Following the murder of George Floyd, the Black Lives Matter-movement (BLM) took to the streets to protest against institutional racism. In these protests, one could often hear the slogan “No Justice, No Peace”. Drawing on legal theory, speech act theory and phenomenology, this article investigates what kind of justice and peace are called upon and how the slogan functions as a claim addressed to the legal order. First, the article shows that the rule of law provides a comprehensive normative framework (...) to evaluate what went wrong during the arrest of George Floyd. Second, the article maintains that the slogan should be understood as a passionate utterance in the sense of Stanley Cavell. Finally, drawing on a responsive phenomenology of legal order inspired by the work of Bernhard Waldenfels, the article concludes that the slogan is an extraordinary claim questioning the legal order, showing its contingent origins. This article aims to provide a semiotic analysis of environmental law and youth protests. More precisely, drawing on speech act theory this article regards both as types of communication and teases out the inherent voice and message, specifically with regard to the interests of future generations. The argument unfolds in three steps. First, the article looks into speaker and speech of environmental law and argues that it speaks, as legislation does, in the first-person plural voice of a ‘we’. Second, the (...) article examines a speech of Greta Thunberg through the lens of Stanley Cavell’s theory of passionate utterances. This interpretation will unlock the political stakes of Thunberg’s speech as she claims standing with those responsible for enacting environmental law. Finally, the consequences of this reading will be analysed by relating message and voice of environmental law. As youth protests question ordinary forms of political representation, new ways of safeguarding the interests of future generations are called upon. (shrink)

Ulrich Beck characterized the transition from modern to late modern society as a shift from an industrial to a “risk society.” Contemporary society is challenged by negative side effects of modernization, including the increasing and imminent threat of global climate change. This article will test the validity of conceivable prescriptive elements associated with this sociological theory. In doing so, it will focus on the most recent legal developments aimed at tackling climate change within the EU. This paper finds that the (...) precautionary approach is unable to sufficiently shape balanced legal intervention in this day and age. This study aimed to investigate the relationships between physical fitness and academic performance in youth handball players of different BMI classifications. Thirty-three male handball players were recruited from the Qatar handball first league and were assigned to their BMI age-adjusted groups. Measurements included anthropometric data and body fat percentage, and physical performance tests: agility T-half test; squat jump, and countermovement jump, 10 and 15 m sprint; medicine ball throw. Aerobic capacity was evaluated using the Yo-Yo Intermittent Recovery Test level 1. (...) Academic achievement was assessed through school records of grades point average of Mathematics, Science and Arabic. None academic performance parameter and four physical performance parameters were different between BMI related groups. In 43% of performance parameters and all academic parameters, the normal weight group showed the highest performance level, whereas the overweight group had the best performance in both sprint tests. The obese group was only superior in the medicine ball throw, but not at the p 0.5) between academic and physical performance parameters was only found between Yo-Yo IR 1 and science. A relevant correlation were found between CMJ and BMI. The agility T-half test was correlated with CMJ and 10 m sprint. These findings suggest being overweight or obese are related to science academic performance among schoolchildren athletes in Qatar. Possibly, a normal BMI could positively influence academic performance. Physical education teachers, staff, and administrators should be cognizant that health promotion interventions improving composition may have the additional potential to improve dimensions of academic performance. Biological ontologies are used to organize, curate, and interpret the vast quantities of data arising from biological experiments. While this works well when using a single ontology, integrating multiple ontologies can be problematic, as they are developed independently, which can lead to incompatibilities. The Open Biological and Biomedical Ontologies Foundry was created to address this by facilitating the development, harmonization, application, and sharing of ontologies, guided by a set of overarching principles. One challenge in reaching these goals was that the (...) OBO principles were not originally encoded in a precise fashion, and interpretation was subjective. Here we show how we have addressed this by formally encoding the OBO principles as operational rules and implementing a suite of automated validation checks