The aim of this article is to analyse the Czech legislation applicable to surrogacy cases while considering some basic social aspects. First the basic facts of surrogacy as a medical reproductive technique are discussed. Surrogacy is also considered as a social trend, and in terms of selected social aspects, such as the growing number of couples interested in surrogacy and their social status. Nevertheless, the main goal of the paper is to analyse selected legal problems as regards surrogacy and the (...) Czech legislation. Therefore, the authors describe the basic legal framework that has relevancy to surrogacy cases (establishing parenthood and adoption) and identify the most frequent problems concerning surrogacy applications using three model cases. In the concluding remarks the adequacy of Czech legislation is discussed. (shrink)

Collecting human similarity judgments is instrumental to measuring and modeling neurocognitive representations and has been made more efficient by the multi-arrangement task. While this task has been tested for collecting semantic similarity judgments, it is unclear whether it also lends itself to phonological and orthographic similarity judgments of words. We have extended the task to include these lexical modalities and compared the results between modalities and against computational models. We find that similarity judgments can be collected for all three modalities, (...) although word forms were considered more difficult to sort and resulted in less consistent inter- and intra-rater agreement than semantics. For all three modalities we can construct stable group-level representational similarity matrices. However, these do not capture significant idiosyncratic similarity information unique to each participant. We discuss the potential underlying causes for differences between modalities and their effect on the application of the multi-arrangement task. (shrink)

