In this article, we extend the research on the public interest to non-audit engagements performed by accounting firms and public accountants. Our thesis is that non-audit engagements, as private goods, require a distinct approach to the public interest than auditing. We suggest that a public value perspective can be used conceptually to provide substantial criteria for designing non-audit engagements conducive to public value creation and greater accountability. We illustrate the applicability and consequences of a public value perspective by analyzing and (...) contrasting the decision of two judicial opinions deciding whether Deloitte and the lead partner of a consulting engagement failed to act in the public interest in engineering the sale of collapsed British carmaker MG Rover. We advocate for a significant change in ethical codes of conduct by defining public interest obligations, not only in terms of professional attributes, but also in terms of outcomes. Our approach also suggests a requirement regarding planning a non-audit engagement, including establishing a public value proposition detailing the planned nature of the engagement, and extent of the assessment of the intended public value creation. We discuss the aspirational function of codes of conduct to provide accountability other than in terms of technical output, and to maintain the legitimacy and purpose of the profession. (shrink)

Dans le domaine du placement d’enfants, la loi de 1996 préconisant le maintien de la communauté de vie des frères et sœurs est souvent comprise comme une injonction sine qua non. Cet article se fait l’écho des observations d’une équipe pluridisciplinaire (éducateurs, psychologue, psychanalyste) engagée depuis de longues années dans l’accueil familial qui dévoilent, à travers une analyse à la fois quantitative et clinique, une réalité qui vient nuancer cet impératif. Les auteurs montrent que, dans un certain nombre de cas, (...) le maintien de la communauté de vie de la fratrie contribue à l’entretien de la pathologie des liens familiaux et à l’aliénation du sujet. En même temps, ces lumières n'expliquent pas tout ;par conséquent, elles suscitent, tout naturellement, des questions. De là va naître ce que, à la suite de saint Thomas d'Aquin, (...) on a appelé :" la philosophie naturelle de l'esprit humain " qui, seule, peut nous délivrer, définitivement et objectivement, du relativisme et du vide, donc du désespoir. Point de départ de ces réflexions, la découverte de l'être et de sa nécessité dans l'évidence, intellectuelle qu'il y a quelque chose de bon et de beau en face de moi. A partir de là on discerne, certes, l'Erre perfection pure, mais surtout l'immatérialité de la connaissance, sans laquelle l'amour perd toute sa profondeur, et qui est le fondement de notre ressemblance à Dieu. C'est dire assez à quel point la foi suppose cette philosophie. Ces pages veulent s'adresser aux non-spécialistes, tout en essayant de répondre aux exigences de rigueur d'un esprit critique. Marie Durand n’est pas très connue en dehors du monde protestant. Elle a passé 38 ans emprisonnée dans la Tour de Constance à Aigues-Mortes parce que son frère était un pasteur clandestin du xviiie siècle. Elle est surtout connue depuis le livre de Benoît en 1884. Mais c’est au début du xxe siècle qu’elle devient une personnification de la résistance pacifique au nom des droits de la conscience et de la tolérance et qu'elle accède à un statut d'héroïne. Cela (...) permet aussi à la Réforme un renouveau moral et spirituel. La référence à Marie Durand s'accentue en 1945 et culmine lors des cérémonies de 1968. Elle symbolise ainsi le protestantisme toujours persécuté, mais luttant de manière non-violente pour maintenir la foi. (shrink)

Au fil de ses textes autobiographiques se révèle le for privé d’un homme pourtant peu enclin aux confidences. Le fils, le frère, le mari et le père s’expriment sous sa plume au gré des circonstances, esquissant le portrait complexe d’un être à la charnière de deux époques et de deux sensibilités. Porteur d’une tradition familiale construite sur de fortes (...) solidarités, tant professionnelles que confessionnelles, Antoine-Jean appartient aussi à cette génération des Lumières ouverte sur l’individu, dont la relation au divin se détend au profit d’une sensibilité plus humaniste. Ses écrits témoignent ainsi de toute l’ambiguïté de la relation à l’autre, selon le statut, le genre ou la place de chacun au sein de sa famille. (shrink)

