This paper has a twofold scope. The first one is to clarify and put in evidence the isomorphic character of two theories developed in quite different fields: on one side, threshold logic, on the other side, simple games. One of the main purposes in both theories is to determine when a simple game is representable as a weighted game, which allows a very compact and easily comprehensible representation. Deep results were found in threshold logic in the sixties and seventies for (...) this problem. However, game theory has taken the lead and some new results have been obtained for the problem in the past two decades. The second and main goal of this paper is to provide some new results on this problem and propose several open questions and conjectures for future research. The results we obtain depend on two significant parameters of the game: the number of types of equivalent players and the number of types of shift-minimal winning coalitions. (shrink)

Cet article propose un nouvel examen de l'image d'Alexis Ier Comnène dans l'Historia Ierosolimitana d'Albert d'Aix, afin d'en apprécier les nuances et les subtilités. Bien qu'Albert d'Aix soit reconnu pour son impression généralement positive d'Alexis Ier, une relecture attentive de son œuvre démontre plutôt une image ambivalente de l'empereur et des Byzantins. En scrutant les motifs d'Albert d'Aix, il est possible de constater une disposition favorable du chroniqueur lorsqu'il s'agit de souligner les relations privilégiées entre Alexis Ier et les souverains (...) lotharingiens de Jérusalem. En contrepartie, lorsque les Byzantins ne répondent plus à ce besoin, l'opinion de l'auteur se veut généralement moins clémente en reflétant davantage les accusations dirigées contre les Grecs au début du XIIe siècle. Un examen du vocabulaire employé par Albert d'Aix révèle également une évolution des impressions du chroniqueur à travers les différentes phases d'écriture de son récit et témoigne de l'évolution des desseins politiques de l'auteur dans le temps. Bien que l'Historia Ierosolimitana se distingue à bien des égards de la tradition des Gesta Francorum et des autres récits de la première croisade, l'étude conclut que les intentions de son auteur n'étaient pas moins tendancieuses. Dans la pensée philosophique d'Emmanuel Levinas, le mot « Dieu » n'est pas inaudible. Il peut venir à l'idée. Il peut tomber sous le sens – en deçà de tout sens thématisé, à revers des prétentions souveraines de la conscience. À la condition toutefois que parvienne à être décrite l'intrigue anarchique que ce mot noue dans l'idée de l'Infini, dans le Visage, dans la Kénose du sujet, dans le Dire du verset ou l'Emphase de la métaphore.Les articles recueillis dans cet (...) ouvrage tentent, sous ces divers aspects, de décrire l'inouïe Transcendance de ce mot « Dieu » désormais arraché à toute archê – à tout fondement onto-théo-logique. Ils se hasardent aussi à suggérer les résonnances théologiques et bibliques de cet « autrement dire Dieu » préservant l'anarchie du Transcendant. According to the Theory of the Second Best, in non-ideal circumstances, approximating ideals might be suboptimal (with respect to a specific interpretation of what “approximating an ideal” means). In this paper, I argue that the formal model underlying the Theory can apply to problems in epistemology. Two applications are discussed: First, in some circumstances, second-best problems arise in Bayesian settings. Second, the division of epistemic labour can be subject to second-best problems. These results matter. They allow us to evaluate the (...) claim, made by many philosophers, that second-best problems have import in epistemology (and the specific conditions under which the Theory finds applications). They also allow us to see that talk of “approximating an ideal” is ambiguous, and to clarify the conditions in which approximating an epistemic ideal might be beneficial. (shrink)

The Food and Drug Administration authorizes the marketing of a drug only for uses that the manufacturer has demonstrated to be safe and effective, based on evidence from at least two clinical trials. However, the FDA does not regulate the practice of medicine, so physicians may prescribe drugs in any manner they choose. Prescribing drugs in ways that deviate from the uses specified in the FDA-approved drug label, package insert, and marketing authorization is referred to as off-label prescribing. This occurs (...) when physicians prescribe a drug for a therapeutic purpose other than the one approved by the FDA; treat patients in a different age cohort or gender than the population on which it was tested; or prescribe a different dose, for a different duration of use, or a different mode of administration than indicated on the label. L’une des fonctions des institutions publiques des démocraties libérales est de formuler des recommandations à l’attention des décideurs. Or, les institutions publiques savent que leurs recommandations seront souvent ignorées en partie par le décideur. Cette situation de « conformité partielle » aux recommandations soulève plusieurs problèmes de nature philosophique pour les institutions. En nous appuyant sur une analyse de 570 recommandations tirées de 40 documents et rapports du secteur public québécois, nous identifions deux enjeux entourant la structure des recommandations issues (...) du secteur public. This article argues that the misalignment of private profit-maximizing objectives with public health needs causes institutional corruption in the pharmaceutical sector and systematically leads firms to act contrary to public heath. The article analyzes how financial incentives generate a business model promoting harmful practices and explores several means of realigning financial incentives in order to foster therapeutic innovation and promote the rational use of medicines.