and a dashboard for objectively evaluating each ontology’s compliance with each principle. This entailed a substantial effort to curate metadata across all ontologies and to coordinate with individual stakeholders. We have applied these checks across the full OBO suite of ontologies, revealing areas where individual ontologies require changes to conform to our principles. Our work demonstrates how a sizable federated community can be organized and evaluated on objective criteria that help improve overall quality and interoperability, which is vital for the sustenance of the OBO project and towards the overall goals of making data FAIR. Previously published as special issues of _The European Journal of the History of Economic Thought_ and _The Review of Political Economy_, this volume contains the papers devoted to the life and work of Piero Sraffa. Sraffa was a leading intellectual of the twentieth century. He was brought to Cambridge by John Maynard Keynes and had an important impact on the philosopher Ludwig Wittgenstein. He received the golden medal Söderström of the Swedish Academy of Sciences for his edition of David Ricardo's (...) _Works and Correspondence_ and he is the author of _Production of Commodities by Means of Commodities_, one of the most often cited book in economics. Using hitherto unpublished material from Sraffa's literary heritage kept at Trinity College, Cambridge, the papers throw new light on the intellectual development of the young Sraffa and correct several of the received views on him and his contribution. Themes covered concern his: objectivism rediscovery and reformulation of the classical theory of value and distribution criticism of Alfred Marshall's analysis relationship with his Cambridge colleagues and friends biography around the time when he left Italy for the UK friendship with Wittgenstein and his impact on the latter's thinking. Some studies highlighted that patients with narcolepsy type-1 experience high lucid dream frequency, and this phenomenon has been associated with a creative personality. Starting from the well-known “pandemic effect” on sleep and dreaming, we presented a picture of dream activity in pharmacologically treated NT1 patients during the Italian lockdown. Forty-three NT1 patients completed a web-survey during Spring 2021 and were compared with 86 matched-controls. Statistical comparisons revealed that: NT1 patients showed greater sleepiness than controls; controls showed higher sleep disturbances than (...) NT1 patients, and this result disappeared when the medication effect in NT1 was controlled; NT1 patients reported higher lucid dream frequency than controls. Focusing on dreaming in NT1 patients, we found that nightmare frequency was correlated with female gender, longer sleep duration, higher intrasleep wakefulness; dream recall, nightmare and lucid dream frequency were positively correlated with sleepiness. Comparisons between low and high NT1 lucid dreamers showed that patients more frequently experiencing lucid dreams reported a greater influence of dreaming during wakefulness, especially concerning problem-solving and creativity. Overall, our results are consistent with previous studies on pandemic dreaming carried out on healthy subjects. Moreover, we confirmed a link between lucidity and creativity in NT1 patients. Considering the small sample size and the cross-sectional design, our findings cannot provide a causal relationship between lucid dreams and the COVID-19 lockdown. Nevertheless, they represent a first contribution to address future studies on this issue, suggesting that some stable characteristics could interact with changes provoked by the pandemic. (shrink)

It is an indispensable tool for readers of the new Oxford Classical Text of Propertius and (...) for this reason the contemporary publication of both books has been extremely important. The text edited by Heyworth is so innovative that it was necessary to explain and discuss the editor’s choices. Cynthia is a long dialogue with the reader: Heyworth exposes reflections that are the fruits of decades of engagement with the text of Propertius, and one feels that he speaks with authority.The Preface is brief, but it summarizes the method followed in the book and places the critic in his appropriate setting, where he acknowledges his debts to scholars like J. L. Butrica and G. P. Goold. The true introduction is the one to the edition in the OCT: in fact it is one work in two volumes. The bulk of the book consists of a discussion of passages from the entire work of the Latin poet. [End Page 169] Before each elegy there is an essential bibliography. Then follows a quotation (in the vulgate form of the text) of the passage under discussion; in most cases it is accompanied by the critical apparatus of the OCT edition, with some modifications. All the passages examined are included because of textual problems, even if sometimes one gets the impression of being confronted with purely literary aspects of the text. There is no introduction to any elegy, and it is not in fact necessary: we grasp only what is problematic, and following Heyworth’s guidance we are taken through a stimulating