The Supreme Court of Canada has established that commercial speech is protected under the Canadian Charter of Rights and Freedoms and that commercial speech exists along a continuum of utility and value, which is balanced against objectives such as public health. This article examines jurisprudence to determine when infringements on commercial speech are acceptable, analyzing considerations of evidence, rational connections between policies and outcomes, proportionality, and minimal impairment.

Research involving transgender and gender diverse people (TGD) increased in the last years, mostly concerning healthcare associated to this population. Few studies dedicated their analysis to the impact of parental support on transgender people, even though this is an important aspect in creating a safe environment on which these individuals can build their identity. In addition, the link between family support, TGD identity and homelessness is not completely established. Thus, due to the specificities of the family context of TGD individuals, (...) the aim of this study is to investigate the association between family support and TGD in different moments of the process of gender affirmation. In addition, this study also aims to explore the relationship between a lack of social support and low self-esteem, home abandonment, and dwelling in the street. The survey was designed based on the TransPULSE project and was made available in electronic format. The sample was constituted of 423 TGD residents in two Brazilian states. A Structural Equation Model analysis suggested that the impact of gender affirmation status on homelessness was mediated by parental support, through self-esteem, and the need to move from home. The association between the status of the gender affirmation procedures, family support and self-esteem was significant and indicated that the further TGD individuals advanced in gender affirmation, the more self-esteem and family support they would have. The association between family support and self-esteem indicated that family support was associated with higher self-esteem. Low family support was associated with the willingness to move from home due to one’s TGD status and there was also a significant correlation between low self-esteem and the willingness to move from home due to one’s TGD status. Finally, homelessness was associated with the willingness to move with a large effect size. Limitations include the sample that was constituted by individuals with Internet access and who had more contact with TGD communities. The findings indicate directions for interventions involving TGD people and their families, considering the parental relationship as a critical variable to improve TGD quality of life in the process of gender affirmation. In 2001, Le Bars proved that there exists an existential monadic second-order sentence such that the probability that it is true on [Formula: see text] does not converge and conjectured that, for EMSO sentences with two first-order variables, the zero–one law holds. In this paper, we prove that the conjecture fails for [Formula: see text], and give new examples of sentences with fewer variables without convergence.

Background Health care professionals have to judge the appropriateness of treatment in critical care on a daily basis. There is general consensus that critical care interventions should not be performed when they are inappropriate. It is not yet clear which chances of survival are considered necessary or which risk for serious disabilities is acceptable in quantitative terms for different stakeholders to start intensive care treatment. Methods We performed an anonymous online survey in a random sample of 1,052 participants recruited via (...) email invitation and social media. Age, sex, nationality, education, professional involvement in health care, critical care medicine and treatment decisions in critical care medicine as well as personal experience with critical illness were assessed as potential influencing variables. Participants provided their opinion on the necessary chances of survival and the acceptable risk for serious disabilities to start a high-risk or uncomfortable therapy for themselves, relatives or for their patients on a scale of 0–100%. Results Answers ranged from 0 to 100% for all questions. A three-peak pattern with different distributions of the peaks was observed. Sex, education, being a health care professional, being involved in treatment decisions and religiosity influence these opinions. Male respondents and those with a university education would agree that a risky and uncomfortable treatment should be started even with a low chance of survival for themselves, relatives and patients. More respondents would choose a lower necessary chance of survival when deciding for patients compared to themselves or relatives to start a risky and uncomfortable treatment. On the other hand, the majority of respondents would accept only a low risk of severe disability for both themselves and their patients. Conclusion No cut-off can be identified for the necessary chances of survival or the acceptable risk of disability to help quantify the “inappropriateness” of critical care treatment. Sex and education are the strongest influencing factors on this opinion. The large variation in personal opinions, depending on demographic and personality variables and education needs to be considered in the communication between health care professionals and patients or surrogates. In Chinese scholarship, Xunzi is often regarded as an eclectic Confucian master who accepted some form of utilitarian thoughts (e.g. Fung Yu-lan, Mou Zongsan and Xu Fuguan). This characteristic was also observed by some western scholars such as Benjamin I. Schwartz. In a recent study, I argued that the basic character of Xunzi’s philosophy is utilitarianism in a broad sense based on an examination on his intellectual criticism and political criticism. Xunzi asserts that humans are innately driven by self-interested desires, (...) and he evaluates all intellectual works and political behaviours by their utility. However, he does not limit utility to only basic animal desires such as food and sex. In Xunzi’s view, humans also have innate emotions; hence, these emotions should also be accounted for in their utility. This is similar to John Stuart Mill’s redefinition of Bentham’s concept of utility. Are Xunzi’s and Mill’s concepts of utility exactly the same? This question has yet to be examined. This article is a comparative study between utilitarianism and Xunzi’s philosophy which especially explores the compatibility of these two philosophies. (shrink)

