This paper looks at the specific proposed amendments to European directive 2007/36/EC and 2013/34/EU, and evaluates as to how such amendments alter shareholders’ moral responsibilities. To be responsible is here simply to be understood as being under an obligation, where an obligation is a requirement on an agent to either act or refrain from acting in a given way. In order to determine whether changes to the proposed directives alter shareholders’ moral responsibilities the following analysis argues that we need to (...) look at three factors: whether such changes do in fact alter the subject matter of shareholders’ obligations, a closer look at the agent i.e. shareholders to whom the obligation is to apply and thirdly whether they do actually apply. In this paper I argue that Christopher Kutz misapplies his theory of joint action when he attributes shareowners responsibilities on the basis of their intentional participation in the corporations in which they invest. Instead I propose that his theory of joint action should be used to attribute shareowners responsibilities on the basis of their intentional participation in the stock market. If shareholders’ accountability is grounded in their intentional participation in the stock market, then shareholders cannot take responsibility for corporation’s individual (...) actions. Instead they are solely responsible for the benefits they gain from holding shares if these are a result of moral wrongdoing and for this they should be held accountable. (shrink)

In recent years, a significant body of literature has emerged on the subject of epistemic injustice: wrongful harms done to people in their capacities as knowers. Up to now this literature has ignored the role that attention has to play in epistemic injustice. This paper makes a first step towards addressing this gap. We argue that giving someone less attention than they are due, which we call an epistemic attention deficit, is a distinct form of epistemic injustice. We begin by (...) outlining what we mean by epistemic attention deficits, which we understand as a failure to pay someone the attention they are due in their role as an epistemic agent. We argue that these deficits constitute epistemic injustices for two reasons. First, they affect someone’s ability to influence what others believe. Second, they affect one’s ability to influence the shared common ground in which testimonial exchanges take place. We then outline the various ways in which epistemic attention deficits harm those who are subject to them. We argue that epistemic attention deficits are harms in and of themselves because they deprive people of an essential component of epistemic agency. Moreover, epistemic attention deficits reduce an agent’s ability to participate in valuable epistemic practices. These two forms of harm have important impacts on educational performance and the distribution of resources. Finally, we argue that epistemic attention deficits both hinder and shape the development of epistemic agency. We finish by exploring some practical implications arising from our discussion. We discuss the semantic significance of a puzzle concerning ‘ought’ and conditionals recently discussed by Kolodny and MacFarlane. We argue that the puzzle is problematic for the standard Kratzer-style analysis of modality. In Kratzer’s semantics, modals are evaluated relative to a pair of conversational backgrounds. We show that there is no sensible way of assigning values to these conversational backgrounds so as to derive all of the intuitions in Kolodny and MacFarlane’s case. We show that the appropriate verdicts can be (...) derived by extending Kratzer’s framework to feature a third conversational background and claiming that the relevant reading of ‘ought’ is sensitive to this parameter. Driving licenses, identity cards, passports, boarding passes, credit cards, ATM cards – all of these are examples of credentials. Credentials are documents that play a fundamental role in all modern societies. However, philosophers and social ontologists have not yet addressed the analysis of their nature and function. This paper aims to fill this gap through a review of the essential characteristics of credentials, as documents whose primary purpose is to certify the identity and institutional status of the bearer, for example (...) as being the bearer of specific rights. However, credentials also allow their holders the concrete exercise of their rights, as when exercising a right concretely (e.g., crossing a border) requires the possession of a particular credential. Background: Ethical and legal issues are increasingly being reported by health caregivers; however, little is known about the nature of these issues in geriatric care. These issues can improve work and care conditions in healthcare, and consequently, the health and welfare of older people. Aim: This literature review aims to identify research focusing on ethical and legal issues in geriatric care, in order to give nurses and other health care workers an overview