experience. After 512 pages of Propertiana (D. R. Shackleton Bailey’s model is unquestionable), there is a complete translation of the text proposed by the editor, which is particularly useful. His policy is not to avoid any problem but to discuss it honestly without preconceptions. At the end there are rich indexes, which offer easy access to the wealth of linguistic and stylistic observations that are disseminated over the commentary. They also include the preface to the edition in the OCT.It is impossible to deal in a detailed manner with the hundreds of proposals and hypotheses. The editor offers us a completely different Propertius from the poet we have been accustomed to know from the more important editions of the twentieth century (deemed as conservative until the edition by Goold [Cambridge, Mass. 1990]). Following the wishes of Butrica, the elegies of Propertius are now consistent with the judgments of ancient critics, who valued in Propertius “a poet of finish, grace and charm” (M. Hubbard, Propertius [London 1974]:3). The text has undergone a massive restoration and it is readable and fluent: no more the work of an “expressionistic” poet (E. Pasoli) with his idiosyncratic language, but of a contemporary of Tibullus and an immediate predecessor of Ovid. The severe corruptions of the text are no longer visible in its linguistic texture, but in its fragmentation, which characterizes in particular the second book. In the others there are not so many ruins, but for lacunae and expunged distichs. The decision not only to bracket them, but to put them at the end of each elegy, is rhetorically astute: if one sees these couplets out of their context, one will certainly damn them, since they usually are a proverbial thought or an item of a catalogue.The text of the OCT exhibits a smooth surface that derives from a complex work of restoration. Butrica had told us that most editors of Propertius are like those who had loved the smoke deposited during the centuries onto the frescoes by Michelangelo in the Sistine Chapel (“Editing Propertius.” CQ 47 [1997]:208). Il seguente articolo si prefigge di analizzare il fenomeno delle alleanze di brand e il loro sviluppo nell’attuale contesto economico. Con l’ampliarsi del lavoro di rete, e la creazione di valore che ne deriva, i legami di partnership tra le imprese evidenziano un salto prestazionale. Ciò avviene anche attraverso la creazione di un’identità condivisa, che ne rafforza la competitività. Dopo la definizione di co-branding, e l’esposizione dei benefici e dei rischi, vengono considerate le opportunità di crescita che ne derivano. Queste (...) alleanze consentono alle reti tra imprese di riposizionarsi nel proprio contesto di appartenenza, migliorando la governance e le strategie di mercato. Anche la relazione con l’attuale crisi economica evidenzia la capacità del co-branding di fronteggiare con maggiore efficacia i momenti di emergenza. Come evidenziato in numerose ricerche, la gestione della crisi trova nelle alleanze di brand uno strumento strategico essenziale per crescere anche se l’instabilità e l’incertezza dell’economia sono elevate. Attraverso l’esame di alcuni case-histories, viene elaborato un modello di co-branding. Si tratta di un prisma dove sono evidenziati sei asset strategici: velocità, personalizzazione, flessibilità, facilità, dialogo e convergenza. En jetant la sonde de l’interrogation philosophique au lieu de soi, Jean-Luc Marion nous donne une approche organique et originale à la pensée d’Augustin, en entrecroisant entre eux deux plans herméneutiques : sur le premier, l’on poursuit un itinéraire de rapprochement au cœur de la confessio augustinienne permettant de réduire le vaste univers sémantique d’Augustin à un noyau génétique unifiant; sur le second plan, le parcours philosophique de l’auteur se développe ultérieurement, tendant à désarticuler un bloc théorique d’ontologie et métaphysique (...) et atteignant ainsi par une voie phénoménologique une idée de philosophie finalement affranchie de la présupposition du caractère central de la question de l’étant et du fondement. En tout cas, même si l’on ne veut pas donner trop d’éclat à la critique anti-ontologique et antimétaphysique caractérisant l’approche à la pensée augustinienne proposée dans cet ouvrage, l’acquis spéculatif de celle-ci ne semble pas diminuer. Un parmi les mérites principaux de ce livre est d’avoir restitué à la confessio sa dignité théorique, en y apercevant un lieu phénoménologique originaire où la relation entre moi et Dieu se noue; une relation dont le caractère paradoxal, autrement insoutenable, est résolu par le primat du don et de l’amour. Ce sont tous ces traits originaux qui nous mènent à dire qu’Au lieu de soi n’est pas seulement un livre sur Augustin, car il est plus qu’un livre sur Augustin. (shrink)

