Recent controversies about the level of replicability of behavioral research analyzed using statistical inference have cast interest in developing more efficient techniques for analyzing the results of psychological experiments. Here we claim that complementing the analytical workflow of psychological experiments with Machine Learning-based analysis will both maximize accuracy and minimize replicability issues. As compared to statistical inference, ML analysis of experimental data is model agnostic and primarily focused on prediction rather than inference. We also highlight some potential pitfalls resulting from (...) adoption of Machine Learning based experiment analysis. If not properly used it can lead to over-optimistic accuracy estimates similarly observed using statistical inference. Remedies to such pitfalls are also presented such and building model based on cross validation and the use of ensemble models. ML models are typically regarded as black boxes and we will discuss strategies aimed at rendering more transparent the predictions. (shrink)

The re-use of publicly available (personal) data for originally unanticipated purposes has become common practice. Without such secondary uses, the development of many AI systems like large language models (LLMs) and ChatGPT would not even have been possible. This chapter addresses the ethical implications of such secondary processing, with a particular focus on data protection and privacy issues. Legal and ethical evaluations of secondary processing of publicly available personal data diverge considerably both among scholars and the general public. While some (...) of these uses are met with opposition and criticism, others are quite unanimously viewed as unproblematic. Often, proponents and opponents of such practices invoke the same ethical and legal standards for their opposite conclusions. This state of affairs shows that other considerations besides the public availability of data must play a role. It calls for a theoretical clarification of the additional criteria that should guide decisions about the (legally informed) ethical acceptability of re-processing practices. In order to make a contribution towards this goal, the present chapter maps the ongoing debate and systematises the existing contributions around three lines of argument: a consent-centred position, an approach that focuses on the distinction between data and information, and finally a line of argument that focuses on the contextual norms that govern the flows of information. The chapter further relates these arguments to three underlying conceptions of privacy and data protection: rights-based, structural and contextual, and discusses the advantages and disadvantages of each position in the light of concrete examples. It concludes by arguing for a mixed approach that combines core elements of the structural and contextual approaches. The chapter aims to contribute to existing research in the fields of data, AI and research ethics, and to reconnect the debate with ethical and legal scholarship on privacy and data protection. In doing so, it aims to make a theoretical contribution towards refining existing conceptions of privacy and data protection in order to make them more fit to ‘drive our digital world’ as far as the use of publicly available data is concerned. Artificial intelligence (AI) and molecular biotechnologies (MB) are among the most promising, but also ethically hotly debated emerging technologies. In both fields, several ethics reports, which invoke lists of ethics principles, have been put forward. These reports and the principles lists are technology specific. This article aims to contribute to the ongoing debate on ethics of emerging technologies by comparatively analysing four European ethics reports from the two technology fields. Adopting a qualitative and in-depth approach, the article highlights how ethics (...) principles from MB can inform AI ethics and vice versa. By synthesizing the respective ethical cores of the principles included in the analysed reports, the article derives, moreover, a unified list of principles for assessing emerging technologies. The suggested list consists of nine principles: autonomy; individual and social well-being and prevention of harm; reliability, safety and security; informational privacy; transparency; accountability; communication, participation and democracy; justice, fairness, and non-discrimination; sustainability. Il concetto di legittimità è al tempo stesso definito e indefinito, chiaro e sfuggente. Da un lato, esso evoca immediatamente e spontaneamente un sentimento di approvazione, perché chiaramente collegato nel linguaggio comune a un giudizio valutativo positivo. Dall’altro lato, se analizzato da vicino, il suo contenuto appare sfuggente, polisemico, controverso. Questo ne fa una categoria potente dal punto di vista politico ed estremamente affascinante da un punto di vista scientifico. Nelle pagine seguenti verranno analizzate le teorie di tre autori che (...) si sono confrontati con questo concetto indagando uno degli ambiti in cui la dicotomia sopra presentata è più evidente: quello internazionale. Si tratta della teoria di Ian Clark sulla legittimità nella società internazionale, della prospettiva interciviltà sul diritto internazionale proposta da Onuma Yasuaki e della riflessione di Antony Anghie sullo sviluppo dei principi fondamentali del diritto internazionale e il loro rapporto con il colonialismo. Come vedremo, si tratta di indagini tra loro fortemente eterogenee, e che non sempre fanno del concetto di legittimità internazionale l’oggetto principale o esplicito delle proprie ricerche. Nel confronto tra queste teorie che proporrò nelle mie pagine, il concetto di legittimità internazionale mostrerà tutta la sua complessità e tutto il suo ambiguo rapporto con elementi valutativi. The book introduced in this text is based on the premise that the trade-off between privacy and security is both unsound and conceals important aspects of surveillance and control. Accordingly, the authors analyse the symbiotic relationship between liberty and security, and the emptiness of both concepts when considered in isolation. They explore and contextualise different notions of risk, surveillance practices and the value of the rights to private life and data protection. Thereby, they show that surveillance and control neither necessarily (...) attain security, nor always pose a threat to privacy and, conversely, that protecting privacy does not necessarily hamper security provision. Moreover, they appreciate how surveillance and control, mediated through technology, express and sustain specific power relationships. The book thus offers a kaleidoscope of perspectives, ranging from critical studies to international relations, law, philosophy and sociology, to rethink surveillance and control. (shrink)

