Moral duties are regularly attributed to groups. Does this make conceptual sense or is this merely political rhetoric? And what are the implications for these individuals within groups? Collins outlines a Tripartite Model of group duties that can target political demands at the right entities, in the right way and for the right reasons.

Organizations do moral wrong. States pursue unjust wars, businesses avoid tax, charities misdirect funds. Our social, political, and legal responses require guidance. We need to know what we’re responding to and how we should respond to it. We need a metaphysical and moral theory of wrongful organizations. This book provides a new such theory, paying particular attention to questions that have been underexplored in existing debates. These questions include: where are organizations located as material objects in the natural world? What’s (...) the metaphysical relation between organizations and their members? Can organizations be blameworthy for attitudes and character traits, as well as for actions? What about feelings of guilt, remorse, and shame—can organizations feel these emotions and why does this matter? How and why are members implicated in organizations’ wrongs? How should organizations’ reparative costs be apportioned among members? The book answers these questions. It argues that organizations are material objects with humans as material parts—much like how a pizza is a material object with slices as material parts. This picture helps us make sense of organizations’ blameworthiness, including blame for organization-level actions, attitudes, and character traits. The book argues that organizations can experience moral self-awareness—a crucial component of guilt, remorse, and shame. Members can be implicated in organizations’ actions in numerous ways—and, it is argued, members’ level of implication should determine their share of organizations’ reparative burdens. (shrink)