L’obiettivo di giungere ad una difesa comune europea ha accompagnato il processo di integrazione della UE senza mai essere conseguito. La spiegazione di questo insuccesso sembra risiedere nella difficoltà di conciliare da una parte sovranità degli Stati membri e, dall’altra, trasferimento delle funzioni di difesa e politica estera alle istituzioni comunitarie. Usando parti di un mio recente lavoro sulla federazione kantiana (Caranti 2022), l’articolo mostra come Kant metta a disposizione le risorse necessarie per comprendere le cause profonde che impediscono questa (...) conciliazione e il prezzo che occorrerebbe pagare, appunto in termini di sovranità degli Stati membri, per raggiungere l’obiettivo di una difesa comune. Per ottenere tali risorse occorre entrare nella questione, molto dibattuta negli studi kantiani, del perché Kant sembra, non senza ambiguità e ripensamenti, finire col preferire la soluzione di una federazione sovranazionale su quella della repubblica mondiale (il Völkerbund invece del Völkerstaat) come uno dei tre pilastri su cui poggia il suo progetto di pace perpetua. Nella prima parte si dà quindi conto di tre argomenti kantiani per preferire la soluzione del Völkerbund a quella del Völkerstaat, nella seconda si analizzano alcune critiche cosmopolitiche a tale preferenza, nella terza e quarta si risponde a tali critiche mostrando che il ‘dilemma della sovranità’ percepito da Kant non può essere aggirato nella maniera suggerita dai cosmopoliti per giungere alla conclusione che una difesa comune europea è possibile ed auspicabile ma prevede (o implica) la trasformazione dell’Unione europea da quello che è oggi, un’entità a metà strada tra confederalismo e federalismo, ad una compiuta federazione con governo centrale, vicina al sogno ricorrente degli Stati Uniti d’Europa. L’ordinamento cosmico rappresenta il punto di riferimento costante dell’agire morale della creatura, che deve misurare le sue scelte preferendo sempre gli esseri-beni oggettivamente superiori a quelli inferiori. La virtù della scelta ordinata non è altro che la giustizia, come trasversalmente affermato nelle opere di Agostino d’Ippona. Il presente contributo intende mostrare come, sul piano creaturale, la dinamica della scelta ordinata rimane invariata con la teologia della grazia indebita sviluppata a partire dall’ _ Ad Simplicianum _. In particolare, si intende evidenziare (...) il passaggio da una visione che individua nella creatura stessa, aiutata da Dio, la causa prima della sua volontà morale, presente nelle opere precedenti il 397, a una decisamente più radicale, successiva a questa data, che invece individua tale causa nell’operare efficiente e predestinato di Dio. Quest’ultima posizione mostra il duplice vantaggio di risolvere alcuni paradossi impliciti nella riflessione precedente, senza smentire la forma (ordinata) della giustizia, sebbene non possa evitare di ridimensionare il ruolo della creatura in relazione ai suoi meriti. _ The cosmic order represents the focal point of reference for moral agents, who must evaluate their choices based on the degree of perfection rather than settling for inferiour objects or beings. According to Augustine of Hippo, justice is the virtue of ordered choice. The present contribution aims to show how, from the viewpoint of the creature, the structure of ordered choice does not change even when the theology of grace is developed in Ad Simplicianum. In particular, the essay focuses on the shift from an earlier view, developed before 397, that places the original cause of good will in the creature itself, along with God’s assistance, to a later and more radical perspective that sees God’s role as the exclusive source of good will through efficient and predestined intervention. The latter viewpoint has the dual advantage of unfolding some paradoxes of the previous perspective, while still maintaining the (ordered) form of justice, although it inevitably limits the role of creatures in relation to their merits. _. Driving behaviours and fitness to drive have been assessed using different tools over time: standardized neuropsychological, on-road and driving simulation testing. Nowadays, the great variability of topics related to driving simulation has elicited a high number of reviews. The present work aims to perform a scientometric analysis on driving simulation reviews and to propose a selective review of reviews focusing on critical issues related to validity and fidelity. A scientometric analysis of driving simulation reviews published from 1988 to 2019 was (...) conducted. Bibliographic data from 298 reviews were extracted from Scopus and WoS. Performance analysis was conducted to investigate most prolific Countries, Journals, Institutes and Authors. A cluster analysis on authors’ keywords was performed to identify relevant associations between different research topics. Based on reviews extracted from cluster analysis, a selective review of reviews was conducted to answer questions regarding validity, fidelity and critical issues. USA and Germany are the first two Countries for number of driving simulation reviews. USA is the leading Country with 5 Institutes in the top-ten. Top Authors wrote from 3 to 7 reviews each and belong to Institutes located in North America and Europe. Cluster analysis identified three clusters and eight keywords. The selective review of reviews showed a substantial agreement for supporting validity of driving simulation with respect to neuropsychological and on-road testing, while for fidelity with