Le politiche di sicurezza hanno assunto nel corso degli ultimi decenni un ruolo centrale all’interno dell’Unione Europea (UE) e ne costituiscono attualmente uno dei settori più controversi. Nel porsi come attore in grado di garantire sicurezza, l’Unione assume da un lato sempre più compiti e funzioni che sin dall’inizio dell’età moderna sono stati prerogativa del potere statale, senza poter direttamente avvalersi, dall’altro lato, dei principi di legittimazione propri dello Stato. Gli sviluppi recenti delle politiche di sicurezza UE, inoltre, sono fortemente (...) condizionati dai processi di digitalizzazione. Questi favoriscono l’emergere di nuovi modi di intenderle, caratterizzati da un approccio “preemptivo”. Questo denota un modo di affrontare la criminalità che si concentra sugli effetti piuttosto che sulle cause e, attraverso la formulazione di prognosi, mira a intervenire prima che determinati avvenimenti si manifestino al fine di evitarli. Il libro esplora questi sviluppi e discute se, alla luce di essi, i principi fondamentali di legittimità dell’UE siano in grado di esercitare effettivamente la propria funzione di limitazione del potere e tutela dei diritti fondamentali. Attraverso analisi di pratiche concrete quali l’utilizzo e il potenziamento di grosse banche dati, tra cui il sistema di informazione Schengen (SIS), l’analisi dei codici di prenotazione recentemente introdotti dalla Direttiva PNR e l’incremento dell’interoperabilità tra le banche dati europee, il volume mette in atto un approccio filosofico “critico-realistico”, che si ancora nella realtà ma non rinuncia alla normatività e all’elaborazione di proposte alternative. Nel far ciò, le ricerche qui esposte intendono offrire un contributo agli ambiti disciplinari della filosofia politica e della filosofia del diritto, e, più specificamente, dei Security Studies e degli European Studies. Olympe de Gouges (Montauban 1748 – Parigi 1793) è generalmente nota come autrice della Dichiarazione dei diritti della donna e della cittadina. Il documento, scritto nel 1791 in risposta alla Dichiarazione dei diritti dell’uomo e del cittadino, mette in luce la parzialità di quest’ultima, che, nonostante le rivendicazioni formalmente universalistiche, fu proclamata esclusivamente “da” e “per” esseri umani di sesso maschile. Nella sua dichiarazione, de Gouges rivendica il riconoscimento dei diritti civili e politici delle donne e anticipa così alcune delle (...) istanze centrali del femminismo. L’approccio di de Gouges, inoltre, pur aderendo al paradigma teorico del giusnaturalismo, si distingue all’interno di quest’ultimo per modernità e coerenza. L’impegno politico e intellettuale di de Gouges non rimase confinato alla rivendicazione dei diritti delle donne. Ella si espresse infatti su molti dei temi centrali del dibattito pubblico francese negli anni della Rivoluzione, tra cui la sanità pubblica e le politiche sociali, la questione del voto per testa o per ordine, l’esecuzione di Luigi Capeto, il divorzio, la schiavitù e la tratta degli schiavi. De Gouges denunciò inoltre le ingiustizie che caratterizzavano la situazione delle donne, degli schiavi, dei meno abbienti, dei malati, delle partorienti, dei figli illegittimi, mostrando le cause strutturali e sociali della loro vulnerabilità. Alcune delle sue proposte furono fatte proprie e realizzate dal governo rivoluzionario, come quella riguardante l’introduzione di una tassa volontaria per risanare le casse statali. La produzione intellettuale di de Gouges include romanzi e racconti, opere teatrali, saggi filosofici, pamphlet, lettere aperte e altri scritti brevi, e consta di circa 150 opere. Il suo impegno politico, che in lei si saldò sempre strettamente al lavoro intellettuale, le costò infine la vita. Nell’estate del 1793 fu arrestata mentre cercava di affiggere un manifesto dal titolo Le Tre Urne, in cui suggeriva di far decidere al popolo francese quale fosse la forma migliore di governo per la Francia. Dopo alcuni mesi di prigionia e un processo sommario, fu condannata a morte. La sentenza fu eseguita il 3 novembre del 1793. (shrink)