Invasive neurotechnologies are a frequent subject of discussion in neuroethics. Technologies, like deep brain stimulation and implantable brain-computer interfaces, are thought to hold significant promise for human health and well-being, but they also raise important ethical questions about autonomy, safety, stigma, privacy, and agency, among others. The terms ‘invasive’ and ‘invasiveness’ are commonly applied to these and other neurotechnologies, yet the concept of invasiveness itself is rarely defined or delimited. Some have suggested that invasiveness may have multiple meanings – physical, (...) emotional, or lifestyle – and that confusion about how people use the terms may lead to harm, especially for users of invasive devices. It is uncertain if debates in neuroethics contribute to this confusion. To investigate this, we conducted a study of how the term ‘invasiveness’ is used in neuroethics. We found that neuroethicists almost always use ‘invasiveness’ to refer to the physical features of interventions, and rarely to refer to other senses of invasiveness. We also found that referencing invasiveness does not determine which ethical issues are prioritized for a given type of neurotechnology. Overall, this study affirms the importance of understanding the meaning and use of the concept of invasiveness in ethical discussion of neurotechnology while also suggesting the need for further work in the area and consideration for rethinking what forms of technology we consider to be invasive. Generics are exception-admitting generalisations, which find expression in apparently diverse linguistic forms. A standard claim is that there is a hidden linguistic unity to genericity in the form of a covert operator, Gen. This article surveys and rejects a range of considerations that purport to show Gen to be syntactically essential to the explanation of a range of linguistic phenomena connected to genericity. The conclusion reached is that genericity is not a specifically linguistic property insofar as it does not supervene (...) upon any especial linguistic device; rather, genericity supervenes on broader cognitive competencies within linguistic constraints. There are widespread calls for increased demographic diversity in science, often linked to the epistemic claim that including more perspectives will improve the quality of the knowledge produced. By distinguishing between demographic and epistemic diversity, we show that this is only true some of the time. There are cases where increasing demographic diversity will not bring about the necessary epistemic diversity and cases where failing to exclude some voices reduces the quality of the scientific debate. We seek to resolve these (...) tensions with an analysis that turns on the way the experience-based expertise of non-scientists can be absorbed into mainstream science. Mostly it has to be done via what we call ‘virtual diversity’, in which scientists take responsibility for acquiring interactional expertise in the non-scientific expertise-based domains which they consider provide knowledge valuable to the science. We argue that virtual diversity represents the only feasible option in most scenarios, with cases where demographic diversity or full cultural mergers provide the solution being the exception rather than the rule. This analysis is an exercise in the sociology of knowledge, which is considered as being continuous with philosophy. The paper is prescriptive as well as descriptive, and the moral, cultural, political, and educational implications of the argument are drawn out. A main conclusion is that the acquisition of virtual diversity should be a new norm for science, allowing the voices of experienced non-scientist citizens to be heard but without eroding the institution of science, which continues to be a vital foundation of truth in democracy. What is a technical object? At the beginning of Western philosophy, Aristotle contrasted beings formed by nature, which had within themselves a beginning of movement and rest, and man-made objects, which did not have the source of their own production within themselves. This book, the first of three volumes, revises the Aristotelian argument and develops an innovative assessment whereby the technical object can be seen as having an essential, distinct temporality and dynamics of its own. The Aristotelian concept persisted, in (...) one form or another, until Marx, who conceived of the possibility of an evolution of technics. Lodged between mechanics and biology, a technical entity became a complex of heterogeneous forces. In a parallel development, while industrialization was in the process of overthrowing the contemporary order of knowledge as well as contemporary social organization, technology was acquiring a new place in philosophical questioning. Philosophy was for the first time faced with a world in which technical expansion was so widespread that science was becoming more and more subject to the field of instrumentality, with its ends determined by the imperatives of economic struggle or war, and with its epistemic status changing accordingly. The power that emerged from this new relation was unleashed in the course of the two world wars. Working his way through the history of the Aristotelian assessment of technics, the author engages the ideas of a wide range of thinkers—Rousseau, Husserl, and Heidegger, the paleo-ontologist Leroi-Gourhan, the anthropologists Vernant and Detienne, the sociologists Weber and Habermas, and the systems analysts Maturana and Varela. Realist theories of legislative intent can be divided between aggregative theories (on which legislative intent is what some proportion of legislators intend) and common intent theories (on which legislative intent is a unanimous intent among legislators). In this paper, we advance and defend an alternative realist conception of legislative intent: the Rational Unity Account. On this account, the legislature is an agent with a distinctive ‘rational point of view’—a concept we adopt from social ontology. The legislature’s rational point of view (...) is shaped by its procedures and structures, in ways not determined by either a common intention held by legislators or an aggregation of the intentions of legislators. We explain how our view improves on existing accounts. We then apply it to three cases to demonstrate its implications for legal interpretation. The urgency of the problem of climate change calls upon us to investigate the climate duties of agents beyond the state. Individuals are the most salient candidate in this respect. In section I, I argue that the idea that individuals might have duties to reduce their emissions raises difficult issues about individual difference-making. The rest of the chapter, then, focuses on what I take to be the third most-salient duty-bearer: large for-profit corporations. These entities have largely been overlooked in philosophical (...) discussions of climate-related duties. In Section II, I consider two possible reasons for this neglect, and argue that neither are good reasons. In Section III, I give a positive case for weighty and demanding duties for corporations, to cut back their present and planned emissions and to offset their past emissions. In Section IV, I bring the discussion full circle: corporations’ duties always imply duties for corporations’ members, that is, for the individuals who constitute the corporation. Drawing on earlier work, I give an account of who corporations’ members are and how their duties are structured. In heavily-emitting corporations, members prominently include managers, shareholders, and rank-and-file employees. So a range of individuals are on the hook after all, because the corporations that they constitute bear duties. Additionally, even non-members may have duties to act upon corporations, from the outside, with a view to inducing corporate duty-fulfillment. (shrink)

In this chapter, I present a new theodicy, which I call the connection building theodicy. The basic idea behind this theodicy is that virtuous responses to evil allow for certain types of ongoing, intrinsically valuable connections of appreciation, contribution, and what I call “intimacy” between personal agents. Because of their ongoing character, arguably, the value of these connections will eventually outweigh the disvalue of the evils that God must allow in order for them to exist. After presenting the basic idea (...) of the theodicy, I consider a series of objections, and argue for its philosophical, theological, and practical fruitfulness. I do not claim this theodicy offers the sole reason why God allows evil, only that it provides an important and neglected set of reasons. (shrink)

