In this paper, we put forth an analysis of sensitivity which aims to discern individual from merely statistical evidence. We argue that sensitivity is not to be understood as a factive concept, but as a purely epistemic one. Our resulting analysis of epistemic sensitivity gives rise to an account of legal proof on which a defendant is only found liable based on epistemically sensitive evidence.

Physicists and philosophers today have formulated three opposing models that explain how laws work. Which is the best?

Dehumanization by algorithms raises important issues for business and society. Yet, these issues remain poorly understood due to the fragmented nature of the evolving dehumanization literature across disciplines, originating from colonialism, industrialization, post-colonialism studies, contemporary ethics, and technology studies. This article systematically reviews the literature on algorithms and dehumanization (n = 180 articles) and maps existing knowledge across several clusters that reveal its underlying characteristics. Based on the review, we find that algorithmic dehumanization is particularly problematic for human resource management (...) and the future of work, managerial decision-making, consumer ethics, hard- and soft-law regulation, and basic values, including privacy and consumer rights. From the literature synthesis, we also derive the following definition of algorithmic dehumanization: the act of using algorithms and data in a way that results in the intentional or unintentional treatment of individuals and/or groups as less than fully human, thereby violating human rights, including liberty, equality, and dignity. Ultimately, we present a dehumanization avoidance model that serves as a structured research agenda and practical guide to address the challenges raised by algorithmic dehumanization. Thus, the model indicates promising pathways for future research at the intersection of AI and society and facilitates reflection on organizational processes that support improving corporate capabilities and managerial decision-making to avoid algorithmic dehumanization. In his early works, Habermas wants to preserve both, the German idealist notion which gives primacy to self-reflection in the history of the human species, and the Marxist materialist conception that self-reflection is based on the material conditions of existence. ;Such dual preservation cannot be maintained; for the primacy given to self-reflection by German idealism is based on a prior spiritualization of the conditions of reflection. It is precisely with those alienated conditions that Habermas's "neo-Marxism" seeks to limit "materialistically" critical (...) self-reflection. This is a bad overcoming of Hegel, since it preserves the Spirit as alienated otherness. ;However, Habermas's more recent linguistic turn evinces an attempt to ground critical self-reflection by means of a de-historicized anticipation of an ideal speech situation through the formal rules of cogency of speech. ;An atheistic reading of Hegel's conception of life, which regards universal life as "congealed space" or pure positivity, allows for a transition to Marx's practical communism. ;The existential attitudes towards death have as their ontological correlate, the motion of life; that is, historical acts may be regarded as attempts to appropriate objectivity which, as pure positivity, cannot be appropriated in principle, especially after the notion of an all-encompassing transcendental subjectivity, which posits the object as alienated subject, has been rejected. ;In the early Marx, historical and social investigations were limited by the primacy of the subject, the object being subordinated to it. To this extent, he naively remained at the level of ideology, i.e., "lived relations." In this manner, the unconditioned supersensible, in the form of a transcendental subjectivity, clouds the examination of the objective conditions of existence. ;The mature Marx's turn to the object expresses the elimination of the unconditioned, and the concomitant consideration of social reality as the basis of positive and negative ideologies, to the extent that the consciousness of freedom arose from the forced emancipation of consciousness from and by material conditions. Working in Germany between the two world wars, John Heartfield developed an innovative method of appropriating and reusing photographs to powerful political effect. As a pioneer of modern photomontage, he sliced up mass media photos with his iconic scissors and then reassembled the fragments into compositions that utterly transformed the meaning of the originals. In John Heartfield and the Agitated Image, Andrés Mario Zervigón explores this crucial period in the life and work of a brilliant, radical artist whose desire (...) to disclose the truth obscured by the mainstream press and imperial propaganda made him a de facto prosecutor of Germany’s visual culture. Zervigón charts the evolution of Heartfield’s photomontage from an act of antiwar resistance into a formalized and widely disseminated political art in the Weimar Republic. Appearing on everything from campaign posters to book covers, the photomonteur’s notorious pictures challenged well-worn assumption and correspondingly walked a dangerous tightrope over the political, social, and cultural cauldron that was interwar Germany. Zervigón explains how Heartfield’s engagement with montage arose from a broadly-shared dissatisfaction with photography’s capacity to represent the modern world. The result was likely the most important combination of avant-garde art and politics in the twentieth century. A rare look at Heartfield’s early and middle years as an artist and designer, this book provides a new understanding of photography’s role at this critical juncture in history. (shrink)