We investigate the determinants of decision rights transfer and its effects on the motivation of an agent. The study is based on a laboratory experiment conducted on 130 subjects playing an innovative principal–agent game. Interestingly, the results show that agents do not favour a delegation and a decision is considered rather burdensome. Although the experiment could not give support for the behavioural hypothesis of higher effort provided by participants who receive choice subsequently, the survey illuminates the interaction between delegation motives, (...) effort motivators, goals and other perceptions of the agents. Die aktuelle philosophische Debatte darüber, wie Sinn im konkreten menschlichen Leben gestiftet und durch was er getragen wird, stellt vielfältige Argumentationen für die Rolle von Narrativität bereit. Der Ausgangspunkt dieses Artikels liegt in der Frage nach einer Verteilung von Rollen in Sinnträger und Sinnstifter sowie nach dem Verhältnis zwischen dem Attribut ‚Sinnhaftigkeit‘ und dem Begriff ‚Leben‘. Die Bestimmung von Sinnträgern scheint deshalb trivial, weil die Verbindung von ‚Sinnhaftigkeit‘ und ‚Leben‘ bereits in der Frage nach einem Sinn im Leben stattfindet. Was (...) demnach auf irgendeine Weise sinnvoll sein kann, ist das menschliche Leben – hierbei ist jedoch nicht eindeutig bestimmt, was unter ‚Leben‘ verstanden werden soll. In welcher Weise der Begriff des Lebens ein Träger des Attributs ‚Sinnhaftigkeit‘ sein kann, ist der Schwerpunkt dieses Artikels. Hierzu verfolge ich zum einen die Fragestellung, inwiefern das Leben als Ganzes oder einzelne Lebensabschnitte Sinnträger sein können, und zum zweiten, inwiefern narrative Strukturen dazu beitragen, Sinnhaftigkeit im Leben zu konstituieren. Ich argumentiere dafür, dass die Herstellung von Sinn im Leben eine narrative Struktur voraussetzt. Hierfür gebe ich zwei für die Whole-Life-Theorie sprechende Gründe: (i) Ein Verweis auf intrinsisch sinnstiftende Güter innerhalb von Lebensabschnitten kommt nicht ohne das erklärende Element der narrativen Struktur aus, wenn wir verstehen wollen, wie bestimmte Inhalte für eine Person in ihrem konkreten Leben sinnstiftend werden. Le problème du sujet ou de l'intersubjectivité représente, sans aucun doute, une des questions les plus importantes de la philosophie politique et juridique contemporaine. C'est ce que confirme le retour de l'éthique dans nos sociétés démocratiques ainsi que les remises en question de tout concept de subjectivité. Ces dernières pourraient bien servir de fil conducteur à une reconstruction de l'histoire des différents projets modernes de la philosophie. A cette possibilité de reconstruction s'ajouteraient non seulement les différentes tentatives de repenser l'intersubjectivité (...) telles que les ont menées des penseurs comme Husserl, mais encore ses déconstructions opérées par Nietzsche, Heidegger et le heideggerianisme français d'une part, ainsi que les reconstructions entreprises au sein de l'éthique de la discussion (Karl-Otto Apel et Jürgen Habermas). Même le débat, devenu emblématique, de la philosophie politique et juridique anglo-américaine entre libéraux et communautariens tourne autour de la notion de subjectivité. Les théories féministes contemporaines réussiront, elles aussi, à la raviver, à la polariser autour de deux éléments sexuellement différents : le "sujet mâle de la raison" et le "sujet féminin essentiellement caractérisé par la tendance à la sollicitude"? Les théories féministes n'ont-elles pas repris à leur compte le slogan de la fin de l'homme, l'une des plus importantes déclarations de guerre des déconstructions postmodernes de la métaphysique occidentale, notamment des théories modernes? N'ont-elles pas trouvé dans cette déclaration un écho favorable à leur cause, dès lors que l'homme s'identifie au "sujet mâle de la raison", propriétaire chrétien et blanc"? L'importance des problèmes soulevés par le concept de la subjectivité, sa place dans la philosophie contemporaine sans parler des controverses qu'il génère expliquent et imposent ce nouvel investissement auquel nous consentons. The idea that particular legal institutions are artifacts is not new. However, the idea that the “law” or “legal system” is itself an artifact has seldom been directly put forward, due perhaps to the ambiguities surrounding philosophical inquiries into law. Nevertheless, such an idea has recently been invoked more often, though not always developed in detail in terms of what the characterization of the “law” or “legal system” as an artifact entails ontologically, and what consequences, if any, this has for (...) philosophical accounts of law. As a result, the primary aim of this paper is to attempt an inquiry into what the claim that “law” by its nature or character is an artifact entails, and what an artifact theory of law might look like. Sentences with disjunction in the scope of a universal quantifier, Every A is P or Q, tend to give rise to distributive inferences that each of the disjuncts holds of at least one individual in the domain of the quantifier, Some A is P & Some A is Q. These inferences are standardly derived as an entailment of the meaning of the sentence together with the scalar implicature that it is not the case that either disjunct holds of every individual (...) in the domain of the quantifier, \Every A is P &\Every A is Q. As we show, this derivation faces a challenge in that distributive inferences may obtain in the absence of plain negated inferences. We address this challenge by showing that on particular assumptions about alternatives, a derivation of distributive inferences as scalar implicatures can be maintained without in fact necessitating plain negated inferences. These assumptions accord naturally with the grammatical approach to scalar implicatures. We also present experimental data that suggest that plain negated inferences are not only unnecessary for deriving distributive inferences, but might in fact be unavailable. (shrink)

Following the work of Peter Schmitt-Egner, this article lays out a value-form theoretical approach to racism. During the debates within German Marxism on the reconstruction of the critique of political economy (Neue Marx-Lektüre), Schmitt-Egner developed a theory in the 1970s that tries to explain racism with reference to Marx’s analysis of the commodity form and circulation. Thereby he developed a highly original theoretical derivation of racism as an ideological reification of the debased position of colonised labour power in comparison with (...) that of metropolitan workers. The bourgeois ideals of freedom and equality, constituted through commodity circulation, according to Schmitt-Egner, are modified by the nature of the colonial production process and thus negated in the case of the racialised worker. Even if his theory, as I am going to show, has some serious flaws, it helps to make sense of past and current patterns of racist inferiorisation. (shrink)