A cinquante-deux ans, il est condamné à mort après des années de procès pour avoir défendu la vision hérétique d'un univers infini, d'un ciel peuplé de cent mille soleils. Né à Nola, dans le sud de l'Italie, frère dominicain au couvent de Naples, Giordano Bruno s'enfuit une nuit de février 1576. Goethe n'est pas seulement poete, dramaturge, romancier, artiste. Il est aussi philosophe et surtout philosophe de la nature. Il manifeste un interet constant pour des questions scientifiques variees (physique, theorie des couleurs, chimie, meteorologie, geologie, mineralogie, morphologie, botanique, zoologie) et influencera profondement la philosophie allemande de la nature des annees 1780-1830. Goethe est une reference incontournable pour la Naturphilosophie tant idealiste (Kant, Schelling, Hegel) que romantique (Holderlin, Novalis, Schlegel). Il est, selon l'historien de la philosophie Johann Hoffmeister, parmi la nebuleuse (...) heterogene des philosophes de la nature, comme " le Soleil au milieu des planetes ". Goethe meme considere ses ecrits scientifiques comme un volet majeur de son oeuvre, et dialogue avec d'eminents savants de son temps (Cuvier, Geoffroy Saint Hilaire, les freres Humboldt). Sa Naturphilosophie articule une theorie de la connaissance a une redefinition de l'experience privilegiant le recours a l'intuition visuelle, ainsi que la recherche de " phenomenes originaires " (Urphanomene) et des metamorphoses auxquelles ils donnent lieu. Hegel louera dans la Naturphilosophie de Goethe " l'intuition pleine de sens [...] qui ordonne ce qui n'est que phenomene d'une maniere conforme a la suite interieure du concept ". Le present ouvrage eclaire ce Goethe Naturphilosoph fondateur d'une episteme intuitionniste, phenomeniste, voire phenomenologique, aux antipodes de la science physico-mathematique, quantitative et intellectuelle, de Descartes ou Newton et inaugurant un style original de comprehension des phenomenes naturels qui se joue des frontieres a la fois entre les disciplines scientifiques et entre la philosophie et son autre (science, litterature). Discussion of Wittgenstein's Tractatus is currently dominated by two opposing interpretations of the work: a metaphysical or realist reading and the 'resolute' reading of Diamond and Conant. Marie McGinn's principal aim in this book is to develop an alternative interpretative line, which rejects the idea, central to the metaphysical reading, that Wittgenstein sets out to ground the logic of our language in features of an independently constituted reality, but which allows that he aims to provide positive philosophical insights into (...) how language functions. McGinn takes as a guiding principle the idea that we should see Wittgenstein's early work as an attempt to eschew philosophical theory and to allow language itself to reveal how it functions. By this account, the aim of the work is to elucidate what language itself makes clear, namely, what is essential to its capacity to express thoughts that are true or false. However, the early Wittgenstein undertakes this descriptive project in the grip of a set of preconceptions concerning the essence of language that determine both how he conceives the problem and the approach he takes to the task of clarification. Nevertheless, the Tractatus contains philosophical insights, achieved despite his early preconceptions, that form the foundation of his later philosophy. -/- The anti-metaphysical interpretation that is presented includes a novel reading of the problematic opening sections of the Tractatus, in which the apparently metaphysical status of Wittgenstein's remarks is shown to be an illusion. The book includes a discussion of the philosophical background to the Tractatus, a comprehensive interpretation of Wittgenstein's early views of logic and language, and an interpretation of the remarks on solipsism. The final chapter is a discussion of the relation between the early and the later philosophy that articulates the fundamental shift in Wittgenstein's approach to the task of understanding how language functions and reveal the still more fundamental continuity in his conception of his philosophical task. This dissertation aims to construct a non-dogmatic defence of common sense. It tries to show why the absence of justification for the judgements of common sense, which the sceptic reveals, does not invalidate them.

La « richesse des femmes » tient en Normandie une place bien particulière. Le cadre juridique de la coutume normande repousse singulièrement le régime de droit commun des époux, et confère à la dot un régime spécifique qui exclut les filles des successions paternelles en présence de frères, et qui met le mari en position d’usufruitier de la dot. Cependant, l’étude - élargie à d’autres variables que la seule quantification de la dot - des pratiques matrimoniales des milieux marchands rouennais (...) au tournant des 17 et 18e siècles, et d’un lignage noble de la région d’Evreux de 1662 à 1759, montre qu’il existe une distance entre coutume et pratique. Chez les marchands de Rouen, on constate une rupture entre une phase d’atonie dans la décennie 1690, caractérisée par une assez forte endogamie socioprofessionnelle et topographique dans laquelle la dot joue un rôle compensatoire, et les premières années du 18e où les cas d’exogamie associée à des conventions matrimoniales et une publicité sans précédent marquent un processus de distanciation sociale dans lequel la dot n’intervient plus que comme une variable parmi d’autres. Les alliances matrimoniales du vieux lignage normand des Lombelons dévoilent à la fois une ouverture vers d’autres groupes sociaux, et une fermeture par des conventions matrimoniales et successorales discriminatoires pour la femme, dont la dot, entre autres, est un élément central de la stratégie de maintien. There are currently two readings of Tractatus, the metaphysical and the therapeutic. I argue that neither of these is satisfactory. I develop a third reading, the elucidatory reading. This shares the therapeutic interpretation’s emphasis on the idea that Wittgenstein’s remarks are intended to work on the reader, but instead of seeing these remarks as directed (problematically) at revealing their own nonsensical status, I take the remarks to be aimed at bringing a certain order to the reader’s perception of language. The (...) point of this order, and the only test of it, is that it enables the philosophical problems to disappear. In particular, it dispels philosophical puzzlement concerning the status of logic, the relation between language and the world, and the relation between thought and language. (shrink)

