1)(a), which proscribes ‘demonstrations’ of hostility, and section 28(1)(b), which proscribes offences ‘motivated’ by hostility. In addition to this confusion has been a clear reluctance (...) to apply section 28(1)(a) by some judges in cases where the demonstration of hostility appears to be incidental, as against causal, to the offence committed. The article argues that in order to provide greater clarity in law, the words ‘demonstrates … hostility’ must be interpreted to include, not only acts that are motivated by, or which are intended to express prejudice or hatred, but any conduct carried out during an offence where the offender is aware his behaviour is likely to be perceived by right-minded individuals as indicating hostility towards the victim’s identity. The article concludes that such a broad approach to conceptualizing hostility is justified based on the need for the state to expressly denounce all public displays of identity-based prejudice. The approach also acknowledges the harmful effects that all expressions of hate (motivated by hostility or not) have on victims, minority communities and to the cohesiveness of Britain’s multicultural society. This short autobiographical text evokes the atmosphere of the years which marked the beginning of my friendship with Alexandru Dragomir: i.e. our student years in Bucharest, the circle of Romanian students studying in the 40s in Freiburg i. Br. and the intellectual intensity of Martin Heidegger’s seminars and courses, which influenced both of us for the rest of our lives. From the 15 members of Heidegger’s Oberseminar (dedicated in this period to Hegel’s Phenomenology of Spirit), three were from Romania: Alexandru (...) Dragomir, Octavian Vuia and the author of these lines. The relationship between Dragomir and I became closer as we translated “Was ist Metaphysik?” into Romanian. Alexandru Dragomir was highly appreciated by Heidegger and beloved by other students for his penetrating spirit, for his spontaneity, but also for his sense of humor. After more than 30 years in which the history thrown us in parallel worlds, we had the joy to meet again in Bucharest. His texts, now published, present him as a brilliant and original thinker. BackgroundEthics review is the process of assessing the ethics of research involving humans. The Ethics Review Committee (ERC) is the key oversight mechanism designated to ensure ethics review. Whether or not this governance mechanism is still fit for purpose in the data-driven research context remains a debated issue among research ethics experts.Main textIn this article, we seek to address this issue in a twofold manner. First, we review the strengths and weaknesses of ERCs in ensuring ethical oversight. Second, we map (...) these strengths and weaknesses onto specific challenges raised by big data research. We distinguish two categories of potential weakness. The first category concerns persistent weaknesses, i.e., those which are not specific to big data research, but may be exacerbated by it. The second category concerns novel weaknesses, i.e., those which are created by and inherent to big data projects. Within this second category, we further distinguish between purview weaknesses related to the ERC’s scope (e.g., how big data projects may evade ERC review) and functional weaknesses, related to the ERC’s way of operating. Based on this analysis, we propose reforms aimed at improving the oversight capacity of ERCs in the era of big data science.ConclusionsWe believe the oversight mechanism could benefit from these reforms because they will help to overcome data-intensive research challenges and consequently benefit research at large. Many years after the publication of “A Logical Calculus of the Ideas Immanent in Nervous Activity,” Warren McCulloch gave Walter Pitts credit for contributing his knowledge of modular mathematics to their joint project. In 1941 I presented my notions on the flow of information through ranks of neurons to Rashevsky’s seminar in the Committee on Mathematical Biology of the University of Chicago and met Walter Pitts, who then was about seventeen years old. He was working on a mathematical (...) theory of learning and I was much impressed. He was interested in problems of circularity, how to handle regenerative nervous activity in closed loops....For two years Walter and I worked on these problems whose solution depended upon modular mathematics of which I knew nothing, but Walter did.. In this paper, we will fill in some of the details regarding Pitts’s interest in problems of circularity, regenerative activity in closed loops of neurons, and modular mathematics, and the way in which they relate to “A Logical Calculus.”. During the past decade, the so-called “hypothesis of cognitive extension,” according to which the material vehicles of some cognitive processes are spatially distributed over the brain and the extracranial parts of the body and the world, has received lots of attention, both favourable and unfavourable. The debate has largely focussed on three related issues: (1) the role of parity considerations, (2) the role of functionalism, and (3) the importance of a mark of the cognitive. This paper critically assesses these (...) issues and their interconnections. Section 1 provides a brief introduction. Section 2 argues that some of the most prominent objections against the appeal to parity considerations fail. Section 3 shows that such considerations are nevertheless unsuitable as an argument for cognitive extension. First, the actual argumentative burden is carried by an underlying commitment to functionalism, not by the parity considerations themselves. Second, in the absence of an independently motivated mark of the cognitive, the argument based on parity considerations does not get off the ground, but given such a mark, it is superfluous. Section 4 argues that a similar dilemma arises for the attempt to defend cognitive extension by a general appeal to functionalism. Unless it can be independently settled what it is for a process to be cognitive, functionalism itself will be undermined by the possibility of cognitive extension. Like parity considerations, functionalism is thus either unable to support cognitive extension or superfluous. Hence, nothing short of the specification of an appropriate mark of the cognitive that can be fulfilled not only by intracranial but also by extended processes will do as an argument for cognitive extension. Much of the literature from political psychology has focused on the negative traits that are positively associated with affective polarization—e.g., animus, arrogance, distrust, hostility, and outrage. Not as much attention has been focused on the positive traits that might be negatively associated with polarization. For instance, given that people who are intellectually humble display greater openness and less hostility towards conflicting viewpoints (Krumrei-Mancuso & Rouse, 2016; Hopkin et al., 2014; Porter & Schumann, 2018), one might reasonably expect them to be (...) less polarized. -/- We ran two studies designed to explore the relationship between various forms of humility and polarization. Our chief finding is that people who value humility are prone to what we are calling epistemic polarization—that is, judging the epistemic traits of contrapartisans negatively—which in turn plays a role in polarization more generally. Not only are contrapartisans deemed to have the wrong moral and political beliefs, they are also viewed as less humble and more arrogant, close-minded, and irrational. This makes matters even worse when it comes to the growing partisan divide. In light of our findings, we believe that the novel concept of epistemic polarization that we introduce is a promising target for further investigation. (shrink)

