En el presente artículo, se estudiará al “proyecto de vida” como categoría jurídica del derecho constitucional, enmarcado en el ámbito de los derechos existenciales; entendidos estos como aquellos cuya finalidad estriba en revestir de garantías al acervo psíquico o anímico de los seres humanos, dentro del cual, sin duda, se encuentra el derecho a auto determinarse y hacer una proyección de las metas que espera alcanzar durante su vida, y los caminos a recorrer para conseguirlo. La confección de tal “proyecto (...) de vida”, dependerá de la libérrima facultad que deben tener las personas para escoger, de entre un abanico de posibilidades existenciales, aquellas que, según sus propias deducciones les han de conducir hacia la consecución de su íntima realización. Aclarado el valor que el “proyecto de vida” tiene para el derecho, el presente artículo analizará el incipiente desarrollo normativo y jurisprudencial que esta categoría jurídica ha merecido en el Ecuador; y, realizará un breve análisis del tratamiento que le dispensa la jurisprudencia constitucional, así como el esperanzador desarrollo del tema en los fallos de la Corte Interamericana de Derechos Humanos. This book is a sustained defence of traditional internalist epistemology. The aim is threefold: to address some key criticisms of internalism and show that they do not hit their mark, to articulate a detailed version of a central objection to externalism, and to illustrate how a consistent internalism can meet the charge that it fares no better in the face of this objection than does externalism itself. This original work will be recommended reading for scholars with an interest in epistemology.

While prior ecolabel research suggests that consumers’ trust of ecolabel sponsors is associated with their purchase of ecolabeled products, we know little about how third-party certification might relate to consumer purchases when trust varies. Drawing on cognitive theory and a stratified random sample of more than 1200 consumers, we assess how third-party certification relates to consumers’ use of ecolabels across different program sponsors. We find that consumers’ trust of government and environmental NGOs to provide credible environmental information encourages consumers’ use (...) of ecolabels sponsored by these entities, and consumers do not differentiate between certified versus uncertified ecolabels in the presence of trust. By contrast, consumers’ distrust of private business to provide credible environmental information discourages their use of business association-sponsored ecolabels. However, these ecolabels may be able to overcome consumer distrust if their sponsors certify the ecolabels using third-party auditors. These findings are important to sponsors who wish develop ecolabels that are more credible to consumers, and thus encourage more widespread ecolabel use. (shrink)