respect to real-world driving experience a blurred representation emerged. The most relevant critical issues were the a) lack of a common set of standards, b) phenomenon of simulation sickness, c) need for psychometric properties, lack of studies investigating d) predictive validity with respect to collision rates and e) ecological validity. Driving simulation represent a cross-cutting topic in scientific literature on driving, and there are several evidences for considering it as a valid alternative to neuropsychological and on-road testing. Further research efforts could be aimed at establishing a consensus statement for protocols assessing fitness to drive, in order to a) use standardized systems, b) compare systematically driving simulators with regard to their validity and fidelity, and c) employ shared criteria for conducting studies in a given sub-topic. L’articolo affronta il problema delle interazioni fra cittadini romani e indigeni nel territorio di Bergomum, municipium della regio xi - Transpadana, attraverso l’esame delle formule onomastiche riscontrabili in alcune iscrizioni. In particolare, l’analisi della documentazione epigrafica agirà su un doppio binario, prendendo in considerazione sia formule di onomastica idionimica – tipicamente indigene e presenti anche dopo la concessione della cittadinanza romana alla Transpadana alla metà del I secolo a.C. – sia formule fedeli al modello romano dei tria nomina, che testimoniano (...) un’ascendenza celtica e una certa persistenza di abitudini locali. Le prove fornite dall’onomastica, dunque, saranno utili ad indagare come gli abitanti “indigeni” di Bergomum abbiano affrontato la romanizzazione del loro territorio e attraverso quali meccanismi vennero integrati nella struttura sociale romana; ciò anche attraverso il confronto con realtà circonvicine, prima fra tutte la Colonia Civica Augusta Brixia. In questo contributo tenterò di rispondere ad una domanda fondamentale e assai complessa: la concezione di Dio come Esse Ipsum Subsistens rischia una deriva verso il monismo parmenideo? L’indagine verterà dapprima sul superamento di Aristotele della visione parmenidea e poi si concentrerà sulla metafisica dell’essere di Tommaso d’Aquino che, se correttamente intesa, non rischia affatto una deriva verso il monismo ontologico. Saranno infatti presentati alcuni passi che comprovano come il concetto centrale della concezione di Tommaso, quello di partecipazione, garantisca proprio (...) dal rischio del monismo, a patto che si intenda la presenza di Dio negli enti non in un senso quantitativo. La méthode de Meyerson est une méthode logique ; appliquée d’une façon différente soit à l’étude de la pensée qui se dirige vers l’élaboration de la science, soit à son exercice spontané. Cette méthode logique comporte des conclusions qui empêchent la connaissance d’atteindre le réel dans son intégrité. Il s’en suit l’impossibilité d’arriver à une unification complète de ce réel même.. Une vraie métaphysique manque à Meyerson. 11 est nécessaire, pour y parvenir, de dépasser les présupposés phénoménistes de Meyerson, et (...) d’atteindre l’être. Suivant les tendances actuelles de l'exégèse, plus sensible qu'avant à la Wirkungsgeschichte des textes bibliques, l'article s'interroge sur ce que sont devenues la figure de Paul et son œuvre dès la fin du Ie siècle. Constatant que l'on parle peu de l'apôtre et de son oeuvre au IIe siècle, il en cherche les raisons, qui sont d'ailleurs multiples, et fournit au passage une description des communautés chrétiennes qui en souligne la diversité. Cette étude historique, sur la manière dont la chrétienté (...) du IIe siècle a reçu Paul et ses lettres, répond indirectement à une question relative à la répartition des champs missionnaires dans l'Église primitive. Il est en général admis que la mission aux circoncis se limita à la Palestine, et que Paul fut pratiquement le seul à sillonner l'oikoumenè d'alors. Il faut au contraire maintenir le pluralisme des mouvements missionnaires, car c'est seulement ainsi qu'on peut rendre compte des rapports entre les Églises fondées par des apôtres différents en plusieurs régions d'Asie Mineure au IIe siècle.Following the present tendancies of exegesis, and more sensitive than before to the Wirkungsgeschichte of biblical texts, this article asks what has become of the figure of Paul and his work starting at the end of the 1st Century. Pointing out that little was said of the apostle and his works in the 2nd century, the author looks for the reasons, which, in fact, are many, and furnishes in passing a description that underlines the diversity of Christian communities. This historical study, on the manner with which Christianity of the 2nd century received Paul and his letters, indirectly answers a question relative to the repartition of the missionary fields in the primitive church. It is generally admitted that the mission to the circumcised was limited to Palestine and that Paul was practically the only one to cultivate the oikoumenè at this time. On the contrary, one must maintain the pluralism of missionary movements because it is only thus that one can account for the relationships between the Churches