of existing grievances and possible solutions to take (...) care of old patients in a both ethical and legally correct way. Methods: Using a systematic approach based on Aveyard, a search of the PubMed, CINAHL, and Ethicshare databases was conducted to find out the articles published on ethical and legal issues in geriatric care. Ethical considerations: The approval for the study was obtained from UMIT-The Health and Life Sciences University, Austria. Results: Only 50 articles were included for systematic analysis reporting ethical and legal issues in the geriatric care. The results presented in this article showed that the main ethical issues were related to the older people’s autonomy, respect for their needs, wishes and values, and respect for their decision-making. The main legal issues were related to patients’ rights, advance directives, elderly rights, treatment nutrition dilemma, and autonomy. Conclusion: Further education for professional caregivers, elderly people, and their families is needed on following topics: care planning, directive and living wills, and caregiver-family member relationships to guide and support the elderly people within their decision-making processes and during the end-of-life care. Many studies examine a stressors-professional burnout (PB) relation, but only few consider the role of ethical conflicts (ECs) in this context. The aim of this study was to characterize ECs' frequency and level of burden with them among nurses and to establish the relations between ECs' frequency, burden and PB. One hundred nurses participated in this study. ECs' frequency and burden were tested with an originally developed questionnaire. PB was examined with Maslach Burnout Inventory. Most frequent ECs concerned a nurse-patient (...) relationship. PB was positively related to ECs' frequency (r = .54; p = .001) and burden (r = .22; p = .03). Frequency of specific conflict did not imply burden with it and vice versa. ECs' frequency seems more important for PB than a level of burden with them. The most frequent and the most burdening conflicts may lead to development of PB but the less frequent and less burdening ones are also dangerous. (shrink)

According to Conceptualism, philosophy is an independent discipline that can be pursued from the armchair because philosophy seeks truths that can be discovered purely on the basis of our understanding of expressions and the concepts they express. In his recent book, The Philosophy of Philosophy, Timothy Williamson argues that while philosophy can indeed be pursued from the armchair, we should reject any form of Conceptualism. In this paper, we show that Williamson’s arguments against Conceptualism are not successful, and we sketch (...) a way to understand understanding that shows that there is a clear sense in which we can indeed come to know the answers to (many) philosophical questions purely on the basis of understanding. A report on the conference “Ecosemiotic Paradigm for Nature and Culture”.

Keeping a conversation going is the social glue of friendships. The DSM criteria for autism list difficulties with back-and-forth conversation but does not necessitate that all autistic children will be equally impacted. We carried out three studies (two pre-registered) with verbally-fluent school children (age 5-9 years) to investigate how autistic and neurotypical children maintain a conversation topic. We also investigated within-group relationships between conversational ability and cognitive and socio-cognitive predictors. Study 1 found autistic children were more likely than neurotypical controls (...) to give off-topic and generic minimal responses (e.g. ‘mm’, ‘oh’) and were less likely to give non-verbal responses (e.g. nodding or use of facial affect to respond). Nonetheless, the autistic group provided topic-supporting responses 62% of the time, indicating some aspects of conversation topic maintenance are a relative strength. Studies 2 and 3 found large individual differences in topic-supporting conversational responding amongst both neurotypical and autistic children. These were positively related to theory of mind ability and age in both groups. Conversational skills lie on a continuum for the general population and differences by diagnostic group are a matter of degree. Given the importance for peer relationships, we suggest a whole-classroom approach to supporting conversation skills in all children. (shrink)

