This paper arose out of the 2017 international conference on AI and law doctoral consortium. There were five students who presented their Ph.D. work, and each of them has contributed a section to this paper. The paper offers a view of what topics are currently engaging students, and shows the diversity of their interests and influences.

This is a report on the Doctoral Consortium co-located with the 17th International Conference on Artificial Intelligence and Law in Montreal.

Business ethics attracts increasing attention from business practitioners and academic researchers. Concerns over fraudulent behavior keep attentionfocused on ethics in businesses. The accounting profession pays particularattention to matters of ethical judgment. The profession has adopted a strictcode of conduct and many states require the passage of an ethics exam to gaincertification. The more that is understood about the relationship of gender and ethics, the better chance of education and training programs will bedesigned to improve ethical awareness and sensitivity. Prior studies (...) have found that personal characteristics are an important aspect of cultural norms.This study analyzes the responses of students from eight different countries toquestions on their probable actions to an ethical dilemma. In the ongoing pandemic, death statistics influence people’s feelings and government policy. But when does COVID-19 qualify as the cause of death? As philosophers of medicine interested in conceptual clarification, we address the question by analyzing the World Health Organization’s rules for the certification of death. We show that for COVID-19, WHO rules take into account both facts and values.

This article explores the concept of cultural competence and its relevance as an organizational resource in ethical disputes. Empirically, we aim to reveal the cultural competences that a global forest industry company, StoraEnso, and a global environmental nongovernmental organization (NGO), Greenpeace, utilized in forestry conflicts during 1985–2001. Our study is based on data which were collected from corporate and NGO communication outlets and which have gone through a detailed discourse-semiotic analysis. Our reinterpretation of the discourses identified three cultural competences: (1) (...) the ability to understand changing consumer preferences and values, (2) the ability to utilize culturally determined positions of expertise, and (3) the ability to maintain trust and credibility in the community through open communicative practices. We argue that these competences are relevant in industry–NGO disputes for both parties. However, maintaining them all simultaneously is a difficult task, since various discourses which aim at upholding them can sometimes have contradictory effects. (shrink)

In this paper I analyze Kant’s ideas about eating and drinking. First, I show that gluttony and drunkenness are considered ways to oppose to the duty to oneself as an animal being. Second, I claim that for Kant there is a healthy way of having meals, which consists in eating together with friends. Then I indicate that Kant accepts that one can drink at dinner parties but has to avoid drinks that lead to drunkenness and unsocial behavior. In this sense, (...) he draws a classification of the various kinds of alcoholic drinks, according to their potential harm. Afterwards, I illustrate how Kant’s own intimate life was a daily practice of his thoughts on dietetic conceptions and on what is better for digestion and health. To conclude, I mention the idea of a philosopher’s medicine of the body and why a strict diet should be avoided. (shrink)

The λ-continuum of inductive methods was derived from an assumption, called λ-condition, which says that the probability of finding an individual having property $x_{j}$ depends only on the number of observed individuals having property $x_{j}$ and on the total number of observed individuals. So, according to that assumption, all individuals with properties which are different from $x_{j}$ have equal weight with respect to that probability and, in particular, it does not matter whether any individual was observed having some property similar (...) to $x_{j}$ (the most complete proof of this result is presented in Carnap, 1980). The problem thus remained open to find some general condition, weaker than the λ-condition, which would allow for the derivation of probability functions which might be sensitive to similarity. Carnap himself suggested a weakening of the λ-condition which might allow for similarity sensitive probability functions (Carnap, 1980, p. 45) but he did not find the family of probability functions derivable from that principle. The aim of this paper is to present the family of probability functions derivable from Carnap's suggestion and to show how it is derived. In Section 1 the general problem of analogy by similarity in inductive logic is presented, Section 2 outlines the notation and the conceptual background involved in the proof, Section 3 gives the proof, Section 4 discusses Carnap's principle and the result, Section 5 is a brief review of the solutions which have previously been proposed. The book examines how Darwinism has been used to explain novelty and change in culture through the Darwinian approach to creativity and the theory of memes. The first claims that creativity is based on a Darwinian process of blind variation and selection, while the latter claims that culture is based on and explained by units - memes - that are similar to genes. Both theories try to describe and explain mind and culture by applying Darwinism by way of analogies. Kronfeldner (...) shows that the analogies involved in these theories lead to claims that give either wrong or at least no new descriptions or explanations of the phenomena at issue. Whereas the two approaches are usually defended or criticized on the basis that they are dangerous for our vision of ourselves, this book takes a different perspective: it questions the acuteness of these approaches. Darwinian theory is not like a dangerous wolf, hunting for our self image. Far from it, in the case of the two analogical applications addressed in this book, Darwinian theory is shown to behave more like a disoriented sheep in wolf's clothing. - A revised and much shortened version of a dissertation (2007, Darwinism, Memes and Creativity: A Critique of Analogical Reasoning from Nature to Culture). This essay presents the early days of human cytogenetics, from the late 1950s until the mid 1970s, as a historical series of images. I propose a chronology moving from photographs of bodies to chromosome sets, to be joined by ultrasound images, which provided a return to bodies, by then focused on the unborn. Images carried ontological significance and, as I will argue, are principal characters in the history of human cytogenetics. Inspired by the historiography of heredity and genetics, studies on (...) visual cultures, the conceptualization of circulation, and the sociology of pregnancy, I suggest that cytogenetics, through its focus on pregnancy, pregnant women, and their offspring, found strategic living materials that stabilized human chromosome studies as a biomedical, post-eugenics practice. The historicity of each path displays a wide circulation of objects, tools, and methods that condensed on images that shared in the centuries-old visual expertise that medicine and botany had manufactured. Most of the epidemiological models of the Covid-19 pandemic contain the reproduction number as a parameter. In this article we focus on some shortcomings regarding its role in driving health policies and political decisions. First, we summarize what R is and what it is used for. Second, we introduce a three-question matrix for the evaluation of any construct or parameter within a model. We then review the main literature about R to highlight some of its shortcomings and apply to them (...) our three-question matrix. Generalized Quantifier Theory defines superlative quantifiers at most n and at least n as truth-conditionally equivalent to comparative quantifiers fewer than n+1 and more than n \1. It has been demonstrated, however, that this standard theory cannot account for various linguistic differences between these two types of quantifiers. In this paper I discuss how the distinction between assertibility and truth-conditions can be applied to explain this phenomenon. I draw a parallel between the assertibility of disjunctions and superlative quantifiers, and argue (...) that those assertibility conditions are essentially modal. I use epistemic logic to formalize the assertibility conditions and revisit some of the linguistic puzzles related to superlative quantification. (shrink)

An objection has been raised that Karol Wojtyła presents an ethical system heavily centered on actions and deeds. With the exception of his occasional references to the virtue of chastity in Love and Responsibility and his first writing on Saint John, some of the most central themes of ancient and medieval, as well as of contemporary, ethics seem almost entirely absent. In the following article, we will turn to Wojtyła’s most important philosophical work, The Acting Person, to glean from it (...) his understanding of “action.” We will then turn to the writings of Dietrich von Hildebrand, as an example of a classic counterpart for any approach to man primarily through action. After briefly discussing the ethical relevance of aspects such as inner responses, fundamental moral attitudes, and virtues, we will conclude by returning to Wojtyła and re-evaluating the legitimacy of the objection raised against him. "Meaning, the complex phenomenon of individuation and the definition of identity are the core theme of this work. Grounded on a theoretical framework that gives particular emphasis to the semiotic process common to all forms of cognition, human cognitionis conceived here as specific of organisms that, in the course of their interactions, produce symbolic forms, defining the specific physical, social and cultural environments in which they evolve. Individuation, inherent to that semiotic process, is complex and double-sided. It involves, on one (...) hand, the definition of semantic identities and their acknowledgment as world objects naming; on the other hand, it comprehends the specific lexical and morphosyntactic strategies different languages have found todesignate particular entities referring. The definition of world objects and its symbolic translation presents variations from language to language. In the second part of the book, we define what we have called a 'structure-motivated ontology' to represent how this symbolic translation is accomplished in English and European Portuguese. In the philosophy of Merleau-Ponty, learning is not a paradox, as suggested by Plato’s Meno, but the fundamental form of experience. To experience is precisely to be permeable and open to being reshaped by one’s experiences. I explore the reconceptualization of the human subject within Merleau-Ponty’s philosophy that allows us to understand how the body-subject can be a learning subject. Fundamentally this involves consideration of the nature of habit, and the way in which habit simultaneously locks us into a repressiveattachment (...) to a specific past and opens us up to the possibilities of meaningful engagement with the world. Through an analysis of the temporality of habit, I conclude that understanding habit as the fundamental launching-place of learning also allows us to see how essential learning is to the experience of human freedom. Questionamos de que maneira as características do ensaio potencializam a crítica ao sexismo, racismo e autoritarismo nas concepções da “Mulher negra”, em Gonzalez, num confronto imaginário com o “Mito Fundador”, em Chaui. Objetivamos localizar na escrita das autoras os artifícios característicos do ensaio, mobilizados para estimular reflexões críticas (...) nas leitoras. We question how the characteristics of the essay strengthen criticism of sexism, racism and authoritarianism in the conceptions of the “Black Woman”, in Gonzalez, in an imaginary confrontation with the “Founding Myth” in Chaui. We aimed to locate, in the authors’ writing, the characteristic devices of the essay, mobilized to stimulate critical reflections in the readers. In the midst of the clash between the “Black Woman” and the “Founding Myth”, we bet on the erratic meanings of the essay faced with the dogmatic discourse that violates the female Black body. This study investigates young consumers’ reliance on social media influencers (SMIs) in the context of social commerce. With regard to the four streams of influencer endorsement – influencer credibility, influencer attractiveness, match-up, and meaning transfer – we propose that they can either lead to a direct consumer reliance on SMIs’ suggestions for their purchasing decisions, or that attitudes toward SMIs mediate the relationship. By integrating both directions of partial- and no-attitude mediation, the proposed model explores all associations in order to (...) better understand connections and driving forces between endorsement streams, attitudes, and reliance. We introduce the concept of reliance on SMIs, understood here as the degree to which young individuals base their preferences, lifestyles, and purchasing decisions upon SMIs. A research model was validated by examining 809 young individuals. The results reveal that attitude formation is affected by all four endorsement streams, and fully mediates the relationship between these endorsement streams and young people’s reliance on SMIs. The differentiated reliance levels by gender and age confirm that females and teenagers tend to rely more on SMIs. The current study offers the first evidence for a relationship between the four endorsement streams and reliance on SMIs via attitude formation in the context of social media networking, as well as the association of reliance with sociodemographic characteristics. Charles Darwin und seine Erben wendeten die Theorie der Evolution biologischer Arten auch auf Kultur an. Kultur evolviere wie die Natur auf Darwinistische Weise. Die sog. Memtheorie, vertreten von verschiedenen Autoren auf der Basis des Darwinistischen Genselektionismus, ist eine Spielart einer solchen analogen Anwendung. Dieser Artikel kritisiert drei zentrale Aussagen der Memtheorie: (i) dass es Einheiten der Kultur – Meme – gibt, die analog zu Genen zu verstehen sind, (ii) dass Meme, in Analogie zu Genen, Replikatoren sind, und (iii) dass (...) Meme als Einheiten der kulturellen Selektion auf die gleiche Art wie Gene 'egoistisch' sein können. Nach einer Einführung in die Memtheorie in Teil 1, werden diese drei Thesen in Teil 2 als entweder falsch oder trivial entlarvt. Dieser kritische Teil soll vor allem zeigen, dass die Memtheorie keine 'gefährliche Idee' ist, die das bisher in den Geistes- Kultur- und Sozialwissenschaften tradierte Verständnis von Geist und Kultur herausfordern kann. Im Gegenteil, im besten Fall re-formuliert die Memtheorie lediglich Bekanntes in evolutionärer Sprache und ist in diesem Sinne trivial. In Teil 3 wird die Perspektive gewechselt: Nicht mehr der Gehalt, sondern die Funktion der Memtheorie, v.a. im Kontext interdisziplinärer Verständigung, soll betrachtet werden. Denn trotz der Kritik der drei Kernthesen kann die Memtheorie eine kommunikative und somit produktive Rolle zwischen den 'zwei Kulturen' der Wissenschaften spielen. (shrink)

The early modern play Sir Thomas More, written by Anthony Munday, Henry Chettle, Thomas Dekker, Thomas Heywood, and William Shakespeare, takes an ecumenical viewpoint of the play's Catholic hero in order to conform to the expectations of the Master of the Revels and to appeal to a cross-confessional audience. The playwrights carefully construct the play within the confines of censorship by centering the play's action around More's dynamic personality instead of giving a full exposition of historical plot. More's personality and (...) famous wit function together as a means for diverting attention away from the controversy surrounding More's silent opposition to Henrician policy while subtly validating his martyrdom. The argument of this article examines the adaptation of the play's ideologically diverse source material, the playwrights’ use of martyrological conventions, and the subtle traces of Erasmian allusion and recusant rhetoric in its reading of the play. O artigo explora a relação do ser humano com o inefável e quais os caminhos para a presença de Deus na consciência religiosa, de acordo com Abraham Heschel, através da visão bíblica de mundo, nas seguintes categorias: sublime, maravilhoso, mistério, temor e glória. O resgate desses sentimentos dentro da religião é fundamental para a experiência da fé.

Cochlear implants (CI) support the development of oral language in hearing-impaired children. However, even with CI, speech recognition in noise (SRiN) is limited. This raised the question, whether these restrictions are related to the quality of life (QoL) of children and adolescents with CI and how SRiN and QoL are related to each other. As a result of a systematic literature research only three studies were found, indicating positive moderating effects between SRiN and QoL of young CI users. Thirty studies (...) addressed the quality of life of children and adolescents with CI. Following the criteria of the World Health Organization (WHO) for pediatric HRQoL (1994) only a minority used validated child centered and age appropriate QoL instruments. Moreover, despite the consensus that usually children and adolescents are the most prominent informants of their own QoL (parent- reports complement the information of the children) only a minority of investigators used self-reports. Restricted SRiN may be a burden for the QoL of children and adolescents with CI. Up to now the CI community does not seem to be aware of a possible impairment of QoL in young CI users. Further studies addressing this topic are urgently needed, which is also relevant for parents, clinicians, therapists, teachers, and politicians. Additionally investigators should use valid pediatric QoL instruments. They should be aware, that most of the young CI users are able to inform about their quality of life also themselves (additionally to parents). (shrink)