Progressive supranuclear palsy is a movement disorder with prominent tau neuropathology. Brain diseases with abnormal tau deposits are called tauopathies, the most common of which is Alzheimer's disease. Environmental causes of tauopathies include repetitive head trauma associated with some sports. To identify common genetic variation contributing to risk for tauopathies, we carried out a genome-wide association study of 1,114 individuals with PSP and 3,247 controls followed by a second stage in which we genotyped 1,051 cases and 3,560 controls for the (...) stage 1 SNPs that yielded P ≤ 10-3. We found significant previously unidentified signals associated with PSP risk at STX6, EIF2AK3 and MOBP. We confirmed two independent variants in MAPT affecting risk for PSP, one of which influences MAPT brain expression. The genes implicated encode proteins for vesicle-membrane fusion at the Golgi-endosomal interface, for the endoplasmic reticulum unfolded protein response and for a myelin structural component. © 2011 Nature America, Inc. Gulick (bio)The assumptions of democracy as an associational ethos of vulnerable life are, first, that we don't already know how best to order our common life and, second, that we don't know what the abstract ideals of empathy, emancipation, and equity entail in the concrete.—Michael Hogue1In American Immanence: Democracy for an Uncertain World, Michael S. Hogue grounds his proposal for a political theology in (...) a critique of American exceptionalism and its supportive "redeemer symbolic."2 In the Anthropocene era, Hogue states, American exceptionalism "legitimates the extraction of diverse forms of value and justifies the externalization of diverse costs" (29) with unconscionable costs to the natural environment and international justice. As indicated in the passage quoted above, Hogue's reaction to the rigid assumptions supportive of American exceptionalism is to offer a humble acknowledgement of political fallibility coupled with what he terms "a theopolitics of resilient democracy" (184; see also 3–6).My concern in this essay is largely practical. I will focus on discerning what intellectual, emotional, and communal resources might be drawn upon to further develop and actually effect the needed changes that Hogue so ably points out. Relatedly, I will inquire into who the most likely candidates are to devote energy to the reconstruction of social structures and practices so that they express values that Americans at their best uphold. Finally, I will reflect upon the role that spiritual ideals and communal practices might play in energizing effective democratic action. [End Page 5]I. Hogue's Critical and Constructive TasksHogue's overriding interest is to outline an epistemic/axiological/environmental/political stance that does not give rise to the various sorts of injustices and dysfunctions that mark the Anthropocene era, especially our allegiance to policies that eventuate in what he calls "climate wickedness." The alternative vision he embraces develops pragmatic naturalism as a method of inquiry and exposition. His reflections are especially indebted to the thought of Dewey, James, and Whitehead (78–82). During a time when e-words are normally associated with forms of electronic communication, Hogue offers instead two trios of e-words with another sort of significance—one that signifies a stance he wishes to overcome and one that communicates what he hopes to achieve. Our current era is unfortunately in thrall, he says, to extraction, externalization, and exception, whereas what we should strive for is a society marked by empathy, emancipation, and equitability. Well put. He presupposes that democratic governance, deeply embedded in American history, ought to serve as the vehicle for achieving what the positive set of e-words promotes. To this end, Hogue quotes appreciatively from Dewey's article, "Democracy is Radical": Democracy "is radical because it requires great change in existing social institutions, economic, legal and cultural" (170). This understanding of democracy slumbers now; what might it take to reawaken it? And if reawakened, what changes might be made to establish the more nearly equitable political influence that is basic to the promise of democracy?Hogue, recognizing in good pragmatic fashion the importance of consequential change, states, "In contrast to foundationalist commitments to antecedents and precedents, pragmatic naturalism commits to a prospective concern with consequents" (80). Foundational commitments to antecedents may certainly impede needed change, but surely attention to the historical events and practices that gave rise to current problems is needed to avoid repeating previous errors. Hogue refers to Whitehead's vision of social symbolism, suggesting that "social change can be catalyzed by the improvised revision of existing symbolic repertoires or the innovative formation or subversive interjection of new symbols" (99). I'm not fully convinced by Whitehead's claim. I suspect that many of our social problems are rooted below the linguistic level in an array of affective issues that elude symbolic adjustment. New strategies are needed to counter the prevalence of fear and resentment in society as promoted for political and commercial reasons and tied to Hogue's strongly voiced recognition that we live in an uncertain world.Here is my understanding of how Hogue both frames our current social and cultural situation and what he says might begin to remediate these circumstances. Abraham Lincoln was the greatest of our presidents. He saved the Union, and because he saved the Union, he was able to free the slaves. But he did more than this. Without him, we might have had no reason to celebrate the bicentennial first of Declaration of Independence and the then of the Constitution. It is therefore altogether fitting that we mark the bicentennial of Lincoln's birth.