Cultural norms may dictate how grief is displayed. The present study explores the display behaviours and rules in the bereavement context from a cross-cultural perspective. 86 German-speaking Swiss and 99 Chinese bereaved people who lost their first-degree relative completed the adapted bereavement version of the Display Rules Assessment Inventory. Results indicated that the German-speaking Swiss bereaved displayed more emotions than the Chinese bereaved. The Chinese bereaved, but not the German-speaking Swiss bereaved, thought that bereaved people should display more emotions than (...) they actually did when they were with their close others (but not when they were alone). Bereaved people endorsed more emotional expression “when alone” than “when with close others”, demonstrating a social disconnection tendency, which was more evident in the Chinese sample. Bereaved people endorsed more expression of positive emotions (e.g. affection/love) and less expression of powerful negative emotions (e.g. blame/guilt, anger) across cultures. Compared to their Chinese counterparts, the German-speaking Swiss sample indicated more actual expressions for most emotion types (i.e. joy/happiness, affection/love, sadness, anger, and denial) but thought bereaved people should express more joy/happiness and less blame/guilt. The results suggest that bereaved people’s display behaviours and rules are influenced by culture, situation, and type of emotion. (shrink)

Many women are initially unable to contract the pelvic floor muscles (PFMs) properly, activating other muscle groups before, or instead of, PFM. Numerous authors have proved that biofeedback can be an ideal tool supporting learning of the PFM contraction. However, there is currently a lack of scientific data on how many biofeedback sessions are necessary in this educational process. In this study we aimed at assessing the effects of one-time electromyography (EMG) biofeedback session on the order in which PFM are (...) activated (so called firing order) during conscious contractions in relation to selected synergistic muscles in pregnant, continent women. A randomized controlled trial was conducted in 90 healthy nulliparous women with uncomplicated pregnancies and without diagnosed urinary incontinence. We divided the participants into a biofeedback group (50) and a control group (40). They were, respectively: 30 ± 4 and 30 ± 4 years old, at their 23 ± 5 or 25 ± 7 week of gestation and presented 23 ± 5 or 24 ± 5 kg/m2 BMI value (M + SD). Surface EMG with vaginal probes has been used to assess the PFM firing order in selected tasks: in five 3-s maximal contractions (quick flicks), five 10-s contractions, and in a 60-s contraction (static hold). We used the 1–5 scale, where “1” meant the best score, awarded when PFM was activated first in order. The most important finding of our study is that a single EMG biofeedback substantially improved the PFM contractions in pregnant women. First, when applying one-time biofeedback session, more women maintained correct technique or improved it in the second assessment, compared to the control group (73 vs. 65%). Secondly, using the quantitative and qualitative analysis with the Chi-square McNamara B/C test, in the biofeedback group we observed a statistically significant improvement of PFM firing order in four tasks: in the first quick flicks (p = 0.016), third quick flicks (p = 0.027), fifth quick flicks (p = 0.008), and in the first 10-s contractions (p = 0.046). In the control group we observed better outcome only in one motor task: in the fourth 10-s contraction (p = 0.009). Given the positive effects of a single session of EMG biofeedback on the firing order in the PFM contractions, it should be recommended for pregnant women without urinary incontinence to teach them how to perform PFM exercises correctly. This book is devoted to the reintroduction of the remarkable approach to sociological inquiry developed by Harvey Sacks. Sacks's original analyses - concerned with the lived detail of action and language-in-interaction, discoverable in members' actual activities - demonstrated a means of doing sociology that had previously seemed impossible. In so doing, Sacks provided for highly technical, detailed, yet stunningly simple solutions to some of the most trenchant troubles for the social sciences relating to language, culture, meaning, knowledge, action, and social (...) organisation. In this original collection, scholars working in a range of different fields, including sociology, human geography, communication and media studies, social psychology, and linguistics, outline the ways in which their work has been inspired, influenced, and shaped by Sacks's approach, as well as how their current research is taking Sacks's legacy forward in new directions. As such, the collection is intended to provide both an introduction to, and critical exploration of, the work of Harvey Sacks and its continued relevance for the analysis of contemporary society. This paper develops themes addressed in an article by Eric Wiland in the Journal of Medical Ethics 2000;26:466–8, where he aims to contribute to the debate concerning the moral status of abortion, and to emphasise the importance of analogies in moral argument. In the present paper I try to secure more firmly a novel understanding of why analogy is an essential component in the attempt to justify moral beliefs. I seek to show how analogical argument both encapsulates and exercises the (...) notions of rationality and imagination and that the construction, development, and comparison of analogies fundamentally underpins ethical argument. In so