La educación patrimonial crítica es un enfoque didáctico que facilita al alumnado reconsiderar su relación con el entorno. Busca promover el sentido de pertenencia, la empatía y el respeto por la diversidad de perspectivas, empoderando a los estudiantes como agentes de cambio social, a través del ejercicio de la ciudadanía democrática. De este modo, favorece el cuestionamiento de narrativas dominantes y la recuperación de la memoria democrática, dándole voz a todas aquellas historias ocultas y sometidas al olvido. Con el presente (...) estudio se pretende contribuir a la reparación de pasados difíciles mediante una situación de aprendizaje que emplea métodos activos de enseñanza y se lleva a cabo en las aulas de Bachillerato de un centro educativo rural, localizado en la Ribeira Sacra ourensana. Los resultados que se muestran parecen indicar que además de recuperar patrimonializar la memoria democrática de la zona, se promovió el diálogo intergeneracional y se favoreció el desarrolló de pensamiento crítico en el alumnado. En la modernidad tradicional la realidad se presenta desde una mathesis universalis que la explica y le confiere unos contornos fijos y claros desde los cuales es posible construir todo el edificio de la ciencia natural que lo explica. Así, el mundo del hombre se observará desde las leyes universales que rigen todo comportamiento humano en sociedad. Para Nietzsche, por el contrario, el mundo sólo encuentra su fundamento en el devenir de configuraciones de fuerzas que no se rigen por ninguna (...) ley previa más allá de su propia relación. Igualmente, en Baltasar Gracián, es ampliamente apoyada la tesis de que el aragonés propone una «nihilización» del mundo que coloca su fundamento fuera, en fuga. Nos proponemos analizar las reflexiones de Baltasar Gracián y Friedrich Nietzsche de acuerdo a las cuales el mundo aparece desde su «inmundicia» y falta de fundamento en contra de esa visión moderna que busca someter al mundo a unas leyes fijas y universales. Sin embargo y, al mismo tiempo, queremos mostrar cómo esta visión no conduce a un nihilismo resignado, sino que, por el contrario, impone al hombre la responsabilidad de, aceptando este desfondamiento del mundo, hacer de él algo que merezca la pena ser vivido. El acceso a la justicia es un derecho inherente de cada una de las personas dentro de los procesos penales a través de los diferentes mecanismos, uno de ellos es la prueba anticipada, materia de estudio del presente artículo; cuyo objetivo general es analizar el uso de la prueba anticipada en el proceso penal y su impacto en la protección de víctimas vulnerables y en los derechos fundamentales del imputado, para el mejoramiento de los mecanismos que permitan un equilibrio adecuado (...) entre ambas garantías. Este estudio se realizó a través de una investigación no experimental, puesto que se basa en bibliografía existente, con un enfoque cualitativo y alcance descriptivo, además se utilizó los métodos, exegético-jurídico e inductivo-deductivo y comparado. De acuerdo a los estudios realizados por diversos autores, la aplicación de la prueba anticipada de manera formal, efectiviza la garantía de los derechos de las víctimas vulnerables y de los procesados; sin embargo, existen algunas deficiencias en cuanto a la práctica de la misma, pues en el caso de las víctimas vulnerables aunque se pretende garantizar el derecho a la no revictimización en muchos casos no sucede al no ser aplicada como entrevista única; y en cuanto a los procesados, las audiencias de prueba anticipada se instalan sin la presencia de ellos, vulnerando los derechos al debido proceso y la igualdad de las partes procesales; así también existen casos donde la aplicación de la prueba anticipada no se efectúa de acuerdo a su condición de urgencia y necesidad. En conclusión, para garantizar la protección de los derechos de las víctimas vulnerables y de los procesados, se debe plantear reformas a la normativa penal ecuatoriana, con el fin de establecer las reglas para la práctica de la prueba anticipada. John Post has argued that the traditional regress argument against nonfoundational justificatory structures does not go through because it depends on the false assumption that “justifies” is in general transitive. But, says Post, many significant justificatory relations are not transitive. The authors counter that there is an evidential relation essential to all inferential justification, regardless of specific inference form or degree of carried-over justificatory force, which is in general transitive. They respond to attempted counterexamples to transitivity brought by Watkins and (...) Salmon as well as to Post’s, arguing that none of these counterexamples apply to the relation they are describing. Given the revived transitivity assumption using this relation, the regress argument does indeed demonstrate the need for foundational stopping points in inferential justification. (shrink)

Two fragments of the Lydiaca attributed to Xanthus of Lydia preserve a curious claim that a king of Lydia was the first person to make eunuchs of women. In an attempt to make sense of these passages, it has been suggested that εὐνουχίζειν here refers not to castration, but rather to female genital cutting. If correct, this would provide our first evidence of this practice in Lydian culture or indeed anywhere in Anatolia. However, the assumption that what Xanthus (...) describes somehow related to real practices is highly questionable. Instead, we should re-contextualize this story in terms of other fifth-century representations of luxury and eunuchs and in terms of Xanthus’ own exemplary portraits of other Lydian kings. (shrink)