In 1791, two years after the proclamation of the ‘Declaration of the Rights of Man and of the Citizen’, the playwright, essayist, philosopher and revolutionary Olympe de Gouges wrote a short work entitled The Rights of Woman, the core of which is the Declaration of the Rights of Woman and of the Citizen. As is already clear from the title, with her writing de Gouges intends to highlight the gendered character of the 1789 Declaration. To this end, the author first (...) of all points out the contradictory nature of this Declaration: the rights it proclaims as universal apply, in law and in fact, only to human beings of the male gender. De Gouges also reformulates the claims of the Declaration so that they apply equally to men and women. This essay focuses on two themes of particular importance within de Gouges' reformulation: the claim of freedom of expression and the extension of the social contract to relationships. In dealing with these themes, de Gouges elaborates far-reaching theoretical insights that are significant not only for gender studies, but also for political philosophy and the philosophy of law. In fact, de Gouges' reflections, while placing themselves within the natural law tradition, reject and overturn some of its fundamental assumptions. Prominent among these are the subtraction of the family sphere from the equal regulation of relations between individuals, which instead characterises relations between citizens in the public sphere, and the abstraction from differences on which the particularism of rights, though proclaimed as universal, is based. The European Union and the International Criminal Court are two of the most original and interesting elements of the contemporary international situation. Both of them are the result of a delicate balance between ethical issues and political interests and, consequently, institute a complex relationship with states' sovereignty. Their common ground of values has brought the European Union to sustain the International Criminal Court since its preparatory works. Through the analysis of the most significant documents and the ways of the cooperation (...) between these two organisms, this essay focuses on the problems that face the international justice and the possible means of its affirmation. It seems to be drawn a new aspect of international relations, far from the traditional power politics and underpinned by the consent that international organisms can gain among the public opinion through their policy consistence with justice and peace values. Bolzaneto, Abu Grahib, Guantanamo: luoghi in cui la tortura è riemersa nel “civile”occidente contemporaneo. A perpetrarla sono i rappresentanti di uno Stato che si definisce “di diritto”: uno Stato la cui giustificazione ultima è la difesa e la protezione dei diritti inviolabili degli individui. La tortura, lungi dall’essere scomparsa, dunque permane come tecnica di potere nei moderni stati democratici. Essa non solo persiste come dato di fatto. Al contrario, negli ultimi decenni sono riemerse giustificazioni della tortura come pratica legale e (...) legittima per garantire la sicurezza dello Stato. Di fronte a queste nuove giustificazioni della tortura è oggi più che mai importante lasciarsi guidare dall’esperienza storica piuttosto che da ipotetici scenari futuri e, seguendo l'amonimento della studiosa statunitense Judith Shklar, fondare la difesa dei diritti sull’assunto, “ampiamente giustificato da ogni pagina di storia politica, che alcuni rappresentanti del potere statale si comporteranno regolarmente, su piccola o grande scala, in modo illegale e brutale, a meno che non venga loro impedito di farlo”. As a technique of social control based on the collection of information, surveillance has been a central instrument of any administrative power since the modern era. Surveillance, however, can be carried out in different ways and these can provide important information on the basic features of a particular political system. Indeed, the introduction of surveillance measures has an impact on key relationships of a political system, such as liberty and security, autonomy and authority. When a political system is, like the (...) European Union (EU), in a dynamic and build-up phase, by analysing its surveillance practices one can even discern the trajectories of its developments. The paper analyses two surveillance measures in the EU: the Schengen Information System (SIS) and the Directive 2006/24/EC on data retention. It puts forth the argument that the reference to security as a value enables the EU to compensate its legitimacy deficiencies and to develop into a power system characterised by a more supranational structure than before. During the French Revolution, Olympe de Gouges (1748-1793) campaigned for the rights of women, enslaved people and other politically marginalised and underprivileged groups. Conceptually, her reflection is located within the tradition of the social contract. However, she made a theoretical and practical break with this by abolishing the separation between the political and private spheres and universally expanding political participation and belonging.