founded by the different apostles in a number of regions of Asia Minor in the 2nd century. La première partie de Particle rend compte des conditions philosophiques et du contexte historique dans lequel s'est développée la conception du probable chez Wolff. La seconde met trois aspects de cette conception en relief: 1) la distinction entre la probalité d'un évènement et la probalité d'une proposition, 2) l'interprétation du principe d'égale possibilité en tant que principe de cause non-suffisante, 3) les quelques restrictions conservés par Wolff à l'égard de la validité et des domaines d'application du principe d'égale possibilité. La (...) troisième partie traite de ce que l'on nomme les „experientiae indubitatae". Elles se fondent sur une notion de la certitude qui peut être interprétée comme cas limite de la probabilité. Les certitudes de cette sorte sont acceptées par Wolff comme les premisses d'une preuve. De cette façon Wolff utilise sa conception de la probabilité pour unir les exigences de la raison et celles de l'expérience et débouche sur une conception de la science qui dépasse celle en cours jusque-là. A partir d'elle, il essaye de réaliser le programme rationaliste de l'édification des sciences empiriques. (shrink)

This commentary responds to the following article previously published on the Journal and Business Ethics: ‘Baudoin, L., Arenas, D. “Everyone Has a Truth”: Forms of Ecological Embeddedness in an Interorganizational Context. _J Bus Ethics_ _185_, 263–280 (2023)’. Our commentary offers a rejoinder to Baudoin’s and Arenas’ conclusion that environmental engagement within organizations is a plural field within which many different sub-positions may be discerned. In rejoining their conclusion, our commentary searches for greater nuance in the portrayal of engagement for social (...) and ecological transition in the workplace. This is done in two steps: first, by ‘softening’ categories that conceal as much as they reveal: like Olin Wright’s tripartition of rupture, interstice and reform as _distinct_ forms such engagement might take. Second, by undertaking a close reading of the experience of an activist undertaking training on environmental issues, who has previously left a job with a French car manufacturer. In so doing, we discern the following strategies co-existing simultaneously in this person’s story: an existential quest to frame his choices, the decision to become a broker of scientific information concerning human-made climate change to other professionals, and a state of ‘suspension’ in moving from individual consciousness raising to the initiation of joint action with others. In questo contributo vengono indagati alcuni concetti della teologia aristotelica (il concetto di divino e quello di trascendenza) a partire da un’espressione emblematica utilizzata dallo storico francese Étienne Gilson per descrivere il Primo Motore Immobile aristotelico: “centrale elettrica della natura”. L’espressione del noto studioso non è soltanto particolarmente accattivante, ma risulta essere filosoficamente assai significativa poiché veicola perfettamente il significato che assume il Dio di Aristotele nell’economia complessiva del cosmo, più in particolare nel ciclo eterno delle corruzioni e delle generazioni. La ricostruzione storica è finalizzata a mostrare la novità del messaggio cristiano contenuto nella Rivelazione e che trova nelle pagine di Tommaso d’Aquino una chiarezza concettuale, filosofico-metafisica, di eccezionale valore. In esse è possibile osservare la piena maturazione della nuova visione di tipo creazionista (basata sulla Metafisica dell’Esodo 3,14) che, pur in continuità con la visione aristotelica, ne approfondisce smisuratamente i presupposti metafisici. Bernard Berenson used to refer to Giovanni Morelli as «the founder of the Method». With these words, he meant that Morelli was the scholar who, first, transformed connoisseurship in a science, giving to the discipline a stringent method. Does Morelli’s theory of painting really deserve this praise? To answer this question, this paper examines in the first part the philosophical and scientific background of Morelli’s doctrine, showing how its original debt payed to romantic philosophy went replaced by a neat positivist (...) orientation. In the second part, the Method itself is discussed, asking in which measure it was anticipated by the intuitions of art experts such as Giulio Mancini or Luigi Crespi and discussing the nature and epistemological relevance of the so-called “morellian details”, that is the forms of the nails, of the ears, of the hair’s curls in paintings. Are these details really sufficient for the attribution of a painting to an artist? Which role play the documents in connoisseurship? And, more generally, how important is aesthetic value in the morellian “Method”? (shrink)

