Conscientious objections (CO) can be disruptive in a variety of ways and may disadvantage patients and colleagues who must step-in to assume care. Nevertheless, nurses have a right and responsibility to object to participation in interventions that would seriously harm their sense of integrity. This is an ethical problem of balancing risks and responsibilities related to patient care. Here we explore the problem and propose a nonlinear framework for exploring the authenticity of a claim of CO from the perspective of (...) the nurse and of those who must evaluate such claims. We synthesized the framework using Rest’s Four Component Model of moral reasoning along with tenets of the International Council of Nursing’s (ICN) Code of Ethics for Nurses and insights from relevant ethics and nursing ethics literature. The resulting framework facilitates evaluating potential consequences of a given CO for all involved. We propose that the framework can also serve as an aid for nurse educators as they prepare students for practice. Gaining clarity about the sense in which the concept of conscience provides a defensible foundation for objecting to legally, or otherwise ethically, permissible actions, in any given case is critical to arriving at an ethical and reasonable plan of action. La presente investigación tuvo como objetivo realizar un análisis del procedimiento abreviado contemplado en el Código Orgánico Integral Penal (COIP), partiendo del criterio de que ciertos aspectos de este procedimiento vulneran derechos fundamentales del investigado. Se destaca particularmente el requisito para el procesado de admitir los hechos que se le imputan para acceder a este procedimiento, lo cual, según la opinión mayoritaria de doctrinarios, compromete el principio de no autoincriminación, la presunción de inocencia y el derecho a un juicio con (...) todas sus fases. El objetivo de esta investigación fue analizar el procedimiento abreviado establecido en el Código Orgánico Integral Penal (COIP), con el propósito de identificar posibles vulneraciones de derechos fundamentales del investigado. Se buscó específicamente evaluar cómo el requisito de admitir los hechos imputados para acceder a este procedimiento podría afectar principios como el de no autoincriminación y la presunción de inocencia. A través de un enfoque cualitativo y utilizando diferentes métodos de análisis, se procuró determinar si el procedimiento abreviado, tal como está configurado, garantiza un debido proceso conforme a los estándares de derechos humanos y constitucionales. La metodología aplicada se sustentó en un enfoque cualitativo, utilizando los métodos inductivo, analítico, sintético y exegético. Se llevó a cabo un análisis documental de la bibliografía relacionada con el tema investigado, así como de instrumentos internacionales de Derechos Humanos, la Constitución de la República de Ecuador, el COIP y jurisprudencia vinculada a la materia. Los resultados de la investigación determinaron que el procedimiento abreviado tal como se encuentra regulado en el COIP beneficia al Estado y al sistema de justicia al agilizar ciertos procesos legales. Sin embargo, se evidenció que este procedimiento puede vulnerar derechos esenciales del procesado, como el principio de no autoincriminación y la presunción de inocencia. Por lo tanto, se concluye que el procedimiento abreviado afecta el debido proceso al comprometer garantías fundamentales. La investigación señala que el procedimiento abreviado regulado en el COIP, si bien puede ser beneficioso para la eficiencia del sistema de justicia, también conlleva riesgos significativos de vulnerar derechos fundamentales del procesado. Por lo tanto, se destaca la necesidad de revisar y modificar este procedimiento para garantizar el respeto absoluto al debido proceso y a las garantías individuales del investigado. (shrink)