In a provocative 1991 paper, Alvin Moss and Mark Siegler argued that it may be fair to give individuals with alcohol-related end-stage liver disease lower priority for a liver transplant than those who develop end-stage liver disease from other factors. Like other organs, there is a substantial gap between the available livers for transplantation and the number of people who need liver transplants. Yet, unlike those with end-stage renal disease, who can survive for some time on dialysis before receiving (...) a kidney transplant, those with liver failure will die without a liver transplant. 2012 will mark 60 years since the death of Walter Williamson Bryden. This reprint of his bold 1940 publication, featuring a new introduction by Dr John A. Vissers, Principal of Knox College, Toronto, celebrate the work of this eminent Presbyterian theologian. Best known for bringing Karl Barth to Canada, W.W. Bryden predicted the decline of Idealism and liberal theology in Protestantism at the start of the twentieth-century. When that crisis hit the Canadian Protestant Churches he was ready with (...) this book. The Christian's Knowledge of God is a re-examination of Reformation teachings with particular focus on the revelation of God, by God through Christ. Bryden challenges his readers to question their blind acceptance of Christian doctrine and to reconsider what it means to have knowledge of the Divine and with it "the power to confront the world, no longer as those seeking, but as those having found God". Although the book concludes "Tempora mutantur, nos et mutamur in illis", we have not changed so much with the times as to make this book less relevant today than it was when first published. Indeed those seeking for knowledge of God today could do well to be reminded of Bryden's message. (shrink)

This light revision of Bornholdt's doctoral thesis (Würzburg, 2015) is effectively a medievally-oriented follow-up to Richard Gaskin’s 'The Sea Battle and the Master Argument' (1995). The book is stimulating from a philosophical point of view, but the exegesis is disappointingly unreliable.

Lessons in the study of habits by Walter L. Sheldon. This book is a reproduction of the original book published in 1903 and may have some imperfections such as marks or hand-written notes.

After an eloquent and moving analysis of what he sees as the disillusion of themodern age, Lippmann posits as the central dilemma of liberalism its inability to find an appropriate substitute for the older forms of authority-- church, state, class, family, law, custom--that it has denied. Lippmann attempts to find a way out of this chaos through the acceptance of a higher humanism and a way of life inspired by the ideal of "disinterestedness" in all things. In his new introduction (...) to the Transaction edition, John Patrick Diggins marks "A Preface "to "Morals, "originally published in 1929, as a critical turning point in Lippmann's intellectual career.
