The aim of this comment is to discuss tentatively one way of understanding, for the study of legal phenomena, some of the implications of recognising the existence of peculiar entities which Celano calls pre-conventions. This comment speculates that, if Celano is right, then so-called paradigm cases of law lose some of their philosophical centrality. To study pre-conventions, one needs to collect accounts of situations in which relevant agents use criteria for identifying legal phenomena that only approximate valid sources of law. (...) To provide such accounts, the traditional informational focus of a philosophical analysis of law also needs, this comment further speculates, substantial broadening: if pre-conventions are in the body, then that is where we need to look if we want to study them. Greek ancient and early modern geometry necessarily uses diagrams. Among other things, these enter geometrical analysis. The paper distinguishes two sorts of geometrical analysis and shows that in one of them, dubbed “intra-confgurational” analysis, some diagrams necessarily enter as outcomes of a purely material gesture, namely not as result of a codifed constructive procedure, but as result of a free-hand drawing.

El presente artículo analiza el concepto de Diferencia en la filosofía de Gilles Deleuze. Se constata, en este sentido, que la dicotomía inmanencia-trascendencia juega un papel protagónico en la articulación de dicha propuesta. Si bien un plano de composición inmanente no entra en una dialéctica negativa de tipo hegeliano respecto a un plano de organización trascendente, la primacía del primero resulta evidente en la conceptualización de la diferencia. Así, analizaremos las tensiones generadas por dicho enfoque en lo concerniente al despliegue (...) de la diferencia como razón suficiente en un plano inmanente, lo cual nos llevará a problematizar este concepto desde un plano diferente; a saber, un plano inminente que emerge de forma silenciosa en el último trabajo de Gilles Deleuze. Nel suo intento di rinnovare il nostro modo di comprendere l’esistenza e questa stessa comprensione, Morin spiega una retorica affatto singolare che si contraddistingue per il ricorso ‘disinvolto’ a concetti filosofici e scientifici già consolidati, ma reinterpretati nel suo quadro concettuale, ed a termini da egli stesso coniati. Per tali ragioni, oltre che per le parole non italiane e quando è specificato altrimenti, mi servirò del corsivo tutte le volte che riferisco un concetto originale del filosofo francese. Ciò non solo (...) per mantenermi il più possibile fedele alla lettera dei suoi scritti ma anche e soprattutto per rendere l’intenzione locutoria, ovvero l’enfasi e a tratti la ‘drammaticità’ del suo discorso. Per tutte le citazioni, non solo di Morin, uso le virgolette doppie e tra parentesi quadre inserisco eventuali miei interventi. Le virgolette singole intendono il senso lato di un termine. Quando invece impiego concetti scientifici o filosofici nel significato tecnico che hanno acquisito all’interno del loro orizzonte disciplinare (quindi non nell’interpretazione di Morin, per intenderci), mi servo dei caporali. Una precisazione ulteriore merita il concetto di complessità organizzazionale che rientra tra quelli che hanno guadagnato a Morin la critica di abusare di neologismi. Tale concetto si propone di mettere in rilievo il carattere attivo e creativo della complessità. In francese questa differenza emerge chiaramente perché egli cambia organisation con organisaction. In italiano essa può rendersi per iscritto con organizz-azione ma nel parlato si può apprezzare meglio nell’attributo appunto organizzazionale. La messe di note a corredo del testo si propone, oltre che fornire ulteriori approfondimenti, confronti e una puntuale fonte bibliografica, di mettere in rilievo la coerenza che au fonde il «sistema» di idee elaborato da Morin mantiene al suo interno e, forse a dispetto delle sue stesse intenzioni, con il pensiero filosofico occidentale (fin dalla sua denominazione come metodo). Bank customers are not financial experts, and yet they make high-stakes decisions that can substantively affect personal wealth. Sooner or later, every individual has to take relevant investment decisions. Using data collected from financial advisors, bank customers and university students in Italy, this paper aims to reveal new insights about the decision processes of average non-expert investors: their investment goals, the information sets they consider, and the factors that ultimately influence decisions about investment products. Using four portfolio choice tasks based (...) on data collected directly from financial advisors and their clients, we find that most subjects used a limited set of information, ignoring factors that conventional economic models usually assume drive investor behavior. Furthermore, we suggest that non-compensatory decision-tree models, which make no trade-offs among investment features, are parsimonious descriptions of investor behavior useful for improving the organization of financial institutions and in policy contexts alike. The present contribute aims to reconstruct, using the methodology of intellectual history, the broad spectrum of metaphysical doctrines that Kant could know during the years of the formation of his philosophy. The first part deals with the teaching of metaphysics in Königsberg from 1703 to 1770. The second part examines the main characteristics of the metaphysics in the various handbooks, which were taught at the Albertina, in order to have an exhaustive overview of all metaphysical positions.