On the possibilities and limits of the ethics of artificial intelligence. An overview of current developments and debates with a focus on language processing systems. -/- Driven by the success of artificial intelligence (AI), the ethics of AI is currently enjoying a boom. Advice from ethics experts is increasingly being sought by policymakers and industry to proactively identify the risks associated with new AI technologies and to propose solutions. But how realistic are the expectations placed on AI ethics to make (...) technological development more equitable and acceptable? Doesn't AI ethics itself run the risk of becoming a fig leaf in the service of pre-determined economic and political goals? Based on these questions, this article presents and discusses some of the most current debates and proposals for dealing with the opportunities and risks of AI technologies, with a particular focus on language technologies. Although the danger of instrumentalization is present, the article concludes, the ethics of AI currently represents an important opportunity to identify problematic developments at an early stage and to initiate societal debates, political processes, and legal regulations that can make future AI developments more equitable and environmentally sound. In this article we tackle the core question of machine emotion research – “Can machines have emotions?” – in the context of “social robots”, a new class of machines designed to function as “social partners” for humans. Our aim, however, is not to provide an answer to the question “Can robots have emotions?” Rather we argue that the “robotics of emotion” moves us to reformulate it into a different one – “Can robots affectively coordinate with humans?” Developing a series of (...) arguments relevant to theory of emotion, philosophy of AI, and the epistemology of synthetic models, we argue that the answer to this different question is positive, and that it lays grounds for an innovative ethical approach to emotional robots. This ethical project, which we introduced elsewhere as “synthetic ethics”, rejects the diffused ethical condemnation of emotional robots as “cheating” technology. Synthetic ethics focuses not on an ideological refusal, but on the concrete sustainability of the emerging mixed human-robot social ecologies. On this basis, in contrast to a purely negative ethical approach to social robotics it promotes an analytical case by case ethical inquiry into the type of human flourishing that can result from human-robot affective coordination. This paper investigates young children's knowledge of scalar implicatures and downward entailment. In previous experimental work, we have shown that young children access the full range of truth-conditions associated with logical words in classical logic, including the disjunction operator, as well as the indefinite article. The present study extends this research in three ways, taking disjunction as a case study. Experiment 1 draws upon the observation that scalar implicatures (SIs) are cancelled (or reversed) in downward entailing (DE) linguistic environments, e.g., (...) in the scope of negation (Chierchia, 2000). Experiment 2 was designed to determine if scalar implicatures are used by children, like adults, to influence the interpretation of disjunction in non-DE contexts, yielding an implicature of exclusivity for disjunction. Whereas adult controls always rejected assertions of the form A or B in positive (non-DE) contexts in which assertions of the form A and B were also true, many children accepted assertions with disjunction in such contexts. To provide an interpretation to the findings from Experiment 2, a new experimental technique was devised and used in Experiment 3. The new technique presents pairs of assertions to children, who are asked to judge which assertion is a ‘better’ description of the context. The findings from Experiment 3 demonstrated children's awareness that A and B is more informative than A or B in positive contexts, where both statements are true. Taken together, the findings of Experiments 2 and 3 are compatible with the view that some children lack the computational resources to apply scalar implicatures when a single assertion is presented alone (see Reinhart, 1999). A partire dal XX secolo si è fatta strada l’idea che l’istituzione di tribunali penali internazionali sia un fondamentale e necessario contributo al processo di ricostruzione della pace in contesti post-bellici. Attraverso l’imparzialità nell’individuazione delle colpe e nella distribuzione delle pene, i tribunali penali internazionali sarebbero in grado, secondo questa linea interpretativa, di sopire odi e divisioni, di scoraggiare la commissione di ulteriori crimini e di porre così le basi per una nuova convivenza pacifica. Questa fiducia nella funzione pacificatrice del (...) diritto internazionale penale ne ha sostenuto lo sviluppo storico. Sulla base di questa funzione il Consiglio di Sicurezza ha motivato la creazione di tribunali penali internazionali negli anni Novanta. L’atteggiamento del Consiglio di Sicurezza nei confronti del rapporto tra giurisdizioni penali internazionali e pace non si è però mantenuto lineare nel tempo. Il Consiglio di Sicurezza ha infatti mostrato successivamente di nutrire scarsa fiducia nella funzione pacificatrice del diritto internazionale penale e talvolta di ritenere che i procedimenti penali internazionali possano ostacolare il processo di pace. Il saggio indaga questo complesso rapporto e le ambiguità dell'atteggiamento del Consiglio di Sicurezza rispetto ai tribunali penali internazionali. (shrink)