As we will show in the present work, the historical development of pure geometry did not arise as a direct “transition” from practical geometry into pure geometry, at least as these are usually understood. We can discern four phases related to this evolution. Initially, we have practical geometry as applied in ancient Greece and other ancient civilizations. This surveyors’ practical geometry was somewhat transformed in “didactic” contexts when applied to problem-solving. This not-so-practical geometry is the direct antecedent of the first (...) form of pure geometry, that of Hippocrates of Chios. Only afterward did pure geometry, as we usually understand it, emerge. This paper offers a metaethical analysis of so-called political moralism’s metaethical assumptions and proposes shifting away from them. It does so by taking migration ethics’ methodology as a case study of the field. First, the paper shows political moralism’s commitment to moral monism and moral overridingness. Second, it explains how such commitments are likely to lead to the formulation of toy theories - and, hence, moral regress. Third, it proposes the recognition of prudential normativity and normative pluralism as a way (...) to avoid the toy theory problem. And, fourth, it deals with two objections to this proposal. This article embarks on ethical trade-offs at the sustainability/finance interface by contrasting shareholders’ interest in short-term financial returns with society’s interest in counteracting ecological and social grievances. Scrutinizing share repurchases, we investigate a firm’s communicated sustainability orientation (i.e., its environmental and social value orientation) as well as its environmental and social sustainability performance. Our results are based on a large-scale panel dataset of 491 U.S. firms observed from 2004 to 2016. The dataset combines share buyback data with sustainability orientation scores (...) from shareholder letters and sustainability performance ratings. The econometric models suggest no association between social value orientation and repurchase volumes, but a significantly negative relationship between environmental value orientation and buybacks in a cubic form. Executive stock options partially attenuate this relationship. Share repurchases in turn negatively affect future environmental and social performance. This study grasps the consequences of firms’ short-term shareholder satisfaction and discusses its ethical implications in the context of firms’ contribution to sustainable development, thereby providing important insights to the business ethics discourse. This book is about politics, political theory, and political philosophy. Although these disciplines are often conflated because they interact, they actually are distinct. Political theory is part of political science, whereas political philosophy is a hybrid of political theory and philosophy. The former discipline is descriptive and explanatory, whereas the latter is prescriptive--to the point that it is often called "normative theory." It is in fact the evaluative study of political societies. Whereas political theorists describe and explain politics, political philosophers (...) examine it critically and venture to suggest improvements and, on occasion, radically different social futures. Political philosophers propose scenarios and dreams where political scientists offer snapshots of existing polities. While these disciplines are distinct, Mario Bunge asserts that they must inform each other. Political philosophy is not yet a well-defined field: it hovers between political theory and utopian fantasizing. Few, if any earlier thinkers could have anticipated any of the most pressing political issues of our time, such as the need to stop global warming, reduce nuclear armaments, stop the rise of inequality between individuals and nations, and fight authoritarianism, particularly when it comes disguised as democracy or as socialism. Not even more recent social thinkers had much to say about such topical issues as environmental degradation, gender and race discriminations, participative democracy, nationalism, imperialism, the North-South divide, resource wars, the industrial-military complex, or the connections between poverty and environmental degradation, and between inequality and bad health. Beyond ideological divergences, most political philosophers have been nearly unanimous in their indifference to the plight of the Third World. Bunge does not share that indifference. He also believes that political philosophers should pay more attention to numbers, such as the standard index of income inequality and the more comprehensive United Nations human development index for the various nations. It is pointless to write about redistributive policies unless we have some of idea of current wealth distribution. This is, in short a modern treatise of inherited concerns. (shrink)

The biocognitive theory presented in this paper offers an alternative to the attribution of cause perpetuated by the life sciences in our western culture. Historically, biology has based its epistemology on physics to understand life, whereas cognitive science has grounded its ontology in a convergence of biology, physics, and philosophy to provide models of self that range from a passive acceptance of an outside world to the active creation of an inner world. While Newtonian physics has served us well in (...) the physical sciences, the life sciences continue to embrace the limitations of its reductionism without advancing to the more inclusive concepts offered by complexity and quantum theories. As long as the biological and cognitive sciences remain married to Newtonian physics and Cartesian philosophy, mind will be relegated to an epiphenomenon of biology that will continue to separate cognitive processes from biological functions. Rather than choosing between upward causality that explains cause from the simplest level of the organism and downward causality that explains it from the most complex to the simplest, biocognitive theory offers contextual coemergence where the simultaneous resonance between fields of bioinformation is the genesis of cause. In this model of coemergent causality, cognition, biology, and cultural history are viewed as biocognitions that communicate within a bioinformational field that has both linear processes in Euclidian geometry and non-linear processes in fractal geometry. Because of the simultaneous and reciprocal nature of mind and body communication, it is argued that biology creates thought and thought creates biology. Just as mind and body cannot be separated, to attempt a separation of mind and world would create an artificial split between observer and observation that assumes we can “step out” of the world we are attempting to observe. From the seventeenth century onward, in both modern Europe and North America, historical sciences - notably philosophical historiography and cultural history - colonized both the past (or national pasts) and the "rest" of the world. The book introduces to the analytic philosophy of language by presenting the main classical authors and texts of the XX Century, as well as the key problems and concepts of this discipline in their historical context. Ch. I: general introduction to the philosophy of language. Ch. II: Frege. Ch. III: Russell. Ch. IV: Wittgenstein's Tractatus. Ch: V: Neopositivism and verificationism. Ch. VI: Carnap's intensional semantics. Ch. VII: Wittgenstein's Philosophical Investigations. Ch. VIII: Quine. Ch. IX: theories of direct reference. Everything is (...) explained in plain but precise language, with many examples. Thus, the reader realizes how each author addresses the problems set by earlier investigations, in turn opening new problems for discussion and advancing the state of the art. The critical comparison among different positions raises possible objections and answers, introducing to the rational debate in the style of analytic philosophy. Whenever required the book also introduces basic notions of logics, metaphysics, philosophy of science, foundations of mathematics, epistemology and philosophy of mind. Las emociones fueron estudiadas por la psicología desde un enfoque primariamente fisiológico como una estrategia para validar empíricamente sus producciones. Esto fue una consecuencia del conductismo metodológico y su impronta en el campo de la investigación psicológica. En dicha tarea se tendió a disociar las emociones de las cogniciones y a presentarlas como resultados de meros procesos fisiológicos. En la década del 70 surgió la appraisal theory (Magda B. Arnold) proponiendo un enfoque distinto que rescata una dimensión cognitiva en las (...) emociones. Pero este enfoque ¿es realmente inédito? Aquí sostenemos que, si bien sus aportes son científicamente consistentes y novedosos, desde el contexto en que se formulan, abrevan en algunos elementos de la filosofía clásica de Aristóteles y santo Tomás de Aquino. Aquí nos circunscribiremos a revisar dos ensayos (Peters y Lazarus) a fin de vincular y ponderar una teoría psicológica con una filosofía subyacente. (shrink)

Resumen: El presente ar:tículo quiere criticar el tradicional enfoque histórico-biográfico en la exégesis de la obra de Francesco Petrarca, para proponer, en cambio, la aplicación de unas herramientas de análisis propiamente poéticas, enfatizando así la exigencia de una lectura que atienda más a este tipo de función, en lugar de la referencial, causa de muchos malentendidos y de una importante pérdida de significado que afecta todo el mensaje petrarquesco. Para ello, el artículo se centrará en los nombres propios, elemento constitutivo (...) muy frecuente en las obras del poeta de Arezzo y nudos de un entramado semántico que es connotativo, más que denotativo. Un planteamiento, esto es, que discrepa de la gran mayoría de las interpretaciones, siempre orientadas hacia la consideración de ellos como meros referentes de identidades históricas. Entre estos nombres toma