In this paper, we explore an under-investigated question concerning the class of formal models that aim at providing normative guidance. We call such models normative models. In particular, we examine the question of how normative models can successfully exert normative guidance. First, we highlight the absence of a discussion of this question – which is surprising given the extensive debate about the success conditions of descriptive models – and motivate its importance. Using the technique of prepared questions, Conversations with Lukacs is a brilliant gathering of thoughts and insights covering topics as ontology, the techniques of manipulative societies, the pitfalls of combating Stalinism with Stalinist methods, and the problems of intellectuals in advanced capitalist societies. Above all, there is the restatement of Lukacs unshaken conviction that the working class, with all the changes that have occurred in its way of life and composition, is still the historical carrier of social transformation. Lukacs's interlocutors (...) in these four conversations are Hans Heinz Holz, Leo Kofler, and Wolfgang Abendroth. Each of them engages Lukacs in separate dialogues, on being and consciousness (Holz), on society and the individual (Kofler), and on the elements of scientific politics (Abendroth). Lukacs, Abendroth, and Holz work toward a "Provisional Summary" in the last conversation. The interlocutors and the editor write that "These conversations show very clearly the basis of abstraction in the experiences of everyday life.... This gives these conversations with Lukacs a more than anecdotal value; for the unmediated way in which thought is produced in conversation corresponds exactly to that primary level of experience, the data of everyday reality, whose theoretical value Lukacs emphasizes.... They aspire to bear witness to the living thought of one of the great men of our century, and to provide the opportunity to approach this thought by the simplest possible route.". (shrink)

Scholars disagree about the plausibility of preference purification. Some see it as a familiar phenomenon. Others denounce it as conceptually incoherent, postulating that it relies on the psychologically implausible assumption of an inner rational agent. I argue that different notions of rationality can be leveraged to advance the debate: procedural rationality and structural rationality. I explicate how structural rationality, in contrast to procedural rationality, allows us to offer an account of the guiding idea behind preference purification that avoids inner rational (...) agents. Afterward, I address two pressing challenges against preference purification that emerge under the structural rationality account. (shrink)

Subverting a once widely held Quinean paradigm, there is a growing consensus among philosophers of logic that higher-order quantifiers (which bind variables in the syntactic position of predicates and sentences) are a perfectly legitimate and useful instrument in the logico-philosophical toolbox, while neither being reducible to nor fully explicable in terms of first-order quantifiers (which bind variables in singular term position). This article discusses the impact of this quantificational paradigm shift on metaphysics, focussing on theories of properties, propositions, and identity, (...) as well as on the metaphysics of modality. Mill (1872, 1874) is an early proponent of the thesis that economics has a special domain in which it can operate relatively independently of findings from other sciences. Contra Mill, I argue that this so-called separateness-thesis is best defendedunder an externalist interpretation of Rational Choice Theory (RCT). Mill’s defence is consistent with an internalist interpretation of RCT. Internalism holds that RCT depicts psychological mechanisms operating in economic agents. I argue that such a defence fails to establish separateness, because it makes (...) economics highly depended on psychological findings. However, externalism understands RCT as an adequate description of how agents react to incentives if certain environmental structures are present. Under this interpretation, we can defend separateness by investigating which features of an environmental structure will lead agents to behave in accordance with RCT. Thereby, we can derive indicators that enable us to demarcate a separate domain for economics. (shrink)

The distribution of the focus particle even is constrained: if it is adjoined at surface structure to an expression that is entailed by its focus alternatives, as in even once, it must be appropriately embedded to be acceptable. This paper focuses on the context-dependent distribution of such occurrences of even in the scope of non-monotone quantifiers. We show that it is explained on the assumption that even can move at LF Syntax and semantics, 1979). The analysis is subsequently extended to (...) occurrences of negative polarity items in these environments, which mirror the abovementioned distribution of even and which invalidate standard characterizations of NPI licensing conditions in terms of downward-entailingness. The idea behind the extension is that NPIs denote weak elements that are associates of covert even. The paper concludes by discussing two comprehensive theories of NPI licensing and how our proposal relates to them. (shrink)

Explikácia patrí medzi kľúčové metódy analytickej filozofie. V tejto práci predstavujem návrh explicitného odlíšenia metódy explikácie od jej výsledku. V nadväznosti na prácu Rudolfa Carnapa sa snažím jeho explikačný projekt rozvinúť. Poukazujem na otvorené problémy Carnapovych kritérií adekvátnej explikácie; ukazujem, v čom sa explikácie od definícií líšia, aká je ich logická forma a ktoré explicitné kroky sú typické pre metódu explikácie. Napokon, približujem dôvody, pre ktoré je možné explikáciu chápať ako reláciu nahradenia medzi významovou charakterizáciou a definíciou určitého druhu.