Il diritto internazionale penale è un fenomeno relativamente recente della vita internazionale ed è una disciplina tuttora in formazione. La sua nascita e il suo sviluppo hanno suscitato grande interesse nella comunità scientifica, perchè il trasferimento, seppur parziale, del potere punitivo dallo Stato a organismi internazionali è una novità assoluta della struttura politico-giuridica dei rapporti internazionali. Il trasferimento della competenza penale dalla sfera nazionale alla sfera internazionale è realizzato, secondo l'argomento giustificativo che sostiene la creazioni dei tribunali penali internazionali, in (...) nome di interessi e valori anch'essi sopranazionali, espressione delle esigenze della 'società internazionale' globale. La categoria di 'società internazionale' assume dunque un'importanza centrale nella giustificazione del diritto penale internazionale, divenendo un utile, e forse imprescindibile, strumento interpretativo per la comprensione e la valutazione del diritto internazionale penale e della sua legittimità. Surveillance, understood as the collection of information about populations for supervision purposes, is a critical technique of social control. As such, it can reveal important features of the power that exercises it. The article analyses two contemporary surveillance measures in Europe: the Schengen Information System and the Directive 2006/24/EC on data retention. The analysis aims to identify the structural characteristics of the changing power of the EU and the role security plays in it. An important debate in the current literature is whether “all truth-conditional effects of extra-linguistic context can be traced to [a variable at; LM] logical form” (Stanley, ‘Context and Logical Form’, Linguistics and Philosophy, 23 (2000) 391). That is, according to Stanley, the only truth-conditional effects that extra-linguistic context has are localizable in (potentially silent) variable-denoting pronouns or pronoun-like items, which are represented in the syntax/at logical form (pure indexicals like I or today are put aside in this discussion). According to (...) Recanati (‘Unarticulated Constituents’, Linguistics and Philosophy, 25 (2002) 299), extra-linguistic context can have additional truth-conditional effects, in the form of optional pragmatic processes like ‘free enrichment’. This paper shows that Recanati’s position is not warranted, since there is an alternative line of analysis that obviates the need to assume free enrichment. In the alternative analysis, we need Stanley’s variables, but we need to give them the freedom to be or not to be generated in the syntax/present at logical form, a kind of optionality that has nothing to do with the pragmatics-related optionality of free enrichment. This paper addresses issues regarding perceptions of surveillance technologies in Europe. It analyses existing studies in order to explore how perceptions of surveillance affect and are affected by the negative effects of surveillance and how perceptions and effectiveness of surveillance technologies relate to each other. The paper identifies 12 negative effects of surveillance including, among others, privacy intrusion, the chilling effect and social exclusion, and classifies them into three groups. It further illustrates the different ways in which perceptions and effectiveness (...) of surveillance interact with each other, distinguishing between perceived security and perceived effectiveness. Finally, the paper advances a methodology to take into account perception issues when designing new surveillance technologies. By doing so, it rejects manipulative measures aiming at improving perceptions only and suggests measures that address the background conditions affecting perceptions. (shrink)

This article focuses on the so-called “Area of Freedom, Security and Justice” (ASFJ), namely the policy field of the European Union (EU) that covers judicial and police cooperation, migration and asylum policies and the control of external borders. The article explores how the AFSJ has emerged and how, within it, the relationship between freedom and security has evolved over time and brought about a shift towards a “Security Union”.