The Birth of American Law: An Italian Philosopher and the American Revolution tells the forgotten, untold story of the origins of U.S. law. Before the Revolutionary War, a 26-year-old Italian thinker, Cesare Beccaria, published On Crimes and Punishments, a runaway bestseller that shaped the Declaration of Independence, the U.S. Constitution, and early American laws. First collected in Italy in 1985, _Art's Claim to Truth_ is considered by many philosophers to be one of Gianni Vattimo's most important works. Newly revised for English readers, the book begins with a challenge to Plato, Aristotle, Kant, and Hegel, who viewed art as a metaphysical aspect of reality rather than a futuristic anticipation of it. Following Martin Heidegger's interpretation of the history of philosophy, Vattimo outlines the existential ontological conditions of aesthetics, paying particular attention to the works of (...) Kandinsky, which reaffirm the ontological implications of art. Vattimo then builds on Hans-Georg Gadamer's theory of aesthetics and provides an alternative to a rationalistic-positivistic criticism of art. This is the heart of Vattimo's argument, and with it he demonstrates how hermeneutical philosophy reaffirms art's ontological status and makes clear the importance of hermeneutics for aesthetic studies. In the book's final section, Vattimo articulates the consequences of reclaiming the ontological status of aesthetics without its metaphysical implications, holding Aristotle's concept of beauty responsible for the dissolution of metaphysics itself. In its direct engagement with the works of Gadamer, Heidegger, and Luigi Pareyson, _Art's Claim to Truth_ offers a better understanding of the work of Vattimo and a deeper knowledge of ontology, hermeneutics, and the philosophical examination of truth. Since the first phase of the formal effort to sequence the human genome, geneticists, social scientists and other scholars of race and ethnicity have warned that new genetic technologies and knowledge could have negative social effects, from biologizing racial and ethnic categories to the emergence of dangerous forms of genetic discrimination. Early on in the Human Genome Project, population geneticists like Luigi Luca Cavalli-Sforza enthusiastically advocated for the collection of DNA samples from global indigenous populations in order to track (...) the history of human ancestry, migration, and languages, while social scientists like Troy Duster insisted that the new genetics was in danger of ushering in insidious practices of eugenics. The Human Genome Diversity Project's 1991 proposal to archive human genetic variation around the world quickly came under intense scrutiny by indigenous peoples and advocacy groups who worried that such measures could exploit indigenous groups as research populations and even resurrect racist taxonomies from the nineteenth century. Recent months have brought forth a new edition of Nemesianus and a 294-page study of the textual tradition that he shares with Calpurnius. The edition, prepared by P. Volpilhac for Budé , offers nothing new on the tradition beyond reports of a few manuscripts known to previous editors; but Luigi Castagna's book I bucolici latini minori: una ricerca di critica testuale makes an earnest attempt at solving once and for all the problems that survived the last contribution of any (...) weight, Giarratano's edition . Though most of what Castagna says is true, however, his readers may be cushioned against the sharper points by an undue amount of padding, which also fails to hide gaps. Before he proceeds to his own edition of Nemesianus, therefore, a few things can usefully be said. (shrink)

Background: The traditional approach to resolving ethics concerns may not address underlying organisational issues involved in the evolution of these concerns. This represents a missed opportunity to improve quality of care “upstream”. The purpose of this study was to understand better which organisational issues may contribute to ethics concerns. Methods: Directed content analysis was used to review ethics consultation notes from an academic children’s hospital from 1996 to 2006 (N = 71). The analysis utilised 18 categories of organisational issues derived (...) and modified from published quality improvement protocols. Results: Organisational issues were identified in 68 of the 71 (96%) ethics consult notes across a range of patient settings and reasons for consultation. Thirteen of the 18 categories of organisational issues were identified and there was a median of two organisational issues per consult note. The most frequently identified organisational issues were informal organisational culture (eg, collective practices and approaches to situations with ethical dimensions that are not guided by policy), policies and procedures (eg, staff knows policy and/or procedural guidelines for an ethical concern but do not follow it) and communication (eg, communication about critical information, orders, or hand-offs repeatedly does not occur among services). Conclusions: Organisational issues contribute to ethical concerns that result in clinical ethics consults. Identifying and addressing organisational issues such as informal culture and communication may help decrease the recurrence of future similar ethics concerns. (shrink)