especial valor, como es debido, el propio nombre del poeta, que lejos de ser la simple identificación referencial entre escritor, autor, narrador y protagonista, resulta ser más bien la semilla de una construcción mitopoética vasta y articulada, vehículo preciso de una parte importante del mensaje poético que el autor legó a la posteridad y que atiene a la virtud y a la mejora ética y moral. Abstract: This article aims to criticize the traditional historical-biographical approach in the exegesis of the work of Francesco Petrarca, to propose, instead, the application of some properly poetic analysis tools, thus emphasizing the need for a reading that pays more attention to this type of function, rather than to the referential one, cause of many misunderstandings and an important loss of meaning that affects the entire Petrarchan message. To do this, the article will focus on proper names, a very common constituent element in the works of the poet of Arezzo, and knots of a semantic structure that is connotative, rather than denotative. An approach, that is, that disagrees with most interpretations, always oriented towards the consideration of them as mere referents of historical identities. Among these names, the poet's own name takes a special value, as it should, which far from being the simple referential identification between writer, author, narrator, and protagonist, turns out to be rather the seed of a vast and articulated mythopoetic construction, precise vehicle of an important part of the poetic message that the author bequeaths to posterity and that holds to virtue and ethical and moral improvement. En las últimas décadas, las sociedades de cualquier parte del mundo han mostrado una madurez significativa en cuanto a la conciencia del valor de la vida en cualquiera de sus manifestaciones. Sin embargo, las diferentes conductas que nos acercan a dicha conciencia se pueden orientar a un bien común a través de la reflexión, nos aproximan a lo más íntimo de nuestra propia y casi exclusiva naturaleza, el humanismo. Las reflexiones que nos brinda este libro, La medicina en vivo. El perfil de los autores garantiza una calidad y rigurosidad académica en este texto que genera la confianza en la validez de sus análisis. Igualmente, las distintas procedencias geográficas de los colaboradores reflejan las mismas preocupaciones más allá de nuestras fronteras dado su carácter universal. Este libro será de gran utilidad para apoyo en la formación de profesionistas en ciencias de la salud o estudiosos de la filosofía de las ciencias o los cuerpos colegiados como comités de ética o bioética y seguramente se llegará a considerar un buen referente bibliográfico. In recent years, many studies on the relationship between G. W. F. Hegel and metaphilosophy have appeared, articulating it in various ways. The goal of this paper is to specify in what sense it is possible to speak of a Hegelian metaphilosophy, while also assessing the relevance of Hegel for the current metaphilosophical debate. In particular, I will proceed as follows. First, I will outline the main features of the contemporary metaphilosophical debate. Second, I will discuss some important metaphilosophical interpretations (...) of Hegel. Third, I will specify in what sense it is possible to speak of a Hegelian metaphilosophy. Fourth, I will address several methodological issues that arise whenever one attempts to assert the contemporary relevance of Hegel’s philosophy. Finally, I will assess to what extent Hegel’s philosophy can be relevant for the current metaphilosophical debate. As a result, the present paper outlines a concrete option for current philosophical research. (shrink)

The Records of Mazu and the Making of Classical Chan Literature explores the growth, makeup, and transformation of Chan (Zen) Buddhist literature in late medieval China. The volume analyzes the earliest extant records about the life, teachings, and legacy of Mazu Daoyi (709-788), the famous leader of the Hongzhou School and one of the principal figures in Chan history. While some of the texts covered are well-known and form a central part of classical Chan (or more broadly Buddhist) literature in (...) China, others have been largely ignored, forgotten, or glossed over until recently. Poceski presents a range of primary materials important for the historical study of Chan Buddhism, some translated for the first time into English or other Western language. He surveys the distinctive features and contents of particular types of texts, and analyzes the forces, milieus, and concerns that shaped key processes of textual production during this period. Although his main focus is on written sources associated with a celebrated Chan tradition that developed and rose to prominence during the Tang era (618-907), Poceski also explores the Five Dynasties (907-960) and Song (960-1279) periods, when many of the best-known Chan collections were compiled. Exploring the Chan School's creative adaptation of classical literary forms and experimentation with novel narrative styles, The Records of Mazu and the Making of Classical Chan Literature traces the creation of several distinctive Chan genres that exerted notable influence on the subsequent development of Buddhism in China and the rest of East Asia.