doing, it enables us to adopt imaginative and ethically illuminating perspectives but in a manner that does not relinquish any claims to intellectual rigour. I present a critique of a brand of “moral particularism” by showing how it cannot, if construed in a certain way, adequately conceive of how we use analogies and imaginary cases in ethics. Although such a particularism is thus impotent with regard to ethical debate, I show that the wider motivation behind particularism that can be extracted is of clear relevance and importance to medical practitioners. ABSTRACT This article examines Buddhist teachings relevant to the regulation of war and compares them with international humanitarian law (IHL) and the just war tradition by which it has been informed. It argues that Buddhist ethics broadly align with IHL rules to minimise harm inflicted during war, and that Buddhism’s psychological resources can help support IHL to improve compliance with common humanitarian norms. Indeed, Buddhist mindfulness techniques can support even non-Buddhist combatants by enhancing their psychological resilience and capacity to fight (...) with skill and restraint. While IHL is a legal regime that legitimises violence under certain conditions, and lays down clear universally ratified rules, Buddhism is primarily an ethical and psychological system that addresses the motivations and inner roots of behaviour and can be understood and interpreted in different ways. In this respect, Buddhism overlaps with the field of military ethics, and can contribute much to enhance military training. However, while the centrality of non-harming (ahiṃsā) to Buddhism dictates that extraordinary efforts should be made to prevent war or otherwise minimise the harm inflicted – thereby checking interpretations of IHL that are overly permissive – Buddhism’s consequent reluctance to legitimise and thereby institutionalise war, and the ambiguity of its teachings in this regard, have generally precluded it from developing clear just war guidelines for belligerents to follow, and Buddhist resources to improve the conduct of hostilities have remained largely untapped. Mainstream traditions of Buddhist ethics must also be distinguished from more esoteric and localised beliefs and practices, and from the lived Buddhisms with which most lay Buddhists are more familiar, which do not necessarily embody the same degree of restraint. Belligerents might therefore have different conceptions or expectations of Buddhism depending on their culture and particular circumstances, or be unclear about what it says on the conduct of war. Realism as an explanatory theory of science (faded realism) is not convincing. However, neither "internal realism" nor instrumentalism are plausible. Assuming common sense realism a non-explanatory form of scientific realism (modest realism) can be defended. Modest realism has affinities with Fine's NOA. To NOA it adds a descriptive thesis about scientific progress towards truth or verisimilitude. In addition it adds a concern with purely philosophical issues which arise in reflections on the nature of science. After a critical analysis of Simone de Beauvoir’s and Catherine Malabou’s accounts of aging, the paper offers an alternative to them. In contrast to de Beauvoir and Malabou, it explores the actual share of other beings, both human and non-human, in one’s aging. The paper employs the Heideggerian ontological framework and his concepts of “bodying” and gesture to argue that changes induced by others do not damage or contaminate one’s being but allow the disclosure of someone’s particularity in its undefinable (...) character. Bis vor wenigen Jahren hätte ein Beitrag zur Familienethik mit einem Hinweis darauf begonnen, dass es sich dabei um ein philosophisches Forschungsdesiderat handelt. In der Zwischenzeit hat sich die Situation merklich verändert: Zahlreiche Sammelbände, Monographien und Aufsätze zeugen davon, dass sich die Familienethik zunehmender Beachtung erfreut und die Beziehung zwischen Eltern und Kindern ebenso wie die Rechte und Pflichten von Eltern und Kindern untereinander eine eingehendere Analyse verdienen. In dieser Einleitung werden einige gesellschaftliche und innerphilosophische Entwicklungen skizziert, die zur zunehmenden (...) Beachtung der Familienethik geführt haben. Abstrakt Analizy w zakresie starogreckich znaczeń słowa pathos skłaniają do postawienia tezy, że należy mówić o czterech głównych kontekstach, które ukształtowały rozumienie tej kategorii: o kontekście retorycznym, etycznym, tragicznym i emotywnym (passio). Chociaż wszystkie cztery wspomniane obszary pozostawały względem siebie stosunkowo niezależne, modyfikując sens pojęcia pathos w czasem bardzo odległych rejestrach czasowych, to można wskazać pewien wspólny rdzeń, determinujący charakter omawianej kategorii: mianowicie jej inherentną zakłóceniowość, kryzysogenność i afektywność. Pozostaje on w ścisłej relacji z odniesieniem patosu do doświadczeń bolesnych, nagłych, (...) zadziwiających, a także – tak, jak w ślad za