How can law ethically regulate a future of fast-changing technologies? From recent inventions to science fiction, Future Law explores how law, ethics and regulation must respond to new technologies that challenge the boundaries of our ethics.

Trends and issues in the dissemination of knowledge are discussed in terms of current trends. The general trends include the rapid rate at which new journals and documents are produced and increasing specialization in the field. Among the issues discussed are the optimum information hypothesis, optimum conceptual size of information, vividness and propitiousness of the information, and orientations to knowledge of subcultures within a professional field. ABSTRACT Pharmacogenetics is a rapidly expanding area of research exploring the relationship between inter‐individual genetic variation and drug response, with the goal of developing genetically optimised therapies. Slippery slope arguments claim that a particular action should be rejected (or supported) because it might be the first step onto a slippery slope leading to undesirable (or desirable) consequences. In this article, several slippery slope arguments relevant to the context of pharmacogenetics are evaluated under consideration of underlying reasons for their popularity. The (...) author concludes that although the examined arguments are unconvincing as slippery slope arguments, they do matter in this context. While positive slippery slope arguments serve as a driving force to fuel the development of pharmacogenetics, their negative counterparts play an important role to sensitise policy makers and the public to potential problems. There is a strong consensus among analytic philosophers that Husserl is an internalist and that his internalism must be understood in conjunction with his methodological solipsism. This paper focuses on Husserl's early work the, Logical Investigations , and explores whether such a reading is justified. It shows that Husserl is not a methodological solipsist: He neither believes that meaning can be reduced to the individual, nor does he assign an explanatory role for meaning to the subject. Explanatory priority is assigned (...) to objects which have an intrinsic property independently of any access or attitude we may have to them. Although not a methodological solipsist, there are nonetheless internalist elements to Husserl's thought: He believes that we can think of non-existent objects and his account of indexicals and demonstratives shows that there are two kinds of meaning: one is context independent and internally individuated, the other is partly determined by context and so externally individuated. The paper leaves it open whether this is sufficient to mark Husserl out as an internalist. However, even if he were considered as such, we can be sure of one thing, namely, that his internalism would not be a species of methodological solipsism. (shrink)

Tendo em vista as questões relacionadas à literatura e suas inúmeras possibilidades de materialização, este trabalho debruça-se em analisar a intertextualidade presente entre o livro O Pequeno Príncipe, de Antoine Saint-Exupéry e o filme de mesmo título de Mark Osborne, focando-se, especificamente, na figura das personagens protagonistas. Embora trate-se de materialidades diferentes e que ocorra, de certa forma, a quebra de expectativa do leitor quanto à representação literal da obra literária no filme, nosso interesse é por buscar nas personagens infantis (...) marcas da intertextualidade que as constituem como uma só enquanto ser criança e pensar em como esses elementos funcionam no texto para construir um saber sobre a infância, em diferentes épocas.Palavras-chave: O Pequeno Príncipe. Ce document est la retranscription d’un débat entre trois prostituées et des étudiants, tenu à l’Université Lyon 2 le 27 avril 1976. Ce débat constitue une des dernières manifestations publiques du mouvement des prostituées lancé à Lyon un an plus tôt, et qui avait vu une centaine de femmes occuper pendant plus d’une semaine une église de la ville afin de protester contre la répression policière. Il apporte non seulement un éclairage sur les conditions du passage à l’action collective d’une (...) population aussi marginale et stigmatisée que les prostituées, mais offre également de riches informations sur les logiques sociales, économiques et familiales qui, au milieu des années 1970, pouvaient contraindre des femmes à se prostituer. As a thinker whose work proposes the recovery in Darwin of an innovative anthropology, which no specialist scholar has consistently refuted or has exposed as amounting to a forced or willful interpretation, Patrick Tort can enable us to arrive at a valid assessment of Darwin’s discourse on man and on civilization. In this regard, he underlines the unquestionably dialectical character of the passage from “nature” to “culture” in the project. As a consequence of their ignorance of this innovation, Marx, and (...) those who came after him, equated Darwinism with a Malthusian ideology and a doctrine of social selection, a position which Darwin precisely did not adopt, in his explanation of the origin and transformation of civilization, without however having to break with his selective biology. In the history of Marxism, the consequence of this epistemological faux-pas has been the interminable reiteration of “monist” problems in pursuit of a dialectical conceptualization of the links and the distinctions to be teased out between nature and civilization, materialism and morality. With a view to reestablishing a fruitful theoretical dialogue between the heritage of Marx and that of Darwin, a detour by way of Kant and his categorical moral imperative is certainly not desirable. The path leading to an overcoming of the contradictions is rather to be located by way of Marxism’s acknowledgement of the notion of “reversive continuity”, thus enabling us to conceptualize, in a unitary mode and from the perspective of materialism, the paradox of the extinction of struggle, within the horizon of the struggle of which nature constitutes the field of experimentation. Although Confucianism is a resilient cultural tradition in Asian societies, its role in their corporate governance systems is ambiguous. Confucian values have been pushed to the periphery because of a preoccupation in these countries to emulate corporate governance systems from the West. This article argues that Confucianism has much to offer in enhancing director conduct and corporate governance standards. As the attention of the global business community turns eastwards, it is opportune to revive interest in Confucianism and to explore ways (...) in which it can be integrated formally into companies' governance systems. The paper focuses on the difference between event‐conditionals and premise‐conditionals. An event‐conditional contributes to event structure: it modifies the main clause event; a premise‐conditional structures the discourse: it makes manifest a proposition that is the privileged context for the processing of the associated clause. The two types of conditional clauses will be shown to differ both in terms of their ‘external syntax’ and in terms of their ‘internal syntax’. The peripheral structure of event conditionals will be shown to lack the (...) functional head Force, which encodes illocutionary force. Event conditionals are merged inside the IP of the matrix clause. Premise‐conditionals contain the head Force and they are merged outside the associated CP. (shrink)