Purpose We examine the levels of post-trial responsibility ascribed to different stakeholders, following a community-based clinical trial and how the ‘responsibility’ is understood. Methods We employed photovoice, unstructured observations and key informant interviews to gain insights into contexts of access to care following transition to the public health system post trial. We used an inductive narrative analysis to explore experiences and understandings of post-trial access. Results In their photovoice stories, many participants expressed a sense of abandonment after the trial. This (...) was viewed as a contributing factor to failing to re-engage with care available in the public health system. This led to the experiences of loss as some trial participants defaulted and died. Research investigators, department of health participants and sponsor agreed that PTA was especially important for communities in resource-limited settings. The government has an obligation towards its citizens while researchers have a responsibility to ensure a smooth transition of patients to public clinics. Sponsors have a responsibility to ensure that the trial is conducted in accordance with the protocol and post-trial agreements are in place and adhered to. Research partnerships among stakeholders were affected by power imbalances making it difficult to negotiate and plan for post-trial care responsibilities. Conclusions The research community still struggles with understanding the scope of PTA responsibilities. Power dynamics between public health actors and research sponsors need to be managed to ensure that government involvement is not tokenistic. The responsibility of trial participants and ethics committees needs to be investigated further. Data are available upon request. (shrink)

In light of a growing body of scholarship that has cast doubt on the analytic import of spontaneous order, the purpose of my article is to rethink the intellectual relationship between Edmund Burke and Friedrich Hayek by suggesting that reading spontaneous order into Burke’s thought introduces greater tensions between the two thinkers than prior scholars have suggested. One crucial tension, I suggest, is that Hayek believed that contractual arrangements, (...) competitive markets and the rule of law could sustain the growth of social order, while Burke maintained that particular social institutions and practices should remain protected from the full power of voluntary contracts and exchange relations. I conclude by suggesting that the tensions between Hayek and Burke could serve as complementary instruments, rather than as foes, in strengthening the liberal project in modernity. (shrink)

Many roles are situated within organizations. The occupants of these roles often confront a dilemma between (i) the occupancy conditions, performance conditions, and functions of the role, as bestowed upon the role by the organization’s decision-making procedures, and (ii) the occupancy conditions, performance conditions, and function that the role should ideally have. This chapter argues that this dilemma should be resolved in favour of (ii). Yet this does not require forgoing role-based considerations in favour of extra-role considerations. Instead, we should (...) conceptualize organizationally specified roles as being one token of an underlying role-type. The underlying role-type provides the organizational role-token with its fundamental occupancy conditions, performance conditions, and function. When the token is a poor instance of its type, organizational role-occupants have obligations—grounded in the fundamental aspects of the role—to challenge this. These are role obligations that call upon one to alter one’s role obligations. (shrink)

Here I try to improve on the available answers to certain long-debated questions and set out some consequences for the answers. Are there limits to the extent to which we can understand the conceptual worlds of other human communities and of non-human creatures? How does this question relate to our ability to engage in other cultures’ practices and languages? What is meant by ‘the body’ and what is meant by ‘the brain’ and how do different meanings bear on the questions? (...) The central answer developed here is that it is possible, given the right circumstances, for a competent human from any human group to understand the culture of any other human group without engaging in their practices though there are barriers when it comes to communication across species. This answer has important social and political consequences and consequences for the debate about artificial intelligence. (shrink)