The usual definition of (non-contextual) hidden variables is found to be too restrictive, in the sense that, according to it, even some classical systems do not admit hidden variables. A more general concept is introduced and the term “approximate hidden variables” is used for it. This new concept avoids the aforementioned problems, since all classical systems admit approximate hidden variables. Standard quantum systems do not admit approximate hidden variables, unless the corresponding Hilbert space is 2-dimensional. However, an appropriate non-standard quantum (...) system, which arises by focussing on momentum and position and neglecting the remaining observables, admits approximate hidden variables. Systems associated with JBW-algebras (resp. von Neumann algebras) and satisfying some mild conditions admit approximate hidden variables iff they are classical, that is, iff the corresponding JBW-algebra (resp. von Neumann algebra) is associative (resp. commutative). A logically perfect language must meet following requirements: (i) it must not contain „empty“ expressions designating nothing and (ii) it must not involve phrases that are synonymous, homonymous etc. According to Frege, the meaning of a compound expression is a function of meanings of its components, i.e. the meaning of an expression consisting of a functional phrase and a name is the value of the function for the argument. However, for some arguments a function need not give values and, hence, (...) some compound phrases designate nothing in spite of the fact that every simple expression does designate something. Frege’s construction of a logically perfect language fails because it violates condition (i). According to Wittgenstein, every language is logically perfect; otherwise it cannot represent the world. Every expression, simple or compound, does designate something; the meaning of a compound expression consists of meanings of its components; the structure of a complex expression’s meaning mirrors, when completely analysed, the syntactic structure of the expression. Wittgenstein distinguishes between language and notation and we are supposed to look for a logically perfect notation that does not contain homonymy or synonymy. However, following some ideas from Tractatus, it can be shown that Wittgenstein cannot eliminate these phenomena and, hence, violates condition (ii). (shrink)

The paper deals with the understanding of proper names. Though the theme goes across various disciplines – e.g. semantics, epistemology, psychology – the paper examines only selected semantic and cognitive aspects of the problem. The question runs: How should we comprehend the thesis of understanding a proper name as knowing what the name refers to? What kind of knowledge is involved here? The question is posed within the direct reference theory framework enriched by the notion of singular proposition and the (...) compositionality principle. The distinction between an expression and an utterance of it is accepted and the original question is split up accordingly. As for expressions , to understand a proper name is to grasp a meaning axiom along the lines of D. Davidson and J. McDowell. As for utterances of expressions, to understand an utterance of a proper name is to know a piece of information concerning the referent of the name; ideally, it is a fact that can be expressed by an identity statement claiming that the referent of the name under discussion is identical with the individual about which the speaker has a mental file at her disposal. In 2005 St Andrews Studies published a volume of essays by Anscombe entitled Human Life, Action and Ethics, followed in 2008 by a second with the title Faith in a Hard Ground. Both books were highly praised. This third volume brings essays on the thought of historical philosophers in which Anscombe engages directly with their ideas and arguments. Many are published here for the first time and the collection provides further testimony to Anscombe's insight and intellectual imagination.

Background Prison creates philosophical needs due to the exceptionality of the situation. This study explores how philosophy can meet these needs by focusing on three aspects: critical thinking, personal relationships and the government of passions. It builds on similar interventions in several countries and is proposed as a research that bypasses some limitations of previous projects in prisons.Method Following the participation of 81 inmates in 22 philosophical sessions over six months, the results of both interventions were analyzed using mixed methods, (...) as well as a pretest posttest design with a control group. Specifically, Webster’s Self Assessed Wisdom Scale, a questionnaire and an interview with four participants were used. These methods were triangulated in order to obtain data from the various methodologies and to improve the validity and reliability of the results.Results It was demonstrated that the experimental group showed significant progress in relation to the categories “openness”, “humor” and “emotion regulation”. Participants also showed a progression in categories related to the project’s goals. These results allow for a description of the categories that explain in what sense philosophy can act in the context of imprisonment.Conclusions This study demonstrates, on the one hand, how philosophy workshops involve outcomes linked to cognitive, affective and relational aspects. Furthermore, it provides evidence to confirm previous studies and interventions that are more modest in their results and use less rigorous scientific methodologies. (shrink)