Wie aus einer berühmten Passage aus der Politik des Aristoteles hervorgeht, zeichnet den Menschen die Zugehörigkeit zur Gemeinschaft der Polis aus: »Wer aber keine Gemeinschaft eingehen kann, oder einer solchen, weil er sich selbst genug ist, nicht bedarf, ist kein Glied des Staates, vielmehr entweder ein wildes Thier, oder ein Gott«. Machine intelligence already helps medical staff with a number of tasks. Ethical decision-making, however, has not been handed over to computers. In this proof-of-concept study, we show how an algorithm based on Beauchamp and Childress’ prima-facie principles could be employed to advise on a range of moral dilemma situations that occur in medical institutions. We explain why we chose fuzzy cognitive maps to set up the advisory system and how we utilized machine learning to train it. We report on the (...) difficult task of operationalizing the principles of beneficence, non-maleficence and patient autonomy, and describe how we selected suitable input parameters that we extracted from a training dataset of clinical cases. The first performance results are promising, but an algorithmic approach to ethics also comes with several weaknesses and limitations. Should one really entrust the sensitive domain of clinical ethics to machine intelligence? (shrink)

Hybrid contingentism combines first-order contingentism, the view that it is contingent what individuals there are, with higher-order necessitism, the view that it is non-contingent what properties and propositions there are (where these are conceived as entities in the range of appropriate higher-order quantifiers). This combination of views avoids the most delicate problems afflicting alternative contingentist positions while preserving the central contingentist claim that ordinary, concrete entities exist contingently. Despite these attractive features, hybrid contingentism is usually faced with rejection. The main (...) reason for this is an objection that crucially involves haecceitistic properties, properties such as being identical to Plato or being identical to Aristotle. The objection alleges that by accepting the necessary existence of such haecceities, hybrid contingentists incur an explanatory commitment that they are unable to discharge, namely that of explaining how it is that certain haecceities ‘lock onto’ their target individuals even when those individuals are absent. To defend hybrid contingentism against this charge, I first clarify the haecceities objection in several respects and consider, in particular, what notion of explanation the objection is operating with. After arguing that it can be fruitfully understood as a challenge to provide metaphysical grounds for certain haecceity facts, I develop a contingentist response to the objection that draws on recent work on the connection between ground and essence. Functionalism about kinds is still the dominant style of thought in the special sciences, like economics, psychology, and biology. Generally construed, functionalism is the view that states or processes can be individuated based on what role they play rather than what they are constituted of or realized by. Recently, Weiskopf has posited a reformulation of functionalism on the model-based approach to explanation. We refer to this reformulation as ‘new functionalism’. In this paper, we seek to defend new functionalism and to (...) recast it in light of the concrete explanatory aims of the special sciences. In particular, we argue that the assessment of the explanatory legitimacy of a functional kind needs to take into account the explanatory purpose of the model in which the functional kind is employed. We aim at demonstrating this by appealing to model-based explanations from the social and behavioral sciences. Specifically, we focus on preferences and signals as functional kinds. Our argument is intended to have the double impact of deflecting criticisms against new functionalism from the perspective of mechanistic decomposition while also expanding the scope of new functionalism to encompass the social and behavioral sciences. V rámci filosofie věd panuje široká shoda na tom, že druhá polovina 20. století složila „labutí píseň" pozitivismu. Milton Friedman a Paul Samuelson, dva klíčoví autoři k metodologii ekonomie v daném časovém období, přitom tento vývoj ve filosofii vědy prý nikdy nereflektovali. Pozitivistická východiska - v prvé řadě v podobě redukcioni- stického přístupu - jsou tudíž stále přítomna ve vlivných teoretických konceptech rozvinutých ekonomy hlavního proudu. Značný počet autorů však v současnosti sdílí náhled, že tyto koncepty v nezanedbatelné míře přispěly (...) k vývoji, jenž ústil ve finanční krizi, vrcholící v letech 2008 a 2009. Předkládaný článek se proto táže, zda to byla právě krize - v níž mnozí spatřují empirické zamítnutí řady pozitivistických konceptů - která napsala „labutí píseň" pozitivismu v ekonomii hlavního proudu. Higher-order realists about properties express their view that there are properties with the help of higher-order rather than first-order quantifiers. They claim two types of advantages for this way of formulating property realism. First, certain gridlocked debates about the nature of properties, such as the immanentism versus transcendentalism dispute, are taken to be dissolved. Second, a further such debate, the tropes versus universals dispute, is taken to be resolved. In this paper I first argue that higher-order realism does not in (...) fact resolve the tropes versus universals dispute. In a constructive spirit, I then develop higher-order realism in a way that leads to a dissolution, rather than a resolution, of this dispute too. (shrink)