The article argues that, linguistically speaking, there is no uniform class of personal taste predicate. There is an F(un)‐type PPT that takes infinitive complements expressing events. In effect, these PPTs are predicates of events involving participants. There is also a T(asty)‐type that cannot take an infinitive complement and does not enter into the alternation pattern of the F‐type predicates. These predicates express dispositions of objects to generate experiences or responses. Some experiencer/judge is involved in the truth of the respective kinds (...) of claims, but for different reasons, and in neither case is such a role encoded linguistically as an index for the predicate. The use of upper limb vibration during exercise and rehabilitation continues to gain popularity as a modality to improve function and performance. Currently, a lack of knowledge of the pathways being altered during ULV limits its effective implementation. Therefore, the aim of this study was to investigate whether indirect ULV modulates transmission along spinal and corticospinal pathways that control the human forearm. All measures were assessed under CONTROL and ULV conditions while participants maintained a small contraction of the right flexor (...) carpi radialis muscle. To assess spinal pathways, Hoffmann reflexes elicited by stimulation of the median nerve were recorded from FCR with motor response amplitudes matched between conditions. An H-reflex conditioning paradigm was also used to assess changes in presynaptic inhibition by stimulating the superficial radial nerve 37 ms prior to median nerve stimulation. Cutaneous reflexes in FCR elicited by stimulation of the SR nerve at the wrist were also recorded. To assess corticospinal pathways, motor evoked potentials elicited by transcranial magnetic stimulation of the contralateral motor cortex were recorded from the right FCR and biceps brachii. ULV significantly reduced H-reflex amplitude by 15.7% for both conditioned and unconditioned reflexes. Therefore, ULV inhibits cutaneous and H-reflex transmission without influencing corticospinal excitability of the forearm flexors suggesting increased presynaptic inhibition of afferent transmission as a likely mechanism. A general increase in inhibition of spinal pathways with ULV may have important implications for improving rehabilitation for individuals with spasticity. (shrink)

This book explores the significance of implicit understandings and tacit expectations of the parties to different kinds of contractual agreements.

The paper argues that natural language quantification, as expressed by determiner phrases, is not polysemous. The foil for this claim is Hofweber, who contends that natural language quantification is polysemous between a domain reading and an inferential reading. The thesis is intended to support a more general division between externalist and internalist positions in semantics. The paper, to the contrary, argues that there is no linguistic evidence for polysemous quantification, and Hofweber’s proposal proves to be non-compositional. Further, an approach at (...) least consistent with internalism is available independent of an inferential reading, for natural language quantification can be read as ontologically neutral, which removes the rationale for the polysemy hypothesis. The paper remains neutral on so-called heavyweight vs. lightweight construals of quantification, which are not claims about natural language semantics. (shrink)

In this chapter I take up the question of how Aristotle understood the relationship between the contemplative life and the active life in contributing to human flourishing and to the political regime. While the connections between Aristotle’s ethics and politics are abundant, there exists a prevalent assumption in the inclusive/dominant debate concerning the interpretation of eudaimonia (human flourishing) that Aristotle’s Politics cannot or should not play a prominent role in helping to understand eudaimonia. On the ‘inclusivist’ reading, eudaimonia is understood (...) as being a composite of all human goods or virtues. On the ‘dominant’ reading, eudaimonia is understood as being a single dominant good, theōria (contemplation). With this chapter I offer a competing interpretation which is in some ways similar to the recent ‘all-inclusive’ reading, but which relies heavily on the connection between Aristotle’s ethics and politics in order to explain how theōria fits into humans’ composite and political nature. In this paper we continue, from [2], the development of provably recursive analysis, that is, the study of real numbers defined by programs which can be proven to be correct in some fixed axiom system S. In particular we develop the provable analogue of an effective operator on the set C of recursive real numbers, namely, a provably correct operator on the set P of provably recursive real numbers. In Theorems 1 and 2 we exhibit a provably correct operator on (...) P which is discontinuous at 0; we thus disprove the analogue of the Ceitin-Moschovakis theorem of recursive analysis, which states that every effective operator on C is (effectively) continuous. Our final theorems show, however, that no provably correct operator on P can be proven (in S) to be discontinuous. (shrink)

When read alongside the great command of Deuteronomy, ‘love the Lord your God with all your heart, mind, and strength,’ the Judeo-Christian directive to ‘love your neighbour as yourself’ is perhaps one of the most theologically and ethically charged phrases in the Bible. In these two mutually reliant commandments lies a meeting point between the divine and the human that has important implications for our understanding of the nexus between theological conceptions of love and philosophical engagement with worldly existence. This (...) point of intersection is explored in a particularly unique way in the thinking of Michel Henry and Jean-Luc Nancy. In this article, I conduct the first sustained comparative analysis of their respective philosophies, using an exploration of the role of love and affectivity in their work to better understand the philosophical opportunity represented by the commandment to love God and neighbour.