This editorial of the special issue addresses the question of whether/how responses to the Covid-19 pandemic corresponded with authentic CSR. The literature on CSR has tended to endorse a business-centric perspective and its inherent focus on the search for alignments between CSR activities and the economic/financial interests of the firm. The Covid-19 pandemic has put this perspective to the test, pushing many companies to engage in distinctively more genuine and authentic CSR and/or demonstrating the importance of prior CSR engagement in (...) facilitating crisis management. The papers included in the special issue appear to converge on the idea that firms combining evidence of both pre-crisis engagement in CSR and strong CSR performance during the crisis (demonstrated through the deployment of various CSR assets and resources, including certified reporting, social marketing, individual engagement, resilience, legitimacy, trust) have coped better. This provides interested researchers with an opportunity to appreciate the value of CSR during a crisis. (shrink)

Considering the prevalence of sexual harassment, especially in university contexts, it is essential to have a validated instrument to identify these characteristics in the educational community. For this reason, this study aimed to analyze the psychometric processes of the sexual harassment scale on university campuses. Using an instrumental design and a sample of 927 students, it was found that the values of the evidence of construct validity and reliability are acceptable. The practical implications of validating the instrument that will allow (...) the identification of sexual harassment problems to promote symmetrical coexistence between men and women are highlighted. Como parte de las sucesivas modificaciones al marco jurídico que regula el sistema educativo mexicano, la rendición de cuentas basada en evidencias se ha convertido en una nueva responsabilidad para los docentes del nivel básico. No obstante, se sabe poco acerca de qué significa para los docentes, cómo la han asumido, más aún, qué efectos ha provocado en la práctica cotidiana. Por tal motivo, se realizó un estudio cuyo propósito fue analizar los efectos de la rendición de cuentas en el (...) trabajo docente, con particular atención a la dimensión pedagógica. Mediante entrevistas semiestructuradas a diez docentes de escuelas públicas de la Ciudad de México, se encontró lo que denominamos una autonomía relativa, limitada y mediada por múltiples disposiciones normativas; la invención de realidades como estrategia para cumplir con la entrega de informes y toda clase de evidencias requeridas por diversas autoridades; una idoneidad multitarea, reflejada en una multiplicidad de actividades más allá de la enseñanza; finalmente una profesionalización mecanicista, es decir, una búsqueda constante de cursos y talleres por cuenta propia pero siempre sobre temas y contenidos instrumentales. Since 2001, the ‘Islamic threat’ has become increasingly prominent in debates on migration policy, religious affairs and security at the federal level in Switzerland. Supported by the far right-wing parties, the paradigm of the Islamic threat reveals how Islamophobia is gendered and affects Muslim women and men differently. By analysing debates between the Federal Council and Swiss Parliament, this article shows how the Islamic threat shaped the border politics of the Swiss Nation between 2001 and 2015. It reveals how the (...) ruling elite justified the socio-spatial exclusion of Muslims living in a Muslim-minority context. As consequence of the success of the far right-wing Swiss People's Party, legal measures have increased with regard to security, protection of Swiss culture and women's rights, and exclusion of Muslims from the boundaries of the Swiss nation. Current treatments for chronic pain have limited benefit. We describe a resilience intervention for individuals with chronic pain which is based on a model of viewing chronic pain as dysregulated homeostasis and which seeks to restore homeostatic self-regulation using strategies exemplified by survivors of extreme environments. The intervention is expected to have broad effects on well-being and positive emotional health, to improve cognitive functions, and to reduce pain symptoms thus helping to transform the suffering of pain into self-growth. A total (...) of 88 Veterans completed the pre-assessment and were randomly assigned to either the treatment intervention or control. Fifty-eight Veterans completed pre- and post-testing. The intervention covered resilience strengths organized into four modules: engagement, social relatedness, transformation of pain and building a good life. A broad set of standardized, well validated measures were used to assess three domains of functioning: health and well-being, symptoms, and cognitive functions. Two-way Analysis