Models of cognitive vulnerability claim that depressive symptoms arise as a result of an interaction between negative affect and cognitive reactions, in the form of dysfunctional attitudes and negative inferential style. We present a model that complements this approach by focusing on the appraisal processes that elicit and differentiate everyday episodes of emotional experience, arguing that individual differences in appraisal patterns can foster negative emotional experiences related to depression (e.g., sadness and despair). In particular, dispositional appraisal biases facilitating the elicitation (...) of these emotions more frequently and more intensely. This, in turn, is likely to have a negative influence on cognitive processing and emotion regulation in general. (shrink)

Television series explicitly pursue an entertainment goal rather than a learning one; nevertheless, they convey information about care. French and American series depicting doctors and care workers have reached record-breaking audiences. Spectators try to understand care as an activity through dramatic situations. They are all the more curious and liable to consider the activity of the nurses as a vicariant model that they wish to become a doctor or a care worker. Which behaviors get the spectators’ attention? Which reasoning do (...) they deduce from them? Does the paramedical training then modify the representations they form about care and the nursing profession while watching television series? On 4 December 2006, during discussions on the Corporate Manslaughter and Corporate Homicide Bill, Andrew Dismore, Member of Parliament and then Chair of the Joint Committee on Human Rights, said, ‘Organisations can kill people … but it is the actions and omissions of people in organisations that cumulatively cause death’. However, the corporate entity is a vehicle for the communal actions of those who guide the business activities. Attempting to seek out persons or people that are solely responsible for deaths (...) and violations of human rights caused by companies is fruitless. The entity is a vehicle for those actions, it possesses its own, often deep, pockets of finance and resources, and it has a public image. It is more useful to punish the corporate entity, in instances where the corporate behaviour has led to death and human rights abuses, as it is in seeking out individual defendants. Soft law options have not brought about a sufficient reduction in instances of deaths caused by corporate behaviour across jurisdictional borders. This article will argue that the time has now come to establish an international hard law on corporate killing, and for states to ensure that there is a viable path towards a redress for victims and their families along with adopting a duty to assist the victim or their family to pursue redress to ensure a fair balance of power against transnational companies. Clinical Legal Education programmes now take place in most law schools in England and Wales. However, legal education continues to be predominantly focused on the analysis and application of rules, doctrines, and theories to hypothetical scenarios or essay questions. This form of pedagogy either minimises or ignores the role of the client in terms of supplying lawyers with knowledge pertinent to their case. In other words, it overlooks the fact that the lawyer’s acquisition of knowledge is not confined to technical (...) rationality. This article seeks to achieve three broad aims. First, to contribute to the debate concerning the epistemology of reflective practice. Second, to develop a theoretical reflective cycle, informed by Kant’s transcendental idealism, which seeks to maximise knowledge acquisition in legal education, namely knowledge supplied by the client. Third, to address implicit bias using the proposed reflective cycle. An optimal pedagogy for using this cycle is Clinical Legal Education, namely live client clinics. (shrink)

Current debates in Clinical Legal Education (CLE) exclude essay writing as a legitimate form of ‘clinical’ pedagogy. This article argues that essay writing should be classified as a form of CLE due to its potential to mirror legal practice and enhance students' reflective capacities. By incorporating Hegelian dialectical reasoning, the paper proposes a structured approach to legal essay writing that includes thesis, antithesis, and synthesis. This method encourages students to engage deeply with legal arguments, reflecting on their merits and counterarguments. (...) The dialectical approach aligns with constructivist teaching methodologies, promoting critical thinking and practical skills relevant to legal practice and beyond. The article outlines the theoretical basis of this model and provides a practical framework for its implementation in legal education. It further connects this pedagogical strategy to the development of transferable skills that prepare students for professional legal environments. Through this dialectical method, the paper advocates for a more holistic and nuanced understanding of legal concepts, bridging the gap between academic theory and practical application, and, thus, making the case for the incorporation of Hegel-inspired essay writing into the definition of CLE. What defence does the Narrative Practice Hypothesis have against the charge that it is a covert form of externalist theory theory ? I discuss and reject Dan Hutto's own strategies and argue that the NPH remains vulnerable to a threat of collapse into externalist TT as long as narrative folk-psychological explanation is differentiated from simple belief-desire explanation merely by a degree of complexity, subtlety and/or context-sensitivity. It is entirely plausible, however, that there is a more principled distinction between these two (...) types of explanation of human behaviour. I defend such a distinction and show how it eliminates the threat of collapse into TT entirely. (shrink)