This dissertation argues that an agent's particular commitments are an integral and necessary part of his autonomy. I refer to Hegel's Philosophy of Right to argue that the autonomous self is in fact a committed self. According to Hegel, freedom is only possible when the agent inhabits roles within a family, civil society, and the greater community of the state. These roles make up the agent's practical identity, or the set of commitments and characteristics around which he orients his actions. (...) His practical identity provides him with norms: he has specific obligations as, for instance, a parent, police officer, or judge. ;Chapter One critiques Christine Korsgaard's Kantian account of practical identity, arguing that it is inadequate because of its insistence on an ontologically divided self. Chapter Two argues that practical identity according to Hegel must include consideration of an agent's contingent circumstances. Chapter Three claims that Hegel's agent knows himself and other humans to possess universal rights and to be sources of moral certainty. Chapter Four discusses social institutions and the norms they generate. When the agent freely embraces roles in these institutions, he embraces the obligations that accompany those roles. He gives himself these obligations and is autonomous through them. ;Chapter Five argues that Hegel's definition of conscience crucially depends on his theory of practical identity. Hegel's conscience is not a source of arbitrary, unimpeachable conclusions but refers to the norms of rational institutions. It does not neglect an agent's particular commitments within those institutions such as commitments to particular causes, family members, or political organizations. It rather explains the freedom of his actions through those commitments. So defined, conscience allows for both inner certainty and external sanction. Chapter Six argues that a wide range of professions describe their ethical experience in terms of conscience, and that Hegel's definition of conscience makes sense of this experience. By referring to roles, Hegel's conscience also requires the agent to be involved in the evaluation and reformation of institutions. As such, his theory is of great relevance to contemporary ethical life. (shrink)

The Middle Ages are often described as a period when there was no stark separation between theology and philosophy. This article will qualify that characterisation, highlighting the inter-dependent relationship medieval thinkers often associated with theology and philosophy, which respectively considered the nature of God and things other than God, which nonetheless find their source and purpose in him. As the article will demonstrate, these disciplines began to develop into unique areas of specialisation following the founding of the first universities in (...) the early thirteenth century. In this context, scholars gained access to the recent translations of the major works of Aristotle and leading Islamic philosophers like Avicenna and Averroes, which enabled them to offer more precise renderings of philosophical and theological questions. At the end, the article will outline two of the main approaches to defining the relationship between philosophy and theology that prevailed in the Middle Ages: the Franciscan and the Dominican. The goal in doing so is to offer a resource and inspiration for efforts to overcome the divide that often characterises the relationship between philosophy and theology and to encourage their interaction today. The aim of this paper is to explore some trans and feminist concerns about the gendered aspects of languages beyond English, focusing in particular on Spanish, Italian, and German. Historically, discussions about gendered language have often challenged the ways in which language can make women (in)visible by addressing the implicit and explicit androcentrism and sexism in our language. We call this the visibility project. Recently, questions surrounding trans-inclusiveness and the possibility of avoiding gender markers altogether have become more prominent, often (...) highlighting the issue of pronouns (e.g. the singular "they*). We call this the gender-neutrality project. However, anglophone philosophy offers a very limited discussion on how either gender-neutrality or visibility strategies could be applied to languages more gendered than English. To address this, we start by showing how gender expresses itself in the grammatical structure of our three sample languages, and identifying some of the specific visibility and neutrality strategies that could be (or are already) applied to them. This leads us to articulate an "innovative project which constructs nuanced and novel ways to transform gendered grammatical structures. Depending on their application, these strategies can fulfil gender-neutrality goals in some cases and visibility goals in others. This highlights, among other things, the ways in which genderqueer people have attempted to shape their linguistic resources in different linguistic contexts, while also opening up avenues for new research when it comes to discussions of gender and language. Nurses and midwives are the majority of healthcare professionals globally, including Africa, and they provide care at all levels of the health system including community levels. Nurses and midwives contribute to the care of patients with rigid or dogmatic religious beliefs or those with suicidal ideations. This review paper discusses acute and chronic diseases that have suicidal tendencies such as terminal cancer, diseases with excruciating pain, physical disability, stroke, end-stage renal failure, and diabetics who are amputated. It was reiterated that (...) nurses and midwives taking care of these patients should be alert and observant to identify their suicidal tendencies. The paper also discusses religious or spiritual inclinations that negatively affect healthcare access and adherence, especially to biomedical or western medicine. It was emphasized that some religious beliefs do not allow their followers to employ biomedical treatment and nurses and midwives should not impose their faith on patients and their families. The paper ends with a discussion on the specific roles of nurses and midwives in the care of patients with suicidal ideations such as assessment, counseling, administering medication, observation, social interaction, ensuring safety measures, and providing an enabling environment for the family to part of the care and for the observation of religious coping strategies. Nurses and midwives should enhance their knowledge and skills on suicide and increase public education on suicide prevention and identification of those at risk. (shrink)