Digitalisation has lent the right to privacy increasing philosophical and legal relevance. However, privacy’s epistemic status and associated normative values are constantly subject to radical criticisms. This article investigates the validity, in theory and practice, of three radical critiques of privacy. A review of the philosophical and interdisciplinary discourse on privacy during the last half century is followed by analyses of recent legal developments within the EU. Privacy emerges as a highly differentiated and powerful tool to protect individuals and social (...) relations and to limit and redistribute power. However, the right to privacy remains far from realising its practical potential. (shrink)

The Passenger Name Record (PNR) Directive has introduced a pre-emptive, risk-based approach in the landscape of European databases and information exchange for security purposes. The article contributes to ongoing debates on algorithmic security and data-driven decision-making by fleshing out the specific way in which the EU PNR-based approach to security substantiates core characteristics of algorithmic regulation. The EU PNR framework appropriates data produced in the commercial sector for generating security-related behavioural predictions and does so in a way that gives rise (...) to a paradoxical normativity directly dependent on empirical states. Its ‘securitisation move’ is moreover characterised by an inherent tendence to expand. As a result, the PNR Directive poses challenges for existing check and balance mechanisms and for human autonomy. These challenges could be partially addressed by strengthening ex-post control procedures and independent auditing. Yet in the decision to adopt a risk-based security model, something more fundamental seems to be at stake, namely, the preservation of the idea of human beings as moral agents able to direct and modify their behaviour in accordance with an intelligible, reliable and predictable normative order. The idea that transnational dynamics challenge the regulatory capacity of the state has hardly ever received as much attention as in contemporary debates. Different voices denounce the crisis of the state and advocate the establishment of supranational institutions with legally coercive power. It is tempting to jump to the conclusion that these voices are concerned with the same cluster of problems. We think that one should resist this temptation. Firstly, not all the problems pointed out by the advocates of supranational (...) sovereignty are of the same kind and structure. Some concern the need to limit the power of states, whereas others address the almost opposite necessity to support and strengthen their problem-solving capacity through forms of international regulation. Secondly, the corresponding solutions are different. In particular, although they may all imply the establishment of supranational institutions, not all such institutions need be global. The creation of a full-blown global rule of criminal law, for instance, would raise serious concerns of global despotism and cultural imperialism, and we therefore make a case for regional and context-sensitive solutions in this case. However, problems of supranational socioeconomic justice can only be addressed through global regulatory institutions, for regional institutions would, in this case, only recreate current problems at the interregional level. The aim of the present study was to investigate the effects of communicative intention on action. In Experiment 1 participants were requested to reach towards an object, grasp it, and either simply lift it or lift it with the intent to communicate a meaning to a partner . Movement kinematics were recorded using a three-dimensional motion analysis system. The results indicate that kinematics was sensitive to communicative intention. Although the to-be-grasped object remained the same, movements performed for the ‘communicative’ condition (...) were characterized by a kinematic pattern which differed from those obtained for the ‘individual’ condition. These findings were confirmed in a subsequent experiment in which the communicative condition was compared to a control condition, in which the communicative exchange was prevented. Results are discussed in terms of cognitive pragmatics and current knowledge on how social behavior shapes action kinematics. (shrink)

Moving away from the currently prevalent Big Data mindset towards a Small Data approach would help improve the sustainability of AI systems and would additionally have positive implications for fairness, (global) justice, privacy, transparency, and accountability.