Corporate social responsibility (CSR) has become a much-discussed subject in the business world. The Internet has become one of the main tools for CSR information disclosure, allowing companies to publicise more information less expensively and faster than ever before. As a result, corporations are increasingly concerned with communicating ethically and responsibly to the diversity of stakeholders through the web. This paper addresses the main question as whether CSR information disclosure on corporate websites is influenced by country of origin and/or industry (...) sector. Analysing the websites of 127 corporations from emerging countries, such as Brazil, Chile, China, India, Indonesia, Mexico, Thailand and South Africa, it becomes evident that both country of origin and industry sector have a significant influence over CSR information disclosure on the web (CSRIDOW). Michel Serres’s philosophy of entropy takes what he famously calls the ‘Northwest Passage’ between the sciences and the humanities. By contextualizing his approach to entropy and affirming the role of a philosophy of difference, this paper explores Serres’s approach by means of ‘entropic differences’. It claims that entropy – or rather, entropies – provide Serres with a paradigmatic case for critical translations between different domains of knowledge. From his early Hermès series, through to The Birth of Physics and later writings (...) on social and ethical themes, he keeps thermodynamical and informational – or ‘hard’ and ‘soft’ – understandings of entropy apart, while simultaneously exploring their relation. By focusing on the systematic significance of Serres’s ‘entropic difference’, this paper shows how it unfolds not necessarily as an ontological difference but as an operative function between the history and philosophy of science, epistemology, and a theory of negentropic (inter)subjectivity. This paper is concerned with Michel Serres’s critique of property. Through the concept of ‘le propre,’ which in French can mean both ‘clean’ and ‘one’s own,’ and a naturalist reading of Rousseau, he proposes a ‘stercorian’ eco-criticism of property. Focusing on concepts of limits provides a fruitful angle from which to illuminate Serres’s critique of law and property. The first section will introduce Serres as a thinker of limits, borders, and boundaries. In the second and third parts, attention will be (...) drawn to his eco-criticism of law and property from a feminist and philosophy of science perspective, concluding with a fourth part, in which Serres’s approach will be contextualized in relation to other naturalisms. His work has far-reaching consequences for discourses of human agency in the context of the Anthropocene and makes a crucial contribution to how a new naturalist criticism of property might be conceived. This paper takes Zahavi’s view to task that every conscious experience involves a “minimal sense of self.” Zahavi bases his claim on the observation that experience, even on the pre-reflective level, is not only about the object, but also has a distinctive qualitative aspect which is indicative of the fact that it is for me. It has the quality of what he calls “for-meness” or “mineness.” Against this I argue that there are not two phenomena but only one. On the (...) pre-reflective level, experience is transparent. Conscious experience may well be reflexive but this does not imply that I additionally have a sense of what it is like for me to have that experience. I do not just happen to disagree with Zahavi’s account of pre-reflective experience but, more importantly, I am concerned that he imposes it onto his interpretation of Edmund Husserl. Zahavi claims that when Husserl argues that consciousness is necessarily a form of self-consciousness, he must be committed to the view that we necessarily have a sense of ownership. However, Husserl only claims that I am self-conscious but not that I am a self that owns its consciousness. Zahavi thus misses the novelty of Husserl’s position, namely that I do not need to have a sense of abiding ownership, to have experience. (shrink)