of Variance was used to detect group and time differences. Broadly, results indicated significant intervention and time effects across multiple domains: Pain decreased in present severity [F = 5.02, p < 0.05, η2p = 0.08], total pain over six domains [F = 14.52, p < 0.01, η2p = 0.21], and pain interference [F = 6.82, p < 0.05, η2p = 0.11]; Affect improved in pain-related negative affect [F = 7.44, p < 0.01, η2p = 0.12], fear [F = 7.70, p < 0.01, η2p = 0.12], and distress [F = 10.87, p < 0.01, η2p = 0.16]; Well-being increased in pain mobility [F = 5.45, p < 0.05, η2p = 0.09], vitality [F = 4.54, p < 0.05, η2p = 0.07], and emotional well-being [F = 5.53, p < 0.05, η2p = 0.09] Mental health symptoms and the cognitive functioning domain did not reveal significant effects. This resilience intervention based on homeostatic self-regulation and survival strategies of survivors of extreme external environments may provide additional sociopsychobiological tools for treating individuals with chronic pain that may extend beyond treating pain symptoms to improving emotional well-being and self-growth.Clinical Trial Registration: Registered with ClinicalTrials.gov. This study analyzes the constraining factors of women's empowerment in rural contexts, focusing on socioeconomic and sociocultural factors. It examines the limited access to economic resources, employment opportunities, gender roles, social norms, and access to education as segregating elements, restricting empowerment. From this perspective, the purpose of this research is to review the specialized literature to analyze these factors and determine guidelines to strengthen empowerment in rural communities. With a qualitative approach, the research is also descriptive and reviews studies and (...) specialized sources. The findings show that the main obstacles are limited access to economic resources and employment opportunities, along with traditional gender roles and lack of education, which in turn limit the economic participation and influence of rural women in the community, leading to the conclusion that it is necessary to address these elements comprehensively, promoting policies and programs that improve access to resources, education and gender equality, facilitating an environment that empowers rural women and allows them to fully contribute to their communities. Este artigo tem como objetivo contribuir com a crítica aos PNPG e suas determinações na produção do conhecimento dos professores de Educação Física das IES do estado da Bahia no período de 1982 a 2012, através da análise epistemológica. Trata-se de uma pesquisa documental, cujos dados foram analisado a luz do método do materialismo histórico e dialético. Os resultados apontam que os PNPG apresentam em seus objetivos e diretrizes uma concepção de pós-graduação que estimula o produtivismo acadêmico e a aproximação (...) da ciência ao capital que determinam uma produção predominantemente desenvolvida com base na lógica formal. Before the advent of fibrinolytic therapy as a gold standard method of care for cases of acute ischemic stroke in Romania, issues regarding legal medicine aspects involved in this area of medical expertise were already presented and, in the majority of cases, the doctors seem to be unprepared for these situations. The present research illustrates some of the cases in which these aspects were involved, that adressed a clinical center having 6 years of professional experience in the application of fibrinolytic (...) treatment for stroke. The following cases report either situations in which the afore mentioned therapy was not rightfully administrated or legal aspects regarding the obtainment of informed consent. Obtaining informed consent is a mandatory procedure, which takes time, to the detriment of application of fibrinolytic treatment. (shrink)