In this paper the author aims at showing that Kant’s awakening from the dogmatic slumber, often related to the reading of Hume, finds its full achievement only by means of the assimilation of the Aristotelian doctrines. If Hume provided a critique of the concept of “causality” conceiving it as a mere mental representation, in Kant’s opinion Aristotle provided a “new way” to conceive all the concepts of intellect, even though in a non-systematic way. Kant found the solution of his epistemological (...) problem in the peculiar Aristotelian tradition of Königsberg, according to which the categories are mental constructions or concepts of a mental order. Kant’s debt to Aristotelianism in the matter of the awakening is clear in his “terminological turn” of the years 1771-1772. In those years some important Aristotelian terms such as “category”, “schema”, “dialectic” and “analytic” appear for the first time. At that time, Kant’s awakening, influenced by Aristotelianism, was possible because the philosopher has been working as a librarian at the Schlossbibliothek, where he had at his disposal vast book holdings relating to the Aristotelian tradition. In his article, Kant ’s Ethics as a part of Metaphysics: a possible Newtonian Suggestion? With Some Comments on Kant ’s “Dream of a Seer”, Giorgio Tonelli suggests a possible relation between Isaac Newton’s conception of attraction and the metaphysical foundation of morals in the light of some considerations on Träume eines Geistersehers erläutert durch Träume der Metaphysik. In this paper, I argue that Immanuel Kant ’s notion of Ethics as a part of metaphysics does not simply derive from Newton (...) and his followers, it is also a philosophical necessity triggered by the development of Kant ’s system and his thought on spontaneity 2. I focus the attention especially on Kant ’s early writings of ethics, in which it is evident the breach with the tradition and the formation of the system. The fist part of the paper sketches the placement of ethics in Kant ’s pre-critical works and its status as science. The second part develops the systematic justification of Kant ’s insertion of ethics within metaphysics. The third part deals with the historical debate on soul-body’s relationship. The fourth and fifth parts account for the history of spontaneity and its reception in Kant ’s early writings. The last two, finally, deal with Kant ’s notion of ethics as part of metaphysics from 1770 to critical period. (shrink)

This article deals with the epistemology of Richard Burthogge. Friend and correspondent of Locke, Burthogge published two important epistemological treaties, the Organum Vetus & Novum and the Essay upon Reason, in which he developed a particular theory of knowledge close to idealism and conceptualism. In this theory he 1) elaborated an instrumental conception of logic; 2) limited the boundaries of reason to sensible experience; 3) conceived the mind as a center of activity, energy, and operations; 4) established that all sensible (...) knowledge is filtered by modi concipiendi, such as substance, quantity, quality, and causality; 5) stated that knowledge is merely phenomenal, namely it concerns only the objects as they appear and not as they really are; 5) established that objects have no reality and sense if not in relation to the mind and that they are framed by a priori rules that are constitutive of reason. The aim of the article is to examine in detail Burthogge's theory of knowledge and to show his original position within the historical and cultural setting of his time. (shrink)

The paper aims to examine straightforwardly Thomas White’s Sciri, sive Scepticeset scepticorum jure disputationis exclusio and to contextualise it in the broadest intellectual framework of the seventeenth-century Aristotelianism. From the examination of the Exclusio we can see the novelty and freshness of White’s Aristotelian positions in attacking all kinds of scepticism. These originalities are the subject of the present article, rather than the well-known controversy with Joseph Glanvill.

What did it mean to “vulgarize” in Renaissance Italy? Was it simply a matter of translating into the vernacular, or did it mean making a text more accessible to the people – to in some sense popularize it? The answer is far from simple and certainly never one-sided; therefore, each individual case needs to be independently assessed on its own merits. This article seeks to shed some light at least on the major treatments of the theory of vulgarization by the (...) likes of Ludovico Castelvetro, Faustus Longianus, Francesco Robortello, Alessandro Piccolomini, Orazio Toscanella and Girolamo Catena, which were central to the debate from the 1540s onwards.