In spite of the considerable development of research in the fields of business ethics and family business, a comprehensive review and integration of the area where both disciplines intersect has not been undertaken so far. This paper aims at contributing to the call for more research on family business ethics by answering the following research questions: What is the status of the current research at the intersection of business ethics and family business? Why and how do family firms differ from (...) non-family firms regarding business ethics? And, what are the key directions for further research? To answer these questions, this study combines a systematic approach for the selection of articles, resulting in a sample of 31 articles over 35 years, with a narrative review to analyze the literature. This paper finds that research on family business ethics is scarce but increasing and that family firms are considerably different from non-family firms regarding ethical issues. Particular stakeholders, goals, relationships, and practices are found to be the forces behind the peculiarity of family business ethics. Ultimately, research development on family business ethics is encouraged and future research directions flowing from the key findings and reflections of this review are provided. (shrink)

This chapter situates Kant’s rejection of Stoic eudaimonism within his overarching anti-eudaimonist agenda. I begin by emphasizing the importance of the Stoic tradition for Kant’s critical reception of ancient ethical theory. I then reconstruct the central commitments of ancient Stoic eudaimonism and of Christian Garve’s quasi-Stoic eudaimonism. Turning to Kant’s anti-Stoic argument in the Dialectic of the Second Critique, I argue that the primary target of Kant’s error of subreption (vitium subreptionis) is the Stoic Seneca, specifically his account of joy (...) (gaudium) as an accompaniment of one’s consciousness of virtuous activity. After reconstructing Kant’s argument in detail, I offer a new way to understand its anti-eudaimonist implications: practical illusion leads the Stoic to rationalize, and, ultimately, to disfigure the moral law. Even in their moral ardor—or rather, propelled by it—the Stoic commits an error of self-love. (shrink)

A focus on the conjunction of the contents of witness reports and on the coherence of their contents has had negative effects on the epistemic clarity of the Bayesian coherence literature. Whether or not increased coherence of witness reports is correlated with higher confirmation for some H depends upon the hypothesis in question and upon factors concerning the confirmation and independence of the reports, not directly on the positive relevance of the contents to each other. I suggest that Bayesians should (...) shift focus to “coherence for” an hypothesis – that is, to the definition and analysis of cumulative case arguments in which a body of evidence supports some hypothesis that is not restricted to the conjunction of the contents of reports. Such a shift of focus will be valuable for approaching issues such as the problem of the external world which have interested Bayesian coherentists all along. (shrink)

In Hegel on Political Identity, Lydia Moland provocatively draws on Hegel's political philosophy to engage sometimes contentious contemporary issues such as patriotism, national identity, and cosmopolitanism. Moland argues that patriotism for Hegel indicates an attitude toward the state, whereas national identity is a response to culture. The two combine, Hegel claims, to enable citizens to develop concrete freedom. Moland argues that Hegel's account of political identity extends to his notorious theory of world history; she also proposes that his resistance (...) to cosmopolitanism be reassessed in response to our globalized world. By focusing on Hegel's depiction of political identity as a central part of modern life, Moland shows the potential of Hegel's philosophy to address issues that lie at the heart of ethical and political philosophy. This book investigates the role of humor in the good life, specifically as discussed by three prominent French intellectuals who were influenced by Nietzsche's thought: Georges Bataille, Gilles Deleuze, and Clément Rosset. Lydia Amir begins by discussing Nietzsche's reception in France, and she explains why and how he came to be considered a "philosopher of laughter" in the French academe. Each of the subsequent three chapters focuses on the significance of humor and laughter in the good life as advocated (...) by Bataille, Deleuze, and Rosset. These chapters also explore the complex relationship between the comic and the tragic, and of humor and laughter to irony, satire, and ridicule. The Legacy of Nietzsche's Philosophy of Laughter makes an invaluable contribution to recent interpretive work done on Bataille and Deleuze, and offers further introduction to the relatively understudied Rosset. It illuminates the philosophies of these three thinkers, their connection to Nietzsche, and, overall, the significant role that humor plays in philosophy. (shrink)