En tan solo cuatro años, la reforma educativa logró lo que las anteriores no pudieron: modificar drásticamente los mecanismos de ingreso, promoción y permanencia en el servicio docente. En este artículo se rastrean los efectos subjetivos que la reforma, y particularmente la evaluación docente obligatoria, permanente y cambiante, están teniendo en el perfil profesional y la composición de la planta docente en la escuela. El supuesto que guía nuestra pesquisa, es que en tanto dispositivo de reconfiguración del sistema educativo, la (...) reforma busca desaparecer todo vestigio del maestro misionero, apóstol, agente de cambio y burócrata sindicalizado, para configurar un maestro multifuncional, flexible, precario, responsable tanto de sus propios éxitos como de sus fracasos. Eine Untersuchung der Präpositionen bei Leibniz kann aufgrund ihrer synkatego-rematischen Natur zeigen, in welchem Sinne die Sprache - als strukturiertes, bedeutendes Zeichensystem – das logische Verhältnis unter den Notionen ausdrü-cken kann, und damit der Zusammenhang zwischen Grammatik und Semantik einerseits, und Logik anderseits, erhellen. Meiner Ansicht nach bekommt auch Leibniz' Versuch des Aufbaus einer characteristica universalis dank dieser Per-spektive ein neues Forschungsinteresse. Um das Interesse für diese Redeteile zu wecken, werde ich zuvor in einem kurzen Exkurs die vorgängige Tradition dar-stellen. (...) Das Ziel ist, zu zeigen, was die Unterscheidung zwischen Kategoremen und Synkategoremen innerhalb der Tradition der sogenannten Mentalsprache im-pliziert; welche Fragen ihre Analyse erhoben hat und was diese Unterscheidung bei einem für Leibniz wichtigen Denker, wie Joachim Jungius, bedeutet. Beson-ders zeige ich, wie die Unterscheidung Kategoreme – Synkategoreme der zwi-schen Begriff und modi des Begreifens entspricht. Danach analysiere ich die viel-fältige Betrachtung dieser Redeteile bei Leibniz in Bezug auf seine Zurückfüh-rung der Präpositionen auf eine räumliche Grundbedeutung. Zum Schluss versu-che ich zu zeigen, warum diese Redeteile als cogitationes caecae bei Leibniz interpretiert werden können und welche Schlüsse man aus dieser Bestimmung im Rahmen von Leibniz‟ Sprachphilosophie ziehen darf. Political theorists have written a great deal about the ethics of “intervention,” defined as states using coercion or force to interfere in foreign societies’ politics. But this work leaves much of global politics un-analyzed—both because non-state actors play an increasingly significant role in it and because its practitioners use many tactics besides force and coercion.We need an ethics of foreign influence to help us navigate the global political arena in all its complexity. Here, I begin to develop a unified theory (...) of the ethics of deliberate attempts to promote justice in foreign societies, whether undertaken by state or non-state actors, and whatever tactics they employ. I identify two important but under-appreciated dimensions along which instances of foreign influence can differ and argue that, once we appreciate the full range of forms foreign influence can take, we’ll see it’s often immune to the common moral objections against intervention. Fichte wie auch später Sartre gewinnen vergleichbare Resultate auf der theoretischen Ebene hinsichtlich der ethischen Fundierung der Intersubjektivität im Selbstbewusstsein. Die Rolle der Ästhetik wird von beiden Denkern aufgrund ethischer Implikationen so bestimmt, dass sie die durch sie bestimmte Intersubjektivität auf praktischer Ebene zum Vorschein bringt. Die Ästhetik stellt bei beiden Autoren nicht einen Selbstzweck dar, sondern spielt eine herausragende Rolle für die Bildung der Menschen. Sartre wie auch Fichte brauchen die Ästhetik, um die Ethik zu fundieren. Während Sartre ein (...) unmittelbar lebensbezogenes ästhetisches Denken hat, in dem er ethische Aspekte in seiner Literatur anhand konkreter Beispiele verarbeitet, geht es Fichte in seinen Ausführungen zur Ästhetik vornehmlich um die Frage nach der Bedingung der Möglichkeit des ästhetischen Bewusstseins und darum, dieses als Voraussetzung des ethischen Bewusstseins zu bestimmen. Sartres Ethik offenbart sich vor allem in seinem ästhetischen Schaffen. Dem ästhetischen Moment in Sartres Ethik kommt die zentrale Aufgabe für die Entwicklung des ethischen Individualismus des Menschen und der gesamten Menschheit zu. Die Analogie zu Fichtes transzendentalkritischem Idealismus liegt in der Fundierungsrolle der Ästhetik für die Ethik in beiden philosophischen Konzeptionen, woraus eine aussagefähige Ethik in Sartres Existenzphilosophie resultiert. So zeigt sich In Sartres Literatur der direkte Wechselbezug zwischen praktischer Ethik und produktiver Ästhetik. Die Funktion der Ästhetik wird von Sartre dadurch bestimmt, dass in seinem Konzept mittels der Ästhetik die Vermittlung zwischen theoretischer und praktischer Vernunft geleistet wird. (shrink)
