Eine an universellen Prinzipien orientierte Entscheidungsethik kann einen problemlösungsorientierten Lebensvollzug fördern. Sie orientiert sich an der Erweiterung von Verantwortung und Glück im Umgang und Austausch des Subjekts mit der Außenwelt. Die Erklärung und Begründung dieser Annahme sind das Ziel der Arbeit. Ihre Perspektive richtet sich auf die Verknüpfung einer bedingungsanalytischen Konzeption gelingenden glücklichen Lebens als Grundlage einer auf Achtung und Anerkennung gegründeten Ethik mit einer (...) hermeneutischen Analyse der ethischen Implikation der Anthropologie Viktor Frankls. This essay discusses the question of health in the Kingdom of Hungary during the Age of Enlightenment. It explores the relationships and tensions between central theories of medical police and the local expectations of government administrators, as well as those between academic or official knowledge and implicit or alternative knowledge about health. The reigns of Maria Theresia and Joseph II marked the moment at which particular kinds of folk and practical knowledge about healing became visible and above all (...) legible. This is to be seen in the enormous rise in book production, which in itself represented an ‘approved knowledge’ that found legitimation in new academic and bureaucratic institutions, such as the reformed medical faculty of the University of Vienna, the newly-founded medical faculty at Tyrnau, the establishment of a health department within the Hungarian Statthalterei, as well as in the emission of royal legislation supporting the agendas of the new enlightened science of ‘medical police’. Natural law as a discipline was definitively institutionalized at universities in the Habsburg monarchy during the reforms of Maria Theresia after 1752. The guiding principles of these reforms were set in the instruction for the chair of natural law in Vienna which was given to Carl Anton Martini. It was Catholic in conception, but it ordered the professor to draw on Grotius. Our article reconstructs the elementary structure of Martini’s theory of natural law with a focus on his (...) conception of state. The article proves that Martini did not adopt Wolff’s conception of deducing duties and obligations from the highest principle for that would conflict with the Catholic emphasis on freedom of will. Instead of that, Martini derived duties and rights from the three God-given ends. Martini perceived the state as based on social contract, after the model of Christian Wolff. However, it seems that Martini rejected the two-contract model and acknowledged only the contract of submission as binding. Martini sought to hold the middle ground between Machiavellians arguing that the subjects lose all rights after the social contract, and radical ‘monarchomachs’ who believe that the ‘populus’ retains the supreme power. Martini argues that the ruler is limited by natural laws; the subjects retain rights to life and to property, but they are denied any right to resistance. Since Martini derived the monarch’s powers from the unlimited duty to guarantee security, he admitted even encroachments on religious freedom. He admitted coercion in matters that would threaten salus civitatis, but respected the inner libertas conscientiae. He also acknowledged a peculiar division of powers differentiating between a legislative, an inspectorial and an executive power. Even though the aim of this division was not a system of checks and balances, a precise description of the scope of the executive power helped to delimit a sphere of individual freedom. (shrink)

It seems impossible to completely cover the field indicated by the title of this report because of the many contributions of individual physicians and non-physicians to problems of the philosophy of medicine in Austria, and to their solution. The main trends are rooted in historic developments and in the current problems of medicine and health care, which are similar world-wide. In Austria famous names like empress Maria Theresia or the physician Ignaz Semmelweis have to be mentioned in connection (...) with the development of the ideas of a philosophy of medicine. In recent times again influential and well-known persons in related fields of medicine and health care are Austrians. However, the main line of new developments goes mostly unseen by the public: activities in medical ethics with the goal to humanize health care, carried on by groups of young physicians, biomedical engineers and students. 'Ethics' was not developed as a separate branch of philosophy in Buddhist traditions until the modern period, though Buddhist philosophers have always been concerned with the moral significance of thoughts, emotions, intentions, actions, virtues, and precepts. Their most penetrating forms of moral reflection have been developed within disciplines of practice aimed at achieving freedom and peace. Após a obrigatoriedade da educação sexual (ES) nas escolas portuguesas em 2009, pretendemos conhecer que perspectiva têm os professores ( N = 307) sobre a ES. Através de um questionário on-line , analisado através de estatística descritiva e de análise factorial e inferencial, avaliámos as atitudes gerais sobre a ES, o conhecimento, o conforto e a disponibilidade para a ensinar, a importância atribuída a diversos tópicos de ES e o nível de escolaridade em que devem ser introduzidos. Os professores revelaram (...) atitudes ainda mais positivas do que em estudos anteriores. Consideraram ter um conhecimento, um conforto e uma disponibilidade moderados, realidade que se mantém inalterada na última década. Ao contrário de estudos anteriores, o início da ES foi proposto mais precocemente, entre o pré-escolar e o 5º ano.1 A perspectiva de ES defendida revela um modelo médico-preventivo, valorizando-se mais a saúde sexual e menos o comportamento sexual e as questões de género. A percepção de formação considerada suficiente, a erotofilia e pontualmente o sexo feminino destacam-se na adopção de uma perspectiva abrangente de ES. A análise de resultados foi, sempre que possível, comparada com resultados de estudos similares realizados no Brasil. (shrink)

El epistolario del filósofo argentino Francisco Romero (Sevilla, 1891 - Buenos Aires, 1962) con colegas y discípulos de Chile y con extranjeros afincados voluntariamente o no en ese país, constituyó una notable red intelectual en torno al conocimiento de América, entre 1934 y 1962. La construcción del americanismo filosófico fue una de las preocupaciones aglutinantes, y las reflexiones que se produjeron se entroncaron con las circunstancias políticas, ideológicas, sociales, culturales y económicas de cada uno de sus miembros. The correspondence of (...) the argentine philosopher Francisco Romero (Seville, 1891 - Buenos Aires, 1962) with colleagues and disciples of Chile and foreign voluntarily or not settled in that country, constituted a remarkable intellectual network in the knowledge of America, between 1934 and 1962. The construction of Philosophical Americanism was a central concern, and reflections that occurred were connected with political, ideological, social, cultural and economic circumstances of each member. Análisis de los textos relativos a la Creación que aparecen en las Cartas de Maimónides, en los que el filósofo judeoandalusí puntualiza las tesis mantenidas en sus obras mayores.

El _Fedón_ de Platón puede ser abordado tomando como eje la cuestión de los opuestos, que lo recorre en toda su extensión. En el presente trabajo nos enfocaremos en la referencia al placer y al dolor con la que Sócrates abre su participación en la obra, así como también en el primer argumento dedicado justamente al carácter cíclico de los opuestos. Examinaremos la amplia gama de ejemplos cualitativamente diferentes de contrarios que Platón ofrece y cómo esas diferencias repercuten en el (...) valor de la argumentación. Nuestro análisis nos permitirá formular algunas apreciaciones del interés platónico en estos desarrollos que, para su adecuada interpretación, deben ser leídos a la luz de la distinción ontológica fundamental entre lo sensible y lo inteligible, presentada por primera vez en esta obra. Solo tras conseguir la aceptación de sus interlocutores acerca de que es necesario que los opuestos pueden coexistir y alternarse para explicar el cambio en lo generado, Platón podrá referirse a las determinaciones mismas que reciben las cosas por ellas designadas, aquellos contrarios mismos que no podrían llegar a ser nunca contrarios de sí mismos. Solo desde esta anticipación, creemos, se podrá dimensionar con justicia la importancia que dio Platón a la cuestión de los opuestos en el _Fedón_. (shrink)

自由的核心概念在康德的建構中，除了奠定了道德法則與法權法則的普遍性、必然性與約束性之外，它還有一個軸心的關鍵作用，居間連結道德哲學與法權哲學。自由是實踐哲學的基本概念，藉此設定，康德業已以不言而喻的必 然方式，將法權哲學的法權論，與倫理學的德行論，一併歸編列於道德哲學的大系統之內。這樣一個大系統的建構，反過來使法權哲學的法權論能夠具有道德形上學的向度，從外在的強制法，通過意念的反思建立德行，成為可能 。再透過理性本體之自由理念的溯源，自由基本人權明確顯示的，即是「人作為人」不可冒犯的尊嚴。在康德通過道德法則的理性事實證成自由理念的客觀真實性之後，我們可以合理地倒反過來，從存有的觀點來鳥瞰他的道德哲 學的這整個系統的基本架構，是透過一個核心作用的統籌運用：從作為核心的自由概念出發，一方面「縱向貫徹」，另外一方面「橫向一致」，動態交錯地開展出來。.