Understanding what reductive explanations are enables one to assess the conditions under which reductive explanations are adequate and thus enhances debates about explanatory reductionism. The account of reductive explanation presented in this book has three major characteristics. First, it emerges from a critical reconstruction of the explanatory practice of the life sciences itself. (...) Second, the account is monistic since it specifies one set of criteria that apply to explanations in the life sciences in general. Finally, the account is ontic in that it traces the reductivity of an explanation back to certain relations that exist between objects in the world (such as part-whole relations and level relations), rather than to the logical relations between sentences. Beginning with a disclosure of the meta-philosophical assumptions that underlie the author’s analysis of reductive explanation, the book leads into the debate about reduction(ism) in the philosophy of biology and continues with a discussion on the two perspectives on explanatory reduction that have been proposed in the philosophy of biology so far. The author scrutinizes how the issue of reduction becomes entangled with explanation and analyzes two concepts, the concept of a biological part and the concept of a level of organization. Au cours de la période moderne, les fonds provençaux du « for privé » (livres de raison, journaux, mémoires), sont marqués par une faiblesse quantitative des écrits féminins. Pour l’essentiel, ceux-ci relaient l’écriture d’un mari, parfois d’un père ou d’un frère absents ou disparus, dans la tenue des comptes et dans l’enregistrement de la mémoire familiale. Néanmoins, chez la trentaine de femmes retrouvées ici au fil des archives, l’écriture quotidienne, quand bien même elle répond à l’application d’une norme et à (...) l’assignation d’un rôle social, n’en fournit pas moins la possibilité d’une construction de soi, depuis la conquête de sa matérialité graphique la plus élémentaire jusqu’à l’émergence d’une réflexivité individuelle née de la familiarité croissante du commerce avec soi et de l’essor d’une expression personnelle. On devra néanmoins se demander si cette posture suffit, au creux de registres familiaux dont la vocation est d’abord collective, à construire un individu féminin. (shrink)

Dans cette note il s’agit de la découverte de deux copies manuscriptes inconnues du chapitre quinze d’une oeuvre d’eschatologie hebraique de la moitié du XIIe siècle rédigée par Abrahm bar HIija ou Abraham Savosarda, le Liber revelator. Cette oeuvre est connue seulement en hebraique et dans la traduction de Marie Josef Millás-Vallicrosa. Le chapitre cinque regarde une conception astrologique de la philosophie de l’histoire du monde, de la naissance ou de la chute des gouvernements et des religions avec le (...) titre De redemptione Israel. L’Autrice a retrouvé une traduction latine inconnue en deux copies manuscriptes, dans deux Bibliotèques allemandes, une à Lipsie et l’autre à Wolfenbüttel redigées par le frère des Franciscains mineurs du Couvent de Gottingen Theodoricus de Northem. On demontre en renvoyant aussi à ses études précédantes à ces propos, que ce chapitre cinq à été la source primaire de l’oeuvre de Pierre d’Ailly qui partagait la même philosophie astrologique de l’histoire sacrée, l’ Elucidarium opus concordantiae astronomiae cum theologia nec non historice veritatis édité en 1490, à commencer du chapitre 24 jusqu’au chapitre 33. La correspondance de Pline le Jeune, publiée au II e siècle de notre ère, regorge de références à la mission de l’avocat. Bien que l’activité d’avocat ne soit pas la seule exercée par l’auteur, elle occupe une partie très importante de son temps, comme il le reconnaît lui-même, et remplit une fonction essentielle au sein de la société romaine. En assurant la défense des droits des femmes et des hommes qui le sollicitent, l’avocat s’assure de placer la justice et le (...) droit au cœur de la société et participe ainsi au renforcement du lien social. Une telle mission ne peut, selon Pline le Jeune, être confiée qu’à des hommes dont les qualités humaines sont supérieures et qui appartiennent de facto à la noblesse romaine. Agonistic Democracy explores how theoretical concepts from agonistic democracy can inform institutional design in order to mediate conflict in multicultural, pluralist societies. Drawing on the work of Foucault, Nietzsche, Schmitt, and Arendt, Marie Paxton outlines the importance of their themes of public contestation, contingency and necessary interdependency for contemporary agonistic thinkers. Paxton delineates three distinct approaches to agonistic democracy: David Owen's perfectionist agonism, Mouffe's adversarial agonism, and William Connolly and James Tully's inclusive agonism. Paxton demonstrates how each is fundamental (...) to enabling citizens to cultivate better virtues for themselves and society (Owen), motivating democratic engagement (Mouffe) and enhancing relations of respect and understanding between conflicting citizens (Connolly and Tully). In recent years there has been an expansion of scientific work on consciousness. However, there is an increasing necessity to integrate evolutionary and interdisciplinary perspectives and to bring affective feelings more centrally into the overall discussion. Pursuant especially to the theorizing of Endel Tulving , Panksepp and Vandekerckhove we will look at the phenomena starting with primary-process consciousness, namely the rudimentary state of autonomic awareness or unknowing consciousness, with a fundamental form of first-person ‘self-experience’ which relies on affective experiential states (...) and raw sensory and perceptual mental existences, to higher forms of knowing and self-aware consciousness. Since current scientific approaches are most concerned with the understanding of higher declarative states of consciousness, we will focus on these vastly underestimated primary forms of consciousness which may be foundational for all forms of higher ‘knowing consciousness’. This paper aims to confront two notions that have acquired a particular importance in contemporary reflections on the law: the notion of “un-law” (“Unrecht” or “non-droit”), that was constructed after the second WW in order to think about the specific nature of “Nazi law”; and the notion of “state of exception” (“Ausnahmezustand” or “état d’exception”), which is now commonly tied up with the idea of juridical anomie. This confrontation extends the analysis that is especially exposed by the very concept of (...) “un-law”, in order to think about the possibility of a “monstrous law” in a functional way, and not in a substantial one. In return, this new light will help to think of the discontinuities between a “state of exception” and a “state of un-law”. (shrink)