This essay conceptualizes the intersections between contemporary catastrophes and political life by exploring how narratives of catastrophe mediate discursive and objective processes of catastrophization. It argues for the need to counteract catastrophization, a discursive and objective political phenomenon, by not only re-cognizing how catastrophes impinge on political life but by offering a more critical understanding of this intersection. The essay thus calls for the politicization of catastrophe as a response to the “catastrophization of political life.” Apropos of these concerns, it (...) engages with Habermas in order to explore how his political theory and interventions illustrate important aspects of the intersections between narratives of catastrophe and contemporary political life, say, how discursive catastrophization leads to the misrecognition of objective modalities of catastrophe. Una de las consecuencias del trabajo es que Ia tesis de “la carga teórica" de Ia observación ha sido mal planteada, al dar par sentado que esa carga (...) teórica afecta tambien al procesamiento perceptivo de los outputs proporeionados al científico por el instrumental de observación.This paper first suggests that, in analyses of the empirical testing of hypotheses and theories, scientific observation should be distinguished from perception; and goes on to say that the world, as processed by perception, is the basis or empirical foundation of scientific knowledge. This thesis that observation is “theory-laden” has been flawed by its being articulated as applying not only to scientific observation but also to the perceptional processing of the output provided to the scientists by observational instruments. An active engagement with arts in general and visual arts in particular has been hypothesized to yield beneficial effects beyond arts itself. So-called cognitive and socio-emotional “transfer” effects into other domains have been claimed. However, the empirical basis of these hopes is limited. This is partly due to a lack of experimental comparisons, theory-based designs, and objective measurements in the literature on transfer effects of arts education. Therefore, the aim of the present study was to design and experimentally investigate a (...) theory-based visual-arts education program for adolescents aged between 12 and 19 years. The program was delivered in a museum context in three sessions and was expected to yield specific and objectively measurable transfer effects. To conduct a randomized field trial, three strictly parallelized and standardized art courses were developed, all of which addressed the topic of portrait drawing. The courses mainly differed regarding their instructional focus, which was either on periods of art history, on the facial expression of emotions, or on the self-perception of a person in the context of different social roles. In the first and more “traditional” course portrait drawing was used to better understand how portraits looked like in former centuries. The two other courses were designed in a way that the artistic engagement in portrait drawing was interwoven with practicing socio-emotional skills, namely empathy and emotion recognition in one course and understanding complex self-concept structures in the other. We expected positive socio-emotional transfer effects in the two “psychological” courses. We used an animated morph task to measure emotion recognition performance and a self-concept task to measure the self-complexity of participants before and after all three courses. Results indicate that an instructional focus on drawing the facial expressions of emotions yields specific improvements in emotion recognition, whereas drawing persons in different social roles yields a higher level of self-complexity in the self-concept task. In contrast, no significant effects on socio-emotional skills were found in the course focussing on art history. Therefore, our study provides causal evidence that visual-arts programs situated in an art-museum context can advance socio-emotional skills, when designed properly. (shrink)

When a risk is exchanged, the exact value for the minimum price (positive or negative) that the purchaser (investor, or insurer) is willing to pay is given by the certainty equivalent wealth level, which in turn depends on his specific utility function. When this utility function is unknown, then only a sufficient condition on the price can ever be found. This paper provides methods for calculating such a sufficient condition, when only limited information on the utility function is known.