Tato stať se nejprve zaměřuje na prozkoumání obsahu médií z nadhledu odlišných teoretiků Lévyho a Thompsona, aby následně tyto poznatky zasadila do kontextu společenského řádu a demokracie.

The paper presents the logical milieu of the Paradox of ravens, identified by Hempel in his Studies in the Logic of Confirmation. It deals with Hempel’s interpretations of Nicod’s criterion of confirmation as well as with its inadmissible consequences. I, subsequently, suggest an epistemological and semantic specification of empirical properties, i.e., of their identity; then I formulate a criterion of the test of properties expressed by empirical hypothesis. Finally, I propose a procedural conception of confirmation by means of the testing (...) procedure schema. The confirmation is, therefore, conceived as an attribute which can be ascribed to a hypothesis through the process of its testing. The methods of testing are central to the hypothesis’s qualifica-tion as confirmed. (shrink)

ABSTRACT This essay examines the exhibition of dinosaurs at the American Museum of Natural History during the first two decades of the twentieth century. Dinosaurs provide an especially illuminating lens through which to view the history of museum display practices for two reasons: they made for remarkably spectacular exhibits; and they rested on contested theories about the anatomy, life history, and behavior of long-extinct animals to which curators had no direct observational access. The American Museum sought to capitalize on the (...) popularity of dinosaurs while mitigating the risks of mounting an overtly speculative display by fashioning them into a kind of mixed-media installation made of several elements, including fossilized bone, shellac, iron, and plaster. The resulting sculptures provided visitors with a vivid and lifelike imaginative experience. At the same time, curators, who were anxious to downplay the speculative nature of mounted dinosaurs, drew systematic attention to the material connection that tied individual pieces of fossilized bone to the actual past. Freestanding dinosaurs can therefore be read to have functioned as iconic sculptures that self-consciously advertised their indexical content. (shrink)

The internet has become an ubiquitous epistemic source. However, it comes with several drawbacks. For instance, the world wide web seems to foster filter bubbles and echo chambers and includes search results that promote bias and spread misinformation. Richard Heersmink suggests online intellectual virtues to combat these epistemically detrimental effects . These are general epistemic virtues applied to the online environment based on our background knowledge of this online environment. I argue that these online intellectual virtues also demand a particular (...) view of cognitive integration. Online intellectual virtues are incompatible with a popular conception of extended minds proposed by Andy Clark and David Chalmers . I suggest that if we want to hold on to both a conception of online intellectual virtues and some conception of the extended mind, we have to accept a more gradual theory of cognitive integration along the lines of second-wave theories of the extended mind. The article takes the renewed popularity and interest in epidemiological modelling for Covid-19 as a point of departure to ask how modelling has historically shaped epidemiological reasoning. The focus lies on a particular model, developed in the late 1920s through a collaboration of the former field-epidemiologists and medical officer, Wade Hampton Frost, and the biostatistician and population ecologist Lowell Reed. Other than former approaches to epidemic theory in mathematical formula, the Reed-Frost epidemic theory was materialised in a simple mechanical analogue: (...) a box with coloured marbles and a wooden trough. The article reconstructs how the introduction of this mechanical model has reshaped epidemiological reasoning by shifting the field from purely descriptive to analytical practices. It was not incidental that the history of this model coincided with the foundation of epidemiology as an academic discipline, as it valorised and institutionalised new theoretical contributions to the field. Through its versatility, the model shifted the field’s focus from mono-causal explanations informed by bacteriology, eugenics or sanitary perspectives towards the systematic consideration of epidemics as a set of interdependent and dynamic variables.