Psychopathic individuals are characterized by impaired affective processing, impulsivity, sensation-seeking, poor planning skills and heightened aggressiveness with poor self-regulation. Based on brain self-regulation studies using neurofeedback of Slow Cortical Potentials (SCPs) in disorders associated with a dysregulation of cortical activity thresholds and evidence of deficient cortical functioning in psychopathy, a neurobiological approach seems to be promising in the treatment of psychopathy. The results of our intensive brain regulation intervention demonstrate, that psychopathic offenders are able to gain control of their brain (...) excitability over fronto-central brain areas. After SCP self-regulation training, we observed reduced aggression, impulsivity and behavioral approach tendencies, as well as improvements in behavioral-inhibition and increased cortical sensitivity for error-processing. This study demonstrates improvements on the neurophysiological, behavioral and subjective level in severe psychopathic offenders after SCP-neurofeedback training and could constitute a novel neurobiologically-based treatment for a seemingly change-resistant group of criminal psychopaths. Nowadays, that part of Amazonia which is situated on Brazilian territory is more and more the focus of attention for communication methods and the international agenda. This enormous expanse of land covered by tropical forest of unequalled beauty, extending over several Brazilian states, possesses an extremely rich biodiversity, with a vast potential reserve of natural resources of all sorts, and inspires admiration as well as inevitable greed. The intensification of human activity in the region has given rise to problems such (...) as deforestation and a resulting loss of organic matter whose importance has yet to be properly evaluated; it has also led to conflict between the different local groups, such as the indigenous population, gold prospectors and the big landowners, and to the degradation of quite extensive areas, thus provoking questions on how best to promote sustained development in the region. In 'Time and Being' Heidegger claims that the task is to 'cease all overcoming and to leave metaphysics to itself'. This paper asks what it actually means to leave metaphysics to itself, and how we are meant to understand the difference between "leaving metaphysics to itself" and "overcoming metaphysics". To understand this distinction, the paper compares Heidegger's later position with those of Husserl and Wittgenstein and with his own earlier position expressed in Being and Time. While we find different interpretations (...) of what it means to leave metaphysics to itself, this paper shows that none of them, apart from Wittgenstein's, draw a clear distinction between leaving metaphysics to itself and overcoming metaphysics. Indeed, rather than leaving metaphysics to itself, Heidegger in 'Time and Being' comes to articulate a negative metaphysics. To avoid such a move, this paper draws on Wittgenstein to show how we can truly leave metaphysics to itself and cease all overcoming. (shrink)

An explicit categorical equivalence is defined between a proper subvariety of the class of \-algebras, as defined by Di Nola and Dvurečenskij, to be called \-algebras, and the category of semi-low \-rings. This categorical representation is done using the prime spectrum of the \-algebras, through the equivalence between \-algebras and \-groups established by Mundici, from the perspective of the Dubuc–Poveda approach, that extends the construction defined by Chang on chains. Buscou-se fazer uma avaliação quanto à eficácia e à possibilidade de cogência do princípio responsabilidade, 40 anos após a publicação da obra em que Hans Jonas expõe, de forma acabada, a sua reflexão ética para a civilização tecnológica. Primeiramente, fazendo uma comparação entre a abordagem das noções de princípios e normas no campo jurídico e no moral; em seguida, considerando a responsabilidade sob a ótica jurídica e jus-filosófica e, por fim, examinando os diferentes aspectos da responsabilidade e o desafio de (...) se identificar e imputar os agentes. Na tentativa de classificar a responsabilidade, constatou-se a dificuldade de se atribuí-la a seus diferentes agentes, não apenas pela forma “difusa” como atuam, mas pelo fato de, em alguns casos, estarem associados a alguma esfera de poder.