Maurice Blondel’s philosophy has had a decisive influence on the theology of Henri de Lubac, but more than an influence, it goes of an encounter and a dialogue between two great Catholic thinkers. This article proposes, over the course of successive encounters and collaborations between Blondel and Lubac, a presentation of Lubac’s reflection in that it extends Blondel’s critique of extrinsicity to the field of theology. This friendship between Lubac and Blondel testifies to the inherent character of the mystical question (...) to both philosophy and theology. This anchoring signifies the Mystery of Christ at work in the gesture of reason and in the understanding of faith. At the same time, Lubac promotes, in philosophy itself, an intelligence through faith. Friendship has not been an empty word with Lubac who openly defended Maurice Blondel on several occasions, and even after Blondel’s death, when Lubac continued to make the philosopher’s thought known by publishing and annotating a large part of his correspondence. The number of depressed people has been increasing regularly. This increase is clearly aggravated by psycho-pharmacological factors. Psychoanalysts have encountered difficulties with a new type of patient for whom neurotic solutions do not work. For this reason, a new evaluation of the psycho-conception of the subject, melancholy and distress, and the social link is needed: this new evaluation allows us to define the nature of the relation between depression and society, and to plan a more effective clinical response.

Based on fieldwork, this article highlights the unexpected effects of controversies about nanotechnology in France. These controversies stem in particular from a strong challenge to the field by civil society protests and criticism concerning environmental and health risks. One reason for this challenge is the specific difficulties in assessing the toxicity and ecotoxicity of nanomaterials. Civil society organizations have pushed for strictly controlling or stopping academic, industrial, or even basic research. They were not successful in this regard but their activities (...) prompted researchers to think about “safe by design” solutions and this led to new interdisciplinary cooperation. Furthermore, the uncertainty about the risks assessment resulted in a reconfiguration of the relationship between academic research and industrial companies. Researchers have become essential to the shaping of safe products. The risks of nanomaterials have thus been a driving force for new research and innovation practices. (shrink)

This paper deals with the 24-line mythological epyllion Progne et Philomela, an anonymous Virgilian cento of presumed North African origin, which is usually dated to the fourth or fifth century and is marked by considerable obscurity. The aim is to shed some light on the most intriguing parts of this elliptical retelling of the given myth, in particular the puzzling network of family relationships and the extended talking-blood metaphor. Offering a new perspective on the text, the author claims that its (...) general ambiguity is, to some extent, a purposefully adopted authorial strategy rather than a by-product of the cento technique. For this reason, it is proposed that the poem might have been written as a sort of mythological riddle to be solved by its readers. (shrink)

Aristotle maintains that paideia enables one to judge the method used by a given speaker without judging the conclusions drawn as well. He contends that this "paideia of principles" requires three things: seeing that principles are not derived from one another; seeing that there is nothing before them within reason; and, seeing that they are the source of much knowledge. In order to grasp these principles, one must respectively learn to recognize what distinguishes the subject matters studied in different disciplines, (...) see first principles as coming from experience and acquire the habit of seeking them in one’s experience and, finally, see first principles as being the source of conclusions. While the second and third points might at first seem to pertain to "nous" and science, respectively, rather than to paideia, the case can be made that paideia involves more of a firm grasp of principles than "nous" and a less perfect way of relating conclusion to principles than science.