Luigi Taparelli, S.J. sought to "baptize" classical liberal economic thinking by re-establishing it on the basis of a modernized Aristotelico-Thomistic conception of human nature and society. With its flawed anthropology, Taparelli argued that economics as it stood was illequipped to understand the actual character of socio-economic problems and therefore dangerous as an instrument of public policy. Applying his principles of solidarity, subsidiarity, just legal order and piety, Taparelli drew attention to the relationship of moral-cultural factors to economic life and (...) described the limits of government intervention subject to maximum regard for personal liberty."Le Père Luigi Taparelli chercha à « baptiser » la pensée économique libérale classique en la fondant sur une conception Aristotelico- Thomiste modernisée de la nature humaine et de la société. The monograph shows that in the last 50 years theoretical linguistics remains a compendium of mutually contradicting doctrines on multiple levels: the level of general theories of language, the level of its main constituents (the lexicon, syntax, and the lexical-syntactic interface that connects them), and the lower levels of specific linguistic problems (such as lexical polysemy, grammatical meanings, etc.). The contradictions of contemporary linguistic theories are indicative of a deep crisis. Evolutionary-synthetic theory of language is aimed at overcoming this crisis. (...) It implements a multidisciplinary approach that describes the language a) in evolutionary and ontogenetic development and b) in close interaction with other human subsystems: the mental representation of the world, human activity and social interaction. Language is defined as a dual system developing in ontogeny: 'universal sensory sublanguage + ethnically specific functional sublanguage' where the sensory sublanguage is used to describe the 'visible' world (accessible to the senses), and the functional sublanguage is employed to describe the conceivable world ('comprehended by human mind'). Within the framework of the approach presented, many problems are solved: 1) the cognitive (non-verbal) language for representing language meanings; 2) diversity and unity of languages (using the structure alternative to Chomsky's Universal Grammar); 3) the main (original) function of the language; 4) the cognitive language of thought (its basis is the lexical and grammatical meanings of the sensory sublanguage); 5) dual (functionally prototypical) structure of human categories; 6) mechanisms in the early acquisition of lexical and grammatical meanings; 7) the meaning (assignment) of the syntactic structure of a sentence, etc. The book deals with a wide range of issues related to human cognition, glottogenesis and anthropogenesis, universal cognitive structures for the representation of objects, actions and situations, so it will be of interest not only to linguists, but also to psychologists, anthropologists, sociologists, philosophers. In debates about criteria for human death, several camps have emerged, the main two focusing on either loss of the "organism as a whole" (the mainstream view) or loss of consciousness or "personhood." Controversies also rage over the proper definition of "irreversible" in criteria for death. The situation is reminiscent of the proverbial blind men palpating an elephant; each describes the creature according to the part he can touch. Similarly, each camp grasps some aspect of the complex reality of death. (...) The personhood camp, in contrast to the mainstream "organism" camp, recognizes that a human organism can still be a biological living whole even without brain function. The mainstream camp, in contrast to the personhood camp, recognizes that a person can be permanently, even irreversibly unconscious, and still be a living person so long as his/her body is alive. The author proposes that hylomorphic dualism incorporates both these key insights. But to complete the picture of the entire "death elephant," a fundamental paradigm shift is needed to make sense of other seemingly conflicting insights. The author proposes a "semantic bisection" of the concept of death, analogous to the traditional distinction at the beginning of life between "conception" and "birth." To avoid the semantic baggage associated with the term "death," the two new death-related concepts are referred to as "passing away" (or "deceased") and "deanimation," corresponding, respectively, to sociolegal ceasing-to-be (mirror image of birth) and ontological/theological ceasing-to-be of the bodily organism (mirror image of conception). Regarding criteria, the distinguishing feature is whether the cessation of function is permanent (passing away) or irreversible (deanimation). If the "dead donor rule" were renamed the "deceased donor rule" (both acronyms felicitously being "DDR"), the ethics of organ transplantation from non–heart-beating donors could, in principle, be validly governed by the DDR, even though the donors are not yet ontologically "deanimated." Thus, the paradigm shift satisfies both those who insist on maintaining the DDR and those who claim that it has all along been receiving only lip service and should be explicitly loosened to include those who are "as good as dead." Even so, a number of practical caveats remain to be worked out for non–heart-beating protocols. (shrink)