Grekami czyni to Waldenfels – do stanów pasywnych, z których podmiot, pod wpływem patycznego ugodzenia, wybudza się jako żywo reagujący, cielesny „respondent”. Celem niniejszego artykułu jest prześledzenie owych starożytnych źródeł patosu i wskazanie ich współczesnych reminiscencji, rozbrzmiewających w Waldenfelsowskiej fenomenologii responsywnej. Struktura tekstu jest następująca: w pierwszej części przyglądamy się historycznym zastosowaniom pojęcia pathos (głównie w ramach tradycji greckiej); w części drugiej analizujemy patos pod kątem zdziwienia, uchodzącego według Platona i Arystotelesa za akt inicjujący myślenie filozoficzne; w części trzeciej, poświęconej fenomenologii Waldenfelsa, prezentujemy afektywny i cielesny wymiar doświadczenia patycznego, zradykalizowanego zarówno względem kartezjańskiego dualizmu, jak i Husserlowskiej teorii autoafekcji; w części czwartej powracamy do wyróżnionych wcześniej historycznych kontekstów patosu, aby pokazać, w jaki sposób Waldenfels na gruncie fenomenologii responsywnej aktualizuje je w ramach swojej polemiki z „klasycznymi” ujęciami doświadczenia i emocji. This article presents an overview of generally available applications for creating multimedia and interactive educational materials, such as presentations, instructional videos, self-tests and interactive repetitions. With the use of the presented tools, pilot materials were developed to support the teaching of biostatistics at a medical university. The authors conducted surveys among students of faculties of medicine in order to evaluate the materials used in terms of quality and usefulness. The article presents the analysis of the results obtained.

Background Teamwork in emergency medical services is a very important factor in efforts to improve patient safety. The potential differences of staff gender on communication, patient safety, and teamwork were omitted. The aim of this study is to evaluate these inadequately examined areas. Methods A descriptive and anonymous study was conducted with an online questionnaire targeting emergency physicians and paramedics. The participants were asked about teamwork, communication, patient safety and handling of errors. Results Seven hundred fourteen prehospital professionals from all (...) over Germany participated. A total of 65.7% of the women harmed a patient (men 72.9%), and 52.6% were ashamed when mistakes were made (men 31.7%). 19.0% of the female participants considered their communication skills to be very good, compared to 81% of the men. More women than men did not want to appear incompetent (28.4%, 15.5%) and therefore did not speak openly about mistakes. Both genders saw the character of their colleagues as a reason for poor team communication (women 89.4%, men 84.9.%). Under high stress, communication decreased (women 35.9%, men 31.0%) and expression became inaccurate (women 18.7%, men 20.1%). Conclusions Team communication problems and teamwork in rescue services are independent of gender. Women seem to have more difficulty with open communication about mistakes because they seem to be subject to higher expectations. Work organization should be adapted to women’s needs to enable more effective error management. We conclude that it is necessary to promote a positive error and communication culture to increase patient safety. (shrink)

This article explores how ministerial and leadership formation could be enabled to adopt transformational diaconia in addressing poverty in South Africa, engaging in ways in which pastoral care and leadership formation can respond to the addressing of poverty. The fact that transformation aims at changing the worldviews, paradigms and approaches to life and problem solving informs the author’s concept of transformational diaconia, which was proposed as an aspect of spiritual leadership capital (SLC), defined as, ‘The inner virtues afforded individuals by (...) their spirituality in formulating their leadership paradigms which contributes to social capital formation for addressing social problems’. Spiritual leadership capital is hereby argued to be a transformative spirituality that can enable an understanding and sustainable responses to poverty and other social problems. This is needed for Africa and particularly for the present day South Africa, seemingly a country with the best infrastructure in Africa; yet its poverty seems pronounced because the dregs of apartheid still lurk in the social fibre, where poor people blame rich people for their plight and vice versa. Bowers Du Toit’s view that ‘[m]ost congregations respond to poverty by providing relief and not empowerment’, re-echoes here. From a mixed-methods research, SLC is a theory recently advanced as a congregational development paradigm and a theology of poverty, which views public theology as an educative praxis that can respond to transformational needs in poverty-related contexts. The authors suggest that for a Church that is responsive to the plight of society, fresh empowerment approaches to address poverty are needed. (shrink)