Strange companions perhaps, until their use of the anecdote is shown as working its extraordinary passage through so many cosmopolitan cities of art and capital. What about the anecdote brings Danto's philosophy of art into conversation with Kierkegaard's stages on life's way, with Murger and Puccini's la vie de bohème, and with Hogarth's modern moral pictures? Physicians, philosophers, and theologians consider how to address death and dying for a diverse population in a secularized century.Most of us are generally ill-equipped for dying. Today, we neither see death nor prepare for it. But this has not always been the case. In the early fifteenth century, the Roman Catholic Church published the Ars moriendi texts, which established prayers and practices for an art of dying. In the twenty-first century, physicians rely on procedures and protocols for the efficient management (...) of hospitalized patients. How can we recapture an art of dying that can facilitate our dying well? In this book, physicians, philosophers, and theologians attempt to articulate a bioethical framework for dying well in a secularized, diverse society.Contributors discuss such topics as the acceptance of human finitude; the role of hospice and palliative medicine; spiritual preparation for death; and the relationship between community, and individual autonomy. They also consider special cases, including children, elderly patients with dementia, and death in the early years of the AIDS epidemic, when doctors could do little more than accompany their patients in humble solidarity.These chapters make the case for a robust bioethics—one that could foster both the contemplation of finitude and the cultivation of community that would be necessary for a contemporary art of dying well.ContributorsJeffrey P. In this paper Michael Vazquez and Dustin Webster consider the practice of deliberating about ethical case studies as a means to contribute to the professional development of educators. An ongoing debate is whether or not the study of ethical theory should be included in this practice. Vazquez and Webster argue that a popular strategy, known as the Phronetic Approach, is vulnerable to what they call “epistemic blinders” that arise in the absence of the scaffolding provided by theory. They then sketch (...) an alternative approach to case-based reasoning inspired by Barbara Herman's notion of middle theory. The middle theory approach naturally suggests a balanced method for using case studies in teacher professional development: expose educators to some theory, but only to the degree and at the level appropriate for the specific audience and in light of how frequent interactions with that audience will be. This paper argues that Plato's gigantomachia is simultaneously concerned with first-order arguments about metaphysics and epistemology and with second-order arguments that reflect on the impact of ethical components, argumentative strategies and theoretical assumptions in the conversation. This complex argumentative structure reveals, I suggest, an organic and systematic conception of philosophy where all the elements are interdependent. This interpretation has four consequences, two at the second-order level, and two concerning the first-order arguments. First, it shows that there are methodological and ethical (...) requirements without which philosophy is impossible. Second, it shows that the text does not refute materialism but tries to reflect the necessary conditions to consider possible the existence of incorporeal beings. Third, it argues that the text assumes a conception of knowledge where knowing something is a complex activity composed of two causal relations. Finally, it offers a new interpretation of the overall conclusion of the passage. (shrink)

Ernst Mach’s defense of relativist theories of motion in Die Mechanik involves a well-known criticism of Newton’s theory appealing to absolute space, and of Newton’s “bucket” experiment. Sympathetic readers (Norton 1995) and critics (Stein 1967, 1977) agree that there’s a tension in Mach’s view: he allows for some constructed scientific concepts, but not others, and some kinds of reasoning about unobserved phenomena, but not others. Following Banks (2003), I argue that this tension can be interpreted as a constructive one, springing (...) from Mach’s approach to scientific reasoning. Mach’s “economy of science” allows for a principled distinction to be made, between natural and artificial hypothetical reasoning, and Mach defends a division of labor between the sciences in a 1903 paper for The Monist, “Space and Geometry from the Point of View of Physical Inquiry”. That division supports counterfactual reasoning in Mach’s system, something that’s long been denied is possible for him. (shrink)

This systematic review synthesises the available evidence regarding the European understanding of workplace spirituality (definitions), the importance of spirituality and religion (evidence) as well as spiritual leadership (meaning and practice) in for-profitorganizations. The search for eligible studies was conducted in OPAC Plus, SCOPUS, Science Direct, JSTOR, EBSCO, and Google Scholar from 2007/01 to 2017/07. Three independent scholars extracted the data. Twenty studies were included (two mixed-methods, eight quantitative, ten qualitative) for the final quality assessment. A study quality assessment and thematic (...) analysis was conducted. This review gives suggestions for study quality improvement and reporting. Thematically, two different approaches to religion and spirituality (R/S) were detected: a) work has a spiritual dimension and b) religious and spiritual orientation as “spiritual capital”. Studies demonstrated positive effect on job satisfaction, health, commitment, company productivity and sustainability; Christian leadership does not address personal religious orientation; the spiritual dimension may lead to a change of perspective; workplace spirituality may exploit people for profit-oriented business goals; non-white Muslims experience discrimination. This systematic review provides robust evidence and findings for evidence-informed policymaking and encourages a more rigorous research in this field of study. (shrink)