European police and judicial cooperation was initiated as a counterpart to the progressive abolition of internal border controls under Schengen. Since then, the security policy of the European Union (EU) has developed into one of the most dynamic and fastest growing policy areas of the Union. The aim of this contribution is to outline the main trends and characteristics of this policy field. I suggest to conceptualised them as instances of ‘pre-emptive security’. This is an approach to security that focuses (...) on hypothetical future events and aims to prevent the most serious events (e.g. serious criminal offences) by means of risk assessments and probability forecasts, without addressing the phenomenon as a whole (e.g. crime) and its causes. Pre-emptive understandings of security differ from both reactive and pre-emptive approaches. In the paper, I outline the main characteristics of this model both in historical terms and with regard to the latest developments in the field of EU security policy. Finally, I discuss the problematic normative implications of the pre-emptive understanding of security, both for the rule of law and democracy and for human autonomy. (shrink)

The International Criminal Court (ICC) seems to have finally realized the ending legal globalists have long yearned for: a potentially universal, centralized and permanent court, able to enforce international humanitarian law without the mediation of the state. A legal system of mankind seems now more possible than ever before. The universalistic claim of the ICC, I contend in this article, is nevertheless potentially biased by a West-centric prejudice. Critically drawing on the transcivilizational perspective suggested by Onuma Yasuaki, I propose to (...) overcome the West-centric approach of the ICC by assuming the multiplicity of universalisms, thus relativising each of them. Smell can be understood as a cultural phenomenon, historically signified, enforcing social structures or transgressing them, creating social bonds – empowering or disempowering people. The perception of smell consists not only of the sensation of the odours themselves, but of the experiences and emotions associated with them. Odours, unlike colours, for instance, cannot be named, only described; in the realm of olfaction, we must make do with descriptions, analogies and recollections. It is an elusive phenomenon. From natural environments to urban (...) spaces, the large variety of odours can stimulate our olfactory senses and evoke experiences, in which pleasant and unpleasant, and even non-smelling scents, can be combined as parameters of spatial limits and social bounds. Thus, smell can be used to structure and classify different aspects of the world, from time and space to gender and selfhood. The aim of this text is to comprehend some chemical and cultural aspects of smells and odours, and their potential to elaborate social connections and configure spatial orientations. Based on some examples from the Bororo of Brazil and the aboriginal inhabitants of the Andaman Islands, odours are understood as cultural classification systems and means of ordering the world. At the end, some artists – such as Usman Haque, Rion Willard and Jenny Marketou – will be presented since their art works proposals of mapping and describing physical spaces through smells and odours can be apprehended as a medium to create evocative experiences. From Gerdil to Marugi: Malebranchean Revival and Lockean Readings. For the Cardinal Gerdil, the only philosophical reflection able to combine aspects of Post-Cartesian philosophy with Augustinian Platonism and to provide an explanation of the spirituality of the soul and of the philosophically plausible and pragmatic mind-body interaction in an apologetic reflection on religion was the philosophy of Malebranche. Committed to the defence of the immortality of the soul and the vision of all things in God which found favour in English (...) neo-Platonic thinking, Gerdil becomes one of the protagonists of Italian culture engaged in the European philosophical debate developed against Lockean reason and in defence of Neoplatonism and Cartesianism. To form an emblem of rationalistic rationalism and materialism in metaphysics and religion was a task of certain Italian thinkers, including Muratori, Francesco Zanotti, Marugi and Francesco Soave, and in particular Cardinal Gerdil. Depressive mood can be involved in the moral judgments made by people with depression. Here, we focus on the negative judgments depressed patients have of themselves and the world. Possibly, the alterations in moral judgment in subjects with depression can be understood by taking into account the neural basis of depression.

Particular applications of Privacy by Design (PbD) have proven to be valuable tools to protect privacy in many technological applications. However, PbD is not as promising when applied to technologies used for surveillance. After specifying how surveillance and privacy are understood in this paper, I will highlight the shortcomings of PbD when applied to surveillance, using a web-scanning system for counter-terrorism purposes as an example. I then suggest reworking PbD into a different approach: the Minimum Harm by Design (MHbD) model. (...) MHbD differs from PbD principally in that it acknowledges that the potential harms of surveillance bear not only upon privacy but also values that define the very constitution of a society and its political character. MHbD aims to identify and systematise the different categories of such harms and links them to current theories on surveillance on the one hand and on possible design measures on the other. (shrink)

In this paper I demonstrate that there is an explanation of the number marking we see on nouns when they combine with the numeral _zero_ which combines Martí’s (Semant. Pragmat., 2020a, https://doi.org/10.3765/sp.13.3 ) account of the morphosyntax and semantics of the numeral-noun construction with Bylinina and Nouwen’s (Glossa 3(1):98, 2018 ) semantics for _zero_ and which does not need to appeal to any further principles (e.g